GOVERNMENT REGULATION
of 23 April 2025
amending Government Regulation No. 590 / 2006 Coll., determining the scope and extent of other important personal barriers at work
The Government mandates pursuant to § 199 (2) of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 365 / 2011 Coll. and Act No. 230 / 2024 Coll.:
Čl. I
Government Decree No. 590 / 2006 Coll., establishing the scope and scope of other important personal barriers at work, is amended as follows:
1. The following heading is inserted under the title of Section 1:
"Heading and scope of other important personal obstacles at work."
2. After Paragraph 1, the following Section 1a is inserted:
„§ 1a
Common provision
For the purposes of this Regulation, a spouse shall mean, in addition to a partner who has entered into a partnership under the Civil Code, a partner who has entered into a registered partnership under the Registered Partnership Act, and by marriage in addition to a partnership under Section 655 (2) of the Civil Code, a registered partnership under the Registered Partnership Act. ';
3. Under the heading of Section 2, the following heading is inserted:
"Efficiency."
4. In point 4 of the Annex, the words "non-mass weather reasons' are replaced by" personal 'and the words "due to adverse weather effects, natural events or other incidents' are added at the end of the text of point 4.
5. In the Annex, point 5, including the title, shall read:
"5. Marriage
a) Staff leave shall be granted for 2 days for their own wedding, of which 1 day to attend the wedding ceremony; However, it is only for 1 day to pay compensation. If a staff member takes two days' leave, he shall be entitled to compensation only for the day on which he attended the wedding ceremony.
(b) leave with compensation for wages or salaries shall be granted to a staff member for one day to attend the wedding ceremony of his child and, to the same extent, leave shall be granted to the staff member without compensation for the salary or salary to attend the wedding ceremony of his parents.
Reimbursement of wages or salaries under this item shall also be for employees under Section 87a of the Labour Code. '
6. In Annex, point 7, including the title:
"7. Death
(a) leave with compensation for wages or salaries shall be granted for two days when the spouse, partner or child dies and for another day to attend the funeral of such persons.
(b) Employment leave with compensation for wages or salaries shall be granted for 1 day to attend the funeral and for the following day if the staff member provides the funeral, if it is death
1. parents, grandparents, grandchild or siblings of the staff member,
2. parents, grandparents or siblings of the employee's husband,
3. the spouse of the child of the staff member or of the sibling of the staff member; or
4. another person who lived with an employee at the time of household death.
(c) leave without compensation of salary or salary shall be granted for up to a further 5 days when the spouse, spouse, child, grandchild, parents, grandparents or siblings of the staff member dies.
Compensation of wages or salaries under this item shall also be paid to employees under Section 87a of the Labour Code.
7. In the Annex to point 8 (a) of the introductory part of the provision, the words "and back 'shall be inserted after the word" treatment'.
8. In point 8 (c) of the Annex, the words "and back 'are inserted after the words" the needs of the child'.
9. In point 10 of the Annex, the words "referred to in § 317 'are replaced by the words" pursuant to § 87a'.
10. In the Annex, point 11, including the title, shall read:
"11. Search for a new job
Before the termination of employment, staff members shall be granted leave for the necessary time to seek a new job, namely:
(a) with compensation for a salary or salary within a maximum of 4 days if the employment is to end on the basis of a statement given by the employer under § 52 (a) to (e) of the Labour Code or an agreement concluded for the same reason;
(b) without compensation of a salary or salary within a maximum of 2 days if the employment is to end on the basis of an employer's statement pursuant to § 52 (f) to (h) of the Labour Code or an agreement concluded for the same reason;
(c) without compensation of a salary or salary, within a maximum of 4 days, provided that the employment is to end in a manner other than that referred to in (a) and (b).
The staff member shall be entitled to additional leave without compensation of the salary or salary for the purposes of using the advisory services of the Labour Office of the Czech Republic, up to a maximum of 2 days in the cases referred to in points (a) and (c) and a maximum of 1 day in the case referred to in point (b).
Where a staff member draws leave within the scope of part of the shift, he shall be deemed to be exhausted on the whole day of leave. ';
Čl. II
Efficacy
This Regulation shall enter into force on the first day of the second calendar month following its publication.
