on the negotiation of a Protocol on the implementation of the Treaty between the Government of the Czech Republic and the Government of the Republic of Uzbekistan on the readmission and transit of persons
The Ministry of Foreign Affairs announces that on 11 October 2023 the Protocol on the implementation of the Treaty between the Government of the Czech Republic and the Government of the Republic of Uzbekistan on the readmission and transit of persons was signed in Prague 1).
The Protocol entered into force on 1 May 2024 pursuant to Article 10 (1) thereof.
The Czech version of the Protocol and the Russian version, which is relevant for its interpretation, shall be published simultaneously.

PROTOCOL
ON THE IMPLEMENTATION OF THE TREATY BETWEEN THE GOVERNMENT OF THE CZECH REPUBLIC
AND THE GOVERNMENT REPUBLIC OF Uzbekistan
RESEARCH AND TRANSPORT OF PERSONS
GOVERNMENT OF THE CZECH REPUBLIC
and
THE GOVERNMENT OF THE REPUBLIC OF UZBEKISTAN,
hereinafter jointly referred to as "Parties' and separately as" Party ',
expressing a common desire to address issues relating to the implementation of the Treaty between the Government of the Czech Republic and the Government of the Republic of Uzbekistan on the readmission and transit of persons, hereinafter referred to as "the Treaty ', in accordance with Article 15 of the Treaty,
HAVE AGREED AS FOLLOWS:
Request for readmission
1. The request for readmission pursuant to Article 5 of the Treaty shall be made on a form, the model of which forms Annex 1 to this Protocol.
2. The application for and response to readmission shall be faxed as a priority.
3. If necessary, interview in accordance with Article 6 (4) A request for an interview shall be entered in Section F of the readmission application.
4. The application shall be accompanied by copies of documents demonstrating the citizenship of the State of the requested party pursuant to Article 6 of the Treaty or the fulfilment of the conditions for readmission of third-country citizens or non-nationals pursuant to Article 7 of the Treaty.
5. The Parties shall, no later than 30 days after the entry into force of the Treaty and of this Protocol, exchange models of the documents listed in Annex 1 to the Treaty, as well as the travel document issued in accordance with Article 3 (3) of the Treaty.
The Parties shall inform each other of any amendment to the documents referred to in this paragraph without undue delay and shall transmit to each other new models of documents.
Transmission with escort
If the transfer of the returnees is carried out with an escort, the transfer of the returnees shall be made by means of two copies, using a form to be drawn up in accordance with Annex 2 to this Protocol.
Application for transit
1. An application for transit pursuant to Article 12 of the Treaty shall be made on a form the model of which forms Annex 3 to this Protocol.
2. The transit application and the reply shall be submitted preferably by fax.
Competent authorities
1. The competent authorities of the Parties for the implementation of the Treaty and this Protocol shall be:
on the Czech side:
Police of the Czech Republic
Directorate of Foreign Police;
on the Uzbek side:
Ministry of Interior of the Republic of Uzbekistan.
2. Upon entry into force of this Protocol, the Parties shall exchange the official addresses, e-mail addresses, telephone and fax numbers of the competent authorities referred to in paragraph 1 of this Article.
The Party shall inform the other Party of any change to the contact details without undue delay and transmit new contact details to it.
Border crossing points
1. The following border crossing points shall be used for the implementation of the Treaty and this Protocol:
in the Czech Republic:
Václav Havel Airport Prague;
in the Republic of Uzbekistan:
International Airport Islama Karimov Tashkent.
2. A Party shall inform the other Party without undue delay of any change to the list of border crossing points referred to in paragraph 1 of this Article.
3. The competent authorities of the Parties shall agree on the use of a border crossing point at the borders of the requested Party in any particular case where it is impossible to return a readmission or associated person by air.
Compensation of costs
1. The requesting Party shall provide the requested Party with compensation for all costs incurred under Article 13 of the Treaty by means of a bank transfer to the account of the requested Party within 30 calendar days of receipt of the invoice. These costs concern:
(1) transport;
(2) diet;
3) accommodation;
4) urgent medical care;
5) interpretation services, if necessary;
(6) other necessary expenditure agreed in advance by the competent authorities of the Parties.
2. The amounts of refunds granted under paragraph 1 of this Article shall be governed by the law of the State of the requested Party and shall be determined on the basis of documents proving the actual costs.
3. Transport costs are the costs of the use of a service motor vehicle or mass transport vehicles; the costs of using taxis are excluded. Other necessary expenditure shall include only costs effectively incurred while respecting the principle of maximum economy.
4. The requested party shall account for the costs referred to in paragraph 1 of this Article for the preceding calendar month.
5. The accounting for costs shall include documents proving the actual costs.
6. The provisions of paragraph 1 of this Article shall also apply to the escort of persons.
Languages
In implementing the Treaty and this Protocol, the competent authorities of the Parties shall use the English or Russian language.
Dispute settlement
Any dispute concerning the interpretation or implementation of the provisions of this Protocol shall be settled by negotiation and consultation between the Parties.
Amendments and additions
The Parties may agree on amendments to and additions to this Protocol, which shall form an integral part thereof and shall form separate protocols.
Final provisions
1. This Protocol shall enter into force at the same time as the Treaty.
2. This Protocol shall expire at the same time as the expiry of the Treaty.
Dane in Prague on 11 October 2023 in two copies in Czech, Uzbek, Russian and English, all texts being equally authentic. In the event of any differences in the interpretation of the provisions of this Protocol, the Russian text shall prevail.
