amending Decree No. 335 / 1997 Coll., implementing § 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, for soft drinks and concentrates for the preparation of soft drinks, fruit wines, other wines and mead, beer, drinking alcohol, spirits and other alcoholic beverages, fermented vinegar and yeast, as amended
The Ministry of Agriculture provides, pursuant to Article 18 (1) (a), (b), (g) and (h) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 119 / 2000 Coll., Act No. 306 / 2000 Coll., Act No. 146 / 2002 Coll., Act No. 274 / 2003 Coll., Act No. 316 / 2004 Coll. and Act No. 120 / 2008 Coll.:
Čl. I
This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
Čl. II
Decree No. 335 / 1997 Coll., implementing § 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, for non-alcoholic beverages and concentrates for the preparation of soft drinks, fruit wines, other wines and mead, beer, drinking alcohol, spirits and other alcoholic beverages, fermented vinegar and yeast, as amended by Decree No. 45 / 2000 Coll., Decree No. 57 / 2003 Coll. and Decree No. 289 / 2004 Coll., are amended as follows:
1. in Paragraph 1, point (g) is deleted;
Points (h) to (q) shall be renumbered as points (g) to (p).
2. In Paragraph 3 (1), the words "special legislation (1a) 'are replaced by the words" a regulation governing the labelling of foodstuffs (4)';
footnote 4:
"(4) Decree No. 113 / 2005 Coll., on the labelling of foodstuffs and tobacco products, as amended."
footnote 1a is deleted.
3. in Paragraph 3 (1) (d), "usable energy" is replaced by "energy value."
4. in Article 3 (1) (g):
"(g) in the case of fruit nectar, the minimum content of fruit juice, fruit pulp or a mixture of these ingredients shall be indicated by the words" share of fruit ingredient: at least...% "to be indicated in the same field of view as the name of the product,"
5. in Paragraph 3 (1) (i) (3), the words "and the evaluation according to the total mineralisation (content of dissolved solids) according to the specific legislation (1b)" shall be deleted;
footnote 1b is deleted.
6. in § 3 (1) (q):
"(q) in the case of a mixture of fruit juice and fruit juice from concentrate and fruit nectar obtained in whole or in part from one or more concentrated products, the indication" from concentrate or concentrates "or" partly from concentrate or concentrates "shall be given; this figure shall be clearly visible in letters close to the product name and shall be well marked in the background, '.
7. In Article 3 (1), the words "the renewal of the original state of fruit juice, fruit juice from concentrate, concentrated fruit juice, dried fruit juice or powder juice or fruit nectar juice using the substances strictly necessary for this operation shall be added at the end of the text in point (r). ';
8. in Article 3 (1), the comma at the end of point (t) shall be replaced by a dot and point (u) shall be deleted;
9. in Paragraph 3 (2) (b), the word "non-alcoholic" shall be inserted after the word "it is."
10.Paragraph 4 (2) reads as follows:
"(2) The physical and chemical requirements for fruit and vegetable juices from concentrate or concentrate are set out in Annex 1, Table 2."
footnote 2 is deleted.
11. in Article 4 (4), the words "and the microbiological requirements for non-alcoholic beverages, whether or not saturated, laid down by special legislation2a" shall be deleted;
footnote 2a is deleted.
12. in Article 4a (1), the word "addition" shall be inserted at the beginning of point (c).
13. in Article 4a (2) (g), the words "in the law and in the specific legislation2b)" shall be replaced by the words "in the Decree governing the requirements for supplements of the strav7) or in the Decree governing flavourings of food 8)."
footnotes 7 and 8 are as follows:
"7) Decree No. 225 / 2008 Coll., laying down requirements for food supplements and enrichment.
8) Decree No. 447 / 2004 Coll., on the requirements for the quantities and types of food flavourings, their conditions of use, their health requirements and the conditions of use of quinine and caffeine. '
14. in Article 4a (7), the word "tomato" is replaced by the word "vegetable."
15. in Paragraph 8 (1) of the Introductory Part of the provision, the words "Special Regulation (1)" are replaced by the words "Order governing the labelling of foodstuffs (4)."
16. in Article 8 (1) (a):
"(a) the ethanol content shall be given as a percentage by volume of the number with a maximum of one decimal place; followed by the symbol"% 'followed by the word "volume' or" vol '; "alcohol" or "alc." or "alc." may be indicated before the figures; the absolute value of the deviation of the ethanol content from the information on the packaging may not exceed 1%;';
(17) footnote 2c, including the footnote reference, is deleted.
18. in Paragraph 11 (b), "barley or wheat" is replaced by "barley, wheat or other cereals."
19. in § 11 (c), the words "yeast Saccharomyces cerevisiae subsp. uvarum (carlsbergensis)" shall be replaced by the words "brewing yeast of lower fermentation."
20. in § 11 (d), the words "yeast Saccharomyces cerevisiae subsp. cerevisiae" shall be replaced by the words "brewing yeast of the upper fermentation."
21. in Article 11 (g), the words "the same group" shall be deleted;
22. in Article 11 (h):
"(h) table beer beer made predominantly of barley malt with an extract of the original youth up to and including 6% by weight;"
23. in Paragraph 11 (i), "8" is replaced by "7."
24th Paragraph 11 (o) reads:
"(o) beer made from other cereals with an extract from the malt used, other than barley or wheat, exceeding one third of the weight of the extract,"
25. in Article 11 (q), the words "pure yeast culture or" shall be inserted after the word "addition," and the words "during rotation" shall be deleted;
26. in Article 11 (r), the words "and food supplements in accordance with the specific legislation (2b) and" shall be replaced by "food supplements, food or raw materials with their own flavourings,"
27. In Section 12, the words "species and groups' are replaced by" species, groups and subgroups'.
28. in Article 12 (2) (a), "light" is replaced by "table."
29. in Paragraph 12 (2) (g) read:
"(g) non-alcoholic beer."
30. in Article 12 (2), points (h) to (k) are deleted;
31. in Article 12, the following paragraph 4 is added:
"(4) The beer groups may also be subdivided into the following subgroups:
(a) wheat beer;
(b) beer of other cereals;
(c) yeast beer;
(d) flavoured beer. ';
32. in Article 13 (1) and (5) of the introductory part of the provision, the words "special legislation1)" are replaced by the words "a decree governing the labelling of foodstuffs 4)."
33. in Article 13 (1) (a), the words "or sub-groups, as the case may be, shall be inserted after the word" groups. "
34. in Paragraph 13 (1), the words "with a maximum number of one decimal place" shall be added at the end of the text of point (b); followed by the symbol "% 'followed by the word" volume' or "vol ';" Alcohol "or" alk. "or" alc. "may appear before the figures.';
35. in Article 13, paragraphs 3 and 4, including footnote 2d, are deleted;
Paragraphs 5 to 7 shall be renumbered paragraphs 3 to 5.
36. In Article 13, paragraph 6 is added:
"(6) Beer from other cereals must be indicated in the name by the type of cereal from which it was produced."
37. in Article 14 (1), the words "in Article 11 (h) and (o) and" shall be deleted;
38. In Paragraph 14 (4), the words "or to beer with a reduced alcoholic strength 'are replaced by the words" beer with a reduced alcoholic strength or table beer'.
39. Paragraph 16 to 18, including the headings and footnotes No 9, read:
„§ 16
Definition of certain terms
For the purposes of this decree:
(a) drinking alcohol, adjusted by the addition of drinking water to not more than 80% by volume of ethanol,
(b) other alcoholic beverages containing more than 1,2% by volume and less than 15% by volume of ethanol, excluding egg liqueur, in accordance with the directly applicable European Union provision for spirit drinks (9), beer, wine and partially fermented grape must - cigarillos,
(c) other alcoholic beverages with an alcoholic strength by volume of more than 0,5% ethanol and not more than 1,2% ethanol,
(d) pine-leaved or pine-leaved spirit drinks produced by distillation of juniper fruit in watered alcohol, the product may be coloured with a spirit ball; the addition of juniper oil is not permitted;
(e) a fermented pine spirit produced from ground juniper berries after addition of water, the addition of sugar being inadmissible; the resulting sash is distilled without addition of alcohol and the juniper oil is separated during distillation; the pine distillate thus obtained is cut and the finished product must contain at least 5% by volume of ethanol obtained from pine distillate,
(f) a spirit drink made of alcohol, water and rum punishments, the basis of which is acetate and ethyl formate, dyed in a spirit ball, the addition of vanilla, vanilla and sugar being possible;
(g) the name "Gold Water" shall be liqueur with an addition of ticket gold containing at least 38% by volume ethanol.
§ 17
Breakdown of species and groups
The breakdown of drinking alcohol, spirit drinks and other alcoholic beverages per species and group is set out in Annex 7, without prejudice to the specific rules on the categorisation of spirit drinks laid down in Annexes II and III to the directly applicable European Union Regulation on spiritues9).
§ 18
Labelling
(1) In addition to the information provided for in the Act, in the Decree regulating the labelling of foodstuffs (4) and in the directly applicable European Union provisions governing spirit drinks (9), the packaging shall also bear:
(a) the ethanol content by volume, expressed as a number with a maximum of one decimal place; followed by the symbol "% 'followed by the word" volume' or "vol ';" alcohol "or" alk. "or" alc. "may appear before the figures,
(b) as distillates of varietal purity, named according to a variety of plant species, only products produced exclusively from a designated variety.
(2) As part of the product name, the word "old 'may be used only for distillates which have matured at least one year before curling, with the exception of" Old Hunger' spirit.
(3) Spirituous beverages which comply with the requirements of the directly applicable European Union Regulation adjusting spirit drinks (9) to "Geist" may be identified in the same field of vision as "fruit-based elongated distillate."
(4) Spirituous beverages which comply with the requirements of the directly applicable European Union Regulation adjusting spirit drinks (9) to "fruit distillate" may be marked in the same field of vision as "brandy."
(5) Spirituous beverages other than those mentioned in this Decree or in a directly applicable European Union provision for spirit drinks (9) may be identified by their trade name derived from the basic raw material or technology used, or by their fictional name.
(6) Without prejudice to the directly applicable European Union Regulation on spirit drinks (9), the names of spirit drinks for which, in this Decree or in the directly applicable European Union Regulation on spirit drinks (9), compositional, sensory or other requirements may not be used for other products which do not comply with those requirements, in any derived form, including small and different attributes which could mislead consumers.
(7) The permissible negative volume deviation, measured at 20 ° C, is given in Annex 7a.
(8) The absolute value of both positive and negative deviations of the ethanol content in percentage vol. from the ethanol content indicated on the packaging is allowed up to a maximum of 0,3% by volume. For alcoholic beverages containing macerated fruit or parts of plants, 1,5% vol. is allowed.
(9) For spirit drinks, the composition does not need to include water.

40. in Paragraph 19 (2) (a), the words "group and subgroup" are replaced by the words "and group."

Note:
Where concentrate juice is produced from fruit not listed in the table, the minimum Brix value of the diluted juice shall be the Brix value of the juice obtained from fruit used to manufacture the concentrate.
For products marked with an asterisk (*) which are produced as juice, the minimum relative density is determined in relation to the water density at 20 / 20 ° C.
For products marked with two stars (* *) which are produced as a pulp, only the minimum uncorrected Brix value (without acid correction) is determined.
As regards blackcurrants, guava, mango and passion fruit, Brix minimum values shall apply only to diluted fruit juices and diluted fruit pulp produced in the European Union. '
43. In Annex 2, the words "low-energy beverage concentrate 'are deleted.
44. In Annex 4, in the column "Group ', the word" sweet' is replaced by "malt '.
45. In Annex 5, Table 1 reads:

Note:
(1) In the case of data, with the exception of those contained in Notes 2 and 3, marked on the packaging in quantitative units, the absolute value of both positive and negative deviations of 10% relative shall be allowed unless it is indicated that they are average values.
(2) For beers with an alcoholic strength of up to and including 1,2%, the absolute value of both positive and negative deviations of 0,3% vol. from the declared value shall be accepted, for beers with an alcoholic strength of more than 1,2% vol. up to and including 5,5% vol. the absolute value of positive and negative deviations of 1,0% vol. shall be accepted, while respecting minimum or maximum specified values.
3) The content of the extract of the original youth, determined by calculation according to the large Balling formula, shall be assessed by a value rounded down to the integer. ';
46. In Annex 6, the words "and sub-groups' shall be inserted after the words" groups'.
47. Efficacy
This Decree shall take effect on 1 May 2011, with the exception of Article II (3) to (9), (18) to (38) and (45) to (47), which shall take effect on 1 May 2012.
