DECLARATION
of 29 April 2015
on the professional and medical fitness of crew members of ships, licences, seafarers' books and captain's promise
The Ministry of Transport provides pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on maritime navigation, as amended by Act No. 310 / 2008 Coll., Act No. 261 / 2011 Coll., Act No. 64 / 2014 Coll. and Act No. 81 / 2015 Coll., ("the Act ') for the implementation of § 32 (4), § 42 (6), § 43 (10), § 44 (4), § 45 (7), § 47 (2) and (8), § 48 (9) and § 54 (6) of the Act:
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for
(a) the procedure for passing the test to demonstrate the expertise and skills, the way in which it is assessed and the content of the test progress and result report;
(b) the details of the training and training plan necessary for the performance of the duties of the crew member of the ship (hereinafter referred to as the "teaching and training plan") and of the certificate of completion of such training;
(c) the enumeration and characteristics of the specific activities the performance of which is necessary to ensure the safety and protection of crew members or seagoing on certain types of ships and to manage emergency situations ("special operations"),
(d) medical fitness conditions, scope, content and manner of carrying out medical examinations, diseases, defects or conditions which exclude or make subject to medical fitness, medical evaluation methods, medical assessment formalities and a model medical certificate;
(e) model certificates;
(f) the content of the examination and other documents certifying knowledge of the legislation of the Czech Republic in the field of maritime navigation and the English language,
(g) a model for the application for the recognition of a licence and a model for the certificate of certification;
(h) the data entered in the maritime book and the model of the maritime book; and
(i) the text of the captain's promise.
Procedure for passing the test
(1) The test to demonstrate the expertise and skills to perform a particular function within the crew of the ship (hereinafter referred to as "test") shall be carried out on the basis of a written application to perform the test submitted by a natural person (hereinafter referred to as "tested") to the Office. The annex to the application for the test shall be documents proving the practice achieved and the completion of the required teaching and training to perform the duties of a crew member.
(2) The dates of the examinations shall be determined by the Office.
Test evaluation
(1) The level of proven knowledge and skills in answering questions from individual areas of knowledge and skills shall be evaluated by classification stages
a) 1 - very well,
(b) 2 - good,
(c) 3 - sufficient; or
(d) 4 - insufficiently.
(2) The classification level "1 - very well" is evaluated by the tested, which excellently controls the area of knowledge and skills according to the question, correctly answers all the additional questions asked.
(3) The classification level "2 - well" is evaluated by the tested, who controls the field of knowledge and skills well according to the question, correctly answers the additional questions asked and can apply his knowledge.
(4) The classification level "3 - sufficiently" is evaluated by a tested person who sufficiently controls the area of knowledge and skills according to the question and usually responds correctly, does not make significant errors, but his answers require assistance from a member of the Commission.
(5) The classification grade "4 - insufficiently" is evaluated by the tested, which has not met the requirements for classification grade "3 - sufficiently" or which has withdrawn from the test after starting the test.
(1) The answers to questions given to one area of knowledge and skills shall be evaluated by the resulting average mark.
(2) The result of the whole test shall be assessed by the degree "benefit 'or" benefit'. For the "benefit 'assessment, the tested shall not receive" 4 - insufficiently' from any area of knowledge and skills.
Content of the test progress and result report
The test procedure and result report shall contain:
(a) the name and, where appropriate, the name, surname, date of birth and address of the place of permanent residence and, where appropriate, the habitual residence of the tested person;
(b) the date and place of the examination;
(c) a register of the questions to be asked in accordance with the syllabus test and their individual evaluation;
(d) the total test result of the test; and
(e) the name and, where appropriate, the names, surnames and signatures of all members of the Examination Committee.
Format of the teaching and training plan and of the certificate of completion
(1) The formalities for the teaching and training plan are set out in Annex 1 to this Decree.
(2) The formalities for the certificate of completion of teaching and training are set out in Annex 2 to this Decree.
Specific activities
Specific activities are:
(a) individual rescue techniques;
(b) the provision of basic first aid;
(c) the provision of first aid;
(d) the provision of extended first aid;
(e) the activity of an EMT;
(f) rescue activity using a fast rescue boat;
(g) fire-fighting activity;
(h) extended fire-fighting activity;
(i) ensuring personal safety and awareness of social responsibility in terms of navigation safety;
(j) the performance of the duties of the ship's security officer;
(k) basic provision of ship protection;
(l) performing other tasks to ensure the protection of the ship;
(m) crisis management,
(n) essential activities for oil and chemical tanker cargo operations;
(o) extended activities for oil tanker cargo operations;
(p) extended activities for chemical tanker cargo operations;
(q) essential activities for cargo operations on liquefied gas tankers;
(r) extended activities for cargo operations on liquefied gas tankers;
(s) bulk operations;
(t) cargo operations involving packaged hazardous substances;
(u) essential activities on ships using gases or other low-flash fuels as fuel;
(v) expanded activities on ships using gases or other low-flash fuels as fuel;
(w) basic fishing activities in polar waters; or
(x) expanded fishing activities in polar waters.
Characteristics of specific activities
(1) Individual rescue techniques include activities necessary for personal rescue and survival in the event of the total destruction of the ship, in particular the safe departure of the ship, the use of lifeboats and rafts and other means of rescue and the use of their equipment, the transmission of emergency signals.
(2) The provision of basic first aid means, in particular, the adoption of immediate measures in the event of an accident against injured persons or other health-threatening emergencies.
(3) The provision of first aid means, in particular, the provision of first aid to persons in the event of an accident or illness on board a ship following the provision of basic first aid immediately at the point of the accident.
(4) The provision of extended first aid means the provision of assistance and other necessary care for injured and sick persons while they are present on board the ship, including the use of publications issued for this purpose by the International Maritime Organisation and other auxiliary literature, and using the possibilities of a worldwide health consultation system provided with radio communications.
(5) In particular, the activity of a rescue worker is an activity carried out in order to rescue a person spotted in the sea, to use the personal equipment of a rescue boat and the equipment of a rescue boat, to issue proper instructions for its launching and picking up back to the ship, to pick up a person from the sea or a survivor to a rescue boat, to provide basic first aid to a survivor in the sea.
(6) The activity of a rescue operator using a fast rescue boat is in particular an activity in order to rescue a person seen in the sea using a fast rescue boat and its management, the use of the personal equipment of a rescue boat and the equipment of a fast rescue boat, the issue of proper instructions to launch and pick up a fast rescue boat back to the ship, the search for a person in the sea or a survivor and his pick up on a fast rescue boat, the provision of basic first aid to the survivors in the sea.
(1) The fire-fighting activity includes, in particular, reduction of fire risk, initial fire-fighting, fire-fighting work and the use of ship fire-fighting equipment.
(2) Extended fire-fighting activities include, in particular, planning and management of fire-fighting activities, checking fire-fighting systems and equipment and investigating fire-related accidents.
(3) The provision of personal safety and awareness of social responsibility in terms of safety of navigation includes, in particular, compliance with safe working practices and emergency procedures, contributing to effective communication on board and maintaining good interpersonal relations on board, taking into account the possible multiethnic and multicultural composition of the crew.
(4) The performance of the tasks of the ship's security officer shall include, in particular, the processing, management and supervision of the implementation of the ship's protection plan, the assessment of safety risks and the conduct of periodic checks on the ship in terms of its protection.
(5) The basic provision of ship protection includes, in particular, awareness-raising and awareness-raising of potential threats to the ship, including piracy, early reporting of suspicious phenomena of command, compliance with emergency and emergency procedures related to ship protection.
(6) The performance of other tasks to ensure the protection of the ship shall include, in particular, the performance of the tasks specifically assigned to the ship's protection plan, the identification of security risks and threats, and the proper use of safety equipment and systems installed on the ship.
(7) The management of emergency situations shall include in particular the organisation of emergency procedures, in particular communication with and management of passengers and other persons on board in emergency situations.
(1) Basic activities for oil and chemical tanker cargo operations include, in particular, planning and contributing to the safe handling of liquid cargo, taking measures to prevent hazards, ensure safety and safety at work and prevent environmental pollution, including fire prevention.
(2) Extended activities for oil tanker cargo operations include, in addition to the activities referred to in paragraph 1, in particular the safe implementation, monitoring and control of crude oil operations, taking appropriate measures to prevent hazards, ensure safety and protection at work and to prevent environmental pollution, including fire prevention.
(3) Extended activities for cargo operations on chemical tankers include, in addition to the activities referred to in paragraph 1, in particular the safe implementation, monitoring and control of operations involving the load of liquid chemicals, taking appropriate measures to prevent hazards, to ensure safety and safety at work and to prevent pollution of the environment, including fire prevention by load hazard classes.
(4) In particular, essential activities for cargo operations on liquefied gas tankers shall include planning and contributing to the safe handling of liquefied gas cargo, taking measures to prevent hazards, ensure safety and safety at work and to prevent environmental pollution, including fire prevention by load hazard classes.
(5) Extended activities for cargo operations on liquefied gas tankers include, in addition to the activities referred to in paragraph 4, in particular the safe implementation, monitoring and control of operations with liquefied gas cargo, taking appropriate measures to prevent hazards, ensure safety and safety at work and to prevent environmental pollution, including fire prevention by load hazard classes.
(6) The activities for bulk operations shall include, in particular, the planning and supervision of the placing and loading of individual types of bulk, bulk and bulk dangerous goods and the proper handling of them, the prevention of risks to the individual hazard classes of the goods.
(7) The activities for cargo operations involving packaged hazardous substances shall include, in particular, the planning and supervision of the placing and loading of individual types of packaged dangerous goods and the proper handling of them, the prevention of risks posed by each hazard class of the goods.
(8) The essential activities on ships using gas or other low-flash fuels shall include activities related to the application of requirements for the operation of such ships, in particular taking into account health and safety risks in their operation and maintenance and repair of machinery, activities carried out in the supply of such fuels, including their storage and taking appropriate measures to prevent hazards, ensure safety and protection at work and to prevent environmental pollution, including fire prevention and reaction to fire.
(9) Extended activities on ships using gas or other low-flash fuels shall include, in addition to the activities referred to in paragraph 1, the operational operation of propulsion and machinery, in particular those related to ensuring the safe operation of engines burning the relevant fuel, safe operation and operation of fuel systems, the safe operation, monitoring and control of direct fuel operations and the taking of appropriate risk prevention measures, including the management of fire-fighting activities and the management of accident operations.
(10) Basic activities in polar water navigation include activities related to taking into account the risks associated with possible damage to the ship and the limited possibilities for external assistance and health and rescue in polar areas and effective assistance to passengers in the event of a ship's accident.
(11) Extended activities in polar waters shall include planning and carrying out voyages in polar waters with permanent or prevailing ice cover, in particular with regard to the safety of navigation, navigation and proper guidance of the navigational watch service, taking into account the technical equipment and characteristics of the ship and the management of the activities referred to in paragraph 10 in the event of a ship's accident.
Health requirements
The medical fitness conditions of a crew member to work on board a ship (hereinafter referred to as "medical fitness') and diseases, defects or conditions (hereinafter referred to as" diseases') which exclude or make medical fitness are set out in Annex 3 to this Decree.
Medical examination
A medical examination shall be carried out at the request of a crew member (hereinafter referred to as the person under consideration), employer, operator, master or office (hereinafter referred to as the applicant). In the application, the applicant shall always indicate the function of the crew member, the relevant activity for which the medical fitness is assessed and the reason for its request. The application shall be made in writing or on record in the health file.
(1) The contents of the medical examination are a basic examination which includes:
(a) an analysis of the data on the state of health and diseases so far, with a targeted focus, in particular, on the occurrence of diseases which may reduce or exclude medical fitness or diseases likely to deteriorate as a result of sea service;
(b) a working history; the organisation's response to the occurrence of risk factors shall be monitored in particular;
(c) a comprehensive physical examination, including an indicative examination of hearing, vision, skin and an indicative neurological examination, with an emphasis on assessing the state and function of the organs and systems to be burdened in the performance of the work;
(d) ECG testing; and
(e) a basic chemical test of urine to detect the presence of protein, glucose, ketones, urobilinogen, blood and pH of urine.
(2) Basic examinations are extended by professional examinations, which are
(a) an eye examination, in the case of the first medical assessment, always with the captain, cabin officers, cabin crew and other persons assigned to the exercise of the navigational watch or patrol service during further medical examinations;
(b) an otorinolaryngological examination at the captain, cabin officers, cabin crew and other persons assigned to the exercise of the navigational watch or watch service, machinery watch services and machinery crew, including threshold tone audiometry, when the first medical assessment is carried out, an indicative otorinolaryngological examination at the captain, cabin officers, cabin crew and other persons assigned to the exercise of the navigational watch service, patrol guard services, machinery watch services and machinery crew;
(c) an otorinolaryngological examination, including threshold tone audiometry, after 10 years from the beginning of the exposure to noise for the machine's watch and crew;
(d) dental and psychiatric examinations in the first medical examination; and
(e) further professional examinations, if indicated by the medical assessor, if necessary to exclude diseases which restrict or exclude medical fitness, or diseases likely to deteriorate as a result of service at sea.
(3) The examinations referred to in paragraph 2 may be carried out only after the basic examination has been carried out by the medical assessor.
(4) If, during a medical examination, the person concerned does not submit an extract from the medical file under the legislation governing specific medical services2) and are not cases referred to in paragraph 2 (a) to (d), expert examinations shall always be carried out on the eye, otorinolaryngological and psychiatric, as well as laboratory tests in the range of blood count and differential budget, alkaline phosphatase, alanintransferase, aspartate aminotransferase, bilirubin, creatinine and glycemia.
(5) The medical assessor's application for further medical examinations shall specify, in addition to the particulars required under the legislation governing the formalities and content of the medical documents3) the requirement for assessing the medical fitness of the subject to the extent of the medical professional's expertise.
Medical assessment
(1) The medical assessment shall be carried out in a stable state of health; a stable state of health is considered to be a condition which has stabilised at a certain level of health and working capacity.
(2) The person to be assessed may be recognised as fit or fit on condition that, on the basis of a medical examination, a disease which excludes medical fitness has not been detected in that person. When a disease that reduces medical fitness is detected, the person under assessment may be recognised as fit or fit only on the basis of a positive conclusion of a professional examination.
(3) If the crew member reaches the required visual acuity with correction, he shall have replacement glasses or contact lenses available during the voyage.
Medical assessment requirements
The medical opinion on medical fitness, in addition to the particulars provided for under the legislation governing the formalities and content of medical documents4) contains:
(a) data on the function of the person under consideration, as well as data on risk factors related to the activity carried out; and
(b) the date of the next inspection, if justified by the state of health of the person under assessment.
Medical certificate
The model of the medical certificate is set out in Annex 4 to this Regulation.
Model certificates
Model certificates are set out in Annex 5 to this Regulation.
Recognition of certificates
(1) The model of the application for the recognition of a licence is set out in Annex 6 to this Regulation.
(2) The content of the examination and other documents certifying the knowledge of the legislation of the Czech Republic in the field of maritime navigation and English are set out in Annex 7 to this decree.
(3) The model certificate certifying the certification of the licence is set out in Annex 8 to this Regulation.
Entries in the sailor's book
The data entered in the sailor's book are
(a) details of the identity of the seaman's book holder;
(b) details of the embarkation of the seaman's book holder;
(c) details of the previous embarkation of the seaman's book holder; and
(d) other information.
The identity details of the seaman's book holder are his
(a) surname;
(b) the name and, where appropriate, the names,
(c) nationality,
(d) the day, month and year of birth;
(e) sex,
(f) place of birth;
(g) height,
(h) hair colour,
(i) eye colour;
(j) special signs;
(k) blood type; and
(l) handwritten signature.
The details of the embarkation of the seaman's book holder shall be:
(a) data characterising the ship on which the seaman's book holder is boarded,
1. name of ship,
2. call sign of the ship,
3. port of registry of the ship,
4. owner of the ship,
5. gross tonnage of ship in RT,
6. net tonnage of ship in RT; and
7. the performance of the main machinery ships in kW,
(b) the function of the seaman's book holder on the ship in which the seaman's book holder is included within the crew;
(c) the place and date of embarkation of the shipowner;
(d) the place and date of landing of the seaman's book holder; and
(e) the period of service of the seaman's book holder on board.
The details of the previous embarkation of the seaman's book holder shall be:
(a) the names of the vessels on which the seafarer's book has been boarded;
(b) the function of the seaman's book holder on the ships in which he was boarded;
(c) the total period of service of the seaman's book holder on ships on which he was taken on board in the appropriate capacity; and
(d) the registration number of the seafarer's book, according to which the details of the previous seafarer's embarkation have been entered.
Other data written in the sailor's book are
(a) the registration number of the maritime book;
(b) the international code of the issuing State;
(c) the date of issue of the maritime book;
(d) the expiry date of the maritime book; and
(e) the designation of the Office which issued the maritime book.
Model sailor's book
The model of the sailor's book is set out in Annex 9 to this Decree.
