Regulation implementing the Law on public road traffic

implementing the Public Road Traffic Act.
The Government of the Czechoslovak Republic orders pursuant to § § § 20 and 24 of Act No. 56 / 1950 Coll., on the operation on public roads (hereinafter "the Act"):

ČÁST PRVNÍ.

Taking a public road.

HLAVA I.

Road rules.

Oddíl 1.

General provisions on the use of the public road.
§ 1.
Basic rule.
When using a public road, everyone must ensure that road safety and continuity are not jeopardised. It must also ensure that it does not jeopardise the safety of persons and does not damage property, particularly public road, and does not disturb order.
§ 2.
General use of the public road.
Everyone may use public roads in the usual way for the purposes for which they are intended. However, those who, for their age or for their physical or mental defects, may, by using a public road, endanger the safety or fluidity of road traffic or the safety of persons or property, or violate the order of the public road, may use public roads only if appropriate measures are taken to prevent such a threat.
§ 3.
Road obstructions.
(1) Each person shall be obliged, as far as possible, to ensure that the obstacle caused by the road traffic is removed as soon as possible; However, if there is an obstacle to an accident in road traffic, measures may not be taken to prejudice a proper official examination of the accident. The local national committee shall take the necessary measures to remedy the disturbance as necessary.
(2) If the obstacle to road transport cannot be removed without delay, whoever caused it must take measures to allow other users of the public road to spot it in time.
§ 4.
Road traffic accidents.
(1) If there has been an accident in road traffic, anyone who has participated in it shall, as far as possible, ensure that the consequences of the accident are minimised.
(2) All those involved in the accident are obliged to demonstrate their identity to each other upon request; the obligation to prove its identity is also given to anyone who transfers additional care to a person injured in a road traffic accident (transport, hospital, etc.).
(3) Where damage has been caused in an accident on a public road or on another public establishment, anyone who caused the damage is obliged to notify it without delay to the nearest local national committee or national security authority.
Special use of the public road.
§ 5.
In particular, authorisations for the specific use of a public road shall be:
(a) to organise competitions, competitions and similar undertakings on a public road;
(b) transport of particularly heavy or large objects;
(c) to place an installation or object on a public road where this exceeds the limits of its general use;
(d) the organisation of undertakings and the location of facilities (objects) in the immediate vicinity of the public road, where the safety or fluidity of road traffic could be jeopardised by their operation or by their location, after the operational disturbances they cause.
§ 6.
(1) Authorisations for the specific use of a public road may be withdrawn or tied, including, where appropriate, additional, conditions or restrictions.
(2) The permit for the specific use of the public road in the cases referred to in § 5 (c) and (d) is decided by the district national committee. the local national committee decides instead if there is a special use of a road other than the 1st to 3rd classes.
§ 7.
Maintaining proper state of the public road.
Everyone is obliged to take care and pay attention to the proper state of the public road; public roads shall not in particular be damaged or polluting.

Provisions on driving by vehicles.
Driving vehicles.
§ 8.
(1) On a public road, any vehicle or vehicle assembly shall be driven by a person who is competent to do so and is familiar with the rules on traffic on public roads.
(2) If one driver cannot safely control the vehicle (s), the number of additional drivers needed must be gained.
§ 9.
The driver is responsible for the proper condition of the vehicle and for compliance with all road traffic regulations. In particular, it must ensure that it still controls the vehicle and must take all measures in time to ensure that the safety of other users of the public road is not jeopardised by the operation of its vehicle.
§ 10.
Obligations of the vehicle holder.
The holder of the vehicle shall ensure that the vehicle is driven on a public road only by persons competent to do so and that it is not put into service on a public road, unless it complies either with the road traffic rules itself or its load. This also applies to the holder of an animal used in road traffic.
§ 11.
Direction.
(1) On public roads, the right is used. The slow-moving vehicles and all vehicles shall be driven at the right edge of the road in unclear places.
(2) The left side of the road may be used only for overtaking or when special circumstances require it.
§ 12.
Avoiding and overtaking.
(1) Avoiding to the right. If there is no sufficient distance between the tracks and the edge of the road to the right, the rolling stock on the left shall be avoided.
(2) It passes to the left. Rolling stock shall be overtaken to the right; If this does not allow an insufficient distance between the tracks and the road edge, the rolling stock moving to the left may be passed. On one-way roads, rolling stock can be crossed left and right.
§ 13.
Diversion.
When diverting, the driver of the vehicle shall take greater care and respect for pedestrians and other road traffic and shall not interfere with traffic in the opposite direction or the operation of rolling stock.
Priority in driving.
§ 14.
(1) At the crossroads, drivers of vehicles driving on the side road are obliged to give priority in driving on the main road.
(2) At the crossroads of public roads of the same order, drivers of vehicles are obliged to give priority to vehicles arriving from the right. The priority in driving motor and rolling stock will be regulated by the Decree pursuant to § 35.
(3) These provisions shall not apply to traffic-controlled crossings.
§ 15.
If the vehicles of the armed corps or vehicles provide emergency and fire warning services, they shall be released immediately as they approach. If fire services are involved in the vehicle, drivers of all other vehicles are required to drive to the right and stop temporarily.
§ 16.
Stopping and stopping vehicles.
On a public road, it is possible to stop or stand with vehicles only in places where this does not interfere with road traffic or endangers its safety.
§ 17.
Leaving the vehicle.
Vehicles may remain unsupervised on a public road only if they have all been designed in such a way as not to jeopardise the safety or continuity of road traffic, the safety of persons or property or the order on the public road.
§ 18.
Drive speed.
The speed of the journey must be adapted to circumstances, in particular to the traffic, visibility, condition and nature of the public road and the state of the vehicle. In doing so, the driver must still control the speed of his vehicle and must slow the ride in time, after which, whenever circumstances require.
§ 19.
A sign for stopping and changing direction of travel. Warning signs.
(1) The intention to stop the vehicle or to change the direction of its journey must be given to other road users in a timely and clear manner. This provision shall not apply to the operation of rolling stock unless otherwise provided for in the Decree pursuant to Paragraph 35.
(2) Warning signs can only be given if this is necessary for the safety or fluidity of road traffic.
§ 20.
The cargo and its modification.
The load weight shall not exceed the vehicle load capacity. The load shall be properly located and secured in such a way as not to endanger the safety of the vehicle or the safety, continuity or order of road traffic or the safety of persons and property. This also applies mutatis mutandis to the transport of persons, in particular to their location and behaviour while travelling.
§ 21.
Vehicle lighting.
(1) Under reduced visibility, each vehicle or combination of vehicles in road traffic shall be properly illuminated. If not prescribed for them by a number of lamps, they shall be illuminated by at least one white or slightly yellow light on the left side of the vehicle. Motor vehicles shall illuminate the road effectively while driving.
(2) Specific regulations apply to the illumination of rolling stock.
(3) The driver is obliged to ensure that the safety of operation is not jeopardised by the use of dazzling lights.
§ 22.
Vehicle columns.
The flow of vehicles belonging to each other (column) shall be so arranged that it does not jeopardise the safety or continuity of road traffic, in particular it shall be divided into smaller groups sufficiently distant from each other.

Provisions on cycling and riding.
§ 23.
General provision.
Unless otherwise provided for in this Section, the provisions for riding by the vehicles referred to in Section 2 shall apply mutatis mutandis.
§ 24.
Cycling.
(1) Cyclists are required to go at the right edge of the road. They may also use the right side of the road when driving outside closed settlements, if they do not interfere with the pedestrians. These provisions also apply when a bicycle is driven.
(2) If there is a special path for cyclists, they may use only this path for cycling.
§ 25.
Lighting of the bicycle.
Under reduced visibility, the bicycles shall have a white or slightly yellow light at the front of the lamp, which effectively illuminates the road.
§ 26.
Horse riding.
(1) Special journeys must be used for horse riding and, if not, roads.
(2) Horsemen may not go more than two side by side. However, under reduced visibility, they shall be behind each other if they are not illuminated as closed departments or if they are not sufficiently illuminated by other light sources.

Provisions for pedestrians.
§ 27.
Obligations of pedestrians.
(1) On a public road, pedestrians are obliged to walk on sidewalks or roadblocks. The wagon shall only move with due caution, perpendicular to the direction of road traffic, and shall not delay unnecessarily.
(2) On marked crossings across the road, pedestrians are required to go in the right half of the crossing in the direction of walking. On the right, they must also walk elsewhere where the continuity of operation requires it.
§ 28.
March formations and parades.
(1) Marching formations or parades shall take place on the right side of the road and make room for overtaking and anti-driving vehicles. Longer marching formations (parades) shall be arranged in such a way that they do not endanger the safety or continuity of road traffic, in particular they shall be divided into smaller groups sufficiently distant from each other.
(2) The walking school youth should use the pavement, the pavement only if they cannot walk the pavement; where it uses roads, the provisions of paragraph 1 shall apply to it.

HLAVA II.

Road traffic control by road signs and transport authorities.
§ 29.
Transport signs and equipment.
(1) Traffic signs and equipment are also used for traffic control and security on public roads; The instructions expressed by them must be followed by everyone. The regulations on road signs and equipment will be issued by decree pursuant to § 35.
(2) Other than the above-mentioned road signs must not be used in road traffic. Any device which may lead to confusion with the road signs or which may cause the road mark to be not easily visible shall not be placed on public roads or in their immediate vicinity.
Local road traffic adjustment.
§ 30.
(1) The road operation may be modified, reduced or even stopped by local adjustment, if this is required according to local conditions.
(2) Temporary measures may also be taken to the extent necessary:
(a) to ensure security measures;
(b) when carrying out work on a public road;
(c) if the state of the public road necessitates this;
(d) the specific use of the public road.
§ 31.
Local road traffic arrangements shall be made public by means of a road sign or transport equipment. In Prague, it is possible to do so in the cases referred to in Paragraph 30 (1), where the placing on the market of a sign (transport equipment) would not be appropriate with regard to the safety or continuity of road traffic, by a decree of the Central National Committee in the Official Journal.
§ 32.
Transport authorities' instructions.
(1) The instructions of the authorities directly controlling or supervising traffic on public roads (transport authorities) take precedence over the rules of road traffic and above the instructions expressed by road signs or devices, in particular light signs.
(2) The provisions on signs of transport authorities and light signs intended for road traffic management will be issued by a decree pursuant to Paragraph 35.

HLAVA III.

Provisions common.
Exceptions and relief.
§ 33.
(1) The provisions on the use of a public road do not apply to armed forces, to fire and civil protection and to rescue services where the performance of their specific tasks is strictly required.
(2) If the safety and continuity of road traffic so permit, the Ministry of National Security may provide for further exceptions of a general nature in an official letter in agreement with the participating central authorities.
(3) In particular, the means set out in paragraph 2 shall provide for the exemptions necessary for the operation of special vehicles (special vehicles of the armed corps, working vehicles, etc.).
§ 34.
(1) In individual cases, for each group of cases and for certain public roads, derogations may be permitted by the national committee. Where it is necessary for such an exemption authorisation to be made known in a general manner, it shall become normal in the place.
(2) An exemption which is immediately required in road traffic may also be authorised by the transport authority on the spot itself.
Implementing regulations.
§ 35.
The provisions necessary for the implementation of this Part shall be issued by the Ministry of National Security in agreement with the participating central authorities by a decree in an official document; In particular, the obligations of vehicle drivers and other users of the public road will be laid down. In the same way, matters covered by the provisions of this Part may also be dealt with where international rules so require.
§ 36.
The regulations on the transport of persons on lorries and trailers shall be issued by the Ministry of Transport in agreement with the Ministry of National Security by decree in the official document.
§ 37.
Jurisdiction
(1) In matters governed by this Part, the regional national committees shall, unless otherwise specified, be responsible in the first chair. Instead they are responsible in the first stool
(a) regional national committees, where there is a matter relating to remote traffic on first-class roads;
(b) local national committees, where this is a matter relating to traffic on roads other than Class I to Class III.
(2) Where the Ministry takes measures in these matters, the competent Ministry of National Security is responsible.
(3) The Ministry of Transport is responsible for:
(a) the transport of persons on lorries and trailers;
(b) transport of particularly heavy or large objects.
(4) The Ministry of Construction is responsible for matters relating to:
(a) protection of public roads;
(b) road signs in technical terms and in view of the layout of the road network.
(5) The ministries, regional and regional national committees may delegate their responsibilities to subordinate authorities for each case group and for certain public roads.
(6) If there is a danger of delay, the necessary measures may be taken provisionally by local national committees or transport authorities.
§ 38.
Transport authorities.
(1) The transport authorities shall be national security authorities and other authorities, provided that they are entrusted by the Ministry of National Security, in agreement with the competent central office, to supervise or manage traffic on public roads.
(2) The transport authorities on military roads and roads which have been temporarily reserved for military transport are the military authorities.

Vehicles and motor vehicle control.

HLAVA I.

Vehicles.
§ 39.
Construction and equipment of vehicles.
On public roads only vehicles which are designed and equipped so that they cannot endanger the safety or continuity of road traffic, the safety of persons or property, or the order on public roads may be used; vehicles used on public roads must therefore comply with the provisions of this Regulation and the conditions laid down for their construction and operation.
§ 40.
Eligibility of vehicles to operate.
(1) Only motor vehicles may be used on public roads,
(a) whose technical capability to operate has been approved (§ 43) or which conforms to the approved type (§ 41); and
(b) for which a registration number has been assigned (Section 48).
(2) When approving the technical competence of motor vehicles or their types, they shall ensure that the vehicles are designed and equipped in such a way that their operation is safe and economical and complies with the technical conditions laid down for their construction and operation.
§ 41.
Approval of the technical competence of vehicle types.
(1) The technical competence of a motor vehicle type to operate is decided by the Ministry of Transport.
(2) The type-approval applies to all vehicles manufactured or imported which conform to this type.
(3) The Ministry of Heavy Industry may, in agreement with the Ministry of Transport during the production process, order the removal of structural defects which will emerge after the approval of the technical competence of a motor vehicle and specify a reasonable period.
§ 42.
Certificate of approval of the vehicle's competence to operate (type certificate).
The manufacturer, in the case of an importer, shall issue, for each motor vehicle manufactured or imported under an approved type, a certificate of approval of the technical competence of the motor vehicle for use (hereinafter referred to as the "type certificate ') and certify that the vehicle conforms to the approved type.
§ 43.
Approval of the technical competence of individual vehicles.
(1) The technical competence of motor vehicles which do not conform to a type approved by the Ministry of Transport (§ 41) is decided by the Regional National Committee, which shall confirm the technical competence of the vehicle in the type-certificate.
(2) Any modification of a substantial part of the vehicle's mechanism or structure, as well as any change in its dimensions or its own weight, may only be put into service when its technical competence has been re-approved by the Regional National Committee.
§ 44.
