DECLARATION
of 11 April 2024
amending Decree No. 210 / 2012 Coll., implementing certain provisions of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material, as amended
The Ministry of Industry and Trade, in agreement with the Ministry of Foreign Affairs, the Ministry of Defence and the Ministry of Interior, provides, pursuant to Section 33 of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material, as amended by Act No. 220 / 2009 Coll., Act No. 248 / 2011 Coll. and Act No. 383 / 2022 Coll., ("the Act ') for the implementation of Section 5 (3) of the Act:
Decree No. 210 / 2012 Coll., on the implementation of certain provisions of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material, as amended by Decree No. 85 / 2014 Coll., Decree No. 48 / 2015 Coll., Decree No. 308 / 2016 Coll., Decree No. 171 / 2017 Coll., Decree No. 31 / 2018 Coll., Decree No. 159 / 2019 Coll., Decree No. 346 / 2021 Coll. and Decree No. 46 / 2023 Coll., are amended as follows:
1. footnote 1 shall read:
"(1) Directive 2009 / 43 / EC of the European Parliament and of the Council on simplifying the conditions for transfers of defence-related products within the Community, as amended by Commission Delegated Directive (EU) 2024 / 242."
2. in Annex No 1 SVMe 3, Note 1 (a), the word "tapes" is replaced by the word "belts."
3. In Annex No 1, SVMe 4 (a), the words ", for which submunitions are intended 'shall be inserted after the words" cartridges'.
4. In Annex No 1 SVMe 4 Note 1 (b) is added as follows:
"Reference: Grenades or container missiles for weapons or throwing equipment specified in SVMe1 or SVMe2 and submunitions specially designed for ammunition, see SVMe3. ';
5. in Annex No 1 SVMe 4 Note 2 (a), the words "capable of producing 1 000 kg or more gas daily in liquid form 'are deleted.
6. in Annex 1 to the SVMe 8 (a) under 32 (d):
"(d) BDNTA ((bis- dinitrotriazole) amine),"
7. in Annex No 1, SVMe 8 (f), item 4 shall read as follows:
"4. ferrocene derivatives:
a. Butacene (CAS 125856-62-4);
b. Catocene (2,2- bis-ethylferrocenylpropane) (CAS 37206-42-1);
(c) ferrocencarboxylic acids and esters of ferrocencarboxylic acids,

8. In Annex No 1 SVMe 8 Note 14 (b) is replaced by "binders'.
9. In Annex No 1 SVMe 9 Note 1 is replaced by "Item SVMe (a) 1. is replaced by" Item SVMe 9 (a) (1) is included. "
10. In Annex 1, SVMe 10, the following Note 9 is added:
"Note 9: Point SVMe 10 (f) does not apply to:
1. towing devices;
2. protective pads and covers,
3rd ladders, steps and platforms,
4. cross-country, binding ropes and anchoring equipment. '
11. in Annex 1, SVMe 11 (b):
"(b) jamming equipment designed or modified to disrupt the reception, operation or efficiency of positioning or time services or navigation services provided by" satellite navigation systems "and specially designed components therefor;"
12. in Annex 1 to SVMe 11, Note (e), the words "encryption processes" are replaced by "encryption functions."
13. In Annex 1 to SVMe 13, the following Note 6 is inserted after Note 5:
"Note 6: Point SVMe 13 (d) (1) does not apply to goggles.
Reference: For laser protection glasses see SVMe 17 (o). '
14. in Annex No 1 SVMe 15 The reference is replaced by the following:
15. In Annex 1, SVMe 18 of the title, the word "living 'is replaced by the word" surrounding'.
16. in Annex 1 to SVMe 18 (b), the word "living" is replaced by the word "ambient."
17. in Annex No 1 SVMe 18 The term "construction 'is replaced by" construction'.
18. In Annex No 1, in the Definitions of Terms used in this List, Note 2, the words "given in single quotation marks are 'are replaced by the words" given in single quotation marks'.
19. In Annex No 1, in the Definitions of terms used in this list, the entry:
"SVMe 4, 8" Pyrotechnic compounds "Mixtures of solid or liquid fuels and oxidisers which, when ignited, undergo an energy chemical reaction of controlled speed to cause specific time delays or quantities of heat, noise, smoke, visible light or infrared radiation. Pyrophoric substances consist of a subclass of pyrotechnic compounds which contains no oxidising agents but which are self-igniting when in contact with air. '
