DECLARATION
of 24 May 2018
amending Decree No 332 / 2006 Coll., on crops and propagating material of hops, vines, fruit genera and species and ornamental species, and its circulation
The Ministry of Agriculture shall determine, pursuant to § 3 (8), § 4 (7), § 5 (8), § 7 (6) (a) to (j), (n), (p), (r), (s) and (u), § 14 (6), § 16 (12), § 17 (16) (d), § 18 (12), § 19 (17) (a), (b), (c), (f) and (h), § 23 (7), § 24 (9), § 24a (7) and § 25 (8) of Act No. 219 / 2003 Coll., Act No. 223 / 2009 Coll., Act No. 331.
Decree No 332 / 2006 Coll., on the crops and propagating material of hops, vines, fruit genera and species and ornamental species and its circulation, shall be amended as follows:
1. footnote 1 is deleted.
2. In Article 1, the words "European Community2) 'are replaced by the words" European Union2)';
3. In footnote 2, the sentence "Council Directive 92 / 34 / EEC of 28 April 1992 on the marketing of fruit plant propagating material and fruit plants intended for fruit production. Commission Directive 93 / 48 / EEC of 23 June 1993 laying down the table of requirements for fruit plant propagating material and fruit plants intended for fruit production pursuant to Council Directive 92 / 34 / EEC. Commission Directive 93 / 64 / EEC of 5 July 1993 on implementing measures concerning the supervision and control of suppliers and establishments in the framework of Council Directive 92 / 34 / EEC on the marketing of fruit plant propagating material and fruit plants intended for fruit production. Commission Directive 93 / 79 / EEC of 21 September 1993 laying down additional implementing provisions concerning varietal lists of propagating material and fruit plants and fruit plants maintained by suppliers pursuant to Council Directive 92 / 34 / EEC. 'is deleted and the separate lines of the footnote are added to the text" Commission Implementing Directive 2014 / 96 / EU of 15 October 2014 on requirements for the labelling, closure and packaging of fruit plant propagating material and fruit plants intended for fruit production falling within the scope of Council Directive 2008 / 90 / EC. Article 2
4. In Section 2, at the end of the text in point (b), the words "in field conditions and in in vitro conditions serving as plants for further repropagation 'are added.
5. in Article 2, the following points (c) to (f) are inserted after point (b):
"(c) the propagation of hop plants planted with recognised seed of the same variety, or clone, category, generation, health class and age in the hop structure;
(d) lard hops treated with an underground calcareous part of the hops lobe, which is used for the production of hops, exceptionally for the establishment of a propagation hop;
(e) by spice of hops, a plant grown from the vegetative parts of the hop plant in the root nursery;
(f) packed, packaged and containers with seed hops grown from vegetative parts of the hop plant and rooted in a nutrient substrate, in particular a package, a mug or a container, ';
Points (c) to (u) shall be renumbered as points (g) to (y).
6. In Article 2, point (s) is deleted.
Points (t) to (y) shall be renumbered s) to (x).
7. In the heading of Section 3, "§ 23 (8) and § 24 (8) 'is replaced by" § 23 (7) and § 24 (9)'.
8. Paragraph 3 (4) reads as follows:
"(4) The following vine varieties shall be considered to have been officially authorised for circulation:
(a) White Portugal,
(b) Blue Janek,
(c) nutmeg,
(d) Grey Portugal,
(e) Yellow trama; and
(f) Vellín red and white. ';
9. In Article 4 (1) (b), the words "or pre-basic propagating material 'shall be added at the end of the text of point 2.
10. In Article 4, at the end of paragraph 1, the dot is replaced by a comma and the following point (d) is added:
"(d) standard propagating material known as STANDARD."
11. in Article 4 (2), the words "soil" shall be inserted after the words "V."
12. in Article 4 (2) and (3), the words "Xiphinema and Longidorus" shall be replaced by the words "Xiphinema";
13. In Article 4, paragraphs 4 and 5 are added:
"(4) In the case of micropropagation, varietal identity shall be verified on growing plants. The supplier shall provide the Institute staff with access to the crops used to verify the varietal characteristics and production processes.
(5) The Institute shall carry out a follow-up check to verify its varietal identity and purity in respect of recognised hop propagating material by means of vegetative testing. "
14. in Article 6 (1) (a), the words "and tested for harmful organisms listed in Annex 10 (1)" shall be added at the end of the text of point 1.
15. in Article 6 (1) (a), the words "by means of effective technical isolation" shall be added at the end of the text of point 2.
16. In Section 7, the text "§ 5 (9) 'is replaced by" § 5 (8)'.
17. in Article 7 (4), the words "certificates and certificates" are replaced by the words "certificates, certificates and recognition certificates," and the words "if they contain the information referred to in Article 3 (7) of the Act" are deleted.
18. in Article 7 (5), the words "under Article 3 (7) of the Law" shall be replaced by the words "provided for an accompanying document under Article 16 (1) and (2)."
19. in Article 7, paragraph 6 is deleted;
20. In Section 9, the text "§ 24 (8) 'is replaced by" § 24 (9)'.
21. In Section 11, the text "Paragraph 10 (11)," is deleted.
22. in Article 11 (1) to (3):
"(1) Only conformal propagating material for which requirements for the development and maintenance of critical points in production processes have been met may be put into circulation,
(a) the quality of the propagating material used to set up seed crops;
(b) agronomic operations involving the cultivation of propagating material, including the recording of nutrition and chemical treatment of plants;
(c) plans and methods for planting propagating material;
(d) reproduction, harvesting, packaging, storage, transport,
(e) keeping proper records of the origin and sale of propagating material;
(f) carrying out inspections of propagating material at a time appropriate for plant development and at a time appropriate for the presence of harmful organisms; and
(g) sampling of propagating material for testing to detect the presence of harmful organisms.
(2) In order to verify the origin of the conformal propagating material, a supplier's document which does not resemble a label or accompanying document is used and contains at least the following information:
(a) the indication "EU rules and standards,"
(b) the designation "Czech Republic" or other Member State in which the supplier's document was issued or their code;
(c) the designation of the competent official authority responsible for certification or its code;
(d) the name and surname of the supplier or his registration number issued by the competent official authority responsible for certification;
(e) individual serial number, week number or batch number of propagating material;
(f) botanical name,
(g) the designation "CAC material,"
(h) the name of the variety and, where appropriate, the clone in the case of:
1. a rootstock not belonging to the variety, the name of the species concerned or the interspecific hybrid;
2. the grafted fruit plants shall be indicated for the rootstock and the noble part;
3. the varieties for which an application for official registration or for the granting of protection rights is being discussed shall include the following information: "proposed name" and "application for protection";
(i) quantity,
(j) the country of production and its code, if different from the Member State where the supplier's document was issued;
(k) the date of issue of the document; and
(l) where appropriate, an indication that the propagating material of fruit genera and species put into circulation in accordance with Article 32 of Commission Implementing Directive 2014 / 98 / EU as regards that material.
(3) In particular, invoices and delivery notes may be considered as proof of the supplier if they contain the particulars referred to in paragraph 2. The consignment note may also be replaced by a plant passport in accordance with the specific legislation4) if it contains the particulars referred to in paragraph 2. The document shall include information that it is conformal propagating material in order to avoid confusion with recognised propagating material. ';
23. In Section 12, the text "Paragraph 16 (11) 'is replaced by" Paragraph 16 (12)'.
24. In sections 14 to 16 and 18, the text "Paragraph 19 (15) 'is replaced by" Paragraph 19 (17)'.
25. In Paragraph 14, the words "The colour of the official label shall be:
(a) white with a diagonal violet stripe for the propagating material in transition;
(b) white for basic propagating material;
(c) blue for certified propagating material; and
(d) dark yellow for standard propagating material. ';
26. in Paragraph 14 (3), the sentence "The models of the official labels are set out in Annex No 14" shall be deleted;
27. in Paragraph 15 (10):
"(10) The colour of the official label shall be:
(a) white with a diagonal violet stripe for the propagating material in transition;
(b) white for basic propagating material;
(c) blue for certified propagating material;
(d) dark yellow for standard propagating material; and
(e) brown for propagating material pursuant to Article 23 (4) of the Act. "
28. Paragraph 16 (1) to (3) reads as follows:
(1) The propagating material of fruit genera and species shall be packed and labelled when put into circulation. Where propagating material is supplied to a non-final consumer, it shall also be accompanied by an accompanying document. The accompanying document shall be drawn up in one of the official languages of the European Union, drawn up in at least two copies for the supplier and the consignee, and accompanied by propagating material from the supplier's place to the consignee's place.
(2) The accompanying document shall contain:
(a) the name and surname and address for service to the consignee;
(b) the date of issue of the document; and
(c) similar information provided for in paragraph 3 for the official label.
(3) The official label contains:
(a) the indication "EU rules and standards,"
(b) the designation "Czech Republic" or another Member State or their code,
(c) the designation of the competent official authority responsible for certification or its code;
(d) the name and surname or name of the supplier or his registration number issued by the competent official authority responsible for certification;
(e) the reference number of the package or bundle, the individual serial number, the week number or the batch number of the propagating material;
(f) botanical name,
(g) the category and, in the case of basic propagating material, the generation number;
(h) the name of the variety and, where appropriate, the clone in the case of:
1. a rootstock not belonging to the variety, the name of the species concerned or the interspecific hybrid;
2. the grafted fruit plants shall be indicated for the rootstock and the noble part;
3. varieties which are subject to a variety registration or protection rights procedure, the label must indicate the following:
(i) where appropriate, the indication "variety with an officially recognised description,"
(j) quantity,
(k) the country of production and the code concerned, if different from the Member State of designation;
(l) year of issue,
(m) where the original label is replaced by another label, the year of issue of the original label,
(n) information that the propagating material of fruit genera and species put into circulation in accordance with Article 32 of Commission Implementing Directive 2014 / 98 / EU as regards that material; and
(o) where appropriate, further information under the Plant Health Act (4). ';
29. in Paragraph 16 (8):
"(8) The colour of the official label shall be:
(a) white with a diagonal violet stripe for the propagating material in transition;
(b) white for basic propagating material; and
(c) blue for certified propagating material. ';
30. in Article 17 (1) (b):
"(b) mother plants of hops and propagation hops.";
31. in Article 17 (3) (g):
"(g) one-year education culling for circulation (expedition)."
32. In Article 17, at the end of paragraph 3, the dot is replaced by a comma and the following point (h) is added:
"(h) multi-annual training courses for circulation (expedition)."
33. In Annex 1, Part 1, Table 1 reads as follows:

| a) Podnože rovné, vyzrálé, svěží, zdravé, nepoškozené. b) Podnože pěstované ve volné půdě určené k uvádění do oběhu se sklízí po odlistění. c) Odlisťovat a sklízet se mohou až po ukončeném uznávacím řízení, nejdříve však v následujících termínech: 1. broskvoně, mandloně a ořešák vlašský až po 20. říjnu, 2. ostatní druhy po 1. říjnu. |
