DECLARATION
of 19 May 2014
amending Decree No. 335 / 2004 Coll., implementing certain provisions of the Law on the Verification of Firearms, Ammo and Pyrotechnic Articles, as amended
The Ministry of Industry and Trade provides pursuant to § 24 (1) of Act No. 156 / 2000 Coll., on the Verification of Firearms, Ammo and Pyrotechnic Articles and on the Treatment of Certain Pyrotechnic Products, as amended by Act No. 227 / 2003 Coll. and Act No. 148 / 2010 Coll., ("the Act ') for the implementation of § 6 (1), § 7 and § 8, § 10 (1) (c), § 16 (1) (c), § 16 (2) (a), § 18 (2) and § 19 (1):
Decree No. 335 / 2004 Coll., implementing certain provisions of the Law on the Verification of Firearms, Ammo and Pyrotechnic Articles, as amended by Decree No. 267 / 2010 Coll. and Decree No. 398 / 2010 Coll., are amended as follows:
1. In the title of the Order, the words "and the treatment of certain pyrotechnic articles' shall be inserted after the words" articles'.
2. In the introductory sentence of the Decree, the words "and amending Act No. 288 / 1995 Coll., on Firearms and Ammunition (Firearms Act), as amended by Act No. 13 / 1998 Coll., and Act No. 368 / 1992 Coll., on Administrative Charges, as amended, as amended, as amended by Act No. 227 / 2003 Coll., hereinafter referred to as" the Act "shall be replaced by the words" and the treatment of certain pyrotechnic articles, as amended by Act No. 227 / 2003 Coll. and Act No. 148 / 2010 Coll., (hereinafter referred to as "the Act"), as follows:
3. the following Sections 1a and 1b are inserted after Section 1, including the headings and footnotes 6 and 7:
Basic concepts
For the purposes of this decree:
(a) the mark referred to in Annex 4 which is not a test mark within the meaning of Article 19 (1) of the Act;
(b) the uniform test mark, the mark referred to in Annex 3, Part 1.1.2 or 1.1.3;
(c) the national test identification mark the mark referred to in Annex 3, Part 1.1.1;
(d) the national test sign referred to in Annex 3, Part 2.
Determined method of marking weapons and ammunition
(1) The specified firearms shall be identified by the Office in a manner which shall consist of:
(a) a uniform test mark, which shall be supplemented on at least one of the main parts of the weapon by the national test identification mark and the two-digit number of the year of the test;
(b) the uniform test mark, the national test identification mark and the duplicate number of the year of testing on each heavily loaded part submitted separately for verification; or
(c) the national test mark, which shall be supplemented on at least one of the main parts of the weapon by the marked number of the year of the test and, in the case of a prohibited weapon (6), by the number of the test report on a separate number series.
(2) The specified ammunition shall be identified by the inspected person or authority in a specified manner, which shall consist of a national test mark bearing the type test certificate number or a uniform test mark marked together with the national test identification mark.
(3) For each newly manufactured military weapon (7), which is not intended for the Army of the Czech Republic, the manufacturer shall, where the weapon is marked with identification data indicating the year of manufacture, the manufacturer or the State of origin and the production number of the weapon, mark the control mark in accordance with Annex 4. The manufacturer shall then submit the weapon so marked to the Authority for inspection of the means of identification.

4. In Article 2 (6) (c), the words "test marks' are replaced by the words" national test identification marks and uniform test marks', the words "Part I. 'are deleted, the words" which' are inserted as follows' and the words "this test mark 'are deleted.
5. Paragraph 3 (1) reads as follows:
"(1) In the case of a partial verification of specified firearms, the person or person registered in the gun licence, together with a request under Paragraph 18 of the Act, shall submit to the Office a specified firearm, two consumables for each cartridge chamber and a specified firearm intended exclusively for the use of black powder for each barrel; a specified firearm shall be provided with:
(a) the manufacturer's designation by a commercial company under which it is registered or by the name, if it is a legal person, or by the name and surname, if it is a natural person, or by their trade mark;
(b) type designation,
(c) the indication of the country or place of origin;
(d) the production number,
(e) the caliber of the ammunition used;
(f) the year of manufacture, unless indicated in the serial number of the specified firearm;
(g) the indication or particulars on each barrel of the chamber length with regard to a specified firearm with a smooth-bore barrel,
(h) an indication of the calibre of each barrel if the weapon has mainly different calibre, or an indication of the calibre of the barrel, if the specified firearm has each of the main same calibre;
(i) where the barrel is intended exclusively for the use of black dust, a clear indication of that fact, unless otherwise specified by the Authority;
(j) an indication of each shotgun barrel of the measured diameter of the drill, or an indication of the material from which it is produced, or, where appropriate, a indication of the mass,
(k) an indication of the calibre on the revolver cylinder, if possible to replace the revolver cylinder. ';
6. In Article 3, the following paragraphs 2 and 3 are inserted after paragraph 1:
"(2) The specified firearms for high-performance steel shot rounds shall be so designed that the inclusion of the shotgun barrel shall not be more than 0,5 for 12 and 10 / 89 calibre, using steel shot with a diameter of more than 4 mm and 20 calibre using steel shot with a diameter of more than 3,25 mm.
(3) In the case of the partial verification of the silencers of a specified central-fire firearm, the silencer shall be verified by a special test charge for the verification of the silencers. The manufacturer shall bear a marking of the silencers to the same extent as the specified firearms. If a specified firearm is to be fitted with a silencer, the specified firearm shall be verified separately for this purpose in the specified manner. The silencer acquired before 15 June 2014 shall be submitted for verification at the latest when the first specified firearm which may be fitted with it is presented for verification separately for that purpose. The silencer shall bear the mark of the calibre for which it is verified; where it is intended for multi-calibre use, it shall bear the marking of the main calibre and any other calibre, also covered by the verification of the main calibre by a special test charge for the verification of shock absorbers. ';
Paragraphs 2 to 14 shall be renumbered paragraphs 4 to 16.
7. Paragraph 3 (14), including footnote 4, is deleted.
Paragraphs 15 and 16 shall be renumbered paragraphs 14 and 15.
8. in Articles 3 (14) and 4 (1), the words "the appropriate test mark referred to in Annex 3 (I)" shall be replaced by the words "the method laid down."
9. In Article 3 (14), at the end of point (c), the dot is replaced by a comma and the following point (d) is added:
"(d) in the case of a weapon charged with black powder, the maximum mass of the dust charge, the seals and the bullets used.";
10. in Article 3 (15), the words "the identification mark of the Office as referred to in Annex 3, Part I." shall be replaced by "the national identification mark of the testing centre."
11. in Paragraph 5 (2), "6" is replaced by "7."
12. in Paragraph 5 (5) (d), the words "test mark as referred to in Annex 3, Part I." shall be replaced by "established method."
13. in Paragraph 6 (8) (c), "I." is replaced by "2."

Labelling by test marks
Controlled products which meet the specified technical requirements and have been verified shall be marked with the test marks specified in Annex 3 as follows:
(a) in the case of unit verification or repeated unit verification, the Authority shall designate a specified firearm which meets the specified technical requirements in a specified manner;
(b) in the specified manner, the office shall mark each barrel, an important part of the conclusion (bed for tilting main, closure for other weapons) and the frame, if any; the date propeller of the specified firearm. In the case of revolvers, the Office shall indicate in a specified manner the barrel, cylinder and frame of the specified firearms. If the specified firearms are not part of the barrel, the Bureau shall indicate the barrel, each chamber and the important parts of the conclusion of the specified weapon as defined in the specified manner. If the essential parts of the weapons which are of metal do not have a soft place to be stamped with the appropriate test mark, the Authority shall indicate in the specified manner at least one of the main parts of the weapon,
(c) if the verification of a specified firearm is no longer a place for marking in a specified manner, the Authority shall only base the specified firearm on the last two digits of the year and the serial number of the test; for the verification of a specified firearms with more than one main weapon, the Authority shall mark each barrel in a specified manner only if the specified firearms cannot be damaged;
(d) at the time of approval, the office or the person responsible for carrying out the specified firearm shall designate at least one of the main parts of the weapon or the smallest packaging in the form of a stamping, printing or sticker,
(e) in the case of a type-check, the inspected person or the office shall identify each of the smallest consumer packaging by means of printing or sticker, as specified in the type-control certificate;
(f) in the type test, the inspected person or the Authority shall mark the test mark for pyrotechnic articles as indicated in the type test certificate on each pyrotechnic article; if the dimensions of the pyrotechnic article do not permit this, the label shall be made on the smallest consumer packaging. The label shall be printed or labelled in both cases,
(g) in the case of unit or repeated unit verification, the Authority shall mark the uniform test mark, the national test identification mark of the test laboratory and the double digits of the year of the silencer test which meets the specified technical requirements;
(h) in the case of the verification of a specified firearm for the purpose of its action with a silencer, the Authority shall, in order to comply with the specified technical requirements, add to the marked test marks the test report number of the test report which has been verified for use with the silencer. ';
15. in Article 9, "4" is replaced by "5."

17. In Annex 1, Part 1.3, the words "permanent offices' are replaced by the words" International Standing Commission on Small Arms Testing (hereinafter referred to as "C. I. P. ')';

20. 21. in Annex 1, Part 2.6 (f), the words "permanent offices" are replaced by "C. I. P."
22. in Annex 1, Part 2.6, point (i) is replaced by the following:
"(j) Noise silencers for specified firearms with central fire shall be verified by a test shooting of 2 pcs of special test charges for the verification of silencers in a double manner:
1. by unit verification together with the specified firearm for which the silencer is intended; or
2. by mass verification using a spare barrel corresponding to the calibre to which the silencer is fixed during the test.
The design of special test charges for the verification of shock absorbers and their use during testing shall meet the requirements of Decision C.I.P. '.
23. In Annex No 1, Part 5.3 (c), points 1 and 2, the word "calibre 'is replaced by" calibre'.
24. Annex 3, including the title, reads:

1.1. Marks valid if marked at the earliest in May 2011. Transitional provisions
1. By 19 October 2014 at the latest, the Office may, in the case of a unit verification or repeated unit verification of a specified firearm which meets the specified technical requirements, mark the test mark in accordance with Annex 3, Part 1.2.1, to Decree No 335 / 2004 Coll., as amended by that Order. In such a case, the weapon which has been tested for steel pellets shall be further marked with the Authority's identification mark. Paragraph 8 (b) of Decree No. 335 / 2004 Coll., as amended by that Order, shall apply mutatis mutandis to labelling.
2. No later than 19 October 2014, the certificate of homologation may specify the marking of the specified firearms instead of the prescribed method of marking the test mark according to Annex 3, Part 1.2.1, to Decree No 335 / 2004 Coll., as amended by that decree. In this case, the weapon shall also be marked with the double digits of the year of verification.
3. No later than 19 October 2016, the certificate of type control of ammunition may specify the marking of the specified ammunition instead of the marking of the test mark provided for in Annex 3, Part 1.2.1, to Decree No 335 / 2004 Coll., as amended by that Decree.
Final provision
This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, as amended.
Efficacy
This decree shall take effect on the 15th day following its publication.
