THE LAW
of 22 January 2004
amending Act No. 89 / 1995 Coll., on the State Statistical Service, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 89 / 1995 Coll., on State Statistical Service, as amended by Act No. 356 / 1999 Coll., Act No. 220 / 2000 Coll., Act No. 256 / 2000 Coll., Act No. 411 / 2000 Coll., Act No. 202 / 2002 Coll. and Act No. 320 / 2002 Coll., is amended as follows:
1. In Paragraph 1 (1), the word 'demographic' shall be inserted after the word 'economic'.

„§ 2
Definition of terms
For the purposes of this Act:
(a) an individual indication concerning an individual legal or natural person obtained for statistical purposes under this law;
(b) a confidential statistical indication that enables the identification, directly or indirectly, of an individual legal person or which is a personal data of a natural person under a special law, 2a)
(c) by anonymous indication, an individual indication which, either in its original form or after processing, does not allow for the direct or indirect identification of an individual legal or natural person;
(d) direct identification of the identification of an individual legal or natural person on the basis of any identifier that may be used without the need to use disproportionate time and effort to establish the identity of the person concerned;
(e) by indirect identification, the possibility to derive the identity of an individual legal or natural person by means other than that referred to in (d);
(f) statistical information of a social, economic, demographic or environmental nature resulting from the aggregation of individual data;
(g) the statistical purpose of use for a numerical, verbal or graphic description of the mass phenomena and processes in society, the national economy and the environment using statistical information;
(h) statistical surveys of the collection of individual data from reporting agents for statistical purposes under this law;
(i) the reporting agent is a legal person, an organisational body of the State or a natural person required to provide individual data in the statistical survey under this law;
(j) reporting obligations for reporting agents to provide the required individual statistical data in a timely, complete, correct and true manner for the statistical surveys specified in the statistical survey programme;
(k) any legal person, organisational body of the State as well as any natural person who has the status of an entrepreneur under special legislation, 2)
(l) the economic operator identification number (hereinafter referred to as "identification number") of the code number used to identify it;
(m) agricultural activities agricultural production of plant and animal products, including greening, horticulture, beekeeping, fishing, fur farming and other animals, hunting and hunting, the production of agricultural products, forest cultivation and logging, as well as the provision of services to ensure such activities;
(n) the protection of confidential statistical data by a summary of the measures and instruments which ensure such handling of confidential data from statistical surveys carried out by the State Statistical Service and data obtained from administrative sources so that they cannot be illegally altered, destroyed, lost, transferred or otherwise misused and used only for statistical purposes; Such protection shall also be subject to combined data for several legal or natural persons from which, without undue time and effort, it is possible to identify or identify the person concerned. ';
3. Paragraph 3 (3) reads as follows:
"(3) The authorities performing the national statistical service shall ensure the protection of confidential statistical data in the manner laid down by this law. Where confidential statistics also contain personal data, such personal data shall be subject to protection in a manner laid down by a special law. 2a) '.
4. in Article 4 (1) (a), the word "demographic" shall be inserted after the word "economic."
5. in Paragraph 4 (1) (d), the word "sector" is replaced by the word "part."
6. in Paragraph 4 (1) (f), the word "demographic" shall be inserted after the word "economic."
7. in Article 4 (1) (g), the words "and processes demographic projections" shall be deleted;
8. in Article 4 (1) (i), the word "demographic" shall be inserted after the word "economic."
9. the following shall be added to Article 4 (1) (m), including footnote 2b:
"(m) cooperate with international organisations; is involved in the production of statistics of the European Communities, 2b)
(2b) Articles 284 and 285 of the Treaty establishing the European Community. Article 187 of the Treaty establishing the European Atomic Energy Community. '
10. in Article 4 (1) (n), the word "ensuring" shall be replaced by the word "creating."
11. in Article 4 (2) (a), the word "demographic" shall be inserted after the word "economic."
12. in Article 4 (2), the words "other professional publications and magazines" shall be added at the end of the text in point (b).
13. in Article 4 (3) (a), "individual" is replaced by "confidential statistical."
14. in Article 4 (3) (b), "duplicate data collection" is replaced by "excessive burden on reporting agents."
15. in Article 6 (2), the last sentence shall be replaced by "the Council shall have a maximum of 25 members."
16. In Article 6, at the end of paragraph 2, the sentence "The function of a member of the Board shall be honorary."
17. Paragraph 6 (3) reads:
"(3) The Council is discussing the draft statistical survey programme, expressing its views on the proposals for statistical surveys without reporting requirements and assessing the need for data provided under Section 9 (1) for the Czech Statistical Office. Other tasks, method of work and assembly of meetings of the Council are governed by its Statute, which will be published by the President of the Czech Statistical Office."
18. In Article 9, the words "Without consulting the Board 'shall be inserted at the beginning of paragraph 2.
19. in Article 9 (2) (c) (2), the word "employer" shall be inserted after the word "obliged to pay."
20. in Paragraph 10 (2) (d), the word "individual" shall be inserted after the word "supply."
21. in Article 11, the word "free of charge" shall be deleted and the word "individual" shall be inserted after the word "provision."
22. In Article 12 (1), the second sentence is replaced by the following: "For the creation of this information, the public authorities and health establishments, according to the nature of their activities, are required to provide the Czech Statistical Office with confidential statistics on the birth number, place of residence, place of residence of a stranger who is resident on the territory of the Czech Republic on the basis of a residence visa of more than 90 days, citizenship, birth characteristics of the unborn child, family status, order of marriage (divorce), number of minors in divorcing marriages, causes of divorce of marriage, where they have been found, cause of death, length of life of the deceased infant, place and time of the event followed."
23. in Article 13 (2), "individual" is replaced by "confidential statistical."
24. The heading above Section 16 is deleted and the heading below Section 16 is inserted: "Obligation to confidentiality and protection of confidential statistical data '.
25. Paragraph 16 (1) reads:
"(1) The staff of the authorities carrying out the State Statistical Service and other natural persons carrying out the processing of statistical surveys or the collection of data for agricultural inventories shall be obliged to keep the confidentiality of confidential statistical data to which they are acquainted. To this end, they shall be obliged to lodge a non-disclosure oath on taking up their employment or before the work in question. ';
26. in Article 16 (2), "individual" is replaced by "confidential statistical."
27. in Paragraph 16 (4), "individual" is replaced by "confidential statistical."
28. In Article 16 (6), "individual 'is replaced by" confidential statistical'.
29. The following heading is inserted under Section 17: "Provision of confidential statistical data '.
30. in Article 17 (1) (a), including footnote 6,
"(a) they may provide each other with confidential statistical data if they are required to provide a national statistical service in a manner that ensures that their confidentiality is protected; they may also provide each other with confidential statistical data for the production of statistics of the European Communities, 6)
6) Article 14 of Council Regulation (EC) No 322 / 97 of 17 February 1997 on Community statistics. "
31. in Article 17 (1) (b), "individual" is replaced by "confidential statistical."
32. in Paragraph 17 (1) (c), "individual" is replaced by "confidential statistical."
33. in Paragraph 17 (1) (d), the word "individual" is replaced by "confidential statistical."
34. in Article 17 (1), at the end of point (d), the dot is replaced by a comma and the following point (e) is added:
"(e) provide confidential statistical data for the purposes of producing statistics of the European Communities in accordance with European Community law. 6a)
(6a) Council Regulation (EC) No 322 / 97 of 17 February 1997 on Community statistics. Council Regulation (Euratom, EEC) No 1588 / 90 of 11 June 1990 on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities. ';
35. in the first and third sentences of Paragraph 17 (2), "individual" shall be replaced by "confidential statistical."
36. Paragraph 17 (3) is deleted.
Paragraphs 4 and 5 shall be renumbered paragraphs 3 and 4.
37. in Article 17 (4), the word "individual" shall be replaced by "confidential statistical" and the words "or scientific" shall be deleted;
38. The heading of Section 18 reads: "Provision of statistical information and anonymous data."
39. In Article 18 (1), the words "and in a way that allows remote access (7a) 'shall be inserted after the words" other media' and the following footnote (7a) shall be added:
"7a) § 2 (o) of Act No. 365 / 2000 Coll., on Information Systems of Public Administration and on the amendment of certain other laws."
40. in Paragraph 18 (1) (a), the word "requested" shall be inserted after the word "provided."
41. in Paragraph 18 (1) (b), the words "and anonymous data" shall be inserted after the words "providing the statistical information generated."
(42) In Paragraph 18 (1) (b), the words "the price of media" shall be inserted after the words "by the acquisition of copies."
43. In Paragraph 18 (1), the words "and anonymous data" shall be added at the end of the text of point (b).
44. In Paragraph 18 (3), the word "bulk 'shall be inserted after the word" notify in'.
45. In Paragraph 18, the words ", own publications and other media and in a way that allows remote access' are added at the end of paragraph 3.
46. In the first sentence of Paragraph 19a (1), the words "and the register of addition circuits' shall be inserted after the words" the register of economic operators'.
47. in the second sentence of Article 19a (1), the words "is a register" shall be replaced by the words "are registers."
48. in Article 19a (2), point (a) is deleted;
Points (b) and (c) shall become points (a) and (b).
49. in Paragraph 20 (2) (n), "capital" is replaced by "capital."
50. in Paragraph 20 (2), at the end of point (r), the dot is replaced by a comma and the following points (s) and (t) are added:
"(s) the value of the goods accepted for the relevant calendar period from the other Member States of the European Communities;
(t) the value of the goods dispatched for the relevant calendar period to the other Member States of the European Communities. ';
51. in Article 20 (6), "(k) to (r)" is replaced by "(k) to (t)";
52. In Paragraph 20a, the current text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) The information referred to in paragraph 1 (a) and (b) shall be public data and shall be made available to anyone who requests it. The authorities referred to in Article 18 (1) (a) shall be provided with this information free of charge, to other applicants at the agreed price according to price regulations.
(3) The information referred to in paragraph 1 (c) is not public. It shall be provided by the Czech Statistical Office to the ministries which provide the State Statistical Service and to another State or Territorial Authority, provided that it is authorised to obtain the required data under a special law and does not lend to the data obtained for statistical purposes. ';
53.In Article 20d, "§ 20a to" is replaced by "§ 20b a."
54. The heading above Section 21 is deleted and the following heading under Section 21 is inserted: "Economic identification number and identification code '.
55. in Paragraph 21 (1), the words "economic operator (hereinafter referred to as" identification number ")" shall be inserted after the words "number";
56. In Article 21 (4), the word "him" shall be inserted after the word "number."
57. in Paragraph 28 (4), the word 'individual' is replaced by 'confidential statistical';
Čl. II
Efficacy
This Law shall take effect on the 15th day following that of its publication, with the exception of the provisions of Article 5 (1) (a), (b), (c), (d) and (e). Annex V.Part 2.123, 124 (c) Annex V.Part 2.123, 124 (c) Point 34 and point 50 of Article I, which shall take effect on the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union.
