REPUBLIC OF FINLAND
No. 14010
The Ministry of Foreign Affairs shows its respect for the Embassy of the Czech Republic and has the honour to appeal to the Agreement on Economic, Industrial and Technical Cooperation between the Government of the Czechoslovak Socialist Republic and the Government of the Republic of Finland signed on 1 March 1971.
Furthermore, the Ministry has the honour to refer to the Treaty on access to the European Union of the Kingdom of Norway, the Republic of Austria, the Republic of Finland and the Kingdom of Sweden, signed at Corfu on 24 June 1994, and the Treaty establishing the European Economic Community, signed at Rome on 25 March 1957.
According to Article 234 of the second Treaty:
Rights and obligations arising from agreements concluded before the entry into force of this Treaty between one or more Member States, on the one hand, and one or more third countries, on the other hand, shall not be affected by the provisions of this Treaty.
Where such agreements are incompatible with this Treaty, the Member State (s) concerned shall use all appropriate means to eliminate the identified incompatibility. Where necessary, Member States shall assist each other to achieve the objective and, where appropriate, adopt a common position.
When implementing the agreements referred to in the first paragraph, Member States shall take account of the fact that the advantages granted in this Treaty by each of the Member States are an integral part of the establishment of the Community and are therefore inextricably linked to the establishment of common authorities, the conferral of powers on those authorities and the granting of the same advantages by all other Member States.
With effect from 1 February 1995, the European Agreement establishing an association between the European Communities and their Member States, of the one part, and the Czech Republic, of the other part, signed on 4 October 1993, shall apply in the relations between Finland and the Czech Republic.
The Ministry therefore has the honour to notify the Embassy of the Czech Republic that the Government of Finland has decided to terminate the Economic, Industrial and Technical Cooperation Agreement signed between the Government of the Czechoslovak Socialist Republic and the Government of the Republic of Finland on 1 March 1971, pursuant to Article 7 thereof. Under this Article, this Agreement is valid for a period of five years. It shall then be automatically extended by one year, unless one of the Contracting Parties denies it within a six-month period of notice.
The Ministry of Foreign Affairs would appreciate a written confirmation from the embassy of receipt of this note.
Copies of those provisions of the Economic, Industrial and Technical Cooperation Agreement and of the Treaties establishing the European Economic Community shall be annexed.
The Ministry of Foreign Affairs uses this opportunity to reassure the Czech Embassy with its deepest respect.
