DECLARATION
of 19 January 2007
amending Decree No. 296 / 2003 Coll., on animal health and protection, on the movement and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll. and Act No. 48 / 2006 Coll., ("the Act ') for the implementation of § 5 (3) (a), § 6 (9), § 9a (5) (d), § 9b (3), § 42 (5), § 51 (6) (b), § 59 (8) and § 70 (3):
Decree No. 296 / 2003 Coll., on animal health and protection, on movements and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended by Decree No. 610 / 2004 Coll. and Decree No. 330 / 2005 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Council Directive 64 / 432 / EEC of 26 June 1964 on animal health problems affecting intra-Community trade in bovine animals and swine. Council Directive 97 / 12 / EC of 17 March 1997 amending and updating Directive 64 / 432 / EEC on animal health problems affecting intra-Community trade in bovine animals and swine. Council Directive 91 / 68 / EEC of 28 January 1991 on animal health conditions governing intra-Community trade in ovine and caprine animals. Council Directive 2003 / 50 / EC of 11 June 2003 amending Directive 91 / 68 / EEC as regards the tightening of control measures for the movement of ovine and caprine animals. Council Directive 98 / 46 / EC of 24 June 1998 amending and updating Annexes A, D (Chapter I) and F to Directive 64 / 432 / EEC on animal health problems affecting intra-Community trade in bovine animals and swine. Council Directive 78 / 1026 / EEC of 18 December 1978 on the mutual recognition of diplomas, certificates and other evidence of formal qualifications of veterinary surgeons, including measures to facilitate the effective exercise of the right of establishment and the free provision of services. Directive 2001 / 19 / EC of the European Parliament and of the Council of 14 May 2001 amending Council Directives 89 / 48 / EEC and 92 / 51 / EEC on a general system for the recognition of professional qualifications and Council Directives 77 / 452 / EEC, 77 / 453 / EEC, 78 / 686 / EEC, 78 / 687 / EEC, 78 / 1026 / EEC, 78 / 1027 / EEC, 80 / 154 / EEC, 80 / 155 / EEC, 85 / 384 / EEC, 85 / 432 / EEC, 85 / 493 / EEC and 93 / 16 / EEC on the profession of nurses responsible for general care, dental practitioners, veterinary surgeons, midwives, architects, pharmacists and doctors. ';
2. in Paragraph 1 (g):
"(g) the organisation, content and conditions of professional courses for the capture and treatment of stray and abandoned animals, including in animal shelters, and for the collection and disposal of pet carcases, as well as the organisation and content of the final examination;"
3. In Section 1, the words "and the official veterinary assistant 'shall be added at the end of the text of point (i).
4. In Article 2 (1) (f), the words "diseases communicable from animals to humans' shall be inserted after the words" diseases'.
5. In Article 2 (2), the words "protective vaccination 'shall be inserted after the words" for example'.
6. in Article 3 (1) (a), the following point 1 is inserted:
"1. the placing of suitable devices to prevent the penetration of wild animals (e.g. through the seatting of openings, nets, scavengers), ';
Points 1 to 5 shall be renumbered 2 to 6.
7. in Article 3 (1) (a), the following points 7 and 8 are added:
'7. the supply of water and feed to poultry and captive birds within or under shelters,
8. Separate breeding of aquatic poultry from other poultry and captive birds, ';
8. in Article 4 (1) (a), the words "in the last month before the date of its intended transfer" shall be deleted;
9. In Article 4 (4), the first sentence is replaced by the following: "Where a certified animal is subject to a marking and registration obligation under special legislation (6), the veterinary certificate and, where appropriate, the health certificate shall indicate the identification number of the animal and the farm registration number (6) of the place of origin or dispatch and destination in accordance with the central register and, where appropriate, the veterinary approval number of the place of origin or dispatch and destination."
10. Paragraph 4 (5) is deleted.
Paragraphs 6 to 8 shall become paragraphs 5 to 7.
11. in Article 5, paragraphs 2 and 3 are deleted;
Paragraphs 4 and 5 shall be renumbered paragraphs 2 and 3.
12. in Article 5 (3), the comma at the end of point (b) shall be replaced by a dot and point (c) shall be deleted;
13. in Article 9 (2) (c), the words "confiscates of animal origin" shall be replaced by "animal by-products."
14. in Article 9 (5) (c), the words "residence or residence" are replaced by the words "residence, residence or residence."
15. in Article 11 (1) (b), the following point 6 is added:
"6th suitably equipped animal investigation rooms,"
16. in Article 11 (3) (b), the words "permanent residence or residence (8)" shall be replaced by "permanent residence, residence (8) or residence,";
17. in Article 11 (4) (a), the words "permanent residence or residence (8)" shall be replaced by "permanent residence, residence (8) or residence (8)," and the words "and vehicle registration number" shall be inserted after the word "carrier."
18. in Article 11 (4) (b), the words "permanent residence or residence (8)" shall be replaced by the words "permanent residence, residence (8) or residence (8)," and the words "and vehicle registration number" shall be inserted after the word "carrier."
19. in Article 12 (1) (b) (3), the words "animal isolation facilities" shall be deleted;
20. in Article 12 (1) (b), the following points 5 to 7 are added:
"5. an animal isolation facility of sufficient capacity to isolate all animals in the event of a disease, a disease communicable from animals to humans or other diseases;
6. an adequate system for waste water disposal and manure storage,
7. suitably equipped premises for animal investigation, '.
21. in Article 12 (2) (a), the words "permanent residence or residence (8)," shall be replaced by the words "permanent residence, residence (8) or residence (8)," and the words "allocated" shall be inserted after the words "identification number";
22. in Article 12 (3) (a), the words "permanent residence or residence (8)" shall be replaced by the words "permanent residence, residence (8) or residence (8)," and the words "vehicle registration mark" shall be inserted after the word "carrier."
23. in Article 12 (3) (b), the words "permanent residence or residence (8)" shall be replaced by "permanent residence, residence (8) or residence (8)," and the words "or vehicle registration number" shall be inserted after the word "carrier."
24. The following Section 12a is inserted after Section 12, including the title and footnote 8a:
Veterinary requirements for persons trading in ovine or caprine animals
(K § 9b (3) of the Act)
(1) The application for approval of a person trading in ovine or caprine animals meeting the requirements laid down in specific legislation8a) contains:
(a) details of the person trading in ovine or caprine animals (name and / or name, surname and place of residence or residence or residence, if any), if any, 8, if it is a natural person, or business name or business name or registered office, or the address of the organisational body in the territory of the Czech Republic, if any, if any, if any, if it is a legal person, the identification number, if any, and the authorisation on the basis of which it carries out its activities;
(b) the listing, description and location of stables, other premises and facilities, as well as the means used for the activity and evidence of their eligibility for the activity.
(2) The Regional Veterinary Administration verifies the basic knowledge of persons employed by a person trading in sheep or goats for the care of animals (§ 9b (1) (d) of the Act) from evidence of their expertise and experience.
8 (a) Decree No 382 / 2003 Coll., on animal health requirements for trade in animals and on animal health conditions governing their importation from third countries, as amended. '
25. in Paragraph 14 (2), the words "permanent residence or residence (8)," shall be replaced by "permanent residence, residence (8) or residence (8)," and the words "allocated" shall be inserted after the words "identification number";
26. in Paragraph 14 (3) (a), the word "killed," shall be replaced by "killed or" and the words "necessarily slaughtered for diagnostic purposes" shall be deleted;
27. in Paragraph 15 (1), in the introductory part of the provision, the words "confiscates of animal origin" shall be replaced by "animal by-products."
28. in Article 15 (1) (a), the words "permanent residence or residence (8)" shall be replaced by the words "permanent residence, residence (8) or residence (8)," after the words "applicant's identification number," the words "allocated" and the words "permanent residence (8)" shall be replaced by "permanent residence, residence (8) or residence."
29. in Article 15 (1) (d), "confiscates of animal origin" shall be replaced by "animal by-products."
30. In Article 16 (1), the words "or equivalent documents issued by the State of which he is a citizen and by States in which he has remained continuously for more than 3 months in the last 3 years which may not exceed 6 months shall be inserted after the words" months, "."
31. in the first sentence of Article 16 (2), the words "or the corresponding documents issued by the State of which the statutory authority or expert representative is a citizen, and by States in which he has remained continuously for more than 3 months in the last 3 years, which may not be more than 3 months old," shall be inserted after the words "representative."
32. in Article 17 (1) (a), the words "residence or residence (8)" are replaced by the words "residence, residence (8) or residence (8)."
33. In Paragraph 17 (2) (b), the words "or the corresponding documents issued by the State of which he is a citizen and by States in which he has been continuously present for more than 3 months in the last 3 years, which may not be more than 6 months old, shall be inserted after the word" months. "
34. in Article 19 (2) (b), the words "and has at least 3 years of experience in the field" shall be deleted;
35. In Paragraph 22, the sentence "This does not apply in the case of senior employees in the first stage of management11) is added at the end."

36. In Paragraph 27, "Annex 3 'is replaced by" Annex 4';
37. In the title above Article 28, the words "stray animals and their handling 'are replaced by the words" stray and abandoned animals and their handling, including their care in animal shelters, and for the collection and disposal of pet carcases'.
38. Paragraph 28 (1) is deleted and paragraph 2 is deleted.
39. In the first sentence of Paragraph 28, the words "for the capture and handling of stray and abandoned animals, including their care in animal shelters," shall be inserted after the word "course."
40. The following Section 28a is inserted after Section 28:
The training course for the collection and disposal of pet carcases shall be organised within 30 hours of theoretical instruction. The participant in the training course shall acquire the basic knowledge of the methods and tools necessary for the collection and disposal of pet carcases, health risks and safety of work in the collection and disposal of animal carcases, as well as the legislation relating to the collection and disposal of animal carcases. ';
41. In the first sentence of Paragraph 29 (1), the words "pursuant to Paragraph 28 'shall be inserted after the word" course'.
42. In Paragraph 29, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) At the end of the professional course referred to in § 28a, its participants shall undergo a theoretical examination before the Examination Committee of the Regional Veterinary Administration, which is three members. The Chairman and other members of the Examination Committee shall be appointed by the Director of the Regional Veterinary Administration in agreement with the Central Director of the State Veterinary Administration from the experts of the Veterinary Administration and Veterinary and Pharmaceutical University in Brno.
(4) The test referred to in paragraph 3 shall take the form of a written test. In the event of failure to fulfil the written test, the candidate shall be interviewed by the examination committee. ';
Paragraphs 3 to 5 shall be renumbered paragraphs 5 to 7.
43. In Article 29 (5), the words "in accordance with paragraphs 1 and 3 'shall be inserted after the word" tests'.
44. In Article 29 (6), the words "in accordance with paragraphs 1 and 3 'shall be inserted after the words" in accordance with paragraphs 1 and 3', and at the end of the paragraph, the sentence "On the basis of a successfully completed test in accordance with paragraphs 1 and 3, a participant in a training course shall obtain a certificate 'shall be added.
45. in Paragraph 29 (7), the words "pursuant to § 28 or § 28a" shall be inserted after the word "course."
46. In Article 29, the following paragraph 8 is added:
"(8) A participant in a vocational course in accordance with § 28 or § 28a who has not passed the examination and has not applied for it to be repeated no later than 6 months from the date on which he was notified that he had not passed the examination, shall take the technical course again before the next examination. '
47. Paragraph 30, including the title, reads:
Certificate of veterinary inspector and official veterinary assistant
[K § 53 (6) (b) of the Act]
(1) The model of the veterinary inspector's service card is set out in Annex 2.
(2) The model of the official veterinary assistant's service card is set out in Annex 3. '

49. The following Annex 3 is inserted after Annex 2:
"Annex 3 to Decree No. 296 / 2003 Coll.
Annex 3 to date shall be renumbered Annex 4.
Efficacy
This decree shall take effect on the day of its publication.
