DECLARATION
of 28 February 2017
on the content and scope of services provided by rail operators and service facilities operators
The Ministry of Transport provides pursuant to § 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 134 / 2011 Coll. and Act No. 319 / 2016 Coll., for implementation of § 23 (1) (a), § 23 (8) and § 23d (5):
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for
(a) the minimum scope and content of services related to the use of the runway and the operation of the rail vehicle provided by the rail operator to the railway operator on the national, regional or publicly accessible rail;
(b) the breakdown of service facilities and their operational components;
(c) categories of causes of disruption of rail traffic,
(d) the minimum extent of data on the disruption of the operation of railway transport transmitted when it is reported between the parties to the contract for the operation of railway transport on a national, regional or public railway track; and
(e) the content of the plan to eliminate the causes of the track overload.
Minimum scope and content of services
(1) The railway operator of a national, regional or publicly accessible railway undertaking shall process the application of the carrier for the allocation of runway capacity, draw up a timetable according to the allocated capacity and allow the use of the allocated runway capacity under the agreed timetable.
(2) Furthermore, the rail operator of a national, regional or publicly accessible tractor shall, under a railway transport contract, provide access to services related to the use of the runway and the operation of the railway vehicle within the scope of:
(a) use of the runway as specified in the Annex to this Decree, including the use of traction current supply facilities, if available;
(b) the organisation of railway transport, the safety of train running and the movement of the railway vehicle, the operational control of the railway transport, the radio connection with the railway vehicle, where available, the communication and provision of information to the carrier on the train running of the carrier;
(c) the provision of further information needed to establish or provide transport services for which the railway capacity has been allocated.
Breakdown of service facilities and operational components
(1) The operational components of the railway station are:
(a) passenger information systems on the arrival and departure of trains, exclusions, carrier services and other transport links within integrated transport systems;
(b) indicative signs of access to trains;
(c) waiting rooms for passengers;
(d) luggage storage,
(e) sanitary facilities for passengers;
(f) parking for buses, cars and bicycles,
(g) premises for the sale of travel and reservation documents,
(h) premises for the operational facilities of those staff of carriers providing services to passengers at the railway station;
(i) other premises for the services of individual carriers;
(j) lifting platforms or ramps on platforms and railway stations to ensure the accessibility of rail transport for disabled persons and persons with reduced mobility and orientation2),
(k) the places of loading and unloading for the transport of goods; and
(l) rail tracks for the assembly of trains and the displacement of railway vehicles.
(2) All operational components referred to in paragraph 1 need not always be operated at the railway station.
(3) Stationary tracks and service stations are service facilities operated without operating components.
(4) Other technical installations for rail transport are subdivided into:
(a) centres for the maintenance of railway vehicles, with the exception of high-speed vehicles and vehicles with specific operational technical characteristics, where the maintenance of such vehicles is carried out after their normal operation is shut down;
(b) equipment for the operational treatment of wagons, in particular their washing, cleaning and filling with water;
(c) loading and unloading equipment;
(d) stable and mobile equipment for the transhipment of transport units between modes of transport;
(e) movement equipment;
(f) outlines,
(g) rolling scales; and
(h) equipment with a non-traction power source intended for the connection of railway rolling stock.
Category of causes of disruption of rail traffic
(1) The reasons for the disruption of rail traffic on the part of the rail operator are:
(a) incorrect organisation of rail transport caused by:
1. lack of timetable,
2. error in the operating procedure for the management of railway traffic,
3. error in applying priority rules to trains,
4. by error of the person controlling the railway transport while operating the runway; or
5. another cause,
(b) failure of the runway components
1. station or track safety equipment,
2. crossing or crossing safety equipment,
3. telecommunications equipment,
4. power supply;
5th malfunction in the dorm,
6. failure on the track construction,
7. error of the person operating the device; or
8. For another reason,
(c) carrying out construction or maintenance work as a result of:
1. planned lockouts of railway transport,
2. exceptional exclusions,
3. defects in the dorm; or
4. Other causes,
(d) defects on the part of another runway operator caused by:
1. the previous runway operator; or
2. the following runway operator.
(2) The reasons for the disruption of rail traffic on the part of the carrier are:
(a) incorrect organisation of rail transport caused by:
1. exceeding the stopping time of the train against the timetable;
2. change of the transport contract at the request of the carrier;
3. exceeding the loading time;
4. a defect in loading,
5. error in train handling,
6. by error of the person responsible for loading, unloading or handling the train; or
7. For another reason,
(b) defects in the operation of the carrier's vehicle fleet caused by:
1. when planning the circulation or changing the vehicle's circulation plan;
2. incorrect formation of the train by the carrier,
3. fault of passenger cars,
4. fault of trucks,
5. failure of units, locomotives and motor vehicles,
6. by error of the person providing service or maintenance of the vehicle fleet; or
7. For another reason,
(c) defects on the part of another carrier caused by:
1. by the following carrier; or
2. by the previous carrier.
(3) Other causes of disruption of rail transport operations are:
(a) strike;
(b) administrative matters such as prohibitions on loading, transport,
(c) unforeseen weather and natural effects;
(d) delay for external reasons on the following network;
(e) incidents;
(f) track occupancy due to the delay of the same train;
(g) track occupancy due to delays in another train;
(h) delayed turnover at the final station;
(i) waiting for the train connection;
(j) violent damage to the runway;
(k) violent damage to the groove vehicles;
(l) obstacle on the track;
(m) other external causes; or
(n) reasons not yet established.
Minimum range of data transmitted when reporting disruption of rail traffic
The minimum range of data on railway traffic disruption transmitted on its reporting between the parties to the railway traffic contract on the national, regional or public railway track shall be:
(a) the identification of the route and section of the runway where the operation of the runway has been disrupted;
(b) the duration of the breach;
(c) the number and designation of the trains concerned;
(d) measures taken to limit the amount of damage;
(e) an overview of the trains affected by the cancellation or delay, indicating the delay period over a period of not more than 1 month; and
(f) the value of delays and thresholds at which one or the other of the contract for the operation of railway transport will be subject to the obligation to pay penalty payments for the disruption of the operation of railway transport, both for individual journeys and for all journeys of trains of the carrier within a given period of time.
Content elements of the plan to eliminate the causes of track overload
The plan to eliminate the causes of the track overload contains in particular:
(a) a description of the overloaded section of the runway;
(b) the reasons for the overload;
(c) likely future development of railway transport on a given railway section;
(d) restrictions on runway development;
(e) the possibilities and costs of extending the runway capacity, the measures to be taken to increase capacity, including the timetable for implementing those measures; and
(f) likely changes in the price for use of the runway and the allocation of its capacity.
Repeal
Decree No 351 / 2004 Coll., on the scope of services provided by the railway operator to the carrier, is repealed.
Efficacy
This Decision shall enter into force on 1 April 2017.

SCOPE OF USE OF THE SPECIES
(1) The runway operator of a national, regional or publicly accessible tractor shall ensure that the carrier can use the runway to the extent that:
1. land within the track perimeter except land within the depot and rolling stock workshops;
2. the bodies of the railway bottom which form the ground body, the structural layer of the body of the railway bottom and the drainage equipment, and the plain of the body of the railway bottom,
3. structures and installations of railway bottom, i.e. forks, bridges, bridges similar to, tunnels, support walls, guarantee walls, protective and tiled walls, accompanying and insulating greens, galleries and protective and regulatory structures, passages, protective devices against the fall of foreign objects, fire, water and snow, stoppers, fences, handrails, inspection and cleaning pits,
4. level crossing of the road track with the infrastructure, including crossing-point signalling equipment;
5. railway superstructure, in particular rail, rail support, fasteners, small rails, crossings, dilation devices, insulated connections, conductive and special connections, holding rails, protective rails, toothing bars, rail-crossing devices, sleepers, rail-bed, switch-heating, turning and sliding, except those exclusively intended for traction railway vehicles;
6. access roads for passengers and for the transport of goods, including transport areas,
7. Communication equipment for the transmission of information containing transmission routes, terminal equipment, connecting, transmission equipment, connected to separate circuits or telephone, telex, data and radio networks, radio equipment, clock, information, industrial television and fire alarms,
8. a safety device incorporating technical means of securing and controlling railway transport at railway stations and on lines, equipment for the mechanisation and automation of gradients and associated transmission routes; track brakes,
9. Electrical equipment containing devices that provide power supply for electric power vehicles including traction power stations and control stations and traction lines, means of dispatching control of the rail operator, track-side electrical power supply and use of electricity, special electrical equipment, apparatus and lighting equipment, equipment for protection against the effects of atmospheric electricity, equipment for protection against the negative effects of reverse traction currents, or other electrical equipment also powered from traction lines,
10. Lighting equipment for operational and safety purposes,
11. buildings or parts thereof and equipment intended for the operation of the runway.
(2) The rail operator of a national, regional or publicly accessible tractor shall not provide access to railway tracks within the depot and the rolling stock workshops.
