GOVERNMENT REGULATION
of 26 January 2005
determining the scope of direct teaching, direct education, direct teaching and direct pedagogical and psychological activities of teaching staff
The Government orders pursuant to § 23 (5) of Act No. 563 / 2004 Coll., on pedagogic workers and on the amendment of certain laws:
§ 1
Scope
This Regulation shall apply to pedagogical staff (1) of schools and educational establishments (hereinafter referred to as "the school ') set up by the Ministry of Education, Youth and Sports (hereinafter referred to as" the Ministry'), the region, municipalities and a voluntary association of municipalities whose tasks are in the field of education.
Scope of hours of direct teaching, direct education, direct teaching, direct social pedagogical and direct pedagogical psychological activity
§ 2
(1) The scope of the hours of direct pedagogical activity is laid down in the Annexes to this Regulation. If the scope of the hours of direct pedagogical activity of a pedagogical worker is not specified in the Annexes to this Regulation, the principal of the school shall set it at a maximum of 32 hours per week.
(2) To the teacher who teaches all subjects in the year in which the number of hours according to approved school training programmes (2) is lower than the number of hours of direct pedagogical activity set out in Annex 1 to this Regulation, the school director shall determine the weekly scope of direct pedagogical activity according to the approved school training programme.
(3) The weekly scope of direct pedagogical activity may be spread out unevenly over each week so as not to exceed the average fixed weekly range of direct pedagogical activity over a period of no more than 5 consecutive months.
(4) For a legal person who carries out several types of school activity, the weekly scope of direct pedagogical activity of the school director shall be determined according to the school's activities carried out, for which the lowest direct teaching activity is laid down in Annex 1 to this Regulation. The number of units referred to in Section 4 shall include all units of that legal person.
(5) A pedagogical worker who represents the head of a pedagogical staff member in full for at least 4 consecutive weeks shall, from the beginning of the fifth week, carry out direct teaching activities to the weekly extent laid down for the represented teaching staff.
(6) The weekly scope of direct pedagogical activity set out in Annex 1 to this Regulation shall be increased by 1 hour, provided that the pedagogical staff provides pedagogical intervention as a support measure. The first sentence shall not apply to a pedagogical worker with a contract of less than a fixed weekly working time and to a pedagogical worker for whom the weekly extent of direct pedagogical activity is set out in a range.
(7) Within the weekly scope of direct pedagogical activity of teachers of higher vocational schools, the school director may count up to 3 hours of consulting activity per week.
(8) In the weekly scope of direct pedagogical activity of the coach, the school director may include up to 4 hours of coaching at the competition of pupils or students.
(9) The principal of the school shall determine the weekly scope of direct pedagogical activity, according to the activity carried out, of the primary school of art, which shall carry out the activity of individual, group or collective teaching. In the case of the same proportion, the weekly scope of direct pedagogical activity shall be determined according to the teaching for which the direct pedagogical activity is the lowest in Annex 1 to this Regulation.
§ 3
(1) A teacher teaching a subject in a foreign language at a school which, subject to the authorisation of the Ministry (3), teaches selected subjects in a foreign language may reduce the scope of direct pedagogical activity by up to 3 hours per week. This does not apply to teaching foreign languages.
(2) Teachers - educational advisors are reduced weekly extent of direct pedagogical activity
(a) in primary and secondary schools with the number of pupils
1. to 150 by 1 hour per week,
2. to 250 by 2 hours a week,
3rd to 550 by 3 hours a week,
4 to 800 by 4 hours a week,
5. Over 800 by 5 hours a week,
b) in primary school special with the number of classes
1. to 7 by 1 hour per week,
2. to 12 by 2 hours a week,
3 over 12 by 3 hours a week.
(3) Teacher - Information and Communication Technologies Coordinator reduces the weekly scope of direct pedagogical activity with the number of pupils or students at school
(a) up to 50 by 1 hour per week,
(b) up to 150 by 2 hours per week,
(c) up to 300 by 3 hours a week;
(d) up to 500 by 4 hours a week;
(e) over 500 by 5 hours a week.
(4) Where it is entrusted with the function of coordinator in the field of information and communication technology or a training advisor to several pedagogical staff, each of them shall be reduced by the scope of direct pedagogical activity, according to the school director, of the assigned number of pupils or classes.
(5) Where a coordinator in the field of information and communication technology or a guidance counselor is performed by the school director, a deputy school director or a leading practical teacher, they shall be reduced by the weekly scope of direct pedagogical activity referred to in paragraphs 2 and 3, up to a maximum of half the weekly range set for the school director in Annex 1 to this Regulation.
§ 4
Number of units responsible for determining direct teaching activities
The number of units responsible for determining the weekly scope of direct pedagogical activity shall be counted:
(a) classes, study groups, departments, educational groups, specifically a teaching centre and a school club; Gymnasium classes with sports training, in which only pupils in this field are included, are counted twice; and
(b) for primary art school, conservatory, language school with the right of state language examinations and secondary vocational school with 24 teaching hours per week as 1 unit.
Scope of direct pedagogical activity of the Deputy Director of the School or of the Head Teacher of Practical Teaching
§ 4a
The weekly scope of direct pedagogical activity of the Deputy Head of the School or of the Head of the School of Practice shall be determined as the weekly scope of direct pedagogical activity set out in Annex 1 to this Regulation for teachers, educators, psychologists, special educator, coach or assistant educator reduced to the extent specified by the School Director, up to a maximum of the hours specified in § 4b to 4g. The reduction of the weekly scope of direct pedagogical activity provided for in Sections 4b to 4g shall not apply to the Deputy Director of the Vocational Training School and the Head of the Vocational Training Teacher.
§ 4b
(1) For a legal person who carries out 1 type of school referred to in Annex No 2 or 3 to this Regulation, the extent of the reduction of direct teaching activities shall be determined by the representative of the school director or of the head of the practical teaching teacher according to the value given for the type of school whose activity the legal person carries out.
(2) For a legal person carrying on 1 type of school listed in Annex 2 to this Regulation, and at the same time:
(a) (1) the type of school referred to in Annex 3 to this Regulation shall be determined by the extent to which the direct pedagogical activity of a representative of the school head or of the head of the practical teaching teacher is reduced by the sum of the values given for the two types of school whose activities the legal person performs;
(b) several types of schools listed in Annex 3 to this Regulation shall determine the extent to which the direct pedagogical activity is reduced by a representative of the school director or the head of the practical teaching teacher, by the sum of the values given for all types of schools whose activities are carried out by a legal person.
(3) For a legal person who carries on the activities of several types of schools listed in Annex 2 to this Regulation, the extent to which the direct pedagogical activity is reduced by a representative of the school director or of the head teacher of practical teaching according to the type of school whose activities are carried on by the legal person for whom the highest value is set in Annex 2 to this Regulation; the extent to which the direct pedagogical activity is reduced by the Deputy Head of the School or the Head of the Practical Teaching Teacher may not be determined according to the values established with the School Cooperative. The number of units of a legal person according to the first sentence shall be the sum of the units of all types of schools listed in Annex 2 to this Regulation whose activities are carried out by a legal person.
(4) For a legal person operating several types of schools listed in Annex 3 to this Regulation, the extent to which the direct pedagogical activity of a representative of the principal of the school is reduced shall be determined by the sum of the values given for all types of schools whose activities are carried out by a legal person.
(5) For a legal person who carries on the activities of several types of schools listed in Annex 2 to this Regulation and at the same time:
(a) (1) the type of school referred to in Annex 3 to this Regulation shall be determined by the extent to which the direct pedagogical activity of the Deputy Head of the School or of the Head of Practical Teachers is reduced by the sum of the values set out in paragraphs 1 and 3;
(b) several types of schools listed in Annex 3 to this Regulation shall determine the extent to which the direct pedagogical activity of the Deputy Director of the School or the Head of the School of Practice is reduced by the sum of the values set out in paragraphs 3 and 4.
§ 4c
(1) In addition, 7 hours per 1 to 120 pupils or students taking part in practical training or training and 2 hours per further 120 pupils or students shall be included in the scope of the reduction of direct pedagogical activity of the Deputy Director of the School or the Head of the School of Practical Teaching.
(2) In addition, 7 hours per 1 to 42 pupils participating in a practical course and another 2 hours per additional 42 pupils started shall be included in the scope of the reduction of direct pedagogical activity of the school's principal or head teacher of practical teaching at the school established under Paragraph 16 (9) of the Education Act.
(3) The number of pupils referred to in paragraph 1 shall not include pupils in the field of vocational training (4) in a school in which vocational training is held in 10 or more groups and pupils who are counted as heads of practical teaching at a school established under Paragraph 16 (9) of the Education Act under paragraph 2.
§ 4d
(1) In addition, two hours per week for each additional school, primary school, secondary school, secondary school or conservatory, shall be included in the scope of the reduction of direct pedagogical activity of the Deputy Head of the School or of the Head of the practical teaching teacher.
(2) In addition, in order to reduce direct pedagogical activity, the Deputy Director of the School shall be counted at 1 hour per week for each additional place of study.
(3) For the purposes of paragraphs 1 and 2, another place of work shall mean any other place where education or provision of educational services is carried out and, in the case of a forest nursery school, the territory in which, in particular, a pedagogical programme is carried out and where the school has facilities, registered in the school register, which:
(a) they are not connected to another school place or territory in space;
(b) is not linked to any other school place or territory by construction or technical means; and
(c) not located on the same or adjacent parcel.
§ 4e
Where more than one representative of the School Director or of the Head of Teachers of Practical Teachers is appointed at the School, they shall be reduced by the weekly scope of direct pedagogical activity to the extent specified by the School Director in a total of not more than the number of hours laid down in this Regulation for one Deputy Head of the School or Head of the Practical Teacher.
§ 4f
The weekly scope of direct pedagogical activity of the Deputy Head of the School or of the Head of the Practical Teacher shall not be less than the specified weekly scope of direct pedagogical activity of the School Director as set out in Annex 1 to this Regulation; Paragraph 3 (5) is without prejudice to this.
§ 4g
The school director does not need to regulate the extent to which the direct pedagogical activity is reduced by the Deputy Head of the School or the head of the practical teaching teacher in accordance with § 4a to 4f if there is a change in the number of children, pupils or students at the school or units in the school during the school year.
§ 5
Common provisions
(1) The principal of the school shall determine the weekly scope of direct pedagogical activity, according to the activity carried out, of a legal person who carries out several types of activity. For the same proportion, the weekly scope of direct pedagogical activity shall be determined by the school for which the direct pedagogical activity is the lowest in Annex 1 to this Regulation.
(2) Where a pedagogical worker carries out at the same time several activities in accordance with Article 3 (2) and (3), the weekly scope of direct pedagogical activity for each such activity shall be reduced separately.
§ 6
Efficacy
This Regulation shall enter into force on the day of its publication.
