DECLARATION
of 9 February 2005
on basic artistic education
The Ministry of Education, Youth and Sports provides in accordance with Sections 112 and 123 (5) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act):
Organisation of basic artistic education
(1) An artistic field of music, dance, artistic or literary may be established in the primary arts school (hereinafter referred to as "school"). More fields of art can be established at school.
(2) Initial study for primary education in grade I shall have a maximum of 2 years. It is intended for pupils from 5 years of age.
(3) The basic degree is 7 years and is intended for pupils from 7 years of age. The primary level of the second degree is 4 years and is intended for pupils from 14 years of age.
(4) For pupils who have not attended or successfully completed the first degree according to § 7 (1) in the course of their studies, it is possible to organise initial education in the second degree, which is one year.
(5) A study with an extended number of teaching hours is intended for gifted and extremely gifted pupils of primary education who demonstrate the conditions for fulfilling the educational content defined in the school curriculum for study with an extended number of teaching hours.
(6) Adult studies have a maximum of 4 years, the length of education in this study is determined according to the individual abilities of the pupil, taking into account his age.
(7) Individual, group and collective training is organised in the various fields of art of basic art (hereinafter referred to as "education"). The number of pupils in each subject and department and the nature of group and collective teaching shall be determined by a framework programme for basic artistic education.
(8) The school director may exceptionally, for health or other serious reasons, release the pupil in full or in part for regular attendance in one of the compulsory subjects provided for by the school curriculum, either for the school year or part thereof; At the same time, it shall determine the alternative method of teaching, the content and scope of the examinations and the date of completion of the examinations from the subject from which the pupil was released.
(9) The school can organise events related to educational activities, in particular concerts, exhibitions, competitions, shows, performances and trips abroad.
(10) The school shall include only those pupils who have concluded a liability insurance in force in the territory of the competent State and medical expenses abroad or, in the case of a trip to a Member State of the European Union, a State of the European Economic Area or the Swiss Confederation, a European Health Insurance Card or a certificate replacing that certificate. A minor student shall also submit the written consent of the legal representative.
(11) The safety and health of minors at school, in training outside the place where the education takes place (1), and in actions outside the place where the training takes place, are provided by the legal person who carries out the school's activities, by his staff, but always by at least one pedagogical worker. A staff member who is not a pedagogical worker may only be appointed by the school director to ensure the safety and health of minors if he is mature and fully qualified.
(12) In actions outside the place where the training takes place, more than 25 of these pupils may not belong to one person ensuring the safety and health of minors. Exemptions from this number may be provided for by the Head of the School in view of the complexity of ensuring the safety and health of minors.
(13) Actions taken outside the place where training takes place, where the place for the assembly of minors is not the place where training takes place, shall ensure the safety and health of minors at a pre-determined place 15 minutes before the time of the assembly. At the end of the event, the provision of safety and health protection for these pupils ends at a predetermined place and at a predetermined time. The school shall announce the place and time of assembly of minors and the termination of the event at least 1 day in advance to their legal representatives.
Admission of applicants for training
(1) Candidates who prove their qualifications for training are admitted to the preparatory study.
(2) Candidates are admitted to grade I and grade II primary studies and adult studies on the basis of the successful performance of the talent test and the recommendation of the Reception Board, whose members are appointed by the School Director. The Talent Test may be replaced by a successful completion of the primary study of the preceding stage. The term of the talent examinations shall be published by the school not later than 14 days before their performance.
(3) In a study with an extended number of teaching hours, the principal of the school shall accept a gifted or extraordinarily gifted pupil of primary education, who has successfully passed a comic examination in accordance with § 6 (1) (d).
(4) Exceptionally, gifted and exceptionally gifted candidates who have demonstrated qualifications for training and who have not reached the age specified may be admitted to the preparatory and primary studies. Candidates who have exceeded the age laid down in Paragraph 1 (3) may be admitted to one of the higher grades of primary education according to the result of the talent test.
Evaluation of the pupil
(1) The assessment of the results of a pupil's education on a certificate may be expressed by classification, vocabulary or combination of both methods. The school director shall decide on the evaluation method. The assessment of pupils with special educational needs shall take into account the recommendations of the educational institution.
(2) The results of the pupil's education in the various compulsory and optional subjects set out in the school curriculum are evaluated in such a way that the level of education achieved is clear, in particular in relation to the expected outputs in the curriculum, its educational and personality assumptions and age.

(a) 1 - excellent,
(b) 2 - praiseworthy,
(c) 3 - satisfactory,
(d) 4 - unsatisfactory.
(4) At the end of the first and second half, the pupil is assessed overall by the following grades:
(a) benefit with distinction;
(b) benefit,
(c) failed.
(5) The pupil has benefited with honours if he is not evaluated in any compulsory subject with a degree of benefit of less than 2 - commendable and the average of the grades of benefit of compulsory subjects does not exceed 1,5. In the case of the use of a verbal assessment or a combination of a verbal assessment and classification, the school shall follow the rules for assessing the results of pupils' education set out in the school system (2).
(6) The pupil has benefited if he has not been assessed in either compulsory subject by a degree of benefit of 4 - unsatisfactory or equivalent verbal assessment.
(7) The pupil did not benefit if he was assessed from a compulsory subject by a degree of benefit of 4 - unsatisfactory or equivalent verbal assessment.
(8) If the pupil cannot be evaluated for the first half of the year for serious objective reasons, the school director shall set a replacement deadline for his evaluation, so that the first half of the year is completed at the latest by the end of the second half of the year concerned. If the pupil cannot be evaluated for serious objective reasons for the second half of the year, the school director shall set a replacement deadline for his evaluation so that the second half of the year is completed by the end of August of the relevant school year.
(9) The school director may recognise the student's partial education if it is demonstrated in a demonstrable manner and no more than 5 years have elapsed since it was achieved. If the school director recognises the pupil's educational attainment, he will release the pupil from teaching and evaluation to the extent recognised.
Pupil's course progress and repetition
(1) A pupil who has been assessed on a grade-by-grade basis at the end of the second half of the year, has benefited or benefited with distinction and has successfully passed the follow-up examination provided for in the school curriculum.
(2) A gifted or extraordinarily gifted pupil may be reassigned at the end of the first semester or at the end of the second semester to one of the higher grades without passing the previous year or years, following successful completion of the procedural examinations of all compulsory subjects.
(3) A pupil who has not been evaluated at the end of the second half of the year may, where justified, be allowed to repeat the year.
(4) A pupil with an extended number of teaching hours who did not benefit at the end of the second semester can be reassigned back to the relevant grade of primary education.
Corrective tests
(1) A pupil who is assessed at the end of the second half of the second year by a degree of benefit of 4 - unsatisfactory or equivalent verbal assessment in one of the compulsory subjects shall take the corrective examination no later than the end of August of the relevant school year.
(2) If the pupil does not show up for a repair test within the prescribed time limit, he is evaluated from the subject from which he was to perform the repair test, at a level 4 - unsatisfactory. If the student was unable to attend the examination for serious objective reasons and if he or she fails to attend the school director no later than 3 days after the date laid down for carrying out the examination, the school director shall set a replacement deadline for its execution by the end of September of the following school year. Until the completion of the exam according to the sentence of the second pupil attends a higher year.
Comprehensive tests
(1) Comprehensive tests shall be carried out:
(a) receiving applicants for training;
(b) in the advance tests referred to in Article 4 (1),
(c) final examinations at the end of grade I and grade II primary studies, studies with an extended number of teaching hours and adult studies;
(d) admission to study with an extended number of teaching hours;
(e) in the case of the transfer of a gifted or exceptionally gifted pupil to one of the higher classes without passing the previous year or years in accordance with Paragraph 4 (2); and
(f) for repair tests.
(2) The examination committee shall be of at least three members, the majority of which shall be experts in the subject or arts. The members of the Board shall be appointed by the School Director. Its chairman is the school director or a teacher appointed by him. The evaluation of the examination shall be decided by the committee by a majority vote, the chairman's vote in the event of a tie.
Termination of training
(1) Basic studies of 1st and 2nd degrees, study with an extended number of teaching hours and adult studies are completed by final examinations. The final examination may take the form of a graduate performance, an art exhibition or another form of presentation allowing evaluation of the results of the pupil's education.
(2) The pupil ceases to be a student of the school:
(a) if he has failed the final examination or has been assessed overall at the end of the second half of the year for no benefit and has not been allowed to repeat the year;
(b) if it has been excluded from school (3),
(c) in the event that a legal representative of a minor or an adult student so requests in writing,
(d) in the event that the legal representative of a minor student or an adult student has not paid for the training or within the time limit laid down by the school director in accordance with § 8 (5).
(3) A legal representative of a pupil or an adult student shall be notified of the termination of the training referred to in paragraph 2 (a) or (d) in writing within one week of the completion of the training.
Reimbursement for education in schools established by the State, Region, Municipality or Municipality
(1) For pupils in preparatory studies, grade I and grade II and studies with an extended number of teaching hours, the level of remuneration in each field of art shall be determined so that the average amount of remuneration fixed does not exceed 110% of the actual average non-investment expenses of the school per pupil during the previous calendar year, with the exception of salaries and compensation for salaries or wages and salary compensation, on-call fees, remuneration for work performed on the basis of non-employment and severance agreements, social security premiums and the contribution to national employment policy and the payment of general health insurance premiums, on allowances to the fund of cultural and social needs provided by the State budget.
(2) For adult studies, the school director determines the level of remuneration for education
(a) for pupils who are also educated in the daily form of secondary education, in the daily form of conservatory education or in the daily form of upper vocational education, as referred to in paragraph 1;
(b) for pupils not referred to in (a), not more than the full average of the actual non-investment expenditure per pupil during the previous calendar year.
(3) If a pupil terminates education under § 7 (2) (b) or (c) during the first or second half of the school year, the remuneration for education is not refunded. During the period when the school allows for distance education, the remuneration does not return. If the pupil terminates the training provided for in Paragraph 7 (2) (c) for reasons of special consideration, in particular health care, a proportion of the pay for education may be reimbursed.
(4) The school director shall determine the amount of remuneration for the school year. Payment may be made annually, half-yearly, quarterly or monthly. The payment for a specified period shall be due by the 15th day of the first month of the relevant period. The school director may agree with the legal representative of a minor student or an adult student another payment date.
(5) If the legal representative of a minor does not pay the remuneration within the time limit referred to in paragraph 4, the school director shall invite him to be paid in writing and shall set a reasonable period for payment.
Shows and competitions
In order to support gifted and extremely gifted pupils, pupils' shows and competitions in individual arts and training courses are organised.
Transitional provision
The amount of remuneration shall be fixed in accordance with Article 8 (1) and (2) from the 2005 / 2006 school year. Until then, it shall be followed in accordance with existing legislation.
Repeal
The following shall be deleted:
1. Decree of the Ministry of Education, Youth and Sports of the Czech Republic No. 292 / 1991 Coll., on Basic Art Schools.
2. Decree No. 151 / 2003 Coll., amending Decree No. 292 / 1991 Coll., on Basic Arts Schools, as amended by Act No. 138 / 1995 Coll.
3. Decree No. 155 / 2004 Coll., amending Decree No. 292 / 1991 Coll., on Basic Art Schools, as amended.
Efficacy
This decree shall take effect on the day of its publication.
