DECLARATION
of 19 March 2007
amending Decree No. 73 / 2005 Coll., on the education of children, pupils and students with special educational needs and children, pupils and students of extraordinary talents
The Ministry of Education, Youth and Sports provides, pursuant to Sections 19, 23 (3) and 56 of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act), as amended by Act No. 383 / 2005 Coll.:
Decree No. 73 / 2005 Coll., on the education of children, pupils and students with special educational needs and children, pupils and students of extraordinary talents, is amended as follows:
1. In Paragraph 1 (2), the word "separation 'is deleted.
2. Paragraph 1 (4) reads as follows:
"(4) A pupil with a severe disability requiring a very high or high degree of support under paragraph 2, in particular in relation to the number of pupils and co-teaching staff in a class or study group set up for disabled pupils, for the purposes of this Decree:
(a) with severe visual impairment which makes it impossible or severely restricting the pupil's visual perception and, even using compensation aids, makes it impossible or severely reduces the perception of black printing and visual orientation;
(b) with severe auditory impairment which makes it impossible or severely restricting the understanding of spoken language even when using compensation aids and visual inspection;
(c) with severe physical impairment which severely limits or excludes the separate movement of pupils, writing and handling of teaching materials;
(d) with a severe problem of communication capability which makes communication and use of language and language spoken or written for the purposes of education impossible or severely restricted;
(e) with autism, severe or deep mental impairment or concurrent defects,
(f) with a severe behavioural disorder manifested in the course of education by violent violations of social relations, emotional disturbances, hyperkinetic disorders or combinations thereof; or
(g) with other disabilities which significantly influence the course of education. "
3. In Article 3 (3), the word "Conservatory" shall be inserted after the word "Division."
4. In Paragraph 8 (5), the word "departments' is deleted.
5. Paragraph 8 (6) reads as follows:
"(6) Where several pedagogic staff are present simultaneously in a class or study group, at least 1 of them must be assistant to the teacher. '
6. In Paragraph 8 (7), the word "Conservatory" shall be inserted after the word "Division."
7. Paragraph 9 (1) reads as follows:
"(1) The school director shall, with the agreement of the legal representative of the pupil or with the consent of an adult student, be included in a specific form of special education as provided for in Section 3, on the basis of a recommendation from the educational institution which shall include the design of support measures. ';
8. Paragraph 10, including the title and footnotes No 10 and 11, reads:
Number of pupils and co-teaching staff
(1) Where at least a number of pupils with the same type and degree of disability are educated in a class or study group set up for disabled pupils corresponding to the lowest number of pupils in the class or study group set out in the Annex to this Decree for the type and degree of disability, the class or study group shall be considered as intended for pupils with the type and degree of disability.
(2) Where a class or study group set up for pupils with disabilities fulfils the condition laid down in paragraph 1 for multiple types and degrees of disability, the class or study group intended for pupils with the type and degree of disability for which a lower maximum number of pupils per class is laid down in the Annex to this Decree.
(3) The lowest and highest number of pupils and the lowest and highest number of co-practitioners in a class or study group intended for pupils with a specific type and degree of disability and in a school class at a health establishment are laid down in the Annex to this Decree. If pupils from different years are included in the class according to the first sentence, a lower year is crucial for determining the number of pupils and co-teaching staff involved.
(4) A class or study group set up for pupils with disabilities which does not fulfil the condition laid down in paragraph 1 shall have a minimum of 6 and a maximum of 14 pupils.
(5) The Conservatory Department, which is set up for pupils with disabilities, shall have at least 4 and a maximum of 150 pupils.
(6) At the request of an adult pupil or legal representative of a minor pupil, pupils without disabilities may be included in a class or study group set up for pupils with disabilities. Their number shall not exceed:
(a) in the case of a class or study group intended for pupils with a particular type and degree of disability, the difference between the lowest and the highest number of pupils referred to in paragraph 3;
(b) in other cases, 25% of the maximum number of pupils in the class or study group.
(7) A maximum of 25% of pupils without disabilities may be admitted to the Conservatory, which is set up for pupils with disabilities, for the first year of education.
(8) The school director may divide classes, conservatory department and study group into groups in accordance with the school curriculum, pedagogical, hygienic, economic and spatial conditions (10), pupil safety requirements and protection of their health and the nature of the subject.
(9) In the nursery, primary or secondary school class, in the Conservatory Department and in the upper vocational school study group, which is not set up for pupils with disabilities, a maximum of 5 pupils with disabilities may be individually integrated, taking into account the extent of the special educational needs of pupils and the degree of support measures.
(10) In the course of vocational training in a secondary school separately established for pupils with disabilities, the groups shall be completed in the number laid down by the special legislation11), in other cases the group shall be filled in the number of pupils in practical training.
(11) The special school and the school at the medical institution have at least 10 pupils. The Conservatory set up for pupils with disabilities shall have at least 30 pupils.
10) Paragraph 7 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws, as amended. Decree No. 410 / 2005 Coll., on sanitary requirements for premises and the operation of facilities and facilities for the education and training of children and adolescents.
11) Government Regulation No. 689 / 2004 Coll., on the system of fields of education in basic, secondary and higher vocational education, as amended by Government Regulation No. 18 / 2006 Coll. '
9. Paragraph 12 (2) reads as follows:
"(2) The educational needs of a pupil with an extraordinary talent are expressed by a school guidance institution. ';
10. the following Annex is added:
