DECLARATION
of 15 February 2008
amending Decree No 376 / 2003 Coll., on veterinary checks on imports and transit of products from third countries, as amended
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll. and Act No. 48 / 2006 Coll., for the implementation of Section 33 (6) of the Veterinary Act:
Decree No. 376 / 2003 Coll., on veterinary checks on imports and transit of products from third countries, as amended by Decree No. 259 / 2005 Coll. and Decree No. 375 / 2006 Coll., is amended as follows:
1. Paragraph 1 (2), including footnote 1b, reads as follows:
"(2) The veterinary inspection provided for in this Decree shall be subject to the import of animals and products listed in the European Community Regulation establishing lists of animals and products subject to checks at border veterinary stations 1b).
(1b) Annex I to Commission Decision 2007 / 275 / EC of 17 April 2007 on lists of animals and products subject to controls at border inspection posts pursuant to Council Directives 91 / 496 / EEC and 97 / 78 / EC. "
Footnotes 1b to 1f to date are referred to as footnotes 1c to 1g, including the footnotes.
2. in Article 2 (a), the words "in Part B of Annex 1 to this Regulation" shall be replaced by the words "in the European Communities Regulation laying down lists of animals and products subject to checks at border veterinary stations (1b)."
3. In Article 3 (1) (c), the words "if it is a consignment of animal products listed in Part A of Annex No 1 to this Regulation, and the examination of documents and conformity, if it is a plant product listed in Part B of Annex No 1 to this Regulation 'are replaced by the words" if it is a consignment of animals and products listed in the European Communities Code establishing lists of animals and products subject to checks at border veterinary stations 1b).
4. Article 6 shall be deleted;
5. In Article 9, at the end of paragraph 2, the sentence "Deep-frozen semen and embryos, by-products or blood products of animal origin which are transported for technical use, including pharmaceutical use, may be checked at the border veterinary station by means of equipment intended for handling packaged products at ambient temperature, if these consignments are transported at ambient temperature, in hermetically sealed containers equipped with temperature control."
6. Paragraph 10 (2) reads as follows:
"(2) On the basis of a risk assessment by the Regional Veterinary Administration, a border veterinary station which procures a limited number of consignments of products of any category per year, namely products intended for human consumption or products intended for non-human consumption, may use the same landing, inspection and storage equipment for all products for which the site is approved, provided that the premises are used separately for each consignment and that such equipment is properly cleaned and disinfected between handling and controls as appropriate. ';
7. Paragraph 30 (3), including footnote 17, reads:
"(3) Veterinary checks shall not apply to foodstuffs which do not contain any meat products and to composite products where:
(a) less than half of their mass constitutes any other than meat processed product, provided that:
1. stored at room temperature or during production have undergone a complete cooking process or other heat treatment throughout the mass so that all raw products have been denatured;
2. explicitly marked with an indication of destination for human consumption;
3. safely packed or sealed in clean containers,
4. accompanied by a commercial document and marked with one of the official languages the Community, in such a way that the commercial document and the labelling together provide information on the nature, quantity and number of packages of the composite product, the country of origin, the manufacturer and the component; or
(b) are listed in the European Communities Regulation establishing lists of animals and products subject to checks at border veterinary stations (17).

8. In Article 30, the following paragraph 4 is added:
"(4) All milk products contained in any composite products must come only from countries listed in the Regulation of the European Communities laying down animal and public health conditions and veterinary certification for the importation of heat-treated milk, milk products and raw milk for human consumption (17a) and must be treated in the manner laid down by this Regulation of the European Communities.
17a) Annex I to Commission Decision 2004 / 438 / EC of 29 April 2004 laying down animal and public health conditions and veterinary certification for the importation into the Community of heat-treated milk, milk products and raw milk for human consumption, as amended. '
9. Annex No 1 shall be deleted;
10. Annex No 7 is deleted.
11. In Annex No 8, Part B, point 4, of the introductory part of the provision, the words "The following entries must be kept at the border veterinary station 'shall be replaced by the words" Where data are not recorded at the border veterinary station in Traces, the following replacement entries shall be kept in electronic or paper form'.
12. In Annex No 8, Part B, point 4, the semicolon is replaced by a dot and subpoint 5 is deleted.
Efficacy
This Decree takes effect on 1 March 2008.
