DECLARATION
of 12 March 2007
amending the Order of the Czech Mining Authority No. 165 / 2002 Coll., on separate ventilation in mining activities in flowing mines
According to § 6 (6) (a) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, the Czech Mining Authority provides:
The Decree of the Czech Mining Office No. 165 / 2002 Coll., on separate ventilation in mining activities in fluent mines, is amended as follows:
1. In Article 1, the sentence "This Order was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, as amended by Directive 98 / 48 / EC, is added at the end. '
2. In Section 2 (u), the words "refrigeration equipment 'are replaced by the words" mine wind cooler'.
3. in Article 2, the following points (v) to (y) are added:
"(v) cooling equipment - equipment designed to reduce the temperature of the mine winds,
x) mine wind cooler - part of the cooling system ensuring heat removal of mine wind;
(y) side - a lute thrust branch, parallel to the main lute thrust in which the mine wind cooler is located. ';
4. In Article 3 (3), the words "refrigeration equipment 'are replaced by the words" mine wind chillers'.
5. In Article 4 (5), the comma and the words "or mine wind cooler in the arrangement referred to in Article 9 (1) (c) and (d)" are inserted after the word "fan."
6. In Paragraph 5 (8), the word "cooling 'is replaced by" mine wind chillers'.
7. In Article 5 (8), the words "placed outside the lute thrust, in the adjacent lute thrust of combined separate ventilation or in the main lute thrust side of the beam shall be inserted after the word" device. "
8. In Section 5, paragraph 9, the sentence "The air-conditioning fan cannot be placed between the mine wind cooler and the mouth of the lute thrust in a lute thrust is inserted after the first sentence. '
9. In Article 5, the following paragraph 12 is added:
"(12) The fan in the main lute thrust, outside the sidewall, shall be located at least 3 m away from another fan, mine wind cooler or scrubbing device, which are sequentially arranged with this fan. ';
10. In Article 8, the following paragraph 4 is added:
"(4) The separate ventilation of combined blowing with the main lute thrust of the blowing and the subsequent lute stroke of the blowing may only be used in the arrangement set out in Annex 2 (Figure G) and provided that:
(a) a mine wind cooler is located in the next lute stroke;
(b) the volume flow rate by side pull is at least 40% smaller than the volume flow rate of the winds in the main lute draw;
(c) throughout the period of the stamping, the concentration of methane in the mining atmosphere of the embossed mine shall not exceed 0,5%.
For the period and in cases specified by the separate ventilation project, the operation of the secondary lute thrust may be stopped. '
11.
Location of mine wind cooler
(1) The mine-wind cooler as part of the separate ventilation device of an intact mine work can only be placed
(a) in a mine with a passing wind current at the beginning of the main blow lute thrust,
(b) in a non-penetrated mine in the next blow-off lute thrust in the combined ventilation mode;
(c) in a non-penetrated mine piece in the side of the main blow lute thrust in accordance with Annex 2 (Figure H) at a distance of not more than 250 m from the mouth of the lute thrust; instead of installing a sidewall, the project sets out the separate ventilation so that the direction of the mine winds flowing through the parallel branches of the main lute thrust is consistent,
(d) in a non-penetrated mine piece in the main blow-off lute thrust at a distance of not more than 200 m from the mouth of the lute thrust, provided that the concentration of methane during the stamping does not exceed 0,5%.
(2) The direction of the flow of mine winds in the main lute thrust in the part parallel to the sidewall, when the mine wind cooler is placed in accordance with paragraph 1 (c), shall be checked remotely by a continuous wind speed monitoring sensor located in accordance with Annex 2 (Figure H) and its change shall be indicated at the central control station. The separate ventilation project also contains measures and procedures for changing the direction of mine winds in the main lute thrust.
(3) The organisation shall ensure remote control of the operation of the refrigeration equipment and signal its interruption at the central control station. The separate ventilation project shall also include measures and procedures in case of interruption of the cooling equipment. ';
12. Article 12, including the title, reads:
Continuous control of methane concentration
(1) Continuous control of the methane concentration by the sensor shall be performed in a separately ventilated mine panel with an electrical device where it is driven or conquered. The sensor shall be placed at a height of 0,1 m below the highest strength point, at the highest methane concentration observed, at a distance of:
(a) within 3,0 m from the front of the head during the separate ventilation of the suction and the combined separate ventilation referred to in Article 8 (2), where it cannot be placed at a distance of less than 0,5 m before the mouth of the intake lute thrust;
(b) within 10 m from the front of the head when the blow is split apart and when the ventilation is combined separately in accordance with § 8 (2) and (4), except for direct influence by free wind current coming out of the mouth of the lute thrust.
(2) The sensors referred to in paragraph 1 may be moved to a safe distance from the tearing site for the duration of the tearing operation.
(3) In the case of separate ventilation combined with blowing according to § 8 (2), continuous control of methane concentration shall be carried out:
(a) in free wind current from the next lute thrust, the sensor being placed at a distance of 5 to 10 m from the lute thrust;
(b) at the point of overlapping the lute strokes in the area of the removal device at a height of 0,1 m below the highest point of reinforcement of the mine.
(4) When the cooling device or electric fan is placed in an embossed mine, at a distance of more than 50 m from the front, continuous control of the methane concentration shall be carried out at the site of the installation. The sensor shall be placed at a distance of 5 to 10 m from this device against the direction of the flow of mine winds, at a height of 0,1 m below the highest point of reinforcement of the mine work.
(5) The organisation shall ensure that the excess of the permitted methane concentration is signalled at the central control post, delineating the area at risk of illicit air composition and determining how the workers at risk are aware of the excess methane concentration. ';
13. In the first sentence of Article 15 (1), the comma and the words "at least once a week when the mine wind cooler is placed in accordance with Article 9 (1) (d) shall be inserted after the word" months. "
14. The following Section 18a is inserted after Section 18, including the title:
Mutual recognition clause
Where that Decree lays down requirements in excess of those laid down in the relevant provisions of the European Communities, those requirements shall not apply to products which have been manufactured or marketed in a Member State of the European Union or Turkey, or originating in one of the States of the European Free Trade Association which is a Contracting Party to the European Economic Area, provided that such a product corresponds to:
(a) the technical regulations which are binding on the production or placing on the market and, where appropriate, on the use of this product in one of those States;
(b) the technical standards or rules of good practice which are issued by the national standardisation body or body equivalent to it, in accordance with the laws and requirements of the State Party to the European Economic Area;
(c) international technical standards, lawfully used in one of those States; or
(d) traditional or innovative production processes used in one of those States in accordance with its legislation, for which there is sufficient detailed technical documentation to ensure that this product can be assessed for the purpose of use, if necessary on the basis of additional (not identical) tests of the product,
where such technical regulations, technical standards, good practice rules or procedures guarantee a level of protection of legitimate interest corresponding to that of the Czech Republic. ';
15. In Annex 1, the following point 1.30 is inserted after point 1.29:
"1.30 Volumetric flow rate of mine winds in the side blow lute thrust during the separate ventilation of blowers with auxiliary thrust of the QVFp [m3. s-1]."
Points 1.30 to 1.34 of Annex No 1 shall become points 1.31 to 1.35.
16. In Annex 1, points 3.10 and 3.10.1 are added:
"3.10. The Qvo mass flow rate with combined separate ventilation to blow according to Figure G of Annex No 2 is determined for the main lute stroke in terms of reduction of CH4, CO2 concentration, reduction of crop concentration after shredding work, compliance with the lowest permitted speed in the mine profile, reduction of exhaust from compression ignition engines, reduction of concentration of exhaling Rn according to relationships 3.1, 3.2, 3.3.1, 3.4, 3.5, 3.6.

17. Annex 2 shall read as follows:
