GOVERNMENT REGULATION
of 12 February 2003
establishing a safeguard measure for imports into the Czech Republic of certain metallurgical products
The Government mandates pursuant to Section 21 of Act No. 62 / 2000 Coll., on certain arrangements for the export or import of products and on licensing and on the amendment of certain laws:
§ 1
(1) For goods covered by the Customs Tariff (1) under subheadings 7306 30 21 - Not exceeding 2 mm, 7306 30 29 - Exceeding 2 mm, 7306 30 78 - Other, 7306 60 34 - Other and 7306 60 38 90 - Other, the rate of the import duty fixed by the Customs Tariff (1) or the international Treaty (2) for the tariff quotas fixed for the relevant periods, as set out in the Annex to this Regulation shall apply.
(2) The tariff quota is opened at 8.00 on the first day of the period for which that quota is opened. If this day falls on a Saturday, Sunday or a public holiday, the quota shall be opened on the next working day.
§ 2
Before and after the opening of the tariff quota provided for in Article 1, the rate of import duty fixed in the tariff quota (1) or the international contract (2), increased by 20,3 in the period from 1 March 2003 to 31 December 2003 and 18,3 in the period from 1 January 2004 to 31 December 2004, shall apply to goods covered by the customs tariff (1).
§ 3
Prior to the opening of the tariff quota and after exhaustion provided for in Article 1, the rate of import duty fixed in the tariff quota (1) or the international contract (2) increased by 13,5 in the period 1 March 2003 to 31 December 2003 and 12,2 in the period 1 January 2004 to 31 December 2004 shall apply.
§ 4
Before and after the opening of the tariff quota provided for in Article 1, the rate of import duty fixed in the tariff quota (1) or the international contract (2) increased by 22,4 in the period from 1 March 2003 to 31 December 2003 and 20,2 in the period from 1 January 2004 to 31 December 2004 shall apply.
§ 5
Before and after the opening of the tariff quota provided for in Article 1, the rate of import duty fixed in the tariff quota (1) or the international contract (2), increased by 17,3 in the period from 1 March 2003 to 31 December 2003 and 15,6 in the period from 1 January 2004 to 31 December 2004, shall apply to goods under tariff (1).
§ 6
Before and after the opening of the tariff quota provided for in Article 1, the rate of import duty fixed in the tariff quota (1) or the international contract (2), increased by 20,3 in the period from 1 March 2003 to 31 December 2003 and 18,3 in the period from 1 January 2004 to 31 December 2004, shall apply to goods under tariff (1).
§ 7
(1) Paragraphs 1 to 6 shall not apply to goods originating in a developing country or in the least developed country which is a member of the World Trade Organisation (3), provided that their share of imports of goods as defined in Article 1 does not exceed 3% of the total import of such goods and that imports from those countries with a share of less than 3% do not represent more than 9% of the total import volume of such goods.
(2) Religious goods originating in a developing country or least developed country are goods which meet the conditions laid down in specific legislation.4)
(3) The provisions of Sections 1 and 5 do not apply to goods covered by tariff subheading 1) 7306 60 31 with additional code 10 - Made of stainless steel.
(4) The provisions of Sections 1 and 6 do not apply to goods covered by tariff subheadings 1) 7306 60 39 with additional code 10 - Made of stainless steel and 7306 60 39 with additional code 20 - Made according to EN 10 219, characterising their method of manufacture and application for dynamically loaded structures. The products are characterised by the S 275 JOH and S 355 J2H marking or another H marking at the last place of the attribute (fine grain steel intended for dynamically loaded square welded tubes).
(5) The additional codes referred to in paragraphs 3 and 4 are laid down in a separate legislation. 5)
§ 8
(1) This Regulation shall enter into force on 1 March 2003.
(2) This Regulation shall expire on 31 December 2004 or on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union if that date is earlier.

1) Government Regulation No 462 / 2003 Coll., on the issue of the Customs Tariff and on the fixing of import duty rates for goods originating in developing and least-developed countries and the conditions for their application (Customs Tariff) and amending certain related provisions.
