DECLARATION
of 28 December 2023
amending Decree No 349 / 2015 Coll., on Gas Market Rules, as amended
Pursuant to Section 98a (2) (i) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 90 / 2014 Coll., Act No. 131 / 2015 Coll., Act No. 362 / 2021 Coll. and Act No. 176 / 2022 Coll.:
Decree No. 349 / 2015 Coll., on Gas Market Rules, as amended by Decree No. 416 / 2016 Coll., Decree No. 326 / 2018 Coll., Decree No. 277 / 2021 Coll., Decree No. 223 / 2022 Coll. and Decree No. 405 / 2022 Coll., are amended as follows:
1. In Paragraph 1, the dot is replaced by a comma at the end of paragraph 1 and the following point (r) is added:
"(r) the rules and conditions for the provision of a service of cross-border use of the gas storage tank.";
2. in Article 2 (1) (a), the words "the border point of the gas storage tank" shall be inserted after the words "the gas storage tank,"
3. In Article 2, at the end of paragraph 3, the dot is replaced by a comma and the following point (d) is added:
"(d) border point of the gas storage tank - border point between the gas storage tank and the gas system of the neighbouring State."
4. In Article 3 (2), the words "the transfer points between the gas storage unit and the gas system of the neighbouring State 'shall be inserted after the words" the gas and the transmission system'.
5. In Article 5, at the end of paragraph 3, the dot is replaced by a comma and the following point (f) is added:
"(f) border points for gas storage tanks in cooperation with the gas storage tank operator providing a service of cross-border use of the gas storage tank and the affected transmission system operator of the adjacent entry-exit system.";
6. In Article 30 (2) (d), the words "the difference between the amount of the reserved capacity by the clearing entity or a foreign participant at that point and the nomination submitted 'are replaced by the words" the nomination submitted above'.
7. In Article 30a (5), the words "but not more than 50% of the transport capacity reserved for the gas service contract 'are deleted.
8. In Paragraph 50, the following paragraph 10 is added:
"(10) In the case of a gas storage tank enabling the provision of a cross-border gas storage service, the transfer of gas shall take place only between the state sub-accounts of the Czech input-output system or between the state sub-accounts of the neighbouring input-output system. Paragraph 9 shall apply only to the state sub-accounts of the Czech entry-exit system. '
9. In Paragraph 52 (3), "whole m3 or kWh or kWh / day 'is replaced by" whole m3, kWh, kWh / day, MWh or MWh / day'.
10. In Article 59, the following paragraph 5 is added:
"(5) Paragraph 1 to 4 shall apply only to the state sub-accounts of the Czech entry-exit system when selling unextracted gas from a gas storage tank providing a service of cross-border use of the gas storage tank."
11. In Section 60, the words "the restriction or interruption of gas storage 'are deleted.
12. in Article 60 (1), the words "pursuant to Article 60 (1) (f) of the Energy Act" shall be inserted after the words "storage of gas."
13. In Paragraph 60 (2), the first sentence is replaced by the sentence "The gas storage operator shall, in accordance with paragraph 1, shorten the reserved storage capacity with interruptible power in accordance with the procedure laid down in the operator's order, on the basis of the price per unit of interruptible input or extractive output in order from the lowest price to the highest, on the basis of the order of the time mark of receipt of the request for reservation of storage capacity in order from the latest accepted request after first accepted, on the basis of a proportional reduction or a combination of these principles."
14. In the first sentence of Article 60 (3), the words "as referred to in paragraph 1 'shall be inserted after the words" as referred to in paragraph 1'; in the third sentence, the words "planned 'shall be deleted; and the words" or restrictions' shall be inserted after the words "interruption ';
15. Paragraph 60 (5) reads:
"(5) In cases different from paragraph 1, the gas storage tank operator shall reduce the reserved storage capacity with interruptible power in the manner defined in the order of the gas storage tank operator. ';
16. In Paragraph 61, at the end of paragraph 3, the words "and, in the case of a gas storage tank providing a service of cross-border use of the gas storage tank, they shall be published in a distinction for each input-output system '.
17. After Paragraph 61, the following Section 61a is inserted:
Rules and conditions for the provision of cross-border gas storage service
(1) In the case of the provision of a cross-border gas storage service, a stock account divided into stock sub-accounts for each input-output system shall be maintained for each storage contract. The gas storage tank operator shall register the volume of gas injected to the extent of the confirmed storage or re-storage nomination on the stock sub-account of the corresponding input-output system.
(2) The gas storage facility operator shall provide a service of cross-border use of the gas storage device up to the registered amount of gas in the adjacent state sub-account of the input-output system of the depositor where the volume of the extracted gas in the scope of the storage or re-entry of storage from the stock sub-account of the corresponding input-output system exceeds the amount of gas registered in that sub-account and in the State sub-account of the adjacent entry-exit system of the same applicant is recorded in order to confirm the submitted storage or re-entry-in-account of that applicant.
(3) The gas storage tank operator shall record the volume of extracted gas in the range of the validated nomination or re-entry of storage on the stock sub-account of the corresponding input-output system. ';
18. In Article 65 (1), the words "or the transmission system operator of the adjacent entry-exit system 'shall be inserted after the word" system'.
19. In Section 65, at the end of paragraph 2, the words "or the transmission system operator of the adjacent entry-exit system 'are added.
20. in Paragraph 66 (1), the words "distribution and storage" shall be deleted;
21. In the second sentence of Paragraph 66 (3), after the words "the nomination of storage by the deadline" shall be replaced by "Paragraph 68 (2)."
22. In Paragraph 69 (4), the word "gas' is replaced by" calendar 'and the words "gas' and" gas' are deleted.
23. in Article 71 (3), "paragraph 3" is replaced by "paragraph 2," the word "gas" is replaced by "calendar" and the word "gas" is deleted;
24. in Paragraph 83 (3) (b), the words "except in exceptional circumstances of emergency" shall be inserted after the word "participant."
25. in Paragraph 83 (3) (c), the words "except for an emergency are" shall be inserted after the words "derogation."
26. In Paragraph 85 (1), the words "settlement of derogations in an emergency," shall be inserted after the words "derogation,"
27. After § 96a, the following § 96b is inserted:
Transmission and publication of data by the gas container operator providing a service of cross-border use of the gas container
(1) No later than 12: 00: 00 on a calendar day, the gas storage tank operator providing a service of cross-border use of the gas storage tank shall transmit to the market operator the previous gas day:
(a) the value of the allocated amount of gas at the point of entry and exit of the virtual gas storage tank, broken down after each gas day hour;
(b) the amount of gas transferred between the state sub-accounts of the Czech input-output system after each gas day hours, broken down into the aggregate value of positive transfers and the aggregate value of negative transfers,
(c) the quantity of gas transferred between the stock sub-accounts of the adjacent entry-exit system after each gas day hours, broken down into the aggregate value of positive transfers and the aggregate value of negative transfers;
d) the aggregate value of the quantity of gas transferred from individual state sub-accounts of the Czech input-output system to the state sub-accounts of the neighbouring input-output system in the breakdown after each hour of the gas day,
e) the aggregate value of the quantity of gas transferred from individual state sub-accounts of the neighbouring input-output system to the state sub-accounts of the Czech input-output system in the breakdown after each hour of the gas day,
f) the aggregate value of the quantity of gas registered on the state sub-accounts of the Czech entry-exit system in the breakdown after each hour of the gas day,
(g) the aggregate value of the quantity of gas registered in the stock sub-accounts of the adjacent entry-exit system, broken down after each gas day hour;
(h) the value of the allocated amount of gas at the entry and exit point of the gas storage tank, broken down after each hour of the gas day;
i) the value of the quantity of gas registered on individual state sub-accounts of the Czech input-output system at the end of the gas day,
(j) the value of the quantity of gas registered on the individual stock sub-accounts of the adjacent entry-exit system at the end of the gas day;
k) the value of the amount of gas transferred from the state sub-accounts of the Czech input-output system to the state sub-accounts of the neighbouring input-output system at the end of the gas day in the breakdown of individual stock accounts,
(l) the value of the quantity of gas transferred from the state sub-accounts of the neighbouring input-output system to the state sub-accounts of the Czech input-output system at the end of the gas day in the breakdown of individual stock accounts,
(m) the value of the quantity of gas measured at the entry into the gas storage tank of the neighbouring State and at the exit from the gas storage tank of the neighbouring State at the end of the gas day;
n) the value of the quantity of gas transferred from individual state sub-accounts of the Czech input-output system to the state sub-accounts of the neighbouring input-output system in the breakdown after each hour of the gas day,
o) the value of the quantity of gas transferred from individual state sub-accounts of the neighbouring input-output system to the state sub-accounts of the Czech input-output system in the breakdown after each hour of the gas day.
(2) By 12: 00: 00 at the latest on the 10th calendar day of the gas month, the gas storage tank operator providing the service of cross-border use of the gas storage tank shall transmit to the market operator the corrective value of the data transmitted for the previous gas month referred to in paragraph 1 (i) and (j) for each gas day; and
(a) the value of the quantity of gas allocated at the entry and exit points of the virtual gas storage device at the end of each gas day, broken down by stock account;
(b) the value of the quantity of gas transferred between the stock sub-accounts of the Czech input-output system for each gas day, broken down into positive and negative transfers by stock account,
(c) the value of the quantity of gas transferred between the stock sub-accounts of the neighbouring entry-exit system for each gas day in the breakdown of positive and negative transfers by stock account;
(d) the aggregate value of the quantity of gas registered on the stock sub-accounts at the end of each gas day, broken down into the Czech entry-exit system and the neighbouring entry-exit system,
(e) the value of the quantity of gas allocated at the entry and exit point of the gas storage tank at the end of each gas day, broken down by stock account;
(f) the value of the quantity of gas consumed for technological consumption and the operational purposes of the gas container operator at the end of each gas day of the previous gas month.
(3) The gas storage tank operator shall transmit the data referred to in paragraphs 1 and 2, including data from stock accounts maintained for the purposes of the records of technological consumption and operational purposes of the gas storage operator.
(4) By 12: 00: 00 on a calendar day at the latest, the transmission system operator shall transmit to the market operator and gas storage unit operator providing the service of cross-border use of the gas storage device the amount of gas measured at the entry into the gas storage tank from the transmission system and at the exit from the gas storage tank into the transmission system on the previous gas day.
(5) The gas storage device operator providing a cross-border gas storage service shall transmit data to the transmission system operator within the scope of paragraph 1 (a), (b), (d) to (g), (i), (k) to (o), paragraph 2 (a), (b), (d) and (f) and the aggregate value referred to in paragraph 1 (j).
(6) Where the result of the calculation of the daily balance of the cross-border gas storage service at the end of the gas day or the result of the monthly balance of the cross-border gas storage service at the end of the gas month referred to in Annex 21 to this Decree is not equal to zero, the gas storage provider providing the cross-border gas storage service to the market operator and the transmission system operator shall transmit the corrected data of the values transmitted in accordance with paragraph 1 no later than 11.00: 00 on the third calendar day following the date referred to in paragraph 103a (2) and the corrected data of the values transmitted in accordance with paragraph 2 no later than 2 days after the deadline referred to Article 103a (3). ';
28. The following Section 103a is inserted after Section 103:
(1) The market operator shall publish the value referred to in Article 96b (1) (k) and (l) in aggregate for all the stock sub-accounts for the previous gas day by 13.00: 00 on the calendar day at the latest.
(2) The market operator shall make available to the transmission system operator and gas storage service operator of the cross-border gas storage service no later than 13.00: 00 on the calendar day
(a) the difference between the sum of the values referred to in Article 96b (1) (h) for the previous gas day and the amount of gas referred to in Article 96b (1) (m) for the previous gas day;
(b) the difference between the sum of the values referred to in Article 96b (1) (a) for the previous gas day and the quantity of gas referred to in Article 96b (4) for the previous gas day;
(c) the daily balance of the service of cross-border use of the gas storage device referred to in point I of Annex No 21 to this Decree.
(3) The market operator shall make available to the transmission system operator and gas storage service operator of the cross-border storage service no later than 12: 00 on the 11th day of the gas month
(a) the aggregate value of the differences between the sum of the values referred to in Articles 96b (2) (e) and 96b (1) (m) for each gas day of the previous gas month;
(b) the aggregate value of the differences between the sum of the values referred to in Articles 96b (2) (a) and 96b (4) per gas day of the previous gas month;
(c) the monthly balance of the service of cross-border use of the gas storage device referred to in point II. of Annex No 21 to this Decree.
(4) The market operator shall make available to the transmission system operator and the gas storage service operator providing the cross-border storage service no later than 13.00: 00 on the 15th day of the calendar year the aggregate value of the differences referred to in paragraph 3 (a) and the aggregate value of the differences referred to in paragraph 3 (b) for each gas month of the preceding calendar year.
(5) Corrective data transmitted pursuant to Paragraph 96b (6) shall be published by the market operator immediately after processing. "
29. in Paragraph 116 (2):
"(2) If the settlement entity referred to in paragraph 1 no longer has the necessary financial collateral to cover supplies to customer demand points on the following calendar day at 8.00: 00, the market operator shall suspend the possibility of nominating, transferring and assuming responsibility for the derogation and participating in the gas market in intraday. The market operator shall immediately publish information on the suspension of the ability of the settlement entity to nominate, transfer and assume responsibility for the derogation and to participate in the gas intraday market in a way that allows remote access. The market operator shall immediately provide a list of the EIC of the sampling points codes to which the fact relates to to all registered gas market participants in the market operator information system. ';
30. Paragraph 118 (5) reads as follows:
"(5) A gas supplier who has lost the power or the ability to supply gas or does not have a transmission or distribution system service provided in the case of a gas supply contract shall suspend the market operator from nominating, transferring and assuming responsibility for the derogation and participating in the gas market within the day. The market operator shall immediately provide a list of the EIC of the sampling points codes to which the fact relates to to all registered gas market participants in the market operator information system. The market operator shall immediately publish information on the suspension of the ability of the settlement entity to nominate, transfer and assume responsibility for the derogation and to participate in the gas intraday market in a way that allows remote access. For customer demand points whose gas supplier has no authorisation or ability to supply gas or does not have a transmission or distribution system service provided for in the case of gas supply under a contract for combined gas supply services, the procedure and deadlines referred to in Sections 116 (5), 117 and this paragraph shall apply mutatis mutandis. ';
31. in Article 119 (3) (a), the word 'fifth' is replaced by 'fourth';
32. the following Annex 21 is added:

I. The daily balance of the service of cross-border use of the gas storage device at the end of the gas day of the CCSd shall be calculated as follows:
