Communication from the Ministry of Foreign Affairs on the negotiation of Additional Protocol No 2 to the Central European Free Trade Agreement

The Ministry of Foreign Affairs announces that on 18 August 1995 Additional Protocol No 2 to the Central European Free Trade Agreement was signed in Warsaw.
Pursuant to Article 3 (3) of the Protocol, the Protocol has been applied on a provisional basis since 1 January 1996 and entered into force pursuant to the same Article (1) on 16 July 1996.
The Czech translation of the Protocol is being announced simultaneously.
ADDITIONAL PROTOCOL No 2
on the Central European Free Trade Agreement
Representatives of the Czech Republic, Hungary, the Republic of Poland and the Slovak Republic,
- having regard to the Declaration of Presidents of 25 November 1994 in Poznan,
- reaffirming its commitment to the principles of the market economy that form the basis of their relations,
- firmly convinced that this Additional Protocol will promote the deepening of mutually beneficial trade relations between them and contribute to the integration process in Europe,
- in accordance with the relevant provisions of Articles 34, 35, 37 and 39 of the Central European Free Trade Agreement,
they agreed as follows:
1. Protocols 1 to 3 to the Central European Free Trade Agreement, applied in accordance with the Additional Protocol, signed in Budapest on 29 April 1994, will be repealed and replaced by new Protocols 1 to 3 as from 1 January 1996, which form an integral part of this Additional Protocol.
The Annexes to Protocols 1 to 3 to the Central European Free Trade Agreement shall not be amended.
This Additional Protocol forms an integral part of the Central European Free Trade Agreement.
1. This Additional Protocol shall enter into force on the date on which the depositary receives the last notification from the Parties to the Central European Free Trade Agreement to terminate the procedures necessary for this purpose.
2. The depositary shall notify all Contracting Parties of the termination of the procedures necessary for the entry into force of this Additional Protocol.
3. If the Parties do not receive the notifications referred to in paragraph 2 of this Article by 31 December 1995, this Additional Protocol shall be applied on a provisional basis from 1 January 1996.
In order to prove that the undersigned, who were duly authorised to do so, signed this Additional Protocol.
Dane in Warsaw on 18 August 1995 in one original copy in English to be deposited with the Government of Poland. The depositary shall transmit certified copies to all Parties.

PROTOCOL 1

REPEAL OF THE CUSTOMS DUTIES BETWEEN THE CZECH REPUBLIC
AND THE SLOVAK REPUBLIC ON THE SINGLE SIDE
A
HUNGARY REPUBLIC ON THE SECOND SIDE
1. Products originating in the Republic of Hungary to which a zero duty rate is applied in the Czech Republic and the Slovak Republic under the "erga omnes' principle are set out in Annex A to this Protocol.
2. Products originating in the Republic of Hungary to which a zero duty rate is applied in the Czech Republic and the Slovak Republic are listed in Annexes B and C to this Protocol.
3. The import duties applicable in the Czech Republic and the Slovak Republic to products originating in the Republic of Hungary listed in Annex D to this Protocol shall be abolished on 1 January 1996.
4. The import duties applicable in the Czech Republic and the Slovak Republic to products originating in the Republic of Hungary listed in Annex E to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 50% of the basic duty,
- 1 January 1997 - the remaining duties will be abolished.
5. The import duties applicable in the Czech Republic and the Slovak Republic to products originating in the Republic of Hungary listed in Annex F to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 75% of the basic duty,
- 1 January 1997 - 60% of the basic duty,
- 1 January 1998 - 45% of the basic duty,
- 1 January 1999 - 30% of the basic duty,
- 1 January 2000 - the remaining duties shall be abolished.
6. Products originating in the Czech Republic or in the Slovak Republic to which a zero duty rate is applied in the Republic of Hungary under the "erga omnes' principle are listed in Annex G to this Protocol.
7. Products originating in the Czech Republic or in the Slovak Republic to which a zero duty rate is applied in the Republic of Hungary are listed in Annexes H and J to this Protocol.
8. The import duties applicable in the Republic of Hungary to products originating in the Czech Republic or the Slovak Republic listed in Annex K to this Protocol shall be abolished on 1 January 1996.
9. The import duties applicable in the Republic of Hungary to products originating in the Czech Republic or the Slovak Republic listed in Annex L to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 50% of the basic duty,
- 1 January 1997 - the remaining duties will be abolished.
10. The import duties applicable in the Republic of Hungary to products originating in the Czech Republic or the Slovak Republic listed in Annex M to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 75% of the basic duty,
- 1 January 1997 - 60% of the basic duty,
- 1 January 1998 - 45% of the basic duty,
- 1 January 1999 - 30% of the basic duty,
- 1 January 2000 - the remaining duties shall be abolished.

POLAND REPUBLIC ON THE SECOND SIDE
1. Products originating in the Republic of Poland to which a zero duty rate is applied in the Czech Republic and the Slovak Republic under the "erga omnes' principle are set out in Annex A to this Protocol.
2. Products originating in the Republic of Poland to which a zero duty rate is applied in the Czech Republic and the Slovak Republic are listed in Annexes B and C to this Protocol.
3. The import duties applicable in the Czech Republic and the Slovak Republic to products originating in the Republic of Poland listed in Annex D to this Protocol shall be abolished on 1 January 1996.
4. The import duties applicable in the Czech Republic and the Slovak Republic to products originating in the Republic of Poland listed in Annex E to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 50% of the basic duty,
- 1 January 1997 - the remaining duties will be abolished.
5. The import duties applicable in the Czech Republic and the Slovak Republic to products originating in the Republic of Poland listed in Annex F to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 75% of the basic duty,
- 1 January 1997 - 60% of the basic duty,
- 1 January 1998 - 45% of the basic duty,
- 1 January 1999 - 30% of the basic duty,
- 1 January 2000 - 15% of the basic duty,
- 1 January 2001 - the remaining duties will be abolished.
6. Products originating in the Czech Republic or in the Slovak Republic to which a zero duty rate is applied in the Republic of Poland under the "erga omnes' principle are listed in Annex G to this Protocol.
7. Products originating in the Czech Republic or in the Slovak Republic to which a zero duty rate is applied in the Republic of Poland are listed in Annexes H and J to this Protocol.
8. The import duties applicable in the Republic of Poland to products originating in the Czech Republic or the Slovak Republic listed in Annex K to this Protocol shall be abolished on 1 January 1996.
9. The import duties applicable in the Republic of Poland to products originating in the Czech Republic or the Slovak Republic listed in Annex L to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 50% of the basic duty,
- 1 January 1997 - the remaining duties will be abolished.
10. The import duties applicable in the Republic of Poland to products originating in the Czech Republic or the Slovak Republic listed in Annexes M and N to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 5 / 7 of the basic duty,
- 1 January 1998 - to 4 / 7 of the basic duty,
- 1 January 1999 - 3 / 7 of the basic duty,
- 1 January 2000 - 2 / 7 of the basic duty,
- 1 January 2001 - 1 / 7 of the basic duty,
- 1 January 2002 - the remaining duties will be abolished.

THE REPUBLIC OF POLAND
1. Products originating in the Republic of Poland to which a zero duty rate is applied in the Republic of Hungary under the "erga omnes' principle are set out in Annex A to this Protocol.
2. Products originating in the Republic of Poland to which a zero duty rate is applied in the Republic of Hungary are listed in Annexes B and C to this Protocol.
3. The import duties applicable in the Republic of Hungary to products originating in the Republic of Poland listed in Annex D to this Protocol shall be abolished on 1 January 1996.
4. The import duties applicable in the Republic of Hungary to products originating in the Republic of Poland listed in Annex E to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 50% of the basic duty,
- 1 January 1997 - the remaining duties will be abolished.
5. The import duties applicable in the Republic of Hungary to products originating in the Republic of Poland listed in Annex F to this Protocol, with the exception of the entries set out below, shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 75% of the basic duty,
- 1 January 1997 - 60% of the basic duty,
- 1 January 1998 - 45% of the basic duty,
- 1 January 1999 - 30% of the basic duty,
- 1 January 2000 - the remaining duties shall be abolished.

In the case of exemptions, the import duties applicable in the Republic of Hungary to products originating in the Republic of Poland shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 75% of the basic duty,
- 1 January 1997 - 60% of the basic duty,
- 1 January 1998 - 45% of the basic duty,
- 1 January 1999 - 30% of the basic duty,
- 1 January 2000 - 15% of the basic duty,
- 1 January 2001 - the remaining duties will be abolished.
6. Until the import duties applicable in the Republic of Hungary to products originating in the Republic of Poland listed in Annex G are fully eliminated, the Republic of Hungary shall declare, starting on the date of entry into force of the Agreement, duty-free quotas above the limits set out in that Annex each year.
7. Products originating in the Republic of Hungary to which a zero duty rate is applied in the Republic of Poland under the "erga omnes' principle are set out in Annex H to this Protocol.
8. Products originating in the Republic of Hungary to which a zero duty rate is applied in the Republic of Poland are listed in Annexes J and K to this Protocol.
9. The import duties applicable in the Republic of Poland to products originating in the Republic of Hungary listed in Annex L to this Protocol shall be abolished on 1 January 1996.
10. The import duties applicable in the Republic of Poland to products originating in the Republic of Hungary listed in Annex M to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 50% of the basic duty,
- 1 January 1997 - the remaining duties will be abolished.
11. The import duties applicable in the Republic of Poland to products originating in the Republic of Hungary listed in Annex N to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 75% of the basic duty,
- 1 January 1997 - 60% of the basic duty,
- 1 January 1998 - 45% of the basic duty,
- 1 January 1999 - 30% of the basic duty,
- 1 January 2000 - the remaining duties shall be abolished.
12. The import duties applicable in the Republic of Poland to products originating in the Republic of Hungary listed in Annexes O and P to this Protocol shall be progressively reduced in accordance with the following timetable:
- 1 January 1996 - 5 / 7 of the basic duty,
- 1 January 1998 - to 4 / 7 of the basic duty,
- 1 January 1999 - 3 / 7 of the basic duty,
- 1 January 2000 - 2 / 7 of the basic duty,
- 1 January 2001 - 1 / 7 of the basic duty,
- 1 January 2002 - the remaining duties will be abolished.
13. Until the import duties applicable in the Republic of Poland to products originating in the Republic of Hungary listed in Annex Q to this Protocol are fully eliminated, the Republic of Poland shall declare, as from the date of entry into force of the Agreement, duty-free quotas above the limits set out in that Annex.
