GOVERNMENT REGULATION
of 21 February 2007
amending Government Regulation No 98 / 2002 Coll., laying down the conditions and arrangements for granting subsidies from the State Budget to activities of members of national minorities and to promote the integration of members of the Roma community, as amended by Government Regulation No 262 / 2005 Coll.
The Government mandates pursuant to § 12 (2) and § 13 (2) of Act No. 273 / 2001 Coll., on the rights of members of national minorities and on the amendment of certain laws, and on the implementation of Act No. 218 / 2000 Coll., on the Budget Rules and on the amendment of certain related laws (Budget Rules), as amended by Act No. 130 / 2000 Coll., Act No. 141 / 2001 Coll., Act No. 187 / 2001 Coll., Act No. 320 / 2001 Coll., Act No. 450 / 2001 Coll., Act No. 202 / 2002 Coll., Act No. 482 / 2004 Coll., Act No. 1 / 2005 Coll., Act No. 127 / 2005 Coll., Act No. 361 / 2005 Coll.
Government Regulation No. 98 / 2002 Coll., laying down the conditions and arrangements for granting subsidies from the State Budget to activities of members of national minorities and to promote the integration of members of the Roma community, as amended by Government Regulation No. 262 / 2005 Coll., is hereby amended as follows:
1. In Article 1 (1), the words "to 'shall be replaced by" to' and the words "in the languages of national minorities' shall be inserted after the words" to '.
2. in Article 2 (a), "activities of members of national minorities or activities for the benefit of members of national minorities" shall be replaced by "projects."
3. In Article 2 (b), the word "project 'is replaced by" application for grant of a project subsidy ("application') '.
4. In Article 2 (d) (3), the word "a 'is replaced by the word" education' and the words "and educational programmes promoting the development of tolerance and respect for the different identities of others' are inserted after the word" education '.
5. in Article 2 (e), the word "admission" shall be replaced by "submission" and the words "grant and project applications, project evaluation" shall be replaced by "application evaluation."
6. In Paragraph 3 (1) (c), the words "and the Office of the Government of the Czech Republic 'shall be inserted after the words" the case'.

Announcement of the selection grant procedure
The provider shall, at least once a calendar year, issue a selection procedure with the Council to support projects of activities of members of national minorities and through the Council in cooperation with the Roma Affairs Council for projects supporting the integration of members of the Roma community. The announcement of the selection grant procedure, including its terms and conditions, shall be notified by the provider through the national periodical press and on his official record. ';
8. Article 5, including the title and footnote 3, shall be deleted.
9. The heading of Section 6 reads "Application."
10. in the first sentence of Article 6 (1), the word "project" shall be replaced by "application," the word "processed" shall be replaced by "processed" and the word "submitted" shall be replaced by "submitted."
11. in the second sentence of Article 6 (1), the word "project" shall be replaced by "applications" and the words "in a remotely accessible information system" shall be replaced by the words "on their official record."
12. in Paragraph 6 (2):
"(2) The application shall include a description of the project and the budget for its implementation. The application shall be accompanied by a declaration that the applicant does not have a liability due on the date on which the application is submitted in respect of the State budget, the State Fund, the budget of the local authority or the health insurance undertaking, and also by agreement with the publication of the identification data and the amount of the subsidy provided. ';
13. in Article 6, paragraph 4 is deleted;
14. The heading of Section 7 reads: "Evaluation of applications."
15. in the first sentence of Paragraph 7 (1), "Projects" is replaced by "Applications."
16. in the third sentence of Article 7 (1), the words "Members of the Council or other representatives of the members" shall be replaced by the words "Members" and the words "projects" shall be replaced by "applications."
17. in Article 7 (2), "projects" is replaced by "applications."
18. in Article 7 (3), after the first sentence, the sentence "If the provider decides to grant a grant to the project, he shall publish on his official record an overview of who and to what extent the grant was granted; until then, the results of the selection grant procedure shall not be public. ';
19. in the last sentence of Article 7 (3), "projects" shall be replaced by "applications."
20. The heading of Section 8 reads: "Conditions for granting and using the subsidy."
21. Paragraph 8 (1) reads:
"(1) The subsidy may be granted and used only for the purpose set out in the decision granting the subsidy. Any changes to the terms and conditions or the amount of the subsidy provided for in the decision granting the subsidy may be made only at the written request of the beneficiary, received by the provider no later than 31 October of the year of the grant, by issuing a new grant decision. The new decision in the part which it amends replaces the original decision, which remains unaffected in the others. '
22. in Article 8 (3), the second sentence is replaced by the following: "The subsidy may be granted to an applicant who, at the date of the application, does not have a commitment due in respect of the State budget, the State Fund, the budget of the local authority or the health insurance undertaking; This is demonstrated by the applicant by a declaration pursuant to Article 6 (2). ';
23. in Paragraph 8 (4), the first sentence is replaced by the following: "The subsidy may be granted for a maximum of 70% of the budgeted costs of the approved project, the total amount of the subsidy may not exceed 70% of the actual costs; the payment of 30% of the actual costs of the approved project shall be made by the beneficiary from sources other than the State budget. ';
24. in Article 8 (5), "expenditure" is replaced by "costs."
25. In Paragraph 8 (7), the first sentence is replaced by the sentence "Subsidy under this Regulation shall not have the character of a grant for the acquisition or technical evaluation of tangible and intangible assets."
26. Paragraph 8 (9) is deleted.
27. Article 9, including the title and footnote 8, shall be deleted.
28. In Paragraph 10 (1), the word "identification 'shall be inserted after the word" amendment'.
29. in Article 11 (6), the words "in cooperation with the Council, in the case of projects promoting the integration of members of the Roma community and in cooperation with the Roma Council" shall be deleted.
30. Paragraph 13 (1) and (3) are deleted and paragraph 2 is deleted.
31. in Article 14 (2), the words' following a Council recommendation 'shall be inserted after the word' culture ';
32. In Article 16 (1), the words "as well as information on national minorities in society 'are deleted.
33. in Article 16 (2), the words "following a Council recommendation" shall be inserted after the word "culture."
34. in Article 17 (a), the words "or information on national minorities in society" shall be replaced by "(hereinafter referred to as" printing in the languages of national minorities ")."
35. in Article 17 (b), the word "operation" is deleted and the words "or information on national minorities in society" are replaced by "(hereinafter referred to as" broadcasting in the languages of national minorities ")."
36. in Paragraph 18 (2):
"(2) The selection subsidy procedure is intended to support the publication of press in the languages of national minorities, which is not issued for profit and is publicly distributed in the Czech Republic."
37. in Article 18 (3), the word "periodic" shall be deleted and the words "in languages" shall be inserted after the word "printing."
38. in Article 18 (4) and (5):
"(4) The applicant for the subsidy for printing in the languages of national minorities shall submit to the provider the justification of the application, including the expected revenue and costs, the title-oriented data, the method of dissemination and other data if requested by the provider.
(5) Subsidies for printing in the languages of national minorities may only be granted for the demonstrable costs of publishing or expanding them. "
39. Paragraph 18 (6) is deleted.
40. The following Section 18a is inserted after Section 18, including footnote 13:
(1) The selection procedure is intended to promote broadcasting in the languages of national minorities, which is not operated for profit and is distributed in the Czech Republic.
(2) Selective subsidy procedures to promote broadcasting in the languages of national minorities may be attended by legal and natural persons authorised to carry out broadcasting activities under the Broadcasting and Television Act (13), focusing on national minority activities.
(3) The applicant for the subsidy to promote broadcasting in the languages of national minorities shall submit to the provider the justification for the request, including the expected revenue and costs, the project focus data, the mode of transmission and other data if requested by the provider.
(4) The subsidy to promote broadcasting in the languages of national minorities may only be granted for the demonstrable costs associated with the production and dissemination of programmes.
13) Act No 231 / 2001 Coll., on the operation of radio and television broadcasting and amending other laws, as amended. '
41. in Paragraph 19 (2), the word "support" and the word "education" shall be inserted after the words "minorities and" education. "
42.In Paragraph 20 (b):
"(b) social cultural and leisure activities for children and young people, where such activities are aimed at promoting the preservation and development of the traditions and identities of a national minority or the development of sensitivity to the positive importance of the national diversity of society,";
43. In Paragraph 21, the words "and the Office of the Government of the Czech Republic 'shall be added at the end of paragraph 1.
44. in Paragraph 21 (2), the words "competent ministries" shall be replaced by the words "competent central authorities of the State, following a recommendation from the Roma Council."
Transitional provision
Legal relations arising under Government Decree No. 98 / 2002 Coll., as effective by the date of entry into force of this Regulation, as well as the rights and obligations arising therefrom shall be governed by existing legislation.
Efficacy
This Regulation shall enter into force on 1 March 2007.
