DECLARATION
of 18 September 2020
amending Decree No. 156 / 2008 Coll., on improving the professional competence of drivers and amending Decree No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws, as amended by Act No. 478 / 2001 Coll.
The Ministry of Transport provides pursuant to Article 62 of Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., Act No. 374 / 2007 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 64 / 2014 Coll., Act No. 230 / 2014 Coll. and Act No. 199 / 2017 Coll., for implementation of § 47 (6), § 48 (7), § 52c (11) and § 52i (3) of this Act:

Decree No. 156 / 2008 Coll., on improving the professional competence of drivers and amending Decree No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws, as amended by Act No. 478 / 2001 Coll., is amended as follows:
1. In Part One of Title I:
"INTRODUCTORY PROVISIONS."
2. In Part One, Title I, Part 1, including the title, is deleted.
3. Paragraph 1, including footnote 16, reads as follows:
„§ 1
This decree implements the relevant provisions of the European Union16)
(a) the curriculum for entry and regular training and safe driving;
(b) the share of teaching and training on the overall range of entry and regular training;
(c) the content of teaching and training of entry and regular training and safe driving training;
(d) the scope of the common part and the specific parts of the initial training and the part of the training in driving the vehicle, which may be replaced by training on the driver's trainer;
(e) the scope of the part of the teaching of regular training, which may take place in a way that allows remote access, and the conditions for the course of that part of the teaching;
(f) the scope of teaching and training for safe driving;
(g) the maximum number of participants in the entry and regular training courses and safe driving training;
(h) fields related to road transport within secondary education with a graduate examination and higher vocational education;
(i) a model for the certificate of teaching and training completed;
(j) the content, scope and method of carrying out the test and evaluating its results and the model of the certificate of completion;
(k) the model of the driver's professional licence and the model of the certificate of loss, theft, damage or destruction of the driver's professional licence;
(l) basic technical requirements for non-residential premises and equipment for providing safe driving training and for the training area, its equipment and technical provision of training on it;
(m) a model for the completion of safe driving training.
16) Directive 2003 / 59 / EC of the European Parliament and of the Council of 15 July 2003 on the initial qualification and periodic training of drivers of certain road vehicles for the carriage of goods or passengers and amending Council Regulation (EEC) No 3820 / 85 and Council Directive 91 / 439 / EEC and repealing Council Directive 76 / 914 / EEC. Council Directive 2004 / 66 / EC of 26 April 2004 adapting, by reason of the accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia, Directives 1999 / 45 / EC, 2002 / 83 / EC, 2003 / 37 / EC and 2003 / 59 / EC of the European Parliament and of the Council and Council Directives 77 / 388 / EEC, 91 / 414 / EEC, 96 / 26 / EC, 2003 / 48 / EC and 2003 / 49 / EC in the fields of free movement of goods, freedom to provide services, agriculture, transport policy and taxation. Directive (EU) 2018 / 645 of the European Parliament and of the Council of 18 April 2018 amending Directive 2003 / 59 / EC on the initial qualification and periodic training of drivers of certain road vehicles for freight or passenger transport and Directive 2006 / 126 / EC on driving licences. ';
4. In Part One, the following shall be inserted after Section 1:

„HLAVA II

DETERMINATION OF TRAINING LIQUIDITY OF RANGE FOR THE PURPOSES OF PROFESSIONAL ELIGIBILITY OF RANGE

Entry and regular training '.
Title II shall be renumbered Title III.
5. The following Section 1a is inserted after Section 1:
„§ 1a
(Paragraph 47 (6) of the Law)
(1) The curriculum, the proportion of teaching and training in the overall range of initial training and the scope of the common part and the specific parts of teaching are defined for:
(a) a basic range of 140 hours in Annex 1;
(b) an extended range of 280 hours in Annex 2.
(2) The maximum number of participants in the entry training course is 30 persons. "
6. in Article 2 (1) (c):
"(c) limits on the use of brakes and retardants, combined application of brakes and retardants, use of the relationship between vehicle speed and transmission ratio, use of vehicle inertia, use of deceleration and braking modes when driving on slopes, intervention in the event of failure, use of electronic and mechanical devices such as electronic stability programme (ESP), advanced emergency braking systems (AEBS), anti-lock braking system (ABS), traction control systems (TCS) and on-board monitoring systems (IVMS) and other assistance or automation devices approved for use; ';
7. In Paragraph 2 (1), the words ", the importance of forecasting traffic flows, compliance with a reasonable distance from other vehicles and the use of vehicle momentum, steady driving speed, smooth driving style and proper tyre pressure and awareness of intelligent transport systems that improve driving efficiency and assist in route planning 'shall be added at the end of the text in point (d).
8. In Article 2, at the end of paragraph 1, the dot is replaced by a comma and the following points (f) and (g) are added:
"(f) anticipation and assessment of road traffic risks under different road conditions, traffic and weather conditions and adaptation of the management arrangements to these risks, planning of the journey during exceptional weather conditions, decisions when to postpone or cancel the journey as a result of extreme weather conditions, adaptation of the management method to traffic risks, including dangerous behaviour in transport or dispersion while driving;
(g) the ability to identify dangerous situations and to manage the stress resulting therefrom, in particular in relation to the size and weight of vehicles and vulnerable road users and to adapt the management method, to anticipate potentially dangerous situations and to take appropriate measures to enhance safety to the extent possible to prevent them. "
9. In Article 2 (2), the words "the use of automatic transmission systems' shall be inserted after the words" road '.
10. in Article 2 (3) (b), the words "the use of automatic transmission systems" shall be inserted after the words "the road,"
11. in Article 3 (1) (b), the words "and Council Regulation (EEC) No 3821 / 85 on recording equipment in road transport" shall be replaced by the words "and in accordance with the directly applicable European Union provisions governing tachographs in road transport17";
Footnote 17 reads:
"(17) Regulation (EU) No 165 / 2014 of the European Parliament and of the Council of 4 February 2014 on tachographs in road transport, repealing Council Regulation (EEC) No 3821 / 85 on recording equipment in road transport and amending Regulation (EC) No 561 / 2006 of the European Parliament and of the Council on the harmonisation of certain social legislation relating to road transport."
12. in Article 3 (2) (b):
"(b) documents which, under other legislation, must be in the vehicle;"
13. in Article 3, at the end of paragraph 2, the dot is replaced by a comma and the following points (m) and (n) are added:
"(m) restrictions on the movement of certain vehicles,
(n) use of toll-charged infrastructure. ';
14. In Article 6, at the end of paragraph 3, the dot is replaced by a comma and the following point (f) is added:
"(f) the issue of the transport of persons with disabilities."
15. in Paragraph 10 (2), the words "C + E and D + E and subcategories of driving licences C1 + E and D1 + E" are replaced by the words "C + E, D + E, C1 + E or D1 + E";
16. In Article 10 (4), the word "group 'is replaced by" group' and the words "and subgroup of driving licences' are replaced by" or '.
17. in Paragraph 10 (5) of the introductory part of the provision, the words "C and C + E and subcategories of driving licences C1 and C1 + E" are replaced by "C, C + E, C1 or C1 + E."
18. In Section 10 (6) of the introductory part of the provision, the words "driving licences D, D + E and subcategories of driving licences D1, D1 + E 'are replaced by the words" driving licences D, D + E, D1 or D1 + E'.
19. In Article 11, paragraphs 4 to 7 are added:
"(4) Regular annual training shall consist of 6 hours of instruction and 1 hour of training.
(5) The training shall cover at least one subject relating to road safety and shall meet the specific needs of the driver in the field of training.
(6) Teaching may be replaced within 1 hour by teaching in a manner that allows remote access. A clear identification of the person being taught, recording the date and time of commencement and termination of teaching, recording the subjects discussed and confirmation of completion by each person being taught shall be ensured for teaching in a way that allows remote access. Teaching performed in a way that allows remote access may be completed only after the remaining range of teaching and training has been completed.
(7) The training shall consist of training practical skills that meet the specific needs of the driver in the field of training within at least one of the subjects of the curriculum of periodic or entry training or improvement in the driving of the vehicle. ';
20. in Article 15 (3), point (b) is deleted;
Points (c) and (d) shall be renumbered (b) and (c).
21. In Paragraph 15 (3), the words "printed in white in a blue rectangle and placed in a circle of twelve yellow stars" shall be added at the end of the text (b).
22. in Article 15 (3) (c), the words "8. Not to be completed," and the words "and subgroups" are deleted.
23. in Article 15 (4), the words "and subgroups" shall be deleted;
24. in Article 15 (4), the word "Community" shall be replaced by "Union."
footnote 11 is deleted.
25. in Article 15 (4), "95.dd.mm.rrrr" is replaced by "95 (dd.mm.rr)."
26. In Section 21 (1) of the Introductory Part of the provision, the words "AM and A and subgroup A1 'are replaced by the words" AM, A1, A2 or A'.
27. in Paragraph 21 (2) of the introductory part of the provision, the words "B, C and D and subgroups B1, C1 and D1" are replaced by the words "B, C, D, B1, C1 or D1."
