DECLARATION
of 19 September 2025
on the implementation of certain provisions of the State Social Assistance Benefit Act
According to Articles 36 (4), 60 (3), 61 and 63 (2) of Act No 151 / 2025 Coll., on the Benefit of State Social Assistance ("the Act '), the Ministry of Labour and Social Affairs provides:
Increase in the amount of living needs of a member of the household due to diet
(1) The amount of living needs of a member of the household pursuant to § 36 (2) (a) and (b) of the Act, the state of health of which, according to the competent medical practitioner, requires dietary meals, which require increased food costs, is increased monthly for a diet
a) low protein by CZK 1,511,
b) at dialysis by CZK 1,095,
c) Low cholesterol in hypercholesterolaemia or hyperlipoproteinaemia by CZK 1,150,
d) Diabetic by CZK 1,238,
e) in the case of phenylketonuria by CZK 2 431,
f) in the case of celiac disease of CZK 3,066,
g) in osteoporosis, if the whole body bone density has fallen by more than 25% and the T-score is worse than -2.5, by CZK 1,194,
h) in the case of lactose intolerance 1 172 CZK,
i) during pregnancy and breast-feeding up to 1 year of age of the child by CZK 1,205.
(2) Where the health status of a member of the household referred to in paragraph 1 requires more than one type of diet, the amount of his / her living needs shall be increased only once by an amount corresponding to that of the diet for which the increase referred to in paragraph 1 is the highest.
Physician's competence to confirm the need for a particular type of diet
The doctor responsible for confirming the need for the diet is for the diet
(a) a low protein doctor providing professional outpatient care in the field of internal medicine or nephrology to a member of the household pursuant to Article 1 (1);
(b) on dialysis, the doctor shall separate the medical establishment where the household member is in the dialysis programme referred to in Article 1 (1),
(c) low cholesterol in hypercholesterolaemia or hyperlipoproteinaemia by a physician providing a household member with specialised outpatient care in the field of internal medicine or endocrinology,
(d) a diabetic doctor providing specialised outpatient care to a household member under § 1 (1) in the field of diabetes, or a registered practitioner who has a member of the household under § 1 (1) with regard to this diagnosis in dispensary care,
(e) in the case of phenylketonuria, a physician providing household member under § 1 (1) with specialised outpatient care in the field of internal medicine or gastro-enterology, a doctor providing specialised outpatient care in the field of pediatric gastro-enterology and hepatology, or a registered practitioner for children and adolescents who has a member of the household under § 1 (1) with regard to this diagnosis in dispensary care, or another doctor who has a member of the household under § 1 (1) with regard to this diagnosis in dispensary care,
(f) in the case of celiac disease, a doctor providing a household member under § 1 (1) with specialised outpatient care in the field of internal medicine or gastro-enterology, in children and youth, a doctor providing specialised outpatient care in the field of paediatric gastro-enterology and hepatology, or a registered practitioner for children and youth who has a member of the household under § 1 (1) with regard to this diagnosis in the field of dispensary care;
(g) in the case of osteoporosis, a doctor providing a household member under § 1 (1) with specialised outpatient care in the field of internal medicine, endocrinology, rheumatics, orthopaedic surgery or gynaecology and obstetrics,
h) in the case of lactose intolerance, by a doctor providing a member of the household in accordance with § 1 (1) with specialised outpatient care in the field of gastroenterology;
(i) in pregnancy, a doctor providing a household member under Section 1 (1) with specialised outpatient care in the field of gyno and obstetrics;
(j) when breast-feeding up to 1 year of age, its registered physician for children and adolescents.

The communication specifications between the State Social Assistance Authority and the Bank and another similar institution and the format, content and structure of the data file are set out in Annex 3 to this Decree.
Efficacy
This decree shall take effect on 1 October 2025.

Annex No 1
Specifications of communication between the State Social Assistance Authority and the employer and the format, content and structure of the data report
A) Specifications of how the employer responds to a call from a State Social Assistance Body
1) The employer uses the ways of sending a reply to a call from a State Social Assistance Authority through:
(a) a complete XML file from the employer's data box,
(b) the web form; or
(c) direct calling of a service based on the GovTalk standard.
2) Specifications of the employer's response to a call by the State Social Assistance Authority using the sending of an XML file from the employer's data box:
a) To send the additional XML file, the employer's data box or the data box of the person authorised by the employer through the Czech Social Security Administration's Identity Management and Mandate System shall be used and the XML file shall be addressed to the data box designated by the State Social Assistance Authority in the call.
b) To complement the XML file, it is possible to use your own technical means or freely available online editor of the State Social Assistance Authority.
3) The specification of the employer's response to a call from a State Social Assistance Authority through a web-based form, available in the reference contained in the call for the use of the web-based form, requires the authentication of the employer via the Data Box Information System or by the data box of the person authorised by the employer through the Identity Management System and the mandate of the Czech Social Security Administration.
4) Specifications of the employer's response to a call by a State Social Assistance Authority through direct call of a GovTalk-based service:
a) Authentication and electronic signature of data for the service is carried out exclusively by a qualified certificate registered with the Czech Social Security Administration.
(b) For submission by direct call of service, the data theorem shall be inserted into the envelope in the format GovTalk version 2.
c) The data theorem is part of the XML item.
d) The employer shall use the envelope structure published on the developers' website. mpsv.cz or developers.mpsv.gov.cz on the date of sending the employer's reply to the call of the State Social Assistance Authority.
B) Format
The employer's answer is accepted exclusively in XML format by the State Social Assistance Body.

Communication specifications between the State Social Assistance Authority and the electricity or gas supplier and format, content and structure of the data report
A) Specifications of ways of responding to a call from a State Social Assistance Body to a supplier of electricity or gas
1) The supplier of electricity or gas will send a reply to the call by the State Social Assistance Authority as an added JSON file from the data box of the supplier of electricity or gas.
2) Specifications of the response method of the electricity or gas supplier to the call by the State Social Assistance Authority using the sending of the added JSON file from the electricity or gas supplier's data box:
(a) The data box of the electricity or gas supplier shall be used to send the JSON file with the required data.
(b) To supplement the JSON file, the supplier of electricity or gas shall use his own technical means or freely available online editor of the State Social Assistance Authority.
B) Format
The answer of the electricity or gas supplier shall be accepted exclusively by the State Social Assistance Authority in JSON format.

1) The Bank and other similar institutions will send a reply to the call by the State Social Assistance Authority as an XML file from the bank's data box and other similar institutions.
2) Specifications of how the bank and other similar institutions respond to a call from a State Social Assistance Authority using the sending of an XML file from a bank data box and other similar institutions:
a) To send an XML file, the bank's data box and other similar institutions are used, and the XML file is addressed to the data box designated by the State Social Assistance Authority in the call.
(b) To create an XML file, the bank and another similar institution shall use their own technical means.
B) Format
The answer of the bank and other similar institutions is only accepted by the State Social Assistance Body in XML format.
The XML file has a fixed name according to the following rules:
• File is encoded in UTF-8
• File rows are sorted by CR + LF characters (ASCII 13 + 10), including last row
• The file must have an XML header "<? xml version =" 1.0 "encoding =" UTF-8 "? >" + spacing
• The file is named according to the following rules, separated by "_"
