on the Agreement between the Government of the Czechoslovak Socialist Republic and the Austrian Federal Government on criminal cooperation on the rivers Danube, Moravia and Dyja
On 5 December 1975, the Agreement between the Government of the Czechoslovak Socialist Republic and the Austrian Federal Government on criminal cooperation on the Danube, Moravia and Dyja rivers was signed in Vienna. Pursuant to Article 9 thereof, the Agreement entered into force on 3 February 1976.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Austrian Federal Government on criminal cooperation on the rivers Danube, Moravia and Dyja
The Government of the Czechoslovak Socialist Republic and the Austrian Federal Government, led by the wish to accelerate the identification of dead bodies fished out or washed out from the rivers of the Danube, Moravia and Dyje, as well as the search for missing persons on these rivers, agreed on the following:
The Agreement applies to the Danube, Moravia and Dyja rivers in the sections where they form a common national border between the Czechoslovak Socialist Republic and the Republic of Austria and, as regards the Danube, also in its other section on the sovereign territory of the Czechoslovak Socialist Republic (hereinafter referred to as the "rivers').
Criminal cooperation for the purposes of: Agreements shall mean cooperation in identifying dead bodies caught or washed from rivers and searching for missing persons on those rivers.
The competent authorities of the Contracting Parties shall be informed without delay:
(a) missing persons which may be presumed to have been harvested or washed from rivers;
(b) dead bodies harvested or washed out of rivers, unless it can be ruled out with certainty that they have been drained from the sovereign territory of the other State.
The competent authority is the Federal Ministry of Interior on the Czechoslovak side and the Federal Minister of Interior on the Austrian side (Directorate-General for Public Security). These authorities shall engage through the Consulate General of the Republic of Austria in Bratislava.
Notification under Article 3 of this Regulation The agreements shall be made in writing by the e-mail or by a registered mail. In cases of extreme urgency, the notification will be made by telephone. In such cases, written notification shall be submitted without delay if necessary for further search or identification.
(1) The competent authority of one Contracting Party shall transmit the following documents to the competent authority of the other Contracting Party, in one of the languages of the Contracting States:
(a) a description of the missing person;
(b) a report on the finding of the corpse;
as well as where appropriate and if available:
X-ray images of surgical operations, dental records, photographs, documentation or descriptions of other special signs and tattoos of the missing person or bodies found;
photographs of the missing person or photographic documentation of the body's discovery;
dactyloscopic card;
a sample of clothing components, hair and the unknown corpse of the items found;
autopsy report.
(2) The competent authorities of the Contracting Parties shall transmit the supporting documents referred to in paragraph 1 on their forms.
(1) The competent authorities of the Contracting Parties shall allow the recognition of witnesses, in accordance with the laws in force in their State, to appear at the request of the competent authority of the other Contracting Party promptly for the recognition procedure at the designated place of identification.
(2) If one Contracting Party to the proposed recognition witness in the territory of the other State threatens to prosecute a criminal offence, it shall be informed thereof. The admission of such a person as a cognitive witness under this Agreement shall be waived.
Where a cadaver is identified as a former State citizen of one of the Contracting States, the Contracting Parties shall facilitate the processing of the necessary formalities for possible transfer of the cadaver.
This Agreement shall enter into force on the 60th day following its signature.
It shall be closed for a period of five years and shall be extended for a further period of five years each time unless it is terminated six months before the expiry of the relevant five-year period.
Done at Vienna, 5 December 1975 in duplicate, each in the Slovak and German languages, the two texts being equally authentic.
