of 9 April 1976
on scientific and technical staff in centrally managed research and development base organisations
The Federal Ministry of Technical and Investment Development, in agreement with the Czechoslovak Academy of Sciences, the Federal Ministry of Labour and Social Affairs, the Ministry of Construction and Technology of the Czech Socialist Republic and the Ministry of Construction and Technology of the Slovak Socialist Republic, according to § 52 (a) (4) of Act No. 133 / 1970 Coll., on the jurisdiction of federal ministries:
Scientific and technical staff
This decree provides for a system for obtaining and increasing the qualifications of scientific and technical staff working in relation to centrally managed research and development base organisations.
Scientific and technical staff are creative workers - experts in principle with higher education - who further develop knowledge of basic or applied research, verify their applicability under specific conditions, propose and participate in the social practice of innovative change and whose creative competence has been verified by the award of a scientific and technological qualification degree. 1)
The assessment of the creative competence of scientific and technical staff shall distinguish between three stages of that competence, which shall correspond to three scientific and technical qualification degrees in its verification:
(a) Basic creative competence (scientific and technical qualification level III) is the ability of the worker to apply scientific knowledge in the management of follow-up research and development tasks and to participate in the implementation of their results; eligibility for collective management of tasks is required.
(b) Higher creative competence (scientific and technical qualification level II) is the ability of the worker to deal separately, in a non-traditional way, with the planned research and development tasks with the applicable result, to fully evaluate the results of the completed tasks, to familiarise the professional public with the results of his or her work and to assist in the implementation of research and development results in social practice.
c) The highest creative competence (scientific and technical qualification level I) is the worker's ability to solve complex problems relevant to the objectives of science and technology policy in the original way, to manage working groups both in the management of research and development tasks and in their implementation, and to increase the qualifications of entrusted staff.
Acquisition and improvement of qualifications of scientific and technical staff
(1) The improvement of qualification is an integral part of the tasks of scientific and technical staff and the organisation's cadre policy.
(2) Organised improvement of the qualifications of the worker is based on a plan for its personal development.
(3) The personal development plan of the worker is based on the current and prospective tasks of the workplace, the inclusion of the worker in the work process and the conclusions of its comprehensive evaluation. It contains a programme of professional and ideal growth of the worker. It sets out in particular the objectives, tasks, time limits and method of intermediate and final control, the length of the relevant cycle of organised qualification enhancement (Section 6 (2)), as well as the practice and internships to be completed by the worker.
(4) The plan for the personal development of the worker is prepared by its direct superior, in cooperation with the cadre and personnel, and approved by the head of the organisation, in accordance with the instructions of the manager and with the participation of the worker.
(1) Care for increasing the qualifications of subordinate workers is one of the responsibilities of managers of all grades. The results of the work on this section are assessed as their other basic tasks.
(2) Leaders shall be required to create the material technical and other conditions necessary to continuously increase the qualifications of scientific and technical staff.
(1) All forms of adult education and education may be used in universities, as well as in corporate and non-educational education.2)
(2) The acquisition and improvement of qualifications of scientific and technical staff takes place in three cycles according to the degree of creative competence to which it is directed.
(1) The basic cycle prepares staff with higher education to acquire basic creative competence. The head of the organisation selects into it personnel who have already participated in the solution of research or development tasks and have gained initial experience from the application of their results in practice. In each individual case, the head of the organisation shall designate an experienced trainer who shall assist the worker in raising his / her qualifications and shall evaluate the implementation of his / her personal development plan.
(2) In the basic cycle, the main forms of raising qualifications are organised vocational and ideas education and leadership in the performance of the job. Education takes place mainly by courses, seminars, lectures, graduate studies at universities, consultations, study visits at home and abroad.
(1) In the higher cycle, workers are preparing to achieve higher creative capacity. The organisation's management selects staff who have already reached scientific and technical qualification level III and have proven their ability to further increase creative competence in their practice and study.
(2) In addition to the forms applied in the base cycle, experience in the performance of the entrusted function and the follow-up of independent studies shall be used in this cycle.
(3) During the higher cycle, the worker must, in particular, gain experience in independent problem solving, in cooperation with the practice of implementing innovation, defending his own results, publishing them and consulting him.
(1) In the highest cycle, workers prepare to achieve the highest creative capacity. The Head of Organisation shall include, on the basis of a narrow selection, personnel who have already reached scientific and technical qualification level II. In doing so, it takes particular account of the worker's ability to manage systematically a wide range of professional themes, to lead a collective of people, to develop their skills and to mobilise them to solve challenging tasks.
(2) In this cycle, in particular, the independent study and the planned intensity of the working environment shall be applied. The content of the increase in qualifications is mainly the study of people's work and the management of creative activities, the management of professional and political, economic and social development issues, the performance of management, conceptual, prognostic, educational, advisory and similar functions.
Evaluation of the creative competence of scientific and technical staff (attestation)
(1) Two types of tests are used for evaluation and verification of the creative competence of scientific and technical staff: scientific and technical qualification level and periodic tests.
(2) On the basis of the verification of the results of the improvement of the qualification, scientific and technical qualifications shall be awarded to staff members by means of a scientific and technical qualification step.
(3) The scientific and technical qualification degree may exceptionally also be awarded to a staff member with lower than university education, provided that he has demonstrated the results of his work that he has acquired knowledge at higher education level.
(4) A staff member may be granted a higher level of scientific and technical qualification than III on the basis of a verification corresponding to his creative competence, without having previously been granted a degree III or II, as appropriate.
(5) According to the relevant regulations, the award of a scientific and technical qualification step is a condition for the inclusion of a worker as scientific and technical staff.
(6) The acquisition of a scientific rank or the award of a scientific qualification step does not replace a scientific and technical qualification degree. 3)
(7) The periodical attestation evaluates the results of the scientific and technical staff and the implementation of its personal development plan over the past period. This period shall be no more than four years for workers to whom grade III or II has been awarded, no more than six years for workers to whom grade I has been awarded.
(8) The conclusions of the periodic tests are one of the basis for a comprehensive assessment of the staff and are in the nature of recommendations for the Head of Organisation.
(1) The award, withdrawal or reduction of the scientific and technical qualification level is decided by the ministerial attestation commission set up with the central authorities of the directly managing organisations of the research and development base.
(2) The Central Authority may set up a special attestation committee for each area of its operation.
(3) On the basis of the agreement of the participating central authorities, a joint ministerial committee may be set up.
(1) The recognition of the scientific and technical qualification level shall be valid for all centrally managed research and development base organisations in the field of competence of the Ministry Attestation Commission which has granted the scientific and technical qualification degree.
(2) When transferring a worker to a centrally managed organisation of a research and development base in the field of competence of another ministerial body, the head of that organisation may recognise the validity of the awarded scientific and technical qualification step to that organisation, unless otherwise provided for by the central authority superior to that organisation.
(1) The Ministry Attestation Board has at least nine members. Its chairman and other members shall be appointed by the head of the competent central authority, the chairman of the managers of the central authority, the other members of the representatives of the implementation practice, the scientific and scientific and educational staff of ČSAV, SAV and universities, research and development staff of the highest qualification in the relevant fields and representatives of social organisations. A representative of the Federal Ministry of Technical and Investment Development or the relevant Ministry of Construction and Technology is usually a member of the ministerial committee.
(2) The appointment of members shall take place with the agreement of the head of the organisation or of the central body in which they work, on a proposal from their competent authority, with members representing social organisations.
(3) When setting up the Ministry Attestation Board, the Head of the competent central authority shall determine how administrative work related to the activities of the Board, including, in particular, the keeping of records of its decisions, is to be ensured.
(1) The Ministerial Attestation Committee shall decide on the basis of a proposal submitted by the Head of Organisation after consulting the Institute Attestation Committee (§ 16). The head of the organisation shall be responsible for prior discussion of the proposal with the party and trade union bodies of the workplace.
(2) Proposals for the award of the scientific and technical qualification degree by the head of the organisation shall be submitted to the committee responsible by the representative (s) of the central authority responsible.
(3) The Ministerial Attestation Commission is entitled to require the appellant to supplement the supporting documents necessary for an objective decision. The President of the Commission may also invite other experts who participate with an advisory vote to attend its deliberations.
(1) The ministerial committee is capable of a quorum if an absolute majority of the members are present. The proposal shall be adopted if the majority of the members present votes for it, but at least four. The vote is public. Minutes shall be taken of the proceedings of the Commission.
(2) The Commission shall communicate its decision to the applicant within 30 days. The negative decision shall be justified. The appellant may, within 2 months of its notification, appeal the ministerial attestation committee if it is able to state the essential facts which were not included in the rejected application. If the appeal is lodged by the head of the organisation, they shall be discussed first with the party and trade union bodies of the place of work and in the certification committee of the establishment.
(3) The appeal will be discussed by the Ministerial Attestation Commission in a similar manner to the original proposal. If it does not comply with it itself, it shall forward it, accompanied by its observations, to the head of the central authority of the superior organisation in which the worker operates.
(4) If a proposal to award a scientific and technical qualification step has been rejected, a further proposal, justified by the new facts, may be submitted no earlier than one year after the rejection decision on the previous proposal.
(5) The head of the organisation shall notify the decision in writing of the Ministry Attestation Committee to the worker within 15 days of receipt of the decision. The records of the decision of the Ministry Attestation Commission are based on the personnel files.
(1) Periodic attestations of scientific and technical staff are carried out by the testing committees set up in the research and development base organisations (Institute Attestation Committee). The composition of the Institute Attestation Board shall be approved by the central supervisor. The Institute Attestation Committee also comments on the proposals of the Head of Organisation before submitting them to the Department Attestation Commission.
(2) The Chairman of the Commission shall be the Head of the Organisation, which shall appoint at least four other members of the Commission, of which at least one member from experts working in, on the one hand, related research or development centres and, on the other hand, in the field of implementation practice, with the agreement of their managers. The other members of the Commission are representatives of social organisations at the workplace, appointed on their proposal.
(3) For the evaluation of individual staff, the President of the Commission may invite other experts who participate with an advisory vote to act.
(4) The head of the evaluated staff appointed by the head of the organisation shall prepare the necessary documents with draft conclusions in accordance with his instructions for the deliberations of the commission and shall participate in the meetings of the committee without the right to vote. The evaluated staff member shall attach an opinion on the draft conclusions.
(1) The Attestation Board of the Institute is capable of a quorum if an absolute majority of the members are present. The proposal shall be adopted if the majority of members present votes for it, but at least three. The vote is public. Minutes shall be taken of the proceedings of the Commission. Within 15 days, the senior officer shall notify him in writing of the conclusions of the periodic attestation.
(2) Periodic attestations of management organisations shall be carried out by the ministerial committee on the basis of documents prepared by the staff, which shall be entrusted by the central competent authority. The conclusions of these attestations shall be communicated in writing by the Ministry Attestation Committee to the evaluated head of organisation within 30 days.
(3) The plan of periodic tests is part of the organisation's cadre work plan.
A binding content of the conclusions of the Institute Attestation Committee during periodic tests is an assessment of the development of the creative capacity of the worker based on an evaluation of the results of his work and the implementation of his personal development plan and an opinion on the existing scientific and technical qualification degree of the worker.
Transitional provisions
(1) The organisation of a research and development base covered by this Decree must ensure, within six months of the beginning of its effectiveness, that all personnel who are subject to a scientific and technical qualification step are drawn up and approved by their personal development plans.
(2) Proposals for the award of scientific and technical qualification degrees prepared in the framework of the establishment of a salary schedule for staff of centrally managed research and development base organisations issued by the Federal Ministry of Technical and Investment Development in 1976 will be submitted by the organisation to the relevant ministerial accreditation committee by one single submission.
(3) These proposals shall include, as a priority, proposals for the award of scientific and technical qualification degrees to those workers whose creative capacity has been demonstrated by past social recognition of work results, such as awards, honours or rewards for particularly important improvements or protected solutions (discoveries, inventions, etc.).
Final provisions
(1) Exemptions from the provisions of Section 1 may be granted by the Minister for Technical and Investment Development in an agreement with the Minister for Labour and Social Affairs of the CSSR for individual organisations for which the application of the salary schedule for staff of centrally managed research and development organisations has been authorised.
(2) The evaluation of staff and the preparation of proposals for the award of scientific and technical qualification degrees shall be based on the principles set out in the Annex to this Order.
(3) The central authorities shall, as appropriate, issue guidelines for the activities of the management organisations of the research and development base, specifying in particular the dates of the regular meetings of the management committees and the dates for the submission of proposals to those committees.
This decree shall take effect on 1 May 1976.

PRINCIPLES
for evaluation of staff in proposals for the award of scientific and technical qualification grades
A. Presumption and components of the creative competence of scientific and technical staff
(1) The competence of a scientific and technical worker is based on theoretical knowledge, professional skills and experience.
(2) Theoretical knowledge is essentially due to undergraduate education and is further developed by the participation of a worker in a system of increasing the qualifications of scientific and technical staff.
(3) The professional skills are in particular:
(a) control of the methodology for solving research or development tasks in the field;
(b) the ability to successfully address research or development tasks, to bring new, original knowledge and to work successfully as a member of the research and development teams set up to help implement the results of research and development;
(c) the ability to evaluate the results of the solutions to research or development tasks, both in terms of the requirements for the task or the field concerned and in the wider social context;
(d) control of the methodological and organisational aspects of the process of addressing research and development tasks and the conditions for implementing their results up to the ability to manage research or development work;
(e) the ability to foresee possible conditions and problems of implementation when establishing and addressing research and development tasks and to effectively assist in the implementation of research and development results.
(4) In doing so, mutual proportions between professional skills may change, in particular following tasks falling within different stages of the research cycle, in connection with the performance of the management of research and development work, etc.
B. Results of scientific and technical staff
(1) An objective evaluation of the results of the work of a scientific and technical worker and their proven application in the proposals for the award of a scientific and technical qualification degree is a prerequisite for this, taking into account in particular:
(a) the stage of the R & D cycle in which the results have been achieved and the way the worker is involved in the division of work at the appropriate stage;
(b) the nature and importance of the personal contribution of the worker;
(c) the potential and actual social importance of the results in terms of technical economic or other benefits in the implementation and use.
(2) The results of the work to be carried out for the recognition of the scientific and technical qualification level shall be demonstrated in proposals submitted to the ministerial accreditation committees for example:
(a) certificates of inventions already issued;
(b) significant technical parts or other significant implementation actions the worker has actively contributed to;
(c) successfully opposed results of addressing the tasks of state plans for the development of science and technology in which the worker was actively involved;
(d) successfully opposed results in the resolution of the tasks of the department or branch and business (constitutional) in which the worker was actively involved;
(e) significant improvements made or accepted;
(f) the results of the publication activity of the worker;
(g) works on the development of methodology or technology for the processing of information, or analyses, where appropriate, for the practical application of the results of research and development (provided that they are results in addressing the tasks of the scientific and technological development plan).
1) The category of creative staff of science, research and development (class 09 of the single classification of employment) is also composed of scientific and scientific staff whose education and qualification systems are governed by specific regulations.
2) The staff covered by this system of obtaining and increasing the qualifications of scientific and technical staff shall also take part in it if they are included in the system of cyclic management of management personnel under the Resolution of the Government of the CSSR of 16 February 1972 No 42 / 1972.
