on the adjustment of pay ratios of teachers and educators.
The Bureau of the National Assembly of the Czechoslovak Republic has decided on the following legal measure under Article 66 of the Constitution:
Basic provisions.
(1) In building a socialist society, schools and extracurricular education facilities have an important mission as they prepare our youth ideally and professionally to cope with the important tasks of socialist construction. The important mission of schools and extracurricular educational establishments places high demands on quality of work and on the ideal and professional level of teachers and educators. An important prerequisite for improving the work of schools and out-of-school educational establishments is the material involvement of these workers in constantly improving their work and in the continuous growth of their political and professional level.
(2) The pay ratios of teachers and educators are therefore adjusted in accordance with the socialist principle of pay for work according to its quality, quantity and social importance, so as to contribute to increasing their idea of maturity and vocational education and thereby to continuously increasing the level of socialist school and non-school educational establishments.
Scope of validity.
(1) This adaptation shall apply:
(a) teachers and directors of education and youth schools requiring special care;
(b) teachers and directors of professional and educational schools;
(c) teachers, educators and directors of nursery schools and educators and directors of extracurricular educational establishments.
(2) According to this legal measure, public servants who provide teaching and education in schools are considered to be educators of civil servants who provide education in non-school educational establishments.
Determining the types and number of jobs and setting up for jobs.
Depending on the difficulty, scope and social importance of the tasks assigned to teachers and educators, the following shall be established for each type of school and extracurricular educational establishment:
(a) the different types of employment;
(b) the conditions for their holding;
(c) the number of different types of posts according to the organisational structure and scope of each school and extracurricular educational establishment, taking into account the number of teachers and educators needed for representation.
Work income.
A teacher's salary and a tutor's salary.
(1) The salary of a teacher or educator shall consist of a basic salary and, where appropriate, a differential salary.
(2) The amount of the basic salary is determined according to the type and extent of the work carried out, the professional competence and the duration of teaching experience.
(3) Differential pay may be awarded for the greater extent and difficulty of work, mainly resulting from the organisation of a school or an out-of-school educational establishment, from the number of pupils, from the nature of education and teaching fields and from the working conditions of a school or out-of-school educational establishment.
The salary of the Director and the Deputy Director.
(1) The teachers' salary (educator) and the functional allowance for school management (educational establishment) are to be determined according to the type and scope of the school (extracurricular educational establishment) to directors of national and maternity schools and their corresponding extracurricular education establishments.
(2) A functional salary is payable to the directors and representatives of the directors of the secondary, educational and selection schools and to the directors of the corresponding non-school educational establishments (the "Directors"). The amount of the functional salary shall be determined by the type and extent of schools and non-school educational establishments, by their professional capacity, by the length of the period of their duties and by the length of teaching experience.
(3) The functional salary referred to in paragraph 2 shall also include remuneration for teaching or educational activities within a specified number of hours. Where, in exceptional cases, it is necessary for the Director to carry out the activity of a teacher or educator above the specified scope, he shall be granted for such activity a proportion of the basic salary rate, following the difference pay as teachers and educators to the extent provided for in the Regulations.
Personal salary.
(1) The Minister-in-Office may, instead of a basic salary and a differential salary or a functional salary, grant a personal salary to particularly excellent experts who show extremely successful work results.
(2) The highest limit to which a personal salary may be awarded and the total amount of the higher cost of personal salaries shall be determined by the Government or by the institution empowered to do so.
Entitlement to work income.
(1) The basic or functional salary, after the functional allowance linked to the post to which the teacher, educator or director has been appointed, is due from the date of the appointment of the post, if it is for a newly appointed worker. Where the amount of this salary (allowance) is changed, the new salary (allowance) shall be due from the first day of the month following the date on which the event justifying the change occurs; if this day is the first day of the month, starting from that day. However, if the teacher, educator or director has been reassigned to a post with a lower basic or functional salary, in the event of a functional allowance because he has neglected or violated his duties, he shall be entitled to lower income from the date of transfer. If there is a change in the amount of the basic salary as a result of a change in the scope of the work responsible for determining the amount of that salary, a new basic salary shall be payable from the date of that change.
(2) Entitlement to the differential salary is incurred (ceases), unless otherwise specified in the Regulations, on the date on which the fact justifying its creation (termination) occurred.
Reward for representation.
(1) The teacher (educator), who, in addition to his duties, represents the absent teacher (educator), is responsible for the hours of teaching (educational activity) in which the absent teacher (educator) is represented, under the conditions laid down in the Staff Regulations.
(2) For the representation of the Director, the teacher or educator shall be entitled, for the duration of the period of representation, if more than 4 weeks, to pay as director instead of his current salary.
Non-safety surcharge.
Teachers, educators and directors who work permanently in an environment in which their health is at extreme risk shall be granted a risk premium according to the degree of health risk.
Special rewards.
Special remuneration may be granted to teachers, educators and directors for significant work merit, in particular for carrying out important tasks, for introducing better working methods or for an exceptional initiative at work.
Remuneration for secondary activity.
A special remuneration shall be paid for the activity carried out by a teacher, educator or director in his or her own or other field of administration in addition to all tasks corresponding to the place of employment on which he or she is assigned.
Entitlement to pay for the period of absence at work.
The right to a basic (personal) salary and functional allowance shall apply mutatis mutandis to the current provisions on the provision of basic salary during that period of absence until the new general arrangements. The salary for the period of absence of work shall not be paid.
Transitional and final provisions.
More detailed provisions for the implementation of this legal measure, unless otherwise provided for in it, shall be adopted by the Government, in the case of the authorities empowered to do so.
(1) Workers subject to this statutory measure (§ 2) will be transferred to new salaries at the date of the entry into force of the relevant regulations.
(2) In the case of transfer to new salaries, the period of pedagogical practice applicable to the determination of the basic salary shall be deemed to be the period counted or payable to increase the fixed (basic) salary in accordance with the existing rules on the date of transfer.
(3) Unless otherwise provided for in that legal measure, the provisions on the adjustment of their pay ratios, in particular the provisions of the relevant Regulations, shall cease to apply to the staff covered by that legal measure,
(a) Sections 16 and 32 of Law No 66 / 1950 Coll. on the modification of the employment and pay ratios of civil servants,
(b) Government Decree No. 69 / 1950 Coll., establishing the Regulations on the salary of teachers, with the exception referred to in paragraph 4.
(4) Without prejudice to Article 15 of Law No 66 / 1950 Coll. and Article 23 of Decree-Law No 69 / 1950 Coll.
This legal measure shall take effect on 1 September 1956; They shall be implemented by ministers of education and culture, health, agriculture and forestry and national defence in agreement with the participating members of the Government.
