on the Locarne Agreement establishing an international classification of industrial designs and models, signed at Locarn on 8 October 1968
On 8 October 1968, the Locarn Agreement on the establishment of an international classification of industrial designs and models was negotiated in Locarn.
The instrument of approval of the Czechoslovak Socialist Republic was deposited with the Director-General of the World Intellectual Property Organisation - depositary of the Agreement - 4 August 1970.
Pursuant to Article 9 (3) (a) of the Agreement, it entered into force on 27 April 1971 and also entered into force on that date for the Czechoslovak Socialist Republic.
The Czech translation of the text of the Agreement is announced simultaneously.

LOCARN AGREEMENT
on the establishment of an international classification of industrial designs and models, signed at Locarn on 8 October 1968
The creation of a Special Union; acceptance of international classification
1. The States to which this Agreement applies shall constitute a Special Union.
2. For industrial designs and models, these States accept the same classification ("international classification ').
3. the international classification shall include:
I. List of classes and subclasses;
II. the alphabetical list of products which may be the subject of models and models, indicating the classes and subclasses in which they are classified;
Third explanatory notes.
4. The list of classes and subclasses shall be the list annexed to this Agreement, subject to any amendments and additions which may be made to it by the Committee of Experts, established in accordance with Article 3 (the Committee of Experts).
5. The Alphabetical List of Products and explanatory notes shall be adopted by the Committee of Experts on the basis of the procedure laid down in Article 3.
6. The Committee of Experts may amend and supplement the international classification in the framework of the procedure laid down in Article 3.
7. (a) The international classification shall be drawn up in English and French.
(b) The official texts of the international classification in other languages, which may be designated by the Assembly referred to in Article 5, shall be drawn up by the International Intellectual Property Office (hereinafter the "International Office"), in consultation with the participating governments, as set out in the Convention establishing the World Intellectual Property Organisation (hereinafter the "Organisation").
Use and legal reach of international classification
1. Subject to the obligations imposed by this Agreement, international classification shall be of administrative importance only. However, each State may grant it the legal meaning it considers appropriate. In particular, it does not oblige the international classification of States of the Special Union as to the manner and extent of protection of models and models in those States.
2. Each of the States of the Special Union reserves the possibility to use international classification either as a main classification or as an auxiliary classification.
3. State authorities The specific Union shall indicate in the official documents the registration or registration of the models and models and, where they are officially published, the numbers of the classes and sub-classes of international classification to which the products covered by the models or models are included.
4. In selecting the names to be included in the alphabetical list of products, the Committee of Experts shall avoid the use of such designations for which exclusive rights may exist, if possible.
However, the inclusion of the designation in the alphabetical list cannot be interpreted as expressing the opinion of the Committee of Experts as to whether or not exclusive rights exist for such designation.
Committee of Experts
1. A Committee of Experts shall be set up at the International Office, which shall be responsible for the tasks referred to in Article 1, paragraphs 4, 5 and 6. Each State of the Special Union shall be represented in the Committee of Experts; The Committee shall be governed by the Rules of Procedure, the adoption of which shall require a simple majority of the votes of the States represented.
2. The Committee of Experts shall adopt an alphabetical list of products and explanatory notes by a simple majority of the States of the Special Union.
3. Proposals for amendments or additions to international classification may be submitted by the Office of each State of the Special Union or by the International Office. Any proposal submitted by the Office shall be forwarded to the International Bureau. The proposals of the offices and the International Office shall be forwarded by the International Bureau to the members of the Committee of Experts not later than two months before the meeting at which the proposals are to be examined.
4. Decisions of the Committee of Experts on amendments and additions to international classification shall require a simple majority of the States of the Special Union. However, unanimity shall be required when new classes are set up or products are moved from one class to another.
5. Experts may vote in writing.
6. If, for a particular meeting of the Committee of Experts, a Member State does not appoint a representative or a designated representative during a meeting or within the time limit laid down in the Rules of Procedure, the competent State shall be deemed to agree to the resolution of the Committee.
Notification and publication of classifications and amendments thereto
1. The alphabetical list of products and explanatory notes adopted by the Committee of Experts, as well as the amendments and additions to the international classification, shall be notified by the International Bureau to the offices of the States of the Special Union. The decision of the Committee of Experts shall enter into force upon receipt of the notification. However, where a new class is created or products are transferred from one class to another, these changes shall take effect 6 months after dispatch of the notification.
2. The International Bureau, as depositary of the International Classification, shall include amendments and additions which have entered into force. Amendments and additions shall be published in the journals to be determined by the Assembly.
Assembly of the Special Union
1. (a) The Special Union shall have a Assembly consisting of the States of the Special Union.
(b) Government of each State A special Union shall be represented by one delegate who may have representatives, advisers and experts.
(c) The expenditure of each delegation shall be borne by the government which has seconded that delegation.
2. (a) Subject to the provisions of Article 3 of the Assembly
I. discuss all issues relating to the operation and development of the Special Union and the application of this Agreement;
II. Gives guidance to the International Bureau for the preparation of review conferences;
III. Review and approve the reports and activities of the Director-General of the Organisation (the Director-General) concerning the Special Union and give it the necessary guidance on matters falling within the competence of the Special Union;
IV. Establishes the programme, approves the three-year budget of the Special Union and approves its final accounts;
V. approve the Financial Regulation of the Special Union;
VI. Approves the acquisition of official texts of international classification in languages other than English and French;
VII. establishes, in addition to the Committee of Experts referred to in Article 3, other committees of experts and working parties which it considers appropriate for the achievement of the objectives of the Special Union;
VIII. Decides which States which are not members of the Special Union and which international NGOs may be admitted as observers to its meetings;
IX. approves the adaptations to Articles 5 to 8;
X. make other appropriate measures aimed at achieving the objectives of the Special Union;
The XI. shall perform all other tasks arising from this Agreement.
(b) Questions which are also of interest to other Union bodies managed by the Organisation shall be decided by the Assembly after hearing the Coordination Committee of the Organisation.
3. (a) Each Member State of the Assembly shall have 1 vote.
(b) Half of the Member States of the Assembly shall form a quorum (the lowest number required for the quorum).
(c) If the number of States represented is less than half, but if one third of the Member States of the Assembly act or exceed one third, the Assembly may take decisions, irrespective of the provisions of point (b); However, decisions of the Assembly, with the exception of decisions on rules of procedure, shall not become enforceable until the following conditions have been met. The International Office shall notify those decisions to the Member States of the Assembly which have not been represented and shall invite them to give their vote or abstention in writing within three months of the date of such communication. If, after the expiry of that period, the number of States which have so submitted their vote or abstention is equal to at least the number of States missing to reach the quorum at the meeting, these decisions shall become enforceable provided that the necessary majority is achieved at the same time.
(d) Except as provided for in Article 8 (2), decisions shall be taken by the Assembly by a two-thirds majority of the votes cast.
(e) Abstention does not count as a voice.
(f) Only one State may represent the delegate and may vote only on his behalf.
(g) Member States of the Special Union which are not members of the Assembly shall be admitted to its meetings as observers.
4. (a) The Assembly shall meet once every three years at a proper meeting convened by the Director-General, except in exceptional cases, at the same time and place as the General Assembly of the Organisation.
(b) The Assembly shall meet at an extraordinary meeting convened by the Director-General at the request of one quarter of the Member States of the Assembly.
(c) The Director-General shall draw up a agenda for each meeting.
5. The Assembly shall approve its Rules of Procedure.
International Bureau
1. (a) Administrative tasks A special union is provided by the International Bureau.
(b) In particular, the International Bureau shall prepare meetings of the Assembly and of the Committee of Experts and of any other committee of experts or working parties which may be set up by the Assembly or the Committee of Experts and shall be provided by the Secretariat of those bodies.
(c) The Director-General shall be the Chief Officer of the Special Union and shall represent him.
(2) The Director-General and the staff designated by him shall participate, without the right to vote, in all meetings of the Assembly, of the Committee of Experts or of any other committee or working group which the Assembly or the Committee of Experts may establish. The Director-General or his designated co-worker shall be the Secretary-General of these institutions on his or her own initiative.
3. (a) The International Bureau shall prepare, in accordance with the instructions of the Assembly, a review conference on the provisions of the Agreement, except for Articles 5 to 8.
(b) The International Bureau may consult on the preparation of review conferences with intergovernmental organisations and international NGOs.
(c) The Director-General and the persons designated by him shall participate in the meetings of the review conferences without the right to vote.
4. The International Bureau shall perform all other tasks entrusted to it.
Financing
1. (a) The Special Union shall have its budget.
(b) The budget of the Special Union shall contain the own revenue and expenditure of the Special Union, its contribution to the budget of common expenditure by the Union and, where appropriate, the amount available to the budget of the Conference of the Organisation.
(c) Common expenditure by the Union shall be regarded as expenditure not exclusively relating to the Special Union but also relating to one or more other Union managed by the Organisation. The share of the Special Union in these common expenditure is commensurate with the interest of the Special Union.
(2) The Special Union budget shall be drawn up taking into account the requirements of coordination with the budgets of the other Union managed by the Organisation.
3. the budget of the Special Union shall comprise the following revenue:
I. Member States' contributions to the Special Union;
II. fees and charges for services provided by the International Bureau under the Special Union;
III. Proceeds from the sale and benefit of publications of the International Bureau concerning the Special Union;
IV. gifts, references and subsidies;
V. rent, interest and other miscellaneous income.
4. (a) In determining the amount of the contributions referred to in paragraph 3 I, each Member State of the Special Union shall belong to the same class as that in which it is classified in the Paris Union for the protection of industrial property and shall pay its annual contributions according to the number of units established for that class in that Union.
(b) The annual contribution of each Member State The Special Union shall consist of an amount the ratio of which to the total amount of the annual contributions of all States to the Special Union budget is equal to the ratio between the number of units of the class to which it is classified and the total number of units of all States.
(c) The contributions shall be due on the first January of each year.
(d) A State which is late in paying its contributions shall not have the right to vote in any institution of the Special Union if the amount of arrears is equal to or exceeds the total amount of contributions to be paid by that State for the two preceding full years. However, the Special Union authority may allow such a State to continue to exercise its right to vote in that institution if it considers that the delay has occurred under exceptional and unavoidable circumstances.
(e) Where the budget is not approved before the start of the new financial year, the budget of the previous year shall be transferred in the manner laid down in the Financial Regulation.
5. The amount of fees and charges for services provided by the International Bureau under the Special Union shall be determined by the Director-General who shall report to the Assembly.
6. (a) The Special Union shall have an operational capital fund which shall be created by a one-off payment made by each State of the Special Union. If the Fund becomes inadequate, the Assembly shall decide to increase it.
(b) The amount of the initial payment by each State to or participation in the increase of that Fund shall be in proportion to the annual contribution of that State in force in the year in which the Fund is created or the decision to increase it shall be taken.
(c) The Assembly shall, on a proposal from the Director-General, determine the proportional amount and payment arrangements after having heard the opinion of the Coordination Committee of the Organisation.
7. (a) The Agreement on the head office of the Organisation concluded with the State in whose territory the Organisation is established provides for advances in cases where the operational capital fund is insufficient. The amount of such advances and the conditions under which they are granted shall in each case be the subject of separate agreements between that State and the Organisation.
(b) The State referred to in (a) and the Organisation shall have each right to terminate the obligation to provide advances by means of a written notification. The denunciation shall take effect three years after the end of the year in which it was notified.
8. Revision of accounts shall be carried out in a manner specified by the Financial Regulation, by one or more States of the Special Union or by external auditors established by the Assembly with their agreement.
Amendments to Articles 5 to 8
Any Member State of the Assembly or the Director-General may submit proposals for adaptations of Articles 5, 6, 7 and this Article. These proposals shall be notified by the Director-General to the Member States of the Assembly at least six months before they are discussed in the Assembly.
2. The adjustments to the articles referred to in paragraph 1 shall be approved by the Assembly. Their approval shall require a three-quarter majority of the votes cast; However, any adjustments to Article 5 and this paragraph shall require four fifths of the votes cast.
3. The amendments to the articles referred to in paragraph 1 shall enter into force one month after the Director-General has received a written notification of their adoption. Adjustments must be adopted by three quarters of the number of States that were members of the Special Union at the time the adjustment was approved. Adoption shall be made in accordance with the relevant constitutional rules. Any modification of those articles thus adopted shall bind all States which are members of the Special Union at the time the adaptation enters into force or which become members of the Special Union at a later date; However, any adjustment resulting in an increase in the financial obligations of the States of the Special Union shall only bind those States which have notified such an adjustment.
Ratification and approach; entry into force
1. Any State of the Paris Convention for the Protection of Industrial Property which has signed this Agreement may ratify and accede to it if it has not signed it.
2. The instruments of ratification and accession shall be deposited with the Director-General.
3. (a) For the first 5 States which have deposited their instruments of ratification or accession, this Agreement shall enter into force 3 months after the deposit of the fifth such instrument.
(b) For each other country, this Agreement shall enter into force 3 months after the Director-General has notified its ratification or access to it, unless a later date is indicated in the instrument of ratification or accession. In that case, this Agreement shall enter into force for that State at the given date.
4. Ratification or access by law means the adoption of all provisions and the granting of all benefits under this Agreement.
Efficiency and duration of the Agreement
This Agreement shall have the same effectiveness and duration as the Paris Convention for the Protection of Industrial Property.
Revision of Articles 1 to 4 and 9 to 15
1. Articles 1 to 4 and 9 to 15 of this Agreement may be revised in order to achieve the desired improvements.
2. Any revision shall be the subject of a conference held by the delegates of the Member States of the Special Union.
Termination
1. Each State may terminate this Agreement by notifying the Director-General. This statement is only effective for the State which made it. The Agreement remains valid and enforceable for the other States of the Special Union.
2. The denunciation shall take effect one year after the date on which the Director-General receives the notification.
3. The right of defence contained in this Article may not be exercised by any State until five years have elapsed since it became a member of the Special Union.
Territory
Article 24 of the Paris Convention for the Protection of Industrial Property shall apply to this Agreement.
Signature, languages, notifications
1. (a) This Agreement shall be signed in one original specimen drawn up in English and French, the two texts being equally authentic. The original text is deposited with the Swiss Government.
(b) This Agreement shall remain open for signature before 30 June 1969 in Bern.
2. The Director-General shall, after consulting the governments involved, produce official texts in other languages which may be designated by the Assembly.
3. The Director-General shall forward certified copies of the signed text of this Agreement to the governments of those States which have signed it and to the Government of any other State which so requests.
4. The Director-General shall register this Agreement with the United Nations Secretariat.
5. The Director General announces to the governments of all states The date of entry into force of this Agreement, signature, deposit of instruments of ratification or accession, acceptance of amendments to this Agreement and date of entry into force and notification of denunciations.
Transitional provisions
Pending the entry into office of the first Director-General, references in this Agreement to the International Office or to the Director-General shall be construed as references to the United International Intellectual Property Protection Offices (BIRPI) or to their Director.
