DECLARATION
Minister for Foreign Affairs
of 12 March 1976
on the Treaty between the Czechoslovak Socialist Republic and the People's Republic of Poland on a change in the course of national borders and on certain other issues related to the construction and operation of the Polish dam in the Danube region
On 21 March 1975, the Treaty was signed in Warsaw between the Czechoslovak Socialist Republic and the People's Republic of Poland to change the course of state borders and on certain other issues related to the construction and operation of the Polish dam in the Danube region.
The Treaty was approved by the Federal Assembly of the Czechoslovak Socialist Republic and ratified by the President of the Republic. The instruments of ratification were exchanged in Prague on 13 February 1976.
Pursuant to Article 5 thereof, the Treaty entered into force on 14 March 1976.
The Slovak version of the Treaty is hereby published simultaneously. *)

TREATY
between the Czechoslovak Socialist Republic and the Polish People's Republic on changing the course of state borders and on certain other issues related to the construction and operation of the Polish dam in the Danube region
President of the Czechoslovak Socialist Republic and State Council of the People's Republic of Poland
led by a desire to create in a spirit of mutual understanding the necessary preconditions for the construction and operation of the Polish dam in the Danube region
they have decided to conclude this Treaty and to that end have appointed their agents:
President of the Czechoslovak Socialist Republic
František Hagar, Minister of Forestry and Water Management of the Slovak Socialist Republic,
State Council of the People's Republic of Poland
Jerzy Maciak, Deputy Minister of Agriculture,
who, following the exchange of full powers found to be in good and proper form, have agreed on the following provisions:
(1) The course of the Czechoslovak-Polish state border changes in the area of the Czechoslovak municipality Lysá nad Dunajcem, the District of Poprad and the Polish municipality of Sromowce Wyžne, the District of Nowy Targ and the Czechoslovak municipality of Lenártov, the District of Bardejov and the Polish municipality of Wojkowa, the District of Nowy Sacz.
(2) The course of the national borders from the border sign 114 / 7 to the border sign II / 118 (border section II) in the area of the Czechoslovak municipality Lysá nad Dunajcem, the county Poprad and the Polish municipality Sromowce Wyžne, the county Nowy Targ determine the following border and measurement documents:
(a) a protocol description of the progress of the border line with the table of figures, sheets II / 35 and II / 36,
(b) a diagram of the 1: 5000 scale of the border line, sheets II / 35 and II / 36,
(c) an overview of the draft of the 1: 50 000 scale of the border line for border section II, sheet 2,
(d) a 1: 2500 scale plan for the territory of the Czechoslovak Socialist Republic of Poland.
(3) The course of state borders from border sign 278 / 8 to border sign 281 / 3 (border section I) in the area of the Czechoslovak municipality Lenártov, the district of Bardejov and the Polish municipality Wojkowa, the district of Nowy Sacz determine the following border and measurement documents:
(a) a protocol description of the progress of the border line with the table of figures, sheets No I / 107 and I / 108;
(b) diagram of the 1: 5000 scale of the border line, sheets No I / 107 and I / 108,
(c) an overview of the layout of the 1: 50 000 scale of the border line for border section I, sheet 5,
(d) a plan for the area of the national territory of the People's Republic of Poland belonging to the Czechoslovak Socialist Republic of the scale 1: 2500.
(4) The documents referred to in paragraphs 2 and 3 are an integral part of this Treaty.
(5) The border documents referred to in paragraph 2 (a), (b), (c) and (3) (a), (b), (c) replace the relevant border documents which form an integral part of the Treaty between the Czechoslovak Republic and the People's Republic of Poland on the definitive establishment of the national borders, signed in Warsaw on 13 June 1958.
(1) According to Article 1 (2), the Czechoslovak Socialist Republic resigns part of its territory in the area of the municipality of Lysá nad Dunajec, district Poprad on the area 24,9439 ha of the Polish People's Republic. Real estate and facilities and stands ("real estate ') located in that part of the territory are transferred to the property of the People's Republic of Poland.
(2) Pursuant to Article 1 (3) and in connection with paragraph 1 of this Article, the Polish People's Republic resigns part of its territory in the area of the municipality of Wojkowa, the Nowy Sacz district of 24,9439 ha of the Czechoslovak Socialist Republic. Real estate located in this part of the territory is transferred to the property of the Czechoslovak Socialist Republic.
(3) The transfer of ownership referred to in paragraphs 1 and 2 shall cease all rights in rem in respect of the immovable property transferred, as well as any other rights limiting or excluding the disposition of such immovable property or its use.
(4) Where the transfer of ownership referred to in paragraphs 1 and 2 is affected by the rights of third parties to transferred real estate, the Contracting Party in whose territory the real estate was situated prior to the transfer of ownership shall reimburse those persons in accordance with their national rules; third parties may not claim any claims against the party to whose property they have transferred.
(1) The Polish Party will pay the Czechoslovak Party:
(a) the costs of the land expropriation proceedings in the part of the territory of the Czechoslovak Socialist Republic in the municipality of Lysá nad Dunajac, Poprad district, which, pursuant to Article 2 (1), is being transferred to the Republic of Poland;
(b) the price of the road section between the Czechoslovak Municipality of Lysá nad Dunajec and the Polish Municipality of Niedzica, including telecommunications equipment, which, pursuant to Article 2 (1), becomes the property of the People's Republic of Poland.
(2) The payments referred to in paragraph 1 shall be paid by the Polish Party within 30 days of the entry into force of this Treaty in the amount and in the manner specifically laid down.
The Polish Party will take the necessary measures to avoid damage in the territory of the Czechoslovak Socialist Republic as a result of the construction and operation of the dam in the Danube region. Any damage caused in the territory of the Czechoslovak Socialist Republic by the construction or operation of the dam will be paid by the Polish Party unless it proves that it did not cause the damage.
This Treaty is subject to ratification and will enter into force on the 30th day following the replacement of the instruments of ratification to be implemented in Prague.
Done at Warsaw, 21 March 1975 in duplicate, each in the Slovak and Polish languages, the two texts being equally authentic.
To prove this, the agents of the Contracting Parties signed this Treaty and sealed it.
