amending Decree No 14 / 2005 Coll., on pre-school education, as amended, and Decree No 48 / 2005 Coll., on primary education and certain formalities for compulsory education, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 20 (8), § 27 (6), § 28 (6), § 35 (3) and § 161c (2) (c) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 383 / 2005 Coll., Act No. 49 / 2009 Coll., Act No. 472 / 2011 Coll., Act No. 82 / 2015 Coll., Act No. 178 / 2016 Coll., Act No. 101 / 2017 Coll., and Act No. 284 / 2020 Coll.:

Amendment of the pre-school education decree
Čl. I
Decree No. 14 / 2005 Coll., on preschool education, as amended by Decree No. 43 / 2006 Coll., Decree No. 214 / 2012 Coll., Decree No. 197 / 2016 Coll., Decree No. 280 / 2016 Coll., Decree No. 151 / 2018 Coll., Decree No. 196 / 2019 Coll. and Decree No. 423 / 2020 Coll., is amended as follows:
1. In Paragraph 1d, the following paragraph 11 is added:
"(11) The PHmax fixed for the workplace shall be increased by 1 hour for each group in accordance with Paragraph 1e (1)."
2. The following Section 1e is inserted after Section 1d:
„§ 1e
Organisation of education in language training groups
(1) Where the number of children who are foreigners and for whom pre-school education is compulsory is at least 4 children at the individual place of provision of education, in the case of a forest nursery school in a single territory, in particular where a pedagogical programme is under way and where the school has background, the head of the parent school shall set up a group or groups for free language training to ensure a smooth transition to primary education (hereinafter referred to as "language training '), separately for each place of training provided, in the case of a forest nursery school separately for each territory.
(2) A parent school provides language training for children in the group within 1 hour per week.
(3) The language preparation group shall have a maximum of 8 children as referred to in paragraph 1. Another language preparation group may be established if 8 children are included in the existing group as referred to in paragraph 1.
(4) The head of the parent school may, on the basis of an assessment of the need for language support for the child, include children other than those referred to in paragraph 1, even in a number of more than 8 children, provided that this does not prejudice the quality of the language preparation of the children referred to in paragraph 1. ';

Decree No. 48 / 2005 Coll., on basic education and certain formalities for compulsory education, as amended by Decree No. 454 / 2006 Coll., Decree No. 256 / 2012 Coll., Decree No. 197 / 2016 Coll., Decree No. 243 / 2017 Coll., Decree No. 140 / 2018 Coll. and Decree No. 196 / 2019 Coll., are amended as follows:
1. In Paragraph 6 (1), "CZK 200 'is replaced by" CZK 500'.
2. In the group title above the title of Section 10, the word "classes' is replaced by the word" groups'.
Article 3 (10) and (11), including the headings, read:
„§ 10
Designated school
(1) The free preparation for inclusion in primary education, including the teaching of the Czech language, adapted to the needs of foreign pupils who undertake compulsory education (hereinafter referred to as "language training"), is provided at a school established by the municipality, region or association of municipalities, which is on the list of schools for language training (hereinafter referred to as "the list of designated schools"). From 1 September, the school shall be included in the list of designated schools where the proportion of foreign pupils from the total number of school pupils on 31 March of the immediately preceding school year is at least 5%.
(2) If there is no school in the administrative district of the municipality with extended competence which fulfils the conditions laid down in the second sentence of paragraph 1, the regional authority shall, in cooperation with the organiser in the administrative district of that municipality with extended competence, include the school which has the most appropriate conditions for the provision of language training for foreigners. The Regional Office may, in cooperation with the organisers instead of the school referred to in the second sentence of paragraph 1, place another school on the list of designated schools, provided that it has long-term experience in language preparation or that it has more suitable conditions for language preparation than that of the second sentence of paragraph 1.
(3) In the administrative district of the municipality with extended scope, the number of designated schools must be:
(a) equal to the number of schools fulfilling the conditions laid down in the second sentence of paragraph 1; or
(b) (1) a school where there is no school in the administrative district of the municipality with extended competence which fulfils the conditions laid down in the second sentence of paragraph 1;
This shall not apply where schools are designated in accordance with paragraphs 4 and 5.
(4) The Regional Office, in cooperation with the organiser, may include a school on the list of designated schools from 1 September or from a later date during the school year where the conditions referred to in the second sentence of paragraph 1 are fulfilled after 31 March of the immediately preceding school year; paragraph 2 shall apply mutatis mutandis.
(5) At the request of the school, the Regional Office may, in exceptional cases, in cooperation with the founder and with the agreement of the Ministry, include a school which does not fulfil the conditions laid down in the second sentence of paragraph 1.
(6) The designated school provides language training in a personal way. The Regional Authority shall determine which of the designated schools will also provide language training in a distance manner.
(7) The Regional Authority shall publish a list of designated schools in a way that allows remote access, including whether the school also provides language training in a distance manner and, where appropriate, additional information on the mother languages of the pupils and the age of the school.
§ 11
Classification of a pupil in the language preparation group
(1) The Director of the Dedicated School will place a stranger in the group for language training, who has completed compulsory schooling at a school in the Czech Republic no more than 12 months before the application.
(2) The pupil is included in the language preparation group at the request of the legal representative. The application of the legal representative of the pupil shall include a communication as to whether the pupil will participate in the language preparation in person or in a distance manner.
(3) The school director shall include the pupil in the language preparation group no later than 30 days after the application.
(4) Pupils of the Pupils of the Pupils shall take part in the language training in person at the Pupils of the Pupils. If it is not possible to form a group for language preparation with personal participation or more suitable for the pupil, the pupil may participate in language training at a distance at the school or in a person or distance at another designated school chosen by his / her legal representative, provided that the school is in the same region as the school in which the pupil performs compulsory schooling.
(5) A school pupil who is not a designated school may participate in language training in person or in distance at a designated school chosen by his legal representative. Only a designated school can be chosen which is in the same region as the student's school.
(6) The school director does not need to include another school's pupil in the language preparation group unless the school's spatial conditions allow for inclusion. If the pupil cannot be classified according to the first sentence, the school director shall inform the Regional Office without delay, which shall ensure the language preparation of the pupil at another school. ';
footnote 10 is deleted.
4. After Paragraph 11, the following Sections 11a and 11b are inserted:
„§ 11a
Group on Language Preparation
(1) The Director of the Dedicated School establishes a group or groups for language preparation.
(2) The principal of the school in which the pupil performs compulsory schooling shall inform the legal representative of the pupil referred to in Article 11 (1) within one week of the admission of the pupil to school of the possibility of language training and the organisation of such education.
(3) The groups for language training are set up by the Director of the DPO in particular for pupils participating in language training in person and for pupils participating in language training in a distance manner.
(4) The language training group shall have a minimum of 1 and a maximum of 10 pupils as referred to in Article 11 (1), except for the first language training group with a given training method as referred to in paragraph 3, which shall have a minimum of 2 and a maximum of 10 pupils as referred to in Article 11 (1). Another language training group with a given training method as referred to in paragraph 3 may be set up if 10 pupils are included in each of the existing groups under Paragraph 11 (1).
(5) On the basis of the assessment of the need for language support, the school director may include pupils other than those referred to in Section 11 (1), even in a higher number than 10, unless this is detrimental to the quality of language training of pupils under Section 11 (1).
§ 11b
Organisation of language preparation
(1) The total length of the pupil's language training is at least 100 hours and not more than 200 hours for a maximum period of 10 months. The length of language training shall be determined by the school director in which the student will participate in language training, according to the knowledge of the pupil certified before the start of language training. In justified cases, the length of language preparation may be repeatedly extended up to the maximum total length of language preparation of 200 hours.
(2) Language training takes place at the time of teaching. The pupil is released from teaching which overlaps with language preparation. If this is more appropriate for the pupils concerned in terms of their education, language training may take place outside the teaching, with the agreement of the legal representatives of all pupils in the language training group.
(3) The school will provide the student with access to information technology for participation in language preparation in a distance manner.
(4) Language training is recorded in the documentation of the school in which the pupil performs compulsory schooling.
(5) The school in which the pupil performs compulsory schooling and the designated school cooperate with each other and provide information on the pupil and on the course and results of the pupil's language training. "
Čl. III
Transitional provisions
1. According to the rules for determining schools in § 10 (1) to (5) of Decree No. 48 / 2005 Coll., as effective from the date of entry into force of the Decree, the Regional Authority has been pursuing the determination since the school year 2022 / 2023. For the school year 2021 / 2022, the Regional Office, in cooperation with the organisers, shall designate at least 1 school in the administrative district of the municipality with extended competence to provide language training; In the course of the school year 2021 / 2022, the regional authority may, in cooperation with the organisers, make changes to the designation of schools in case of special consideration.
2. In the school year 2021 / 2022, the period according to § 11 (1) of Decree No. 48 / 2005 Coll., as effective from the date of entry into force of the Order, shall not exceed 24 months.
