Czech Socialist Republic
of 26 March 1975
on protection against floods
The Government of the Czech Socialist Republic orders pursuant to § 22 of the Act of the Czech National Council No. 130 / 1974 Coll., on State Administration in Water Economy:
Preliminary provisions
(1) Protection against floods is a set of measures to prevent and prevent damage to the lives and assets of citizens and society and the environment.
(2) The water catchment area means a temporary significant rise in the water flow level which threatens to pour water out of the trough or in which water is poured out of the trough and may cause damage; This applies mutatis mutandis to the presence of internal waters, the running of ice and the risk of the safety or stability of the water works.
(3) A flood risk shall be considered as a situation identified by the flood plans or, where appropriate, by the forecast flood service, in particular:
(a) when the specified water condition is reached at a rising trend in water flow;
(b) in the expected sudden melting according to meteorological forecasts;
(c) on smaller watercourses in high-intensity precipitation or in their immediate danger.
(4) Inner waters shall be considered as indoor waters which occur in the territory protected by water-based components in connection with floods, in particular water which cannot flow naturally under increased water conditions in the recipient.
Measures to protect against floods
Degree of flood activity
(1) A state of vigilance occurs at flood risk; if the causes of such danger are lost (first degree).
(2) At the time of its own flood, the alert status shall be declared on the basis of the data of the patrol service or, where appropriate, the reports of the forecast and reporting flood service or on the proposal of watercourses managers (second stage).
(3) In the event of an immediate risk of major damage or such damage, a state of danger (third degree) shall be declared.
(4) The state of emergency and the state of emergency are declared and withdrawn
(a) the local (urban) national committee,
(b) for the territory of several municipalities of the same district and for the territory of the district district of the national district,
(c) for the territory of several counties of the same region, for the territory of the region and at border flows, the Regional National Committee.
(5) The levels of flood activity, the details of the announcement and recall of the emergency situation and the state of danger are regulated by flood plans.
Types of flood protection measures
(1) The flood protection measures are:
(a) flood plans;
(b) flood inspections;
(c) forecast and reporting flood service;
(d) patrol service,
(e) flood protection and rescue work;
(f) accounting and documentation work.
(2) The scope of the measures to protect against floods is governed by the degree of flood risk and the development of a flood situation.
(3) The investment of flood protection facilities and the maintenance and repair of such installations, as well as flood-related investments, are not flood-protection measures within the meaning of this Regulation.
Flood plans
(1) The Ministry of Forestry and Water of the Czech Socialist Republic (hereinafter referred to as "the Ministry"), the national committees, bodies and organisations to which this is imposed by this Regulation or by the National Committee, draw up flood plans as the basic task of implementing flood protection.
(2) The flood plans include a detailed breakdown of tasks and, where appropriate, assistance from flood authorities, other institutions, organisations and citizens in implementing flood protection measures. The authorities and organisations shall draw up flood plans to the extent and breakdown corresponding to their needs and, where appropriate, flood protection tasks, or to the extent imposed on them by the national committee or ministry.
(3) National Committees shall coordinate and approve flood plans and, where appropriate, shall impose a complement to their flood protection needs.
(4) The Ministry coordinates flood plans from the point of view of the entire river basin and in agreement with the Ministry of Interior of the Czech Socialist Republic from the point of view of central management of flood rescue work carried out by fire units. The Ministry prepares a flood plan of the Czech Socialist Republic after consulting the authorities concerned.
(5) The approved flood plans are reviewed annually and supplemented and adapted as necessary; their amendments and additions shall be approved by the end of the calendar year.
Flood inspections
Surveying shall be carried out to determine whether there are no defects in the water flows and in the flood areas, or in the buildings or facilities situated in those territories or in the water works that could increase the risk of flooding. Flood inspections shall be carried out by flood authorities and other bodies and organisations according to flood plans at least once a year, as a rule before the spring melting period.
Prediction and reporting flood service
(1) The forecast flood service shall inform the flood authorities or other authorities and organisations, where appropriate, of the possibility of flooding and of other dangerous developments, of the hydrometeorological elements relevant for the generation and development of the flood, in particular of expected water conditions or of flows in selected profiles. This service is provided by the Prague Hydrometeorological Institute as instructed by the Ministry.
(2) The notified flood service warns the population at the flood site and at the places below on the water stream, draws the attention of flood authorities and other authorities and organisations to the development of the flood situation and sends the reports and reports needed to evaluate and manage the flood protection measures, as well as reports and reports on any damage or threat. The report flood service is organized and secured by the Ministry and the National Committees.
(3) The details of the organisation of the reporting flood services are regulated by flood plans.
Patrol service
(1) The patrol shall monitor the development of the flood situation and identify the data necessary for the performance of the reported flood service and for the management and coordination of flood measures.
(2) The patrol service is set up by local (urban) national committees at a time of flood risk, especially from among citizens.
(3) The details of the organisation of patrol services are regulated by flood plans.
Flood safety and rescue work
(1) Flood protection works are technical measures carried out on watercourses, or on watercourses or in flood areas at the time of the risk of flooding, flooding, or after flooding, if any, if there is a risk of further flooding, to mitigate the course of the flood, its harmful consequences and to protect the watercourses or objects.
(2) Flood protection work on water flows consists in particular of:
(a) agitation of ice cells and constipation on the water flow;
(b) the removal of drifting barriers to the smooth drainage of water in the water stream;
(c) in the protection of the natural riverbed and banks against flood-flow disturbances and measures to prevent water spillage in vulnerable areas;
(d) emergency securing of offshore tanks.
(3) Flood protection work on objects consists mainly of:
(a) measures to prevent the breach of the levees as a result of the penetration of water by their bodies or subjecting them;
(b) measures to prevent damage or, where appropriate, to destroy the levees by spill-over;
(c) removing obstacles in the profile of objects (passes, footboards, bridges, etc.),
(d) measures against reverse air;
(e) in the temporary closure of the dam opening.
(4) Measures to drain and, where appropriate, drain internal water and water from the flooded territory shall also be considered as flood protection work.
(5) Flood rescue work is measures carried out during floods in the immediately endangered or already flooded territories to save lives and property, in particular the protection and displacement of the population from these territories, care for them for the time necessary, the rescue of property and its transfer to the place of flood no longer threatened.
Registration and documentation work
(1) Evidence and documentation work is carried out to ensure objective records of the course of the flood, the implementation of flood protection measures, the cause and extent of damage and other circumstances related to flooding, such as the basis for assessing and evaluating the flood from the point of view of the hydrological and efficiency of the measures carried out and for the design of repairs, maintenance, where appropriate investments and other measures to protect against flooding.
(2) The following are in particular:
(a) records in the flood book;
(b) the labelling of the maximum water level achieved;
(c) photographic documentation of the flood situation;
(d) targeting and drawing of flooded territory, ice jams, riverbank and dam ruptures;
(e) post-flood inspection reports and summary and overall reports on the course of the flood.
Flood books
(1) The Flood Paper is a working journal kept by the flood authorities and organisations to which this Regulation provides for it; it shall include in particular:
(a) the verbatim text of the messages received, indicating the consignor, the manner and time of receipt (e.g. recording of the call),
(b) the literal text of the messages sent, indicating their source, addressees and the manner and time of dispatch;
(c) the content of the order;
(d) a description of the measures taken;
(e) the results of flood inspections.
(2) Entries in the flood register are carried out only by the persons responsible; are required to sign each entry.
Tasks of flood authorities
Local (urban) national committees
Local (urban) national committees in their territorial districts:
(a) approve the flood plans submitted to them and, where appropriate, impose changes to them and prepare, supplement and specify their flood plans and submit them to the relevant district national committees;
(b) provide, unless otherwise appropriate, for other bodies or organisations, labour and means of defence against floods, including means of property for fire protection units; keep lists of such means, ensure their appropriate storage and allow their use for other purposes,
(c) organise and provide a flood service, in particular to warn citizens in the municipality by local radio, sound signals, draw attention to the danger of the neighbouring municipality and the municipalities located below on the water stream and report the danger to the district national committee;
(d) carry out flood inspections;
(e) declare and recall, for their territorial district, the state of alert and the state of threat;
(f) at the time of flood risk, ensure the availability of the authorities, organisations and citizens and verify their preparedness according to flood plans, establish a patrol service, activate a system of reporting flood services and, if necessary, re-conduct flood inspections;
(g) organise, manage and coordinate flood protection measures carried out by other authorities, organisations and citizens and decide on the measures to be taken to mitigate the course of the flood and the damage that is at risk; take measures according to flood plans, in particular organise, manage and perform rescue work and, if necessary, require the fulfilment of general obligations (1) of organisations and citizens for personal and material assistance to protect against flooding;
h) ensure evacuation and return, temporary accommodation and catering of the evacuated population and ensure the transfer of the endangered property of the population;
(i) provide the necessary hygiene and health care and report to the district national committee the heating of wells;
(j) carry out post-flood inspections, identify the damage and effectiveness of the measures carried out, report to the District National Committees and carry out evidence and documentation work in accordance with the flood plan;
(k) monitor whether the authorities and organisations process, specify and supplement flood plans, carry out the tasks imposed by this Regulation or the flood authorities, if any, contained in flood plans, in particular how security works are carried out; impose the necessary measures when the deficiencies are identified;
(l) keep records in the flood book.
Regional National Committees
Regional national committees in their territorial districts:
(a) approve the flood plans submitted to them and, where appropriate, impose changes to them and prepare, supplement and specify their flood plans and submit them to the relevant regional national committees;
(b) provide, unless otherwise appropriate, for other bodies or organisations, labour and means of defence against floods, including means of property for fire protection units; keep lists of such means, ensure their appropriate storage and allow their use for other purposes,
(c) participate in the flood plans of the reporting flood service, in particular to inform the district national committees whose territorial districts lie on the water flow below, as well as the relevant regional national committee and workplace of the Prague Hydrometeorological Institute;
(d) declare and revoke the alert and threat status for their territorial district;
(e) at the time of flood risk, the other authorities and organisations shall, as appropriate, draw attention to the risk of flooding and ensure that they are achievable and, where appropriate, to their preparedness;
(f) organise, manage and coordinate flood protection measures carried out by local (urban) national committees and other bodies, organisations and citizens and decide on the measures to be taken to mitigate the flood and damage that is at risk; take action under flood plans, in particular organise, manage and perform rescue work and, where necessary, require the fulfilment of general obligations to protect against flooding;
(g) provide sanitary and health care, emergency supply of drinking water to the population and the rendering of flooded wells;
(h) concentrate the reports of local (urban) national committees on the outcome of the post-flood inspections, on the damage suffered and on the effectiveness of the measures taken to protect against floods and process summary reports on the flood for regional national committees and for the relevant Prague Hydrometeorological Institute with a proposal for action; carry out inspections of the territory of the flood concerned where necessary,
(i) monitor whether local (urban) national committees, authorities and organisations, as appropriate, draw up flood plans and fulfil the obligations imposed by this Regulation or by flood authorities, possibly contained in flood plans, in particular how security works are carried out; impose the necessary measures when the deficiencies are identified;
(j) organise training and training of relevant staff of local (urban) national committees and of authorities and organisations from their territorial districts on flood protection;
(k) keep records in the flood book.
Regional National Committees
(1) Regional National Committees in their territorial districts:
(a) approve the flood plans submitted to them and, where appropriate, impose changes to them and prepare, supplement and specify their flood plans and submit them to the Ministry;
(b) ensure that, unless otherwise appropriate to other bodies or organisations, labour and means of protection against flooding, they maintain lists of such means, ensure their appropriate storage and permit their use for other purposes;
(c) methodically direct and control training and training organised by district national committees and organise training and training of relevant personnel of district national committees on flood protection;
(d) manage and coordinate flood protection measures implemented by the district national committees and other authorities, organisations and citizens, and decide on the measures to be taken to mitigate the flood and damage that is at risk; take action according to flood plans, in particular to organise rescue work; require, where necessary, the fulfilment of general obligations to protect against flooding;
(e) declare and withdraw, for their territorial, border or territorial districts, a state of alert or a state of threat,
(f) monitor whether the district national committees, authorities and organisations, as appropriate, draw up flood plans and carry out the tasks imposed by this Regulation or the flood authorities, if any, contained in flood plans, in particular how security works are carried out; impose the necessary measures when the deficiencies are identified;
(g) concentrate reports on the flood situation and summary reports of the district national committees and submit an overall report to the Ministry with any proposal for the necessary measures; issue reports on the flood situation for the media,
(h) in the event of a danger of delay, the assistance of the Czechoslovak People's Army, the railway troops integrated into the Department of the Federal Ministry of Transport (hereinafter referred to as "the railway forces") 2) and the armies of the Ministry of Interior of the Czechoslovak Socialist Republic,
(i) keep records in the flood book.
(2) At border flows, they organise, manage, coordinate and control all flood protection measures of the relevant Regional National Committees.
Ministry
The Ministry shall direct and supervise the protection against floods, in particular:
(a) manage methodically the preparation of flood protection measures, in particular the processing, submission and approval of flood plans, the organisation of forecast and reporting flood services, the conduct of flood inspections, flood security and rescue operations;
(b) at the time of the flood, if the management of flood protection is not taken over by the Central Flood Commission, in particular the report flood service shall take part in the flood plans, shall oversee the implementation of safety and rescue work and shall prepare technical documentation for the possible takeover of flood protection management by the Central Flood Commission; In particular, it provides more extensive research and documentation work (aerial observation, imaging, etc.) and prepares general reports for the media.
Flood Commission
(1) The water commission of the national committees shall manage, coordinate and control flood protection in the national committee's territorial district since the announcement of emergency status. In order to perform their tasks in an operational manner, they shall form a staff member.
(2) If the area of the flood exceeds the territorial area of the local (urban) or district national committee, the management of flood protection shall be taken over in full by the flood committee of the national higher level committee; the date and time of the takeover shall be required to notify the flood committee of the lower level.
(3) The Central Flood Commission shall notify the Regional National Committees concerned of the date and time on which it took over the flood protection management in full. In order to carry out its tasks operationally, the Central Flood Commission shall establish a staff member. At the request of the Regional National Committee or its flood committee, the Chairman of the Central Flood Commission shall convene a committee.
(4) Local (urban) national committees establish flood commissions only if floods are possible in their territorial districts.
Tasks of other institutions, organisations and citizens
Watercourses managers
(1) Watercourses managers:
(a) process, supplement and refine flood plans and submit them to the district national committees and to the local (urban) national committees whose territorial circuits are flowing through them; small watercourses managers shall submit them after an assessment by a water-relevant water-flow manager whose water catchment area is small watercourses;
(b) provide for the labour force and the means of protection against flooding according to flood plans;
(c) in accordance with the flood plans, take measures for the safe discharge of water and ice and carry out flood inspections at the water stream according to those plans, as a general rule, together with the local (urban) national committee, whose territorial perimeter flows through the water flow;
(d) propose to the relevant national committees that they should impose on managers (users, owners) water works or other water-related properties the necessary measures to protect against flooding in the flood area;
(e) monitor at the water stream in particular the freezing process, the extent of frozen areas, the thickness of ice, the formation of dangerous ice cells, the melting process and, where appropriate, the operation of ice, and report on this according to flood plans; if they have a water control unit built, they concentrate these reports and transmit them to the competent workplace of Prague Hydrometeorological Institute,
(f) propose to flood authorities the announcement or withdrawal of an alert or a threat;
(g) if it is not the responsibility of the controllers (users, owners) of water works or other real estate, they shall carry out flood protection work on the water flow according to flood plans;
(h) direct the flow rates on water flows according to the handling rules to reduce the risk of flood damage; in so doing, they may, within the limits of the approved rules of handling, instruct the controllers (users, owners) of water works or other water-related properties;
(i) participate in the flood plans of the reporting flood service, in particular to inform the relevant water-relevant water-flow manager and the relevant hydrometeorological centre of Prague;
(j) after the flood, carry out, as a general rule with flood authorities, inspections of the watercourses they manage and report on the result to the competent workplace of the Prague Hydrometeorological Institute, to its superior authority or, where appropriate, to the water-relevant water-flow manager, whose water-flow water catchment area includes:
(k) carry out other tasks contained in flood plans, in particular providing technical documentation;
(l) keep records in the flood book.
(2) Water management authorities shall, in the light of their water management expertise, carry out the following additional flood protection tasks in addition to the tasks referred to in paragraph 1:
(a) assess flood plans of managers of small watercourses;
(b) process, supplement and refine flood plans for integrated river basins and submit them to regional national committees whose territorial competence covers most of the integrated basins;
(c) communicate expert water management opinions to flood authorities on the management and coordination of measures to mitigate the course of the flood, to water handling on water works exceeding the possibilities given by the handling order, and to remove ice cells and constipation by exceptional means;
(d) after the flood, prepare a summary report for the integrated river basin and submit it to the Regional National Committees whose territorial districts have been affected by flooding and the Ministry;
(e) in cooperation with the Hydrometeorological Institute Prague, care for selected signs of the highest water levels, significant ice jams and floods and record them, so that they can be used to specify flood plans and other flood protection measures.
Managers (users, owners) of real estate
(1) Managers (users, owners) of real estate on watercourses or in flood areas:
(a) process, supplement and refine flood plans concerning their properties and submit them to the national committee responsible for the management of the water flow and to the local (urban) national committee in the necessary extract;
(b) ensure the necessary means of property protection and store them in a suitable place; provide, as far as possible, the necessary workforce;
(c) at least once a year, but always before the spring melt period, examine the state of the buildings and their preparedness in terms of flood protection, in particular the state of all functional objects and equipment (floodgates, overflows, discharges, backair cover, etc.), as a general rule during flood inspections carried out by local (urban) national committees, and remove the detected defects;
d) upset, to ensure the smooth running of ice, ice cells around objects, especially water works,
(e) they shall manipulate the waterworks which may affect the course of the flood in such a way as to reduce the risk of damage, taking into account the expert water-management opinions of the water-management administrator; handling in excess of the approved operating rules requires the approval of the flood authority and also inform the relevant Prague Hydrometeorological Institute of all handling operations,
f) perform flood protection work on the building and rescue of persons and property that are at risk of flooding in the building,
(g) participate in the reporting flood service, in particular report to the watercourse manager on water conditions;
(h) carry out real estate inspections and a list of damage to the property and report to the national committees to which they submit flood plans and a copy to the local (urban) national committees;
(i) keep records in the flood book.
(2) Local (urban) national committees may waive the requirement to carry out the tasks referred to in paragraph 1 in respect of properties of less importance to ensure protection against floods; AIFMs (users, owners) of these properties may impose on them, in order to avoid or mitigate the harmful consequences of flood measures, proportionate to the value of real estate, unless another authority or organisation is competent to impose such measures.
(3) In the case of untaken-over buildings or their integrated parts on watercourses or in flood areas, the AIFM (user, owner) shall carry out appropriate tasks in the flood protection referred to in paragraph 1 by the investor and the contractor of the construction or, where applicable, the technological part of the construction, each in the section of his activity. The details shall be agreed in the economic contract.
Managers (users, owners) of other water-related or endangered or flooded property
(1) On water courses, the seafarers (users, owners) ensure the protection of vessels and gear used to sail against flooding; it follows the instructions of the authorities of the State Navigational Administration, the water flow manager and the flood authorities.
(2) Managers (users, owners) of property in the immediately threatened territory or in the flooded territory ensure its rescue, including any early harvest.
Public fire protection units
Public fire protection units shall carry out the tasks assigned to them by their superior national committees as flood authorities in order to protect against floods, in particular the management and implementation of emergency work interventions. Public fire protection units shall ensure proper treatment and, where appropriate, the storage of the means of storage entrusted to them for the performance of flood rescue operations. They shall draw up flood plans as necessary and submit them to their superior national committees.
National Security Corps services
In order to ensure protection against flooding, the flood authorities require the assistance of the National Security Corps services, in particular in the provision of communications, the protection of the health and life of citizens, the provision of public order and the protection of property.
