Ordinance on the establishment of medical fitness conditions for persons to operate railway and rail transport

DECLARATION
of 22 August 2023
on the laying down of medical fitness conditions for persons to operate railway and rail traffic
According to Section 66 (2) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 426 / 2021 Coll., ("the Act '), the Ministry of Health provides for the implementation of Sections 45 (3), 46d (2), 46f (3) and 66 (2) of the Act:
§ 1
This decree incorporates the relevant European Union1 regulations, following the directly applicable European Union1a regulation) and regulates the conditions of medical fitness of persons to operate the railway and railway transport and the way in which the assessment is carried out.
§ 2
(1) Conditions of medical fitness of the applicant for extradition
(a) the driver's licence shall include a medical examination to assess whether the applicant is suffering from a disease, defect or condition (hereinafter referred to as "disease") which would exclude or make medical fitness to drive a train vehicle on a national or regional track and conduct a traffic psychological examination for that applicant;
(b) a licence to drive a groove vehicle (hereinafter referred to as the "applicant for a licence") shall include a medical examination to assess whether the applicant is suffering from a disease that would exclude or condition medical fitness to drive a groove vehicle on a local, tram, special or rope track or on a tug.
(2) Conditions of medical fitness of the holder
(a) the driver's licence shall include the conduct of an initial medical examination, a periodic medical examination or an emergency medical examination to evaluate whether the holder is suffering from a disease which would exclude or condition medical fitness for the performance of the work consisting in driving a railway train national or regional, and, if the conditions for an emergency medical examination are met, and if the medical examiner considers it appropriate for the purpose of carrying out an emergency medical examination or in the light of the facts identified during an emergency medical examination, a transport psychological examination with that holder,
(b) a licence to drive a groove vehicle (hereinafter referred to as the holder of a licence) shall include an initial medical examination, periodic medical examination or an extraordinary medical examination to assess whether the holder is suffering from a disease which would exclude or condition medical fitness for the performance of the task of driving a groove vehicle on a local, tram, special or cableway track or on a tractor.
(3) Conditions of medical fitness of a person intending to pursue a work activity
(a) in the course of the operation of the runway and railway transport, it directly ensures the operation of the runway, provides or organises railway transport, and is guided by the shape, light and audible signs and signals and / or gives them, includes the conduct of an initial medical examination to assess whether the person is suffering from a disease which would exclude or condition medical fitness for the performance of the work;
(b) enter the road operated without supervision and does not participate directly in the security of the rail operator or in the provision or organisation of railway transport, including the conduct of an initial medical examination to assess whether the person is suffering from a disease which would exclude or condition the medical fitness to carry out such work;
(c) carry out revisions, inspections and tests of designated technical equipment, including the conduct of an initial medical examination to assess whether the person is suffering from a disease that would exclude or condition medical fitness to carry out such work.
(4) Medical fitness conditions of the person performing the work in which:
(a) in the course of the operation of the runway and rail transport, it directly ensures the operation of the runway, provides or organises railway transport and is guided by the shape, light and sound characteristics and signs, or gives them, including the conduct of a regular medical examination or an extraordinary medical examination to evaluate whether the person is suffering from a disease which would exclude or make the medical fitness to carry out such work;
(b) enter and do not participate directly in the security of the rail operator or in the provision or organisation of railway transport without supervision, including the conduct of a regular medical examination or an extraordinary medical examination to evaluate whether the person is suffering from a disease which would exclude or condition the medical fitness to carry out such work;
(c) carry out revisions, inspections and tests of the designated technical equipment, including regular medical examinations or exceptional medical examinations to evaluate whether the person is suffering from a disease which would exclude or condition the medical fitness to carry out such work.
§ 3
Medical examination of the applicant for a driver's licence
(1) The contents of the medical examination of the applicant for the issue of a driver's licence for the purpose of the issue of a licence shall be:
(a) the identification of his health and physical fitness with a targeted focus on diseases which exclude or make subject to medical fitness to drive a train vehicle on a national or regional track;
(b) a comprehensive physical examination, including an indicative examination of hearing, an examination of both eyes to determine the effectiveness of vision, in particular visual acuity and colour, an indicative examination of the visual field, an indicative neurological examination and a balance assessment, with a targeted focus on the detection of symptoms of diseases that exclude or condition medical fitness to drive a groove vehicle on a national or regional track;
(c) urinalysis, glycemia, indicative test for the presence of psychoactive substances, or other laboratory tests according to history and physical examination;
(d) electrocardiographic examination, neurological examination, including electroencephalographic, ear, nasal and cervical examination, including audiometric, eye examination, colour examination using the Ishihara test or any other recognised test; when recognizing colour shades, the test shall be based on the recognition of individual colours, not on relative differences, as well as eye background, spatial vision and shadow blindness;
(e) assessment of cognitive functions, in particular attention, concentration, memory, perception and judgement;
(f) assessment of psychomotor functions, in particular the speed of reaction and hand coordination; and
(g) assessment of communication skills.
(2) The scope of the medical examination of the applicant for the issue of a train driver's licence is further extended by the additional necessary professional examination by the doctor of the relevant specialised competence (hereinafter referred to as the "professional examination") requested by the assessor in the event that it is necessary to rule out the suspicion of a disease which excludes or makes the medical fitness to drive a train vehicle on a national or regional track, or to determine the stage of such disease.
(3) The technical examination shall be carried out to the extent necessary to assess the medical fitness of the applicant for the issue of a driver's licence to drive a railway train on a national or regional track. The conclusion of the technical examination shall state whether the applicant is able or unable to drive a railway vehicle on a national or regional track or whether a condition is proposed to allow the traction vehicle to be driven on that track consisting of:
(a) the use of the necessary medical device; or
(b) any other restriction; where there is another restriction on the condition of further professional examination, the date by which the applicant for the driver's licence is to be subjected to that examination shall also be indicated at the end of the professional examination.
(4) Diseases identified as part of a medical examination of the applicant for the issue of a driver's licence, which exclude or make subject to medical fitness to drive a railway vehicle on a national or regional track, are set out in Part A of Annex 1 to this Decree.
§ 4
Transport psychological examination and assessment of the transport psychological examination of the applicant for a driver's licence
(1) A traffic psychological examination shall be conducted to the extent that it is possible to assess whether the person under assessment is suffering from psychological difficulties, in particular in relation to his / her ability to work, and whether he / she shows other personality deficiencies which could jeopardise the safe performance of his / her work.
(2) In particular, the content of the transport psychological examination is an assessment of the anamnestic data, of the intellectual ability, of the perceptive and psychomotor abilities, of the personality characteristics and of the social psychological assumptions of the person under consideration.
(3) Transport psychological examination shall be carried out by means of a set of psychopaedic methods consisting of at least a standardised intelligence test, a standardised attention test, a standardised personality questionnaire and a semi-structured interview.
(4) The assessment of the transport psychological examination shall contain a conclusion as to whether or not the person assessed is mentally fit for the proposed activity. The opinion shall not contain specific findings resulting from the transport psychological examination.
(5) The validity of the assessment of a person's transport psychological examination shall be 1 year from the date of issue.
§ 5
Medical examination of the applicant for a licence
(1) The contents of the medical examination of the applicant for the issue of a licence shall be:
(a) the identification of his health and physical fitness with a targeted focus on diseases which exclude or make subject to medical fitness to drive a train vehicle on a local, tram, special or cableway track or on a tug;
(b) a comprehensive physical examination, including an indicative hearing examination, an examination of both eyes to determine the effectiveness of vision, in particular visual acuity and colour, an indicative visual field examination, an indicative neurological examination and a balance examination, with a targeted focus on the detection of symptoms of diseases that exclude or condition medical fitness for the driving of a groove vehicle on a local, tram, special or rope track or on a tractor;
(c) urinalysis, glycemia, indicative test for the presence of psychoactive substances, or other laboratory tests according to history and physical examination;
(d) electrocardiographic examination, neurological examination, including electroencephalographic, ear, nasal and cervical examination, including audiometric, eye examination, colour perception, eye background examination, spatial vision and blindness,
(e) an indicative assessment of cognitive functions, in particular attention and concentration, memory, perception and judgement;
(f) indicative assessment of psychomotor functions, in particular the speed of reaction and hand coordination; and
(g) indicative assessment of communication skills.
(2) The scope of the medical examination of the applicant for the issue of a licence is further extended by the additional necessary professional examination requested by the medical assessor in the event that it is necessary to rule out the suspicion of a disease which excludes or makes the medical fitness to drive a railway vehicle on a local, tramway, special or cableway track, or on a tractor, or to determine the stage of such disease.
(3) The professional examination shall be carried out to the extent necessary to assess the medical fitness of the applicant for the issue of a train-driving licence on the local, tram, special or cableway track or on a tractor. The conclusion of the expert examination shall indicate whether the applicant is able or unable to drive a railway vehicle on a local, tramway, special or cableway track, or on a tractor, or whether a condition allowing the steering of a railway vehicle on that track is proposed:
(a) the use of the necessary medical device; or
(b) other restrictions; if there is any other restriction on the condition of further professional examination, the date by which the applicant for the licence is to undergo that examination shall also be indicated at the conclusion of the professional examination.
(4) Diseases identified as part of a medical examination of the applicant for the issue of a licence which exclude or make subject to medical fitness to drive a railway vehicle on a local, tramway, special or cableway track or on a tractor are set out in Part A of Annex No 2 to this Regulation.
§ 6
Entry medical examination
(1) For the purpose of carrying out an initial medical examination of the driver's licence holder for the purpose of assessing his medical fitness for the performance of the work of driving a railway vehicle on a national or regional track, Article 3 shall apply mutatis mutandis.
(2) For the purpose of carrying out an initial medical examination of the licence holder for the purpose of assessing his medical fitness for the performance of his work, consisting of the steering of a railway vehicle on a local, tram, special or cableway track or on a tractor, Section 5 shall apply mutatis mutandis.
(3) The content of the entry medical examination of the person referred to in Article 2 (3) carried out for the purpose of assessing his / her medical fitness to work is:
(a) the identification of her state of health and fitness with a targeted focus on diseases which exclude or make subject to medical fitness for the work in question;
(b) a comprehensive physical examination, including an indicative examination of hearing, eye examination to determine the effectiveness of vision, in particular visual acuity and colour citation, an indicative examination of the visual field and an assessment of balance, with a targeted focus on the detection of symptoms of diseases that exclude or condition medical fitness for the performance of the work;
(c) urinalysis, glycemia, indicative test for the presence of psychoactive substances, or other laboratory tests according to history and physical examination;
(d) electrocardiographic examination, ear, nasal, cervical and ocular examination, colour examination using the Ishihara test or any other recognised test, if it is a person referred to in § 2 (3) (a);
(e) an indicative assessment of cognitive functions, in particular attention and concentration, memory, perception, logical thinking and communication, an assessment of psychomotor functions, in particular the rate of reaction and motion coordination, and an assessment of personality characteristics, in particular reliability, autonomy, conscientiousness and control of own emotions, when it comes to the person referred to in Article 2 (3) (a); and
(f) an eye and ear, nasal and cervical examination if it is a person referred to in § 2 (3) (b) or (c).
(4) Diseases identified as part of the initial medical examination of a person referred to in Paragraph 2 (3) which exclude or make subject to medical fitness for the work in question are set out in Parts A and C of Annex 3 to this Decree.
§ 7
Regular medical examination
(1) The content of a regular medical examination of the holder of the driver's licence, verifying whether his medical fitness to perform the work consisting of driving a train train on a national or regional track is:
(a) the identification of his state of health and physical fitness, with a targeted focus on diseases which exclude or make subject to medical fitness for the performance of his work, consisting of the driving of a railway vehicle on a national or regional track;
(b) a comprehensive physical examination, including an indicative examination of hearing, an examination of both eyes to determine the effectiveness of vision, in particular visual acuity and colour, an indicative examination of the visual field, an indicative neurological examination and a balance assessment, with a targeted focus on the detection of symptoms of diseases that exclude or condition medical fitness for the performance of the task of driving a railway train national or regional; and
(c) urinalysis, glycemia, an indicative test for the presence of psychoactive substances, or other laboratory tests according to history and physical examination.
(2) For the holder of a driver's licence older than 40 years of age, an electrocardiographic examination is included in the regular medical examination.
(3) The scope of the periodic medical examination of the holder of the driver's licence is further extended by the additional necessary professional examination requested by the assessor in the event that it is necessary to rule out the suspicion of a disease which excludes or makes the medical fitness to perform the work of driving a train vehicle on a national or regional track, or to determine the stage of such disease.
(4) The technical examination shall be carried out to the extent necessary to assess the medical fitness of the driver's licence holder to drive a train vehicle on a national or regional track. The conclusion of the expert examination shall state whether the holder is able or unable to drive a railway vehicle on a national or regional track or whether a condition is proposed to allow the traction vehicle to be driven on that track consisting of:
(a) the use of the necessary medical device; or
(b) other restrictions; where there is another restriction on the condition of undergoing further expert examination, the date by which the driver's licence holder is to undergo such examination shall also be indicated at the conclusion of the expert examination.
(5) The frequency of the periodic medical examination of the driver's licence holder shall be up to the age of 56 years 3 years and then 1 year, unless a shorter period of validity is specified in the medical opinion in the light of the driver's licence holder's medical condition.
(6) Diseases identified as part of a periodic medical examination of the holder of the driver's licence which exclude or make subject to medical fitness for the performance of the work of driving a railway train on a national or regional track are set out in Part B of Annex 1 to this Decree.
(7) In order to perform a regular medical examination of the licence holder, verifying that his medical fitness to perform the work of driving a train vehicle on a local, tram, special or cableway track is maintained, Article 5 shall apply mutatis mutandis, with the exception of the provisions of § 5 (1) (d) to (g). For a licence holder over 40 years of age, an electrocardiographic examination is included in the periodic medical examination. Diseases identified as part of a regular medical examination of the licence holder which exclude or make subject to medical fitness for the performance of a work consisting of the steering of a railway train on a local, tramway, special or cableway track or on a tug shall be as set out in Part B of Annex 2 to this Regulation.
(8) In order to carry out a regular medical examination of the person referred to in Article 2 (4), in order to verify that his or her fitness for the work in question is maintained, Article 6 (3) shall apply mutatis mutandis, except for the provisions of Article 6 (3) (d) to (f). For a person referred to in § 2 (4) (a) older than 40 years, an electrocardiographic examination is included in the regular medical examination. Diseases identified as part of a regular medical examination of a person referred to in Paragraph 2 (4) which exclude or make subject to medical fitness for the work in question are set out in Parts B and D of Annex 3 to this Decree.
Emergency medical examination
§ 8
(1) In order to carry out an emergency medical examination of the holder of the driver's licence, in which his medical fitness for the performance of the work consisting of driving a railway vehicle on a national or regional track is reviewed, Paragraph 3 shall apply mutatis mutandis, with the exception of the provisions of Section 3 (1) (d), taking into account the particular reason for carrying out an emergency medical examination.
(2) Extraordinary medical examination of the holder of the driver's licence shall be carried out
(a) on the basis of the regulation of the administrative department responsible for appeal (2),
(b) at the initiative of the railway operator or railway transport
1. after each accident at work following an accident involving persons,
2. after the period of incapacity for work following an accident involving persons,
3. where the person under consideration has been prohibited from working under another legislation (3),
(c) in the case of a decision by a medical assessor, in particular after a period of incapacity for work of more than 30 days; or
(d) at the initiative of the railway operator or railway transport operator or in the case of a decision by the assessor, where there is reason to doubt whether the person under assessment continues to satisfy the medical requirements for driving a railway vehicle on a national or regional track.
(3) If the conditions for carrying out an emergency medical examination of the holder of the driver's licence are fulfilled and if the assessor considers it appropriate for the purpose of carrying out an emergency medical examination or of the information found during an emergency medical examination, the driver's licence holder shall also be subjected to a transport psychological examination in accordance with Section 4.
§ 9
(1) In order to carry out an emergency medical examination of the licence holder, in which his medical fitness for the performance of the work consisting of the steering of a railway vehicle on a local, tram, special or cableway track, or on a tractor, Section 5 shall apply mutatis mutandis, with the exception of the provisions of Section 5 (1) (d), taking into account the particular reason for carrying out an emergency medical examination.
(2) Emergency medical examination shall be carried out with the licence holder:
(a) on the basis of the regulation of the Administrative Bureau of Tremors (4);
(b) at the initiative of the railway operator or railway transport operator, where their activity has shown medical deficiencies which may jeopardise the safety of the operation of the runway or railway transport,
(c) in circumstances where there is evidence of a change in medical fitness for the activity carried out, in particular at the initiative of any treating doctor, or prior to the start of the activity after a disease for which a change in medical fitness cannot be excluded or lasting for more than 8 weeks;
(d) following direct participation in an emergency, if requested by the authority responsible for the emergency investigation under the criminal rules;
(e) on the initiative of the rail operator or railway transport operator before the start of the activity for which the medical assessment has been carried out, after the interruption of work lasting more than 6 months.
§ 10
(1) In order to carry out an emergency medical examination of the person referred to in Article 2 (4), in which his medical fitness for the work in question is examined, Article 6 (3) shall apply mutatis mutandis, with the exception of the provisions of Article 6 (3) (d) and (f), taking into account the particular reason for carrying out an emergency medical examination.
(2) Emergency medical examination shall be carried out for persons referred to in Article 2 (4):
(a) at the initiative of the railway operator or railway transport operator, where their activity has shown medical deficiencies which may jeopardise the safety of the runway or railway transport;
(b) in circumstances where there is evidence of a change in medical fitness for the activity carried out, in particular at the initiative of any treating physician, or prior to the start of the activity after a disease for which a change in medical fitness cannot be excluded or has taken more than 8 weeks;
(c) following direct participation in an emergency, if requested by the authority responsible for the emergency investigation under the criminal rules;
(d) on the initiative of the rail operator or railway transport operator before taking up the activity for which the medical fitness assessment has been carried out, after discontinuing the work of more than 6 months.
§ 10a
(1) In the event of an emergency medical examination pursuant to § 9 (2) (c), the period for carrying out a periodic medical examination determined by the period of validity of the medical examination in the previous periodical examination pursuant to § 13 shall not be stopped or interrupted.
(2) In the event of an emergency medical examination pursuant to § 9 (2) (a), (b), (d) and (e), the new period for carrying out another periodic medical examination shall run according to § 13.
§ 11
The common procedures and medical fitness conditions for the operation of the railway and rail transport of persons referred to in Section 2 are set out in Annex 4 to this Decree.
§ 12
Medical evaluation
(1) A medical opinion on the medical fitness of persons for the operation of railway and rail transport (hereinafter referred to as the "opinion") shall be issued by the medical assessor after assessing the health status of persons referred to in Article 2 (hereinafter referred to as "the person under examination"), as determined by the medical examination and based on the evaluation of previous records in the medical file kept on the person under assessment, the health information communicated by their registered health service provider in the field of general medical practice, and, where appropriate, in the field of practical medicine for children and youth, and the results of other professional examinations requested by the assessor.
(2) The provisions of legislation governing occupational health services and medical documents5 apply mutatis mutandis to the content of the medical opinion.
(3) A person under assessment who has not been diagnosed with a disease which excludes his or her medical fitness for the purpose for which he or she has been assessed may be recognised as unfit.
(4) It shall be clear from the conclusion of the assessment whether the person under assessment is medically, medically or medically eligible for the purpose for which he was assessed. The medical condition assessed by the physician shall be clearly expressed in the opinion. The judgment must not contain a diagnosis of illness.
(5) The condition for the issue of the assessment is the submission of an opinion on a transport psychological examination, if the assessment concerns:
(a) the applicant for the driver's licence; or
(b) the holder of a driver's licence for which an emergency medical examination is to be carried out and where the assessor considers it appropriate to carry out a transport psychological examination for the purpose of carrying out an emergency medical examination or in the light of the information found during an emergency medical examination.
§ 13
Validity of the assessment
(1) The validity of the assessment of the driver's licence holder or licence holder is up to the age of 56 years 3 years and then 1 year, unless a shorter period of validity is specified in the opinion in respect of the health status of the person under assessment.
(2) The validity of the opinion for persons referred to in Section 2 (4), unless the opinion provides for a shorter period of validity in respect of the health status of the person under assessment, is:
(a) aged up to 18 years 1 year,
(b) between 18 and 41 years of age, from 41 to 62 years of age, 3 years of age and 1 year thereafter if the person carrying out the work referred to in Article 2 (4) (a) is a person;
(c) between the age of 18 and the age of 56, 4 years if the person carrying out the work referred to in Article 2 (4) (b) or (c), or
(d) from 56 years of age, 2 years of age, if they are a person carrying out work under § 2 (4) (b) or (c).
§ 14
Repeal
They shall be deleted:
1. Decree No. 101 / 1995 Coll., which is issued by the Order on the Health and Proficiency of Persons in the Operation of Railways and Rail Transport.
2. Decree No. 455 / 2000 Coll., amending Decree of the Ministry of Transport No. 101 / 1995 Coll., which issues the Order on the Health and Proficiency of Persons in the Operation of Railways and Railway Transport.
3. Decree No. 194 / 2005 Coll., amending Decree of the Ministry of Transport No. 101 / 1995 Coll., which issues the Order on the Health and Proficiency of Persons in the Operation of Railways and Railway Transport, as amended by Decree No. 455 / 2000 Coll.
4. Decree No. 305 / 2007 Coll., amending Decree of the Ministry of Transport No. 101 / 1995 Coll., published by the Order on the Health and Proficiency of Persons in the Operation of Railways and Railway Transport, as amended.
5. Part Two of Decree No. 16 / 2012 Coll., on the competence of persons driving a railway vehicle and persons conducting revisions, inspections and tests of designated technical equipment and amending Decree No. 101 / 1995 Coll., which gives rise to the Order on the Health and Proficiency of Persons in the Operation of Railways and Railway Transport, as amended.
6. Decree No. 33 / 2013 Coll., amending Decree of the Ministry of Transport No. 101 / 1995 Coll., which is published by the Order on the Health of Persons in the Operation of Railways and Railway Transport, as amended.
7. Decree No. 129 / 2017 Coll., amending Decree No. 101 / 1995 Coll., published by the Order on the Health of Persons in the Operation of Railways and Rail Transport, as amended.
8. Decree No. 149 / 2019 Coll., amending Decree No. 101 / 1995 Coll., issued by the Order on the Health of Persons in the Operation of Railways and Rail Transport, as amended.
Persons recognised as disabled or disabled, subject to a valid opinion issued pursuant to Decree No. 101 / 1995 Coll., as effective before the date of entry into force of this Order, shall be deemed to be disabled or disabled subject to the condition of that decree.

This Decree shall take effect on 1 January 2024.

Diseases which exclude or make subject to the medical fitness of the applicant for the issue of a driver's licence and of the driver's licence holder

1. Diseases that exclude medical fitness to drive a railway train national or regional identified as part of a medical examination of the applicant for the issue of a driver's licence or as part of an initial medical examination or exceptional medical examination of the holder of the driver's licence
(a) all types of infectious and parasitic diseases at the activity stage;
(b) malignant neoplasms;
(c) diabetes mellitus if it causes such health complications which are dangerous to traffic on the runway, in particular:
1. a second and other hypoglycaemia which occurs within 12 months of the first hypoglycaemia and which must be managed by another person, or
2. Second and other hypos that occur within 12 months of the first hypoglycemia that the applicant is unable to recognise (non-recognition syndrome),
(d) organic mental disorders;
(e) schizophrenia and schizophrenia disorders and delusions,
(f) mental retardation;
(g) excessive use and dependence on alcohol, medicines or other addictive substances;
h) epilepsy and other seizure conditions with impaired consciousness,
(i) systemic atrophy primarily affecting the central nervous system;
(j) extrapyramidal and movement disorders,
(k) demyelinating central nervous system diseases,
(l) degenerative disorders of the nervous system,
(m) disturbances of balance, dizziness,
(n) severe arrhythmias threatening the sudden loss of consciousness considered,
(o) ischaemic heart and vascular disease with complicated course or severe arrhythmias,
(p) post-cardioverter implantation conditions - defibrillator,
q) Heart failure NYHA III, IV or with severe heart rhythm disorders,
(r) vascular diseases of the brain with subsequent functional disorders;
s) repeated embolization from the venous system,
(t) discoloration,
u) a smaller range of visual field than in the horizontal of 80 degrees, inside 50 degrees, in the vertical up 40 degrees, down 60 degrees, spatial visual disturbances, nystagmus, hemoralopia,
(v) visual acuity in a better eye of less than 1,0 and in a worse eye of less than 0,5, even using corrective lenses, visual acuity is investigated for long, medium and short distances, diplopia, good contrast sensitivity, light-elasticity,
(w) intolerance to corrective lenses if necessary to achieve visual acuity;
(x) achieving the minimum visual acuity referred to in (v) using glasses with a force exceeding the spherical equivalent of + 5 / -8 dioptrii; colour contact lenses and photochromatic lenses are not allowed, UV filter lenses are allowed,
(y) hearing disturbances in air guidance examinations with a hearing threshold of less than 40 dB per 500 and 1000 Hz and a hearing threshold of less than 45 dB per 2000 Hz; or
(z) pregnancy in case of insufficient tolerability or pathological course.
2. Diseases identified as part of a medical examination of the applicant for the issue of a driver's licence or as part of an initial medical examination or exceptional medical examination of the holder of a driver's licence, where the medical fitness to drive a train vehicle on a national or regional track is subject to an assessment by a doctor with the relevant specialised competence and its positive opinion on the activity under consideration (hereinafter referred to as the "medical condition ')
(a) serious and decompensated conditions of infectious and parasitic diseases;
(b) neoplasm, if by size or location it causes organ function disturbances or makes body movement difficult:
