on occupational safety rules on a seagoing merchant ship
The Ministry of Transport and Communications provides, pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on Maritime Navigation, for implementation of § 33 (1) (m) of Act No. 61 / 2000 Coll., on Maritime Navigation:
§ 1
General provisions
(1) This decree lays down rules on occupational safety (hereinafter referred to as "the rules') on a seagoing merchant ship (hereinafter referred to as" the ship ').
(2) The rules are intended for crew members of a ship participating in a seagoing voyage, regardless of their function or classification.
(3) For the purposes of this decree:
(a) the competent person is the person who is competent to carry out the relevant activity on the ship;
(b) by an authorised person, the person responsible for carrying out the relevant activities on board the ship, or the legal person who is a member of the international association of classification societies.
(3) There shall be at least five copies of the rules on the ship, after one copy with the master, the first cabin officer and the first engineer officer; two further copies for training purposes shall be stored at the place specified by the master. A crew member shall be allowed access to a copy of the rules on request.
(4) A crew member shall be familiar with the rules in the form of periodic training and instruction and shall be obliged to adopt rules so that his knowledge of the rules is consistent with the function he performs on the ship.
(5) The verification of knowledge of the rules of the master of the ship, the first cabin officer and the first engineer officer shall be carried out before at least four members of the examination committee of the Maritime Office. Verification of knowledge of the rules of other crew members shall be carried out before a three-member examination panel appointed by the master. Knowledge of the ship's crew rules shall be verified regularly at least every two years. If a crew member demonstrates sufficient knowledge of the rules, the test committee shall issue a certificate of successful verification of the knowledge of the rules.
(6) To the extent appropriate to its participation in maritime navigation on board a ship, the person transported shall be familiar with the rules in the form of training before the ship leaves the port or works on the ship.
(7) The rules may only be violated if the ship is in distress or when working with the rescue of survivors; in such a case, the crew members of the ship shall follow the instructions of the rescue director.
§ 2
(1) The working time limits on the ship to ensure the safety of the crew members' work shall be respected as follows:
(a) maximum working time
1. 14 hours during any 24-hour period, and
2.72 hours during any seven-day period;
or
(b) a minimum rest period not less than:
1. 10 hours during any 24-hour period, and
2.77 hours during any seven-day period.
(2) The rest period may be divided into a maximum of two parts, one of which shall be at least six hours long, and the interval between consecutive rest periods shall not exceed 14 hours.
§ 3
(1) Any security risk to the person or crew of a ship (hereinafter referred to as "person") working on board a ship must be adequately assessed and eliminated or reduced to the lowest possible extent by the responsible lead employee.
(2) A member of the crew of a ship must carefully study the instructions for its operation before commencing work with the new equipment.
(3) A person carrying out any activity on board a ship shall carry it out effectively and safely, even if all the details of any necessary action are not explicitly stated in the rules. This activity must be carried out in a manner that does not expose any other person to danger.
(4) Machinery and machinery should be used only for the purpose for which they are intended and in accordance with the manufacturer's instructions. In the presence of a risk to safety, caution should be exercised.
(5) No one shall disconnect, remove or damage any safety device without being duly authorised to do so.
(6) Unauthorised persons shall be prohibited from entering the premises of the ship.
(7) The person transported who is not directly involved in the work on the ship must, for reasons of his own safety, monitor the activity carried out on the ship.
§ 4
(1) A person who ascertains any malfunction or deficiency on board a ship must immediately report this to a guard officer who shall take the necessary precautions.
(2) A member of the crew of a ship must have at his disposal appropriate personal protective equipment, use it in accordance with this decree and deposit it at a designated location after the completion of the work.
(3) In suitable places on board, in the engine room and in the kitchen, first aid boxes shall be provided. The equipment of pharmaceuticals shall be regularly checked by the holder of the extended first aid certificate and supplemented as necessary.
§ 5
Health and hygiene
A person participating in a seagoing voyage on a ship shall, in any activity on a ship, be responsible for his or her health and comply with the sufficient level of purity and hygiene and the rules set out in Annex 1.
§ 6
Fire prevention measures
A person participating in a seagoing voyage on a ship shall, in any activity on a ship, be obliged to prevent the occurrence of fires and comply with the rules set out in Annex 2. The commander of the ship, the officer responsible for a specific operation, may decide to use other special protective clothing and equipment.
§ 7
Personal protective equipment
A crew member shall have at his disposal appropriate personal protective equipment. Personal protective equipment shall be used by the crew member of the ship in accordance with the rules set out in Annex 3.
§ 8
Entry to ship and movement on board ship
Entry into the ship and movement on board the ship shall be governed by the rules set out in Annex 4.
§ 9
Entry into enclosed or otherwise dangerous spaces
Entry into enclosed or otherwise dangerous spaces shall be governed by the rules set out in Annex 5.
§ 10
Manual lifting of loads and tools and materials
A person participating in a seagoing voyage on a ship shall comply with the rules set out in Annex 6 when lifting loads by hand and working with tools and materials.
§ 11
Welding work
Welding works shall be carried out in accordance with the rules set out in Annex 7.
§ 12
Painting, altitudes, boat side and lifeboats
Coating, altitudes, side and lifeboats shall be carried out in accordance with the rules set out in Annex 8.
§ 13
Anchor and tether operations and towing
The anchorages and towing operations shall be carried out in accordance with the rules set out in Annex 9.
§ 14
Work with lifting equipment, shelters and cargo spaces of a ship
Works with lifting equipment, shelters and cargo spaces of the ship shall be carried out in accordance with the rules set out in Annex 10.
§ 15
Engineering work
Works in Engineering shall be carried out in accordance with the rules set out in Annex 11.
§ 16
Radio and electronic equipment operators
Radio and electronic equipment shall be operated in accordance with the rules set out in Annex 12.
§ 17
Kitchen work and food handling
Kitchen work and food handling shall be carried out in accordance with the rules set out in Annex 13.
§ 18
Working in the ship's laundry room
The work in the ship's laundry room shall be carried out in accordance with the rules set out in Annex 14.
§ 19
Works on ships for bulk cargo and container transport
Works on ships for bulk cargo and transport of containers shall be carried out in accordance with the rules set out in Annex 15.
§ 20
Efficacy
This Decree shall take effect on 1 February 2001.

HEALTH AND HYGIENE RULES

(a) Open wounds and abrasions must be immediately cleaned and first aid provided as necessary.
(b) Vaccination must be maintained according to the requirements of the target geographical area.
(c) Medicinal products must be administered to crew members, i.e. antimalariums, on a ship bound to the malaric areas, which are prescribed for this purpose by the competent attending physician, at the doses specified by him. In order to evaluate the current epidemiological condition in the tropical region, the doctor designated by the Maritime Authority pursuant to § 48 (2) of Act No. 61 / 2000 Coll. Effective prophylaxis varies according to the geographical area depending on the resistance of the disease agent.
d) The oil must be carefully washed from the skin but not with organic solvents. The working clothing must be kept clean and washed as necessary. You can't put oil-stained clothes in your pockets.
(e) When working with skin, hair, bones, horns, hooves or other parts of animals, it is necessary to work with them in a safe environment to prevent anthrax disease and to use personal protective equipment consistently. If the animal products are contaminated with anthrax spores, they must be disposed of by incineration and disinfected with spores based on chlorinated aldehydes.
f) Rodents and other potential carriers of infections should not be handled without gloves.
(g) Any exposure or direct contact with toxic chemicals and preparations shall be reported immediately and corrective measures taken.
h) When working with synthetic cleaners or detergents, PVC or rubber gloves shall be used.
(i) When working with chemical corrosive and harmful substances, working procedures must be followed to minimise the risk of damage to health.

(a) When working in an environment with high humidity and temperature, workers must be provided with a sufficient quantity of protective drinks corresponding to the loss of fluid by sweat and breathing. Protective drinks are also provided when working in an environment with a temperature of 5 ° C or lower. The protective drinks must be healthy, have appropriate taste characteristics and temperature, must not contain more than 6,5% by weight of sugar and must not exceed one percentage by weight.
(b) In the work referred to in (a) it is necessary to consume an increased amount of salt, in particular by taking two salt tablets 4 times a day, by using a teaspoon of kitchen salt dissolved in a glass of water each morning and evening or by adding an appropriate amount of salt to the eaten food.
(c) In tropical areas in particular, direct sun stays should be avoided as far as possible, especially in the hottest parts of the day. In the sharp sun, it is possible to work only in clothing protecting the head and body regardless of the degree of acclimation.
(d) Work carried out under hot and humid conditions, cold or working where personal protective equipment is used to protect the respiratory system must be interrupted by breaks and workers must be allowed to stay in appropriate resting areas. A working site with insufficient natural ventilation shall have adequate forced ventilation.
(e) Fresh fruit and vegetables must be carefully washed in a drinking water solution with hypermanganese before consumption.
(f) Only with a personal protective device to protect the respiratory system may be entered into the space where asbestos dust is present.

- Maintenance of ship's interiors
(a) Any unusual damage to the ship and its accessories shall be removed as soon as they are detected.
(b) If, during the journey, the panels, covers or insulation containing asbestos are released or damaged, the repair of damaged parts containing asbestos fibres shall be secured by effective means to prevent further release of asbestos. Such repairs may only be carried out by designated personnel who have been familiar with the conditions of asbestos work and equipped with appropriate protective equipment, including the storage and disposal of asbestos dust and the use of protective equipment.
(c) Intermittent lighting indicating a failure on a line or cap which may cause electric shock or fire shall be immediately inspected by the authorised person and the defects removed. The missing filament lamps must be completed immediately.
(d) The labels, warnings and operational indications shall be legible and kept clean.
(e) Heavy objects, including furniture, shall be securely secured against movements of the ship or unwanted spontaneous relocation.
(f) The door shall be properly secured and shall not move freely.
(g) Waste shall be treated in such a way that they cannot present a risk of fire, cause slip or be a source of other danger.
(h) In carrying out any task, it shall be borne in mind that other persons may be at risk. Dangerous objects such as razor blades or burning butts must be disposed of safely.

- Health of dangerous substances
(a) Healthy hazardous substances are not only substances bearing warning labels in accordance with the IMDG Code (at hazardous costs or in ships' warehouses), but also a whole range of dust, smoke, spores from fungi and plants or substances produced during work on board ships, in particular substances that threaten health by inhalation.
(b) When working with or near dangerous substances, all risks arising from such work must be properly assessed and appropriate measures taken to eliminate or limit them to a minimum. The evaluation must take into account all necessary preventive measures for the crew of the ship and other persons (e.g. port workers and maintenance or repair personnel in the port).
(c) The crew of the ship must be trained and trained to understand and know the risks associated with the work with dangerous substances, the measures to be taken and have been able to properly assess the possible consequences of the risk to which they are exposed.
(d) The risk assessment shall be carried out taking into account the type, concentration, form and potential harmful effects of the dangerous substance, including its harmful products, the likelihood of manual handling of the dangerous substance and the number of persons and crew members carried and likely to come into contact with the dangerous substance. The risks must be considered separately for each position on the ship. Each risk must be assessed individually.
(e) The risks for the purposes of this Order shall be shared as follows:
1. insignificant - no further measures are necessary if the conditions do not change,
2. significant - urgent and long-term measures needed,
3. Currently under control - measures are needed to maintain or strengthen control if the risk is to increase at a later stage,
4. unspecified or unknown - the degree of exposure or risk from exposure must be determined, where appropriate, by an expert invited; caution is required until then.
(f) For ships' stocks, when determining the risk, it shall be based on the manufacturer's instructions and the description of the goods.
(g) Where conditions are changed as a result of a substantial change in the circumstances in which the level of risk has been established, a new risk assessment must be carried out.
(h) Specific dangerous substances (asbestos dust, dangerous gas, hazardous substances occurring during work in enclosed or confined areas) shall be required to apply specific measures taking into account their characteristics.

- Asbest dust
(a) The positions on the ship known or presumed to contain asbestos shall be identified and visibly marked. Crew members working regularly in the vicinity of asbestos or in places likely to contain asbestos shall be warned of increased caution.
(b) A member of the crew of the ship shall report any deterioration or change in the status of the ship known or presumed to contain asbestos, in particular cracks or crumbling asbestos.
(c) Where practicable, asbestos must be removed. 1) Removal must be carried out in port by a specialist in the removal of asbestos.
(d) If it is necessary to carry out emergency repairs during the voyage where asbestos dust is produced, strict protective measures shall be followed, including the use of adequate protective clothing and respiratory equipment.

(a) Spray and empty spray containers shall not be used or placed near open fire or other heat sources.
(b) Empty spray containers must be disposed of safely.

- Smoking
(a) Smoking on a boat outside the reserved premises is prohibited.
(b) Places on the ship where smoking is permitted shall be equipped with ashtrays or other appropriate containers. Burning or smoldering objects, non-extinguished butts and matches shall not be thrown by the side of the ship. Burning butts must be disposed of safely.
(c) In all parts of the ship where smoking is prohibited, conspicuous warnings of this measure shall be provided.
d) Smoking in bed is forbidden.

- Electrical and other equipment
(a) Unauthorised persons shall not handle electrical equipment.
(b) Electrical appliances owned by crew members of ships or persons carried on board ships may be connected to the ship's network only with the consent of an electrical officer or a responsible engineer.
(c) Defects on equipment and distribution which are part of the ship's equipment must be reported immediately.
(d) Electrical equipment shall be securely fixed and, if feasible, supplied via permanent connectors.
(e) Flexible conductors shall be as short as possible and arranged in such a way as to avoid stalling or breaking during operation.
(f) Inappropriately modified plugs, sockets and fuses shall not be used.
(g) Circumstances shall not be overloaded.
(h) Portable electrical appliances shall be disconnected from the network after end of use.
(i) Electric heaters shall be fitted with suitable protection permanently attached to the heater and shall be permanently protected in designated locations. Provisional equipment for hanging clothing above heaters and drying clothing on heaters shall not be used. Drying of clothing shall only be carried out when the equipment is safely designed.
j) When using drying rooms or similar equipment, ventilation holes shall not be obstructed by overfilling the drying area. All covers and fine sieves belonging to these openings shall be regularly checked and cleaned.
k) Portable heating units shall not be placed on wooden floors and bulkheads, carpets and linoleum without thermal insulation by a protective plate of non-flammable material. Portable heating units shall be provided with appropriate covers and, when these bodies are placed in a cabin or other places, shall be sufficiently far away from furniture and other equipment. The drying of clothing on these bodies is prohibited.
(l) The design and installation of electric heaters on ships shall comply with the manufacturer's instructions.
m) Portable heating units owned by crew members of ships or persons carried shall not be used on board the ship without the consent of the authorised person.
n) Items (e.g. laundry or wet clothing) which could cause fire shall not be placed on or near heating bodies (bulbs).

- Self-ignition
(a) Pollutant waste, rags, sawdust and oiled and other similar materials shall not be left lying around. These materials must be stored safely until they can be safely disposed of.
(b) Materials in ships' warehouses, laundry, blankets and other absorbent substances shall be safely stored in rooms with suitable ventilation.
(c) If the materials referred to in (b) are wet, they must be dried before re-entry, if they soak in oil, cleaned and dried or destroyed.
(d) The materials referred to in (b) shall not be stored near or near oils or paints and on or near steam pipes.

- Machinery spaces
(a) The crew members of the ship must still be in charge of the fire prevention measures. Such measures include, in particular, the maintenance of purity, the prevention of fuel and oil lees and the removal of any flammable material from risk points.
(b) Metallic containers shall be established for the storage of used cotton waste, cleaning rags and similar materials. The contents of these containers must be safely disposed of at least every other day.
(c) Wood, paint, alcohol and oil cans shall not be stored in boiler rooms or machinery rooms.
(d) The electrical lines shall be securely maintained, clean and dry. The rated current for lines and fuses shall not be exceeded.

- Kitchen
(a) Burners and electric stoves shall be immediately switched off after the work has been completed. The smoke collection shafts, the fireplace and other similar devices must be kept clean.
(b) There shall be no overheating and spilling of fats and oils. In the vicinity of the stove, means for extinguishing burning fat or oil must always be prepared.

RULES FOR THE USE OF PERSONAL PROTECTIVE WORKERS

(a) The master of the ship shall ensure appropriate personal protective equipment for the crew. Protective clothing, helmet protection, gloves and suitable footwear is a work suit for most of the work on the ship, except for work involving specific risks.
(b) The master of the ship, the officer responsible for a specific action, may decide otherwise to use special personal protective equipment.
(c) Only functional pieces of protective equipment which are kept in good condition, clean and disinfected for health reasons shall be used. In the case of protective equipment, the manufacturer's instructions shall be securely stored and, if necessary, used before and during work.
(d) The person responsible shall check the status of personal protective equipment, in particular before and after use. They must ensure that everything is returned and stored in place. Personal protective equipment must always be checked by the user before the work begins.
(e) Those requiring the use of protective equipment shall be properly trained in their use and informed of their restrictions.
