on the modification of copyright fees for the issue of verbal works
The Ministry of Culture and Information shall, in agreement with the participating central authorities and with the senior creative workers' organisations pursuant to Article 13 (2) of Act No. 35 / 1965 Coll., on works of literary, scientific and artistic (hereinafter the "Copyright Act '):
§ 1
Scope
(1) This decree regulates the author's remuneration for the issue (paragraph 2) of a verb work (hereinafter referred to as "rewards") by the Czechoslovak publishing house (publisher), where copyright to the work belongs to the Czechoslovak citizen (hereinafter referred to as "author"). Remuneration in other cases shall be adjusted by free agreement of the Contracting Parties.
(2) Issue under this Order means making copies of a work by printing or similar means in a book or other similar form, provided that such copies are intended for public dissemination.
(3) This decree does not apply to remuneration for verbal works
(a) printed in periodicals,
(b) dramatic or musically dramatic, reproduced as a manuscript for theatrical operations;
(c) which forms part of the music business;
d) which forms part of the works of small graphics (coloring, cutting, printing, labels, etc.), leporel, postcards, posters and leaflets, theatre and other programmes, exhibition catalogues etc.,
(e) recorded on sound recording (image),
(f) in the form of graphic patterns (typograms).
§ 2
Method of determining remuneration
(1) The remuneration shall be determined in accordance with this Decree and the tariff, which shall include the standard rates and the percentage rates derived therefrom. The tariff list is annexed to this decree.
(2) Within the range of the base rate determined by the tariff, the remuneration is negotiated by agreement of the author with the publisher. In doing so, account shall be taken of the value of the work, of its social importance and of how it is used, of translation and of the difficulty of translation.
(3) The fees under this decree include fees for the contractual creation of the work (§ 27 of the Copyright Act).
§ 3
Remuneration under Part I of the Tariff
(1) For the issue of the works referred to in part The fee shall also be calculated using the agreed rate (Paragraph 2 (2)) according to the scope of the work and the number of copies issued constituting the publishing standard ("the standard ').
(2) For the number of copies issued constituting the first standard, the author shall be entitled to the remuneration agreed within the range of the basic rate, for each additional whole standard he shall be entitled to the remuneration specified in the tariff as a percentage of the agreed standard rate.
(3) For the number of copies issued which do not fulfil a whole standard, the author shall be entitled only a proportion of the remuneration which would be due to him under paragraph 2 for the whole standard. In the first issue of the work, however, the author and the incomplete first standard are paid as a whole.
(4) For the issue of the work of a Czechoslovak citizen of a Hungarian, German, Polish or Ukrainian (Russian) nationality in his native language, or for the issue of a translation of a Czechoslovak citizen's work from a Czech or Slovak language to a language of those nationalities, a remuneration shall be established according to the standard set out in the tariff for the issue of the work in the Slovak language.
§ 4
Remuneration under Part II of the Tariff
(1) For each individual issue of works listed in Part II of the Tariff, the remuneration shall be calculated using the agreed rate (Paragraph 2 (2)) according to the scope of the work and the order of issue.
(2) The first issue shall be subject to the fee agreed with the author within the limits of the basic rate; for each subsequent issue, the remuneration determined in the tariff shall be the percentage of the agreed base rate.
§ 5
Cargo and scope of the work
(1) Prints produced either at the same time or solely for technical reasons shall be regarded as the cost of one edition of the work.
(2) Prints produced successively for reasons other than production technical reasons shall be included in the load of one edition, provided that such an option has been agreed in the publishing contract and that the public dissemination of all parts of the agreed cargo starts within a period of 12 months; for book teaching aids for schools providing primary or secondary education and for works referred to in Part II of Section A tariff under item 4 may, however, be negotiated for a period of more than 12 months.
(3) The scope of the work means the number of copyright sheets *) or the number of verses contained in the work.
§ 6
The possibility of an increase in remuneration
(1) The remuneration for the fifth, sixth, seventh and eighth standards or for a part of them may be increased for each of these standards or parts of them up to the level of remuneration for the first standard or proportion of them.
(2) For any issue of particularly valuable and socially important original scientific and technical works listed in Part II of the Section A tariff under headings 1 to 3 may be increased by up to 20% by one-off remuneration due to the tariff.
(3) For any issue of a valuable translation of beautiful prose and scientific or professional literature into the Czech or Slovak language (Part II, Section B of the Tariff, with the exception of item 1b), the remuneration due by tariff may be increased
a) up to 10%, if the cost exceeds the cost of this edition in the Czech language 30 000 copies, in the Slovak language 15 000 copies,
b) up to 25% if the cost of this issue exceeds 50 000 copies in the Czech language, 25 000 copies in the Slovak language,
c) up to 35% if the cost of this issue exceeds 70 000 copies in the Czech language, 35 000 copies in the Slovak language,
d) up to 50%, if the cost of this edition exceeds 100 000 copies in Czech language, 50 000 copies in Slovak language,
e) up to 60%, if the cost exceeds the cost of this issue for translation into the Czech language 120 000 copies, into the Slovak language 60 000 copies.
§ 7
Special arrangements for determining remuneration
(1) For works listed in Part II of the Section A tariff under items 1 to 3 and Section C under item 1 to be created may be negotiated at the first issue of the tariff rates according to the scope of the work agreed in the publishing contract; the actual scope of the work does not affect the level of remuneration.
(2) An extract from a work already issued shall be awarded in accordance with the principles set out in Section 3 or Section 4, using the rate which would be due for the further issue of such work; Exceptionally, however, the application of the rate may be negotiated from the third or any other standard or third or any other issue. In the subsequent issue of the entire work, the prior issue of the work shall not be taken into account.
(3) The publication of verses or translations of verses contained in the text of works of original beautiful prose or in the text of works listed in Part II of the Tariff shall be remunerated within the limits of the rate (part I of the Tariff, items 2 to 4) according to the number of verses regardless of the amount of cargo. For the subsequent issue of verses so assigned or translation of verses, the remuneration shall be determined in such a way that the cost of each issue is considered to be one standard.
(4) The provisions of paragraphs 2 and 3 are without prejudice to the use of the work under Article 15 of the Copyright Act.
(5) For the current issue of a work in different language versions, small works in a directory or for the issue of a work the copies of which are intended to be distributed free of charge, a lower remuneration may be negotiated than is due under the provisions of this decree, in particular a fixed amount.
§ 8
Processing of work
(1) The remuneration for the issue of a new work resulting from the creative processing of another work (Section 3 (1) of the Copyright Act) is determined according to the schedule. However, where the work has been so worked out, the remuneration may not exceed 50% of the works listed in Part I of the Tariff and 75% of the remuneration calculated from the upper limit of the applicable rate in Part II of the Tariff.
(2) If the copyright of the original work persists, the remuneration shall be distributed between the author of the original work and the processor in their agreed proportion.
§ 9
Derogation of remuneration for further issues
(1) A different basis for the percentage calculation of the remuneration for the issue of the work, taking into account its value and the importance of society, may be agreed at the time of the issue.
(2) The work can be classified under a tariff heading other than that of the previous edition on the basis of a new evaluation or in a different manner of publication. When calculating the remuneration of the newly assigned work, all the copies of the work or all its previous edition pursuant to Paragraph 10 shall be added in respect of the new classification. For works referred to in Part II of the Section A tariff under headings 1 to 3 shall not be taken into account for their issue in the form of teaching texts for universities (scripts) or teaching aids referred to in Part II, Section A of the Tariff under heading 4.
(3) A remuneration higher than that due to the tariff may be fixed for substantially completed or substantially revised work, taking into account the extent of the adjustments made:
(a) for works referred to in part I tariff so that when calculating the remuneration, a rate of up to two standards shall begin; if, as a result, the first standard is to begin, the remuneration for the first standard can be only 90% of the basic rate,
(b) for works listed in Part II of the Tariff, up to 90% of the basic rate for the first issue of the work.
(4) For works remunerated according to the number of copies issued (part I of the schedule), the remuneration may be negotiated in such a way as to continue in the favourable order of the standards, for other works (part II of the schedule) the first substantially supplemented or substantially revised issue of the work for its first edition at all.
§ 10
Compilation of copies and issues
(1) To determine the remuneration, they are added up in the Czechoslovak state territory issued by
(a) any copies of the works referred to in Part I of the Tariff; However, if, before 1 April 1956 (for works in a language other than Czech or Slovak before 1 April 1960), more copies than 2 standards have been issued, only copies corresponding to two standards shall be added,
(b) any issue of works referred to in Part II of the Tariff; However, if there were more than two editions before 1 April 1956 (for works in a language other than the Czech or Slovak language before 1 April 1960), only two editions shall be added.
(2) Prints and editions are added separately in the following language groups:
(a) English,
(b) Slovak language,
(c) all other languages combined.
(3) The first standard or the first issue may be paid only once, for the issue in the original language in any language group. The language in which the work was first published, regardless of the language in which it was created, shall be regarded as the original.
(4) The publication of a work in a language other than the original language shall be remunerated separately in each language group, namely:
(a) for works referred to in part I tariff starting with the reward for the third standard, for Czech works published in Slovak translation and for Slovak works published in Czech translation, however, starting with the reward for the second standard; the third standard shall also apply to the issue of translations of Czech or Slovak works into one of the languages referred to in § 3 (4);
(b) for works listed in Part II of the Tariff, starting with the remuneration for the second edition.
§ 11
Printed copies
(1) At each issue of the work, the publishing house (publisher) is entitled to reprint over the agreed cargo of non-sales mandatory and working copies according to special regulations *) and authors' copies. These copies shall not be included in the issue load.
(2) Unless otherwise agreed in the publishing contract, at least one copy shall belong to the author (each of the co-authors of the works or to each of the authors of the works).
Transitional and final provisions
§ 12
(1) The provisions of the publishing contracts negotiated prior to the entry into force of this Decree remain unaffected; the calculation of the remuneration agreed in them (number of copies of one standard, order of standards or issue, percentage of the basic rate for another standard or for further issue, etc.) shall continue to be governed by the provisions in force until that time (Paragraph 14 (1)) if the work is issued by 31 December 1968. If the publishing contract was negotiated for more than one edition of the work, the calculation of the remuneration according to the current regulations is subject to only one issue.
(2) Where the number of copies of one standard is changed in relation to existing rules, the order of the standards shall be determined, if not in the cases referred to in paragraph 1, from the number of copies of the work issued, including copies issued before the date of its effectiveness.
(3) However, if, according to the new method of determining the number of standards (paragraph 2), there is a reduction in remuneration from the existing rules, the author may receive an increase in remuneration at the earliest single edition of the work by up to the amount of the difference between the remuneration calculated in accordance with the existing rules (Paragraph 14 (1)) and this decree.
§ 13
(1) In an agreement with the Ministry of Finance, the Ministry of Culture and Information may, where justified, authorise the negotiation of remuneration different from the provisions of Sections 2 to 4.
(2) The exceptions allowed under Section 12 of Decree No 97 / 1956 of the Ú. l., on the modification of copyright fees for literary works, as amended by Decrees No 14 / 1957 of the Ú. l. and No 44 / 1960 of the Coll., remain valid for extradition which takes place until 31 December 1968.
§ 14
(1) It shall be repealed:
(a) Decree of the Ministry of Culture No 97 / 1956 Ú. l., on the modification of copyright fees for literary works, as amended by Regulations No 14 / 1957 Ú. l. and No 44 / 1960 Coll.,
(b) Directives and proceeds governing fees for the issue of interim teaching texts, scripts, teaching texts and teaching instructions for schools or educational establishments of any kind, issued before the date of application of this Decree. *)
(2) This Decree shall take effect on 1 April 1967.

2) In exceptional cases, the standard may be reduced by 50% for new works of original poetry.
3) In exceptional cases, the standard may be reduced by 20% for new translations of poetry.
4) Including the remuneration for literal translation.
1) Under this heading, a remuneration may exceptionally also be agreed for university textbooks, which in their nature correspond to it.
1) For fees for translations which are particularly artistic or linguistic demanding, the upper limit of the rate may be increased by up to 25%.
1) In the scope of a critical study, preface or speech of less than one authorial sheet, due to the value and social importance of the work and considering the difficulty of creating it, the remuneration may be increased up to the amount corresponding to the remuneration for the whole copyright archive.
2) For the copyright sheet of the processed text; However, where the register is created by the author of the work to which the register belongs, it shall be remunerated as an integral part of the work.
