DECLARATION
of 27 July 2022
amending Decree No. 173 / 1995 Coll., on the issue of the Railway Regulations, as amended
The Ministry of Transport provides, pursuant to Article 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll., Act No. 64 / 2014 Coll., Act No. 319 / 2016 Coll., Act No. 367 / 2019 Coll., and Act No. 426 / 2021 Coll., (hereinafter "Act ') to implement § 22 (5), § 34 (7), § 35 (4), § 43c (9), § 43d (5), § 44 (1), § 46t (2) and § 49o (9):

Decree No. 173 / 1995 Coll., issuing the Railway Regulations, as amended by Decree No. 242 / 1996 Coll., Decree No. 174 / 2000 Coll., Decree No. 133 / 2003 Coll., Decree No. 57 / 2013 Coll., Decree No. 7 / 2015 Coll., Decree No. 253 / 2015 Coll., Decree No. 78 / 2017 Coll. and Decree No. 47 / 2018 Coll., is amended as follows:
1. In the introductory sentence, "§ 22 (2), § 35 (2), § 42 (3), § 43 (1), (4) and (5), § 44 (1) 'is replaced by" § 22 (5), § 34 (7), § 35 (4), § 42 (3), § 43c (9), § 43d (5), § 44 (1), § 46t (2), § 49o (9)'.
2. in Paragraph 1 (h):
"(h) a special vehicle driving a railway vehicle with a rated mass of more than 20 tonnes with its own propulsion, a driving railway vehicle, regardless of its own propulsion mass, enabling the railway vehicle to reach a speed of more than 10 km / h or a towed railway vehicle or a driving wagon designed for the construction, maintenance, repair or reconstruction of the runway, for the control of the track condition or for the removal of the consequences of incidents,";
3. In the last sentence of Article 4 (4), "Processing and use 'is replaced by" Use'.
4. In Article 4, the following paragraph 5 is added:
"(5) The track operator shall draw up and update track ratios to match the actual track condition. The updated tables shall be transmitted by the railway operator to the carrier operating the runway at least 21 days before the date of their validity, in electronic form in PDF format and with a data structure enabling automated XML processing. ';
5. In Article 5 (3), "twice the stopping distance of 1 000 m 'is replaced by" 2 000 m'.
6. The first sentence of Article 7 (1) shall read: "The signs of the main signals and of the separate signs in the transport and on the open line and the signs of the separate repetitive signs on the open line shall be visible from the standing leader of the train vehicle at least 100 m away and from the driver of the train vehicle driving the highest speed of leave for at least 12 seconds'.
7. In the first sentence of Article 7 (4): "The visibility of signs of separate repetitive signs in railway wagons with rail branching and the visibility of other variables of signals and their signals in transport and open line shall be at least 100 m; if the visibility of another runway vehicle is prevented, the visibility shall be at least 50 m. ';
8. Paragraph 9 (5) reads as follows:
"(5) When a train is driven under the full supervision of the European Train Safety System (14), the provisions of this Regulation on the time of visibility of signals, including the transmission of information on the signals to the leading railway vehicle, the braking distance, the braking percentage and the validity of the signals shall not apply. When a train is driven under the restricted supervision of the European Train Safety System (14), the maximum permissible speed of 120 km / h shall not be exceeded, without the application of the provisions of this Regulation on the transmission of signal information to the leading railway vehicle. The conditions of operation of the European Train Safety System set out in the directly applicable European Union14) shall be taken into account by the railway operator in the technological procedures for the operation of the runway and railway transport. ';

Article 2
9. In Article 11 (1), the words "automatic block and automatic gate or non-variable signals' are replaced by the words" or non-replaceable signals'.
10. in Paragraph 22 (2) (c), the words "and trains exclusively for the carriage of mail" shall be inserted after the words "including locomotives and sets for these trains."
11. The following Section 22a is inserted after Section 22, which includes the title:
„§ 22a
Conditions for the availability of the train path and operational technical characteristics of the runways in terms of their comparability
A track or part of a track shall be considered as an accessible train path between two identical track points using another runway with comparable operational technical characteristics.
(a) with a cross-sectional dimension, a track-side loading class and the permissible length of a train with the same or higher limits as the runway or part thereof intended for the priority allocation of runway capacity,
(b) equipped with an electrical traction, if the track or part thereof is intended for the priority allocation of the track capacity is equipped with an electrical traction; and
(c) the length of which does not exceed the length of the runway or part thereof intended for the priority allocation of the runway capacity by more than 60 km. ';
12. in Article 25 (3), "§ 27 (7)" is replaced by "§ 27 (8)";
13. in Paragraph 26 (5):
"(5) Each extinguished indicator, if not declared invalid or not extinguished by the operation of the signalling device, shall have the meaning of the most serious signal that the indicator may indicate. In the case of automatic operation without the presence of a person driving a railway vehicle, the trailer may be extinguished for the ride of the rail vehicle and may not be declared invalid. ';
14.Paragraph 27 (3) reads as follows:
"(3) The carriage of passenger trains must be managed by:
(a) train safety equipment by means of signals or information transmitted to the station of the person driving the railway vehicle;
(b) signals of light signals,
(c) a technical system for automatic operation;
(d) telephone communications;
(e) shuttle operation on a specified section of the line which is provided by a single passenger train in both directions along the same track;
(f) by order of a competent person managing railway transport; or
(g) driving by view. ';
15. In Paragraph 27, the following paragraph 4 is inserted after paragraph 3:
"(4) At the time of the reconstruction of the runway, the exclusive operation on a two-way track with a single-way automatic block shall be secured in such a way that only a single railway vehicle can enter it. The railway vehicle shall be equipped with a train protection device throughout its journey on such track and shall drive from such a track to regular right-hand one-way traffic in the specified direction. ';
Paragraphs 4 to 7 shall be renumbered paragraphs 5 to 8.
16. In Article 27, at the end of paragraph 8, the dot is replaced by "a 'and the following point (e) is added:
"(e) automatic operation without the presence of a person driving a railway vehicle.";
17. Paragraph 34 (3) reads as follows:
"(3) On a track in line sections with the exclusive operation of trains under the supervision of the European Train Safety System (14) or operated at a track speed exceeding 160 km / h, only a leading railway vehicle equipped with an active mobile part of the European Train Safety System (14) which is compatible with its track section used on that track may be used for the running of the train; This does not apply to the ride of a railway vehicle on an excluded track. ';
18. In Paragraph 34, the following paragraph 4 is inserted after paragraph 3:
"(4) A railway vehicle with a maximum permissible speed of at least 200 km / h may be used on a track built for a speed exceeding 250 km / h; this shall not apply to the carriage of a railway vehicle for the purpose of construction, maintenance, repair or reconstruction of the runway, the control of the track condition or the removal of the effects of an emergency. ';
Paragraph 4 shall become paragraph 5.
19. In Paragraph 34, the following sentence is added at the end of paragraph 5:
"In the case of a groove vehicle for which a marketing authorisation has been issued, the permissible wear limits shall specify the technical specification for interoperability 19) and the documentation necessary for the maintenance of the groove vehicle.
19) Commission Regulation (EU) No 321 / 2013 of 13 March 2013 concerning the technical specification for interoperability relating to the subsystem "rolling stock - freight wagons' of the rail system in the European Union and repealing Commission Decision 2006 / 861 / EC, as amended. Commission Regulation (EU) No 1302 / 2014 of 18 November 2014 concerning the technical specification for interoperability relating to the rolling stock subsystem - locomotives and rolling stock for the carriage of persons of the rail system in the European Union, as amended. Commission Regulation (EU) No 1304 / 2014 of 26 November 2014 concerning the technical specification for interoperability relating to the rolling stock-noise subsystem, amending Decision 2008 / 232 / EC and repealing Decision 2011 / 229 / EU, as amended. ';
20. In Paragraph 35 (1), at the end of point (p), the words "when driving in a occupied section of an automatic block, the speed of 40 km / h shall not be exceeded 'shall be added.
21. In Paragraph 36 (4), the first sentence shall read: "The length of the train shall not exceed a specified value for a given line section determined by the railway operator in the tables of track conditions or operational measures."
22. in Article 37 (7) and (8), the words "ERTMS / ETCS train protection system under European Union14)" shall be replaced by the words "European Train security system14";
23. in Paragraph 39 (1):
"(1) Each train shall be marked with a signal" Start of the train 'and a signal "End of the train'; If the train is in part, the towed parts of the train shall be marked with the" End of the train "sign and the last part of the train by the" End of the train. "'
24. In Paragraph 39 (2), the words' reduced visibility 'are deleted.
25. In Paragraph 40, at the end of paragraph 4, the dot is replaced by "a 'and the following point (g) is added:

26. in Paragraph 41, the following paragraph 3 is added:
"(3) In the case of automatic operations without a person being present, the driving railway vehicle shall control the automatic control and supervision of the safety of the operation of the runway and railway transport by the person controlling the railway transport through audiovisual and other technical equipment and to the extent specified by the technological procedures. The operation of these devices shall be recorded by recording equipment for at least 24 hours and the recording of data shall provide information on the sequence of events leading to an emergency which allows their subsequent analysis. ';
27. in Paragraph 44 (1):
"(1) When an emergency train is stopped on the line due to a fault on the train groove or on a technical system for automatic operation at which the train cannot reach the nearest station or the weaning or control track of the depot, the person driving the railway vehicle or the technical system for automatic operation shall be immediately signalled to the person controlling the track, which ensures further action according to technological procedures. In the case of automatic operation without the presence of a person driving a railway vehicle, the train shall be secured against movement and under the control of the person driving the railway vehicle until the arrival of the auxiliary train or the arrival of the person authorised to drive the train at the stop point, and shall not be tampered with. ';
28. in Article 47 (3), point (a) is deleted;
Points (b) to (e) shall be renumbered as points (a) to (d).
29. in Article 47 (4) (a):
"(a) driving against the tip of the track switch, unless it is ensured against undesirable displacement, the speed of driving when driving to the turn shall at the same time correspond to the curve geometry;"
30. Paragraph 49 (3) reads:
"(3) The runway of a rope shuttle intended for the carriage of more than 20 persons shall be:
(a) accompanied by a guide; This does not apply if it is equipped with a technical device to replace the guide and which will ensure, in particular, the monitoring of the passenger compartment; and
(b) equipped with a device for communication with the cableway controller. ';
31. Paragraph 59, including the title, reads:
„§ 59
Verification of compliance with the technical requirements for the safety of rail transport operation and environmental protection and verification of technical documentation of the railway vehicle and the operability of its components
The verification of compliance with the technical requirements for the safety of the operation of railway transport and the protection of the environment and the verification of technical documentation of the railway vehicle and the operation of its components shall be carried out in the framework of the technical safety test of the railway vehicle. ';
32. in Paragraph 60 (9), "registration" is replaced by "test report."
33. The heading of Section 61 reads:
"Technical requirements for the safety of rail transport operations and the protection of the environment which are a condition for type-approval of a vehicle '.
34. in Paragraph 61 (1), the words "railway, tramway and trolleybus tracks" shall be replaced by the words "local, special, tram or trolleybus or train track."
35. in Paragraph 61 (5), at the end of the text of the first sentence, the words "this shall also apply to the use of parts of a road vehicle of an approved type on a railway vehicle operating on a trolleybus track."
36. After Paragraph 61, the following Sections 61a and 61b are inserted:
„§ 61a
Data to be entered on the trailer licence
The licence of a groove vehicle, with the exception of a groove vehicle operated on a test track or a rope track, shall be registered.
(a) the registration number of the licence, the indication of the railway administration which issued it and the date of issue;
(b) the type, type, serial number, name and year of manufacture and modernisation of the groove vehicle, if any;
(c) details of the manufacturer who is the trading firm or name, registered office and identification number, if any, if it is a legal person, or the trading firm or the name or, where applicable, the names and surname and identification number of the person, if it is a natural person;
(d) the registration number of the groove vehicle;
(e) technical details of the groove of the vehicle;
(f) the reference number and date of issue of the vehicle type-approval decision;
(g) the company or name, identification number, if assigned, and the registered office of the legal person who carried out the technical security test, the date of the technical security test and the registration number of the test report;
(h) the date of entry into service of the groove vehicle and the year of modification of its structure, if any;
(i) the reference number and the date of the decision approving the change in the structure of the groove vehicle, representing a substantial deviation from the approved vehicle type, if approved; and
(j) the results of the periodic technical checks carried out on the groove vehicle and the date of their implementation.
§ 61b
Technical requirements for railway vehicles operating on a national or regional track in the event of non-application of the technical specification for interoperability
The technical requirements for railway vehicles operating on a national or regional track ensure the safe operation of the runway and rail transport shall be established in the event that the technical specifications for interoperability, Parts I and II of Annex 3 to this Regulation and Part I of Annex 4 thereto do not apply. ';
37. The heading of Section 62 reads:
"Essential deviations from the approved vehicle type and the scope and method of verification of compliance with the technical requirements for the safety of the operation of railway transport and the protection of the environment by the railway vehicle whose construction has been modified '.
38. in Paragraph 62 (1):
"(1) Compliance with the technical requirements for the safety of the operation of railway transport and the protection of the environment by a railway vehicle the construction of which has been modified in a manner which constitutes a significant deviation from the approved vehicle type shall be verified by a technical safety test, the implementation of which shall be carried out mutatis mutandis by Paragraph 60; the verification shall be carried out within a range corresponding to the change in the structure of the groove vehicle. ';
39. in Paragraph 62 (2), the introductory part of the provision reads: "A change which constitutes a substantial derogation from the approved vehicle type is an amendment."
40. in Paragraph 62 (2) (v):
"(v) installed technical equipment; This does not apply to the replacement of parts of designated technical equipment which are not part of the other equipment referred to in this paragraph, in which the functional characteristics or parameters of the designated technical equipment are not changed, or to the replacement of parts of designated technical equipment which are part of the construction of a road vehicle which is a contact vehicle operating on the trolleybus track, '.
41. In Paragraph 62, at the end of paragraph 2, the dot is replaced by "or 'and the following point (x) is added:
"(x) of the door type used, including their control, in the case of railway vehicles intended for the carriage of passengers.";
42. In Article 64 (5), the words "operating on a track other than national and regional and historical track 'shall be inserted after the words" technical inspection of the track'.
43. In Paragraph 64, paragraphs 6 and 7 are added:
"(6) A regular technical inspection of a railway vehicle operated on a national or regional track, which is not a historical track vehicle, shall be carried out by the person providing maintenance of the track vehicle as part of the maintenance system.
(7) The entry on the technical inspection carried out in accordance with paragraph 5 shall be recorded in the licence by the competent person who organised or carried out the check. In the case of a groove vehicle which does not have a licence and for which no authorisation for placing on the market has been issued, the carrier shall ensure that the date and mark of the inspection point are indicated directly to the designated place on the groove vehicle. ';
44. in Paragraph 65 (1):
"(1) The regular technical inspection of a railway train for a national, regional, local and tractor track for which no authorisation for placing on the market has been granted shall be verified if the vehicle is of an approved type and ensures its technical condition when the vehicle is properly used by its safe and reliable operation until the following periodic technical inspection. The scope of the check is set out in Annex 6 to this Decree. '.
45. in Paragraph 65, paragraphs 4 and 5 are deleted;
46. In the first sentence of Article 71 (4), "(base radio station) 'is replaced by" radio equipment'.
47. in Article 71 (5) (b), the words "in ETCS" shall be replaced by the words "for a European train safety system14";
48. Paragraph 76 (1) and (3) are deleted.
Paragraph 2 shall become paragraph 1 and paragraphs 4 to 6 shall become paragraphs 2 to 4.
49. In Annex No 1, Part I, point 7.1, the words "a column on which 'are replaced by the words" a column or a sign on which';
50. In Annex 1, Part I, point 9.2., the words "white pillar with blue header 'are replaced by the words" white pillar or sign plate with blue belt at the top'.
51. in Annex 1, Part I, points 11.1 and 11.2 read:

52. In Annex 1, Part I, point 15 reads as follows:
"15. European Train Safety System:
The European Train Safety System is only valid for a person driving a railway vehicle equipped with a mobile part of that system in operation. The European Train Safety System "Stop brand ETCS" shall be used for persons driving any railway vehicle regardless of the operation of the European Train Safety System. ';
53. In Annex No 1, Part I, point 15.1., the words "European Train Safety System 'shall be inserted after the words" Marking'.
54. In Annex 1, Part I, point 15.2. read:
"15.2. The European Train Safety System" Change of ETCS 'is a white square board with black frames, inside the top half the black inscription "LT', in the bottom half the" ETCS '. It shall indicate the location on the line where the area where the rail vehicle is driven under the supervision of the European Train Safety System of a different level begins and shall inform that the switched-on mobile part of the system to another level is controlled by the line part of the system.

55. In Annex 1, Part I, point 15.3 reads as follows:

65. Point 18 of Part III of Annex 3 reads as follows:
"18. The door shall be locked in a closed position and may be opened manually from the passenger compartment in the event of an emergency. At least half of the door on each side of the groove vehicle designed for automatic operation shall be equipped with a device enabling emergency opening of the door from the outside of the vehicle. ';
66. In Annex 3, Part III, point 20 reads as follows:
'20. All doors of the groove vehicle and of a set of groove vehicles intended for the entry and exit of passengers shall be operable from the position of the person driving the track vehicle; in the case of the automatic operation of trains, they shall also be operable from the railway traffic control centre. The closed position of all doors intended for the boarding and exit of passengers shall be actively indicated at the station of the person driving the railway vehicle. In the case of automatic train traffic control, the closed position of the door and the failure of the doors intended for the entry and exit of passengers shall be actively indicated to the control centre for the control of the railway transport. ';
67. In Annex 3, Part III, point 24, the following sentence is added after the first sentence: "In the case of the automatic operation of trains, the device for the manual control of the track vehicle may be located in a passenger compartment in such a place as to ensure the vision of the person driving the track vehicle in all necessary directions under all operating conditions. '
68. In Annex 3, Part III, point 26, the words "or technical system for automatic operation 'shall be added at the end of the text in point (d).
69. In Annex 3, Part III, the following points 30 to 32 are added:
"30. A railway vehicle operated automatically without the presence of a person driving a railway vehicle shall be equipped with:
(a) equipment for manual control of the vehicle against misuse;
(b) a two-way communication device between a passenger and an operational control centre accessible to persons with reduced mobility; and
(c) a system allowing visual monitoring of the passenger compartment and image transfer to the operational control centre.
31. In the case of automatic control of the track vehicle without the presence of a person driving the track vehicle, the operational condition of the train and the failure alarm shall be transmitted to the service control centre.
32. Railway vehicles which are automatically driven without the presence of a person driving a railway vehicle shall be subject to the requirements set out in this Part, mutatis mutandis, to their technical solutions and controls. ';
70. In Annex 4, in the title of Part I, the words ", local tracks' shall be inserted after the words" regional '.
