on company archives
The Ministry of Interior of the Slovak Socialist Republic provides in the agreement with the Slovak Academy of Sciences and the Ministry of Culture of the Slovak Socialist Republic pursuant to § 11 (1) of Decree No. 29 / 1954 Coll., on archiving:
Basic provisions
(1) The organisations designated by this decree concentrate all archive material, i.e. written, visual, sound and other records of permanent documentary value, arising from, or closely related to, the activities of the organisations and their legal predecessors, with historical or political, cultural and economic significance, which have been sorted in accordance with the rules on decommissioning ("archival").
(2) The archives of organisations stored in company archives are an integral part of their integrated scientific and technical and information base.
(1) Organisations shall, through their business archives, take care of the archives, in particular their storage in permanent archives, their protection, records, professional processing, making available and use for economic, technical, political, cultural and scientific purposes; supervise compliance with file manipulation rules and the elimination of documents in the central Registry and in the special Registry offices of organisations.
(2) The archives stored in the company archives are a socialist social property. They're protected by the law.
Establishment and management of business archives
(1) Business archives shall be established by the following organisations:
(a) centrally managed state economic organisations;
(b) centrally managed budgetary and contribution organisations where they carry out an economic activity;
(c) money and insurance organisations;
(d) production and consumer cooperatives and cooperatives set up by higher cooperative organisations.
(2) The Ministry of Interior of the Slovak Socialist Republic (hereinafter referred to as "Ministry of Interior") may, after consulting the organisation referred to in the previous paragraph (hereinafter referred to as "the organisation"), provide that, for reasons of effectiveness, the organisation is to store archives in the relevant state or district archives or in the Archive of the City of Bratislava or in the Archive of Košic.
The organisation may set up a branch of its company archive for its lower organisational component, if an urgent need so requires, in particular taking into account the importance of the archives for the activities of that branch or its distance from the company archive.
Organisations may conclude with a written agreement that archives will be stored in a common archive (a joint company archive) to be set up with one of them. The agreement shall be approved by the Ministry of the Interior after consultation with the authorities of the organisations.
An organisation which has set up a business archive (its branch), as well as an organisation with which a joint business archive is set up, is required to manage the archive, i.e. to provide its activities in a personal, financial, material technical and investment way, and to provide it with comprehensive assistance in its further development, in particular in such a way that the archive is effectively and appropriately located, as well as properly equipped for professional work with archives. The head (Director) of the organisation shall be responsible for establishing and managing the archive.
The costs associated with the establishment and management of the company archive (its branches) shall be borne by the organisation which set it up. If it is a joint enterprise archive, these costs shall be borne by the organisations for which it was set up, by the share agreed between them.
Disposal of documents in organisations and storage of archives in company archives
(1) The organisation is required to submit proposals for the elimination of written, pictorial, sound and other records (hereinafter referred to as "documents") to the relevant national or district (urban) archives or, if they so request, to the Ministry of the Interior. The organisation may surrender the discarded documents for destruction only after approval of the proposal.
(2) Collective raw materials undertakings or undertakings carrying out the industrial destruction of documents may not, to that end, take over the excluded documents without the written confirmation of the relevant national or regional (municipal) archive or of the Ministry of Interior that the documents may be destroyed.
(1) The archives in the company archives are separately recorded and stored separately from the documents in the central and special files. 2)
(2) Archives should be located in specific premises where they are secured before loss, theft, damage or destruction.
(1) The archives shall remain in the company archives for at least 30 years from their submission to the company archives. At the end of this period, the organisations will submit them to the relevant state or district (city) archives according to the guidelines of the Ministry of Interior. The method and detailed conditions for the submission and acceptance of archives are laid down by the state or district (city) archives.
(2) The costs of submitting archives to the state or district (urban) archives will be borne by the organisation from its own resources.
(3) The Ministry of the Interior may authorise an organisation with a properly equipped company archive to take permanent care of archives.
(1) If the organisation which manages the farm archive is cancelled and does not have a legal successor, the Ministry of the Interior shall decide, after consultation with the authority which ordered the cancellation of the organisation or, where appropriate, which organisation it has managed, in which state or district (urban) archives will be deposited from its business archive.
(2) If the organisation is divided or merged, the company archive should also be decided upon when delimitation takes place. The decision requires the approval of the Ministry of Interior.
Management of company archives
The head (Director) of the organisation shall entrust the management of the farm archive to the staff of the organisation competent to carry out the professional archiving work (hereinafter referred to as the "company archivist ') and to manage the activities of subordinate staff of the company archive (its branches).
(1) The company archivist is responsible for the correct storage, clarity and professional processing of archives. He shall in particular:
(a) to concentrate, process and make archives available, allow consultation and study of them within the limits of the Ministry of Interior directives in force, organise their use and keep records of the lending and return of individual archives;
(b) keep records of part of the Single Archive Fund of the Slovak Socialist Republic, stored in the company archive, protect the archives from loss, theft, damage, destruction or abuse and ensure their preservation.
(2) The company archivist is obliged to oversee compliance with the rules on file handling and the elimination of documents in the organisation and its organisational components.
(3) The company archivist shall, in his professional activity, comply with the regulations of the Ministry of Interior, 3) or the regulations of the superior central authority and the rules of the organisation.
Tasks of superior bodies
The central authorities issue standard file and shredding directives for organisations in their field of competence in agreement with the Ministry of Interior.
The bodies directly superior to the organisations shall supervise compliance with the rules on the establishment and management of company archives, as well as the proper registration of all sets of documents in the organisations' files. These authorities may entrust control over the activities of the company archives of their worker, who is subject to the Ministry of Interior rules on professional matters.
Supervision of the Ministry of Interior
(1) The Ministry of the Interior oversees compliance with the legislation governing the activities of the company archives and proposes to the competent authorities measures to address the deficiencies identified. Such supervision may be carried out through appropriate national or regional (urban) archives.
(2) Authorised officials of the Ministry of the Interior and of the State and, where applicable, of the district (urban) archives, if they are supervised in accordance with the provisions of the preceding paragraph, are entitled to enter the premises where they are located for the purpose of checking the state of the company archives and files.
Transitional and final provisions
(1) The organisation shall establish a business archive no later than five years after its establishment; However, if, in whole or in part, the archives of its legal predecessor are established at the same time, they shall establish a company archive.
(2) If an organisation not referred to in Paragraph 3 (1) has established a business archive before the entry into force of this Decree, it may continue to manage it if the agreement of the Ministry of the Interior so requests within 6 months of the date of the entry into force of this Order is obtained.
(3) However, if the organisation referred to in paragraph 2 does not intend to further manage or refuse the necessary approval, it shall deposit the archives concentrated in the company archive in the relevant state or district (urban) archives (4) within the time limit specified by that archive. This archive will also determine the manner and conditions of surrender and acceptance of archives. The costs associated with the submission of archives to the archives concerned shall be borne by the organisation concerned.

This Decree shall take effect on 1 April 1973.
