of 30 July 2019
amending Government Regulation No 75 / 2005 Coll., determining the scope of direct teaching, direct education, direct teaching and direct pedagogical and psychological activities of teaching staff, as amended, and Government Regulation No 123 / 2018 Coll., determining the maximum number of hours of teaching funded by the State Budget for primary school, secondary school and conservatory established by the region, municipality or association of municipalities
The Government mandates pursuant to § 23 (5) of Act No. 563 / 2004 Coll., on pedagogy workers and on the amendment of certain laws, and pursuant to § 161 (2) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 101 / 2017 Coll.:
Amendment of Decree No 75 / 2005 Coll.
The Annex to Government Decree No 75 / 2005 Coll., establishing the scope of direct teaching, direct education, direct teaching and direct pedagogical and psychological activities of teaching staff, as amended by Government Decree No. 273 / 2009 Coll. and Government Decree No. 239 / 2015 Coll., is amended as follows:

Transitional provision
Until 31 August 2021, the provisions of Government Decree No 75 / 2005 Coll., as effective before the date of entry into force of this Regulation, shall apply to the assistant educator, if the activity is carried out in a school class which is not established in accordance with Article 16 (9) of the Education Act.
Amendment of Decree No. 123 / 2018 Coll.
Government Decree No. 123 / 2018 Coll., establishing the maximum number of teaching hours financed by the State Budget for primary school, secondary school and conservatory established by the county, municipality or association of municipalities, is amended as follows:
1. in § 1 (2) of the introductory part of the provision, § 2, § 3 (1), § 3 (2) of the introductory part of the provision, and in § 6, the text "No 1" is inserted after the word "Annex."
2. In Articles 3 (1) and 4 (2), "one 'is replaced by" 1'.
3. In Paragraph 3 (2) of the Introductory Part of the provision, the word "one 'is replaced by the words" one class of school in a school for the performance of constitutional education or protective education'.
4. After Article 5, the following Sections 5a and 5b are inserted:
Determination of maximum number of teaching hours for pupils with severe speech defects
For each pupil with severe language defects in the field of education referred to in Annex 2 to this Regulation in a school or class established under § 16 (9) of the Education Act for pupils with this type of handicap, the total amount of PHmax set for the school shall be increased by 1 hour.
Maximum number of hours of teaching with an assistant educator financed in some cases from the state budget
(1) The maximum weekly number of teaching hours provided by the teaching assistant in addition to the teacher, financed from the state budget for one class of school set up under § 16 (9) of the Education Act, the class established under § 16 (9) of the Education Act or the school class in the educational establishment for the performance of constitutional education or protection education, depending on the average number of pupils in the classroom and other rules for the procedure for its calculation, are set out in Annex 2 to this Regulation, broken down according to the selected fields of primary and secondary education and the type of handicaps referred to in § 16 (9) of the Education Act.
(2) The provisions of Sections 1 (3) and (4) and 5 (1) shall apply mutatis mutandis to the determination of the resulting maximum number of hours of teaching provided alongside a teacher by an assistant educator financed from the state budget. "
5. In Article 6, the text "No 1 'is inserted after the word" Annexes' and the word "one 'is replaced by" 1'.
6. The Annex to date shall be renumbered Annex 1.
7. In Annex 1, Notes 1, 3 and 5 to 7, the word "one 'is replaced by" 1' and in Note 3, the first sentence is added at the end of the text, "and for schools at school institutions for the performance of constitutional education or protective education '.
8. The following Annex 2 is added, including the title:

Other rules for the procedure for calculating the maximum number of hours of teaching with a teacher's assistant funded by the state budget:
1) In cases where pupils are educated simultaneously in one class according to the field of education providing basic education and the field of education providing basic education, the maximum number of hours shall be determined according to the field of education in which the higher number of pupils are educated. In cases where the same number of pupils are in both fields of education, the maximum number of hours shall be determined according to the field of education providing basic education.
2) These maximum number of hours shall also apply to the class set up under Section 16 (9) of the Education Act and to schools in the school establishment for the performance of constitutional education or protective education. In the case of joint teaching of pupils in the first and second classes, the maximum number of hours laid down for the second. However, these numbers shall not apply to a school or class established under Section 16 (9) of the Education Act for pupils with serious speech defects.
3) In cases where pupils are educated in one class at the same time according to the Framework Education Programme for the field of education, the Primary School Special Part I Part 1, and the Primary School Special Part I Part 2, the maximum number of hours for the Primary School Special Part I Part 2 shall apply.
4) In the case that pupils are educated in one class at the same time according to the Framework Education Programme for the field of education of the Primary School special part I and Primary School special part II, the maximum number of hours for the Primary School special part I applies.
5) Pupils with these handicaps must make the majority of pupils of the class.
6) In cases where pupils are educated in one class at the same time according to the field of education Practical school of two years and the field of education Practical school of one year, the maximum number of hours shall be determined according to the field of education in which a higher number of pupils are educated. In cases where the same number of pupils are in both fields of education, the maximum number of hours according to the field of education shall be determined by the Practical School of two years. '

This Regulation shall enter into force on 1 September 2019.
