DECLARATION
of 12 June 2025
amending Decree No. 105 / 2010 Coll., on the frequency band allocation plan (national frequency table), as amended
The Ministry of Industry and Trade provides pursuant to Section 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 110 / 2007 Coll., Act No. 153 / 2010 Coll., Act No. 468 / 2011 Coll., Act No. 214 / 2013 Coll., Act No. 258 / 2014 Coll. and Act No. 374 / 2021 Coll., to implement Section 16 (1) of the Act on Electronic Communications:
Regulation No 105 / 2010 Coll., on the frequency band allocation plan (national frequency table), as amended by Decree No 423 / 2017 Coll. and Decree No 467 / 2021 Coll., is amended as follows:
1. In Chapter 1 of the Annex, the following entry ACS is inserted at the beginning of Part I:
"ACS Automatic coupling system [Automatic connection system] '.
2. in Part I of Chapter 1 of the Annex, the following entry epfd is inserted after the entry "EHF Extra Short Wave [Extra High Frequency] ':
"EPfd Equivalent value of the performance flow density '.
3. In Part I of Chapter 1 of the Annex, the entry "SVTR Systems using tropospheric dispersion 'is deleted.
4. In Annex Chapter 1, Part II, point 1.1, the first and second sentences are replaced by the following: "The following terms are defined for the purposes of the frequency band allocation plan."

"5.159A The use of the 40- 50 MHz band by the Earth's satellite survey service (active) shall comply with the geographical constraints and operational and technical conditions defined in Resolution 677. The provisions of this Note do not in any way reduce the obligation of the Earth's satellite survey service (active) to operate as a secondary service in accordance with provisions 5.29 and 5.30 of the Order '.
43. In Annex Chapter 5, Section III, point 5.162A:
"5.162A Additional allocations: in Germany, Australia, Austria, Belgium, Bosnia and Herzegovina, China, the Republic of Korea, Vatican, Denmark, Spain, Estonia, Finland, France, Indonesia, Ireland, Iceland, Italy, Japan, Latvia, North Macedonia, Liechtenstein, Lithuania, Luxembourg, Monaco, Montenegro, Norway, the Netherlands, Poland, Portugal, the Democratic People's Republic of Korea, the Czech Republic, the United Kingdom, the Russian Federation, Sweden, Serbia, Slovenia and Switzerland, in addition the 46- 68 MHz band is allocated to the radiolocation service. This use is limited to the operation of radiolabelled wind direction and speed sensors in accordance with Resolution 217. ';

5.198B The use of the 117,975- 137 MHz band by air mobile service (R) shall be given priority over satellite air mobile service (R). ';
49. In Annex Chapter 5, Section III, point 5.200, the words "and satellite air mobile services' shall be inserted after the words" air moving services'.
50. "5.228C The use of the 161,9625- 161,9875 MHz and 162,0125- 162,0375 MHz maritime mobile service and satellite maritime mobile service (ascending direction) is limited to the automatic identification system (AIS), including search and rescue transmitters (AIS-SART) and satellite radio beacons with AIS indicating the site of the disaster (EPIRB-AIS). The use of these air-moving (OR) bands is limited to AIS transmissions in air search and rescue operations. AIS, AISSART and EPIRB-AIS operations in these bands shall not restrict the development and use of fixed and mobile services operated in adjacent bands.
5.228D The 161,9625-161,9875 MHz band (AIS 1) and 162,0125-162,0375 MHz band (AIS 2) may continue the preferred use of fixed and mobile services until 1 January 2025. This allocation shall be void after that date. The administrations are required to make every possible effort to prevent the use of these fixed and mobile services before that date. In the transitional period, the maritime mobile service in these bands shall be priority over fixed, mobile and air mobile services.
5.228E The use of an automatic identification system in the 161,9625-161,9875 MHz and 162,0125-162,0375 MHz bands by air-moving (OR) service is limited to aircraft stations for search and rescue operations and other safety-oriented communications. ';
57. In Annex, Chapter 5, Section III, the following point 5.235 is inserted after point 5.228F:
"5.235 Additional allocation: In Germany, Austria, Belgium, Denmark, Spain, Finland, France, Israel, Italy, Liechtenstein, Malta, Monaco, Norway, the Netherlands, the United Kingdom, Sweden and Switzerland, the 174- 223 MHz band is additionally allocated to the terrestrial mobile service. However, the ground mobile service station shall not cause harmful interference to existing or planned radio stations in countries other than those mentioned in this note or require protection from them. ';
58. In Annex, Chapter 5, Section III, point 5.254, the words "except for the additional allocation referred to in note 5.256A 'are deleted.

For the protection of the radio service, mobile service stations shall not cause field intensity for more than 1% of the time at its highest intensity or 10 m above the ground at the borders of each other administration which exceeds the field intensity value calculated in accordance with Section 4.1.3.2 of Annex 2 to GE06 with respect to tolerance for multiple interference, Table A1.10 and the methodology set out in the GE06 Agreement. These limits may be exceeded in the territory of any State whose administration agrees to this. This allocation shall in no way adversely affect the development of the radio service or jeopardise the new radio service records to the GE06 Plan. ';
71. In point 5.296 of Chapter 5 of the Annex to Section III, the word "Algeria," shall be inserted after the word "Algeria," the words "the Republic of Congo" shall be replaced by the words "the Republic of the Congo," the word "Gabon," the word "Gambia," the word "Uganda," the word "Palestine," and the word "San Marino," the word "Senegal," shall be inserted. "
72. In Annex Chapter 5, Section III, point 5.306, the word "zone," is replaced by "zone (see provisions No 5.10 to 5.13)," and the words "with the exception of China and India" are inserted after the number "3."
73. The following point 5.312B is inserted after point 5.312A of Chapter 5 of the Annex:
"5.312B Zone 698- 960 MHz, or parts thereof, in Region 2, and the 694- 960 MHz band, or parts thereof, in Region 1, are identified for use by high-altitude platforms (HIBS) for International Mobile Telecommunications (IMT). This identification does not preclude the use of these bands in advance of any use of services to which they are assigned and do not give priority to the Order. Resolution 213 is applied. HIBS must not require protection from existing priority services. Clause 5.43A of the Order does not apply, see Resolves 2 Resolution 213. Such use of HIBS in the 694- 728 MHz, 830- 835 MHz and 805,3- 806,9 MHz bands is restricted to HIBS reception. '
74. In Annex, Chapter 5, Section III, point 5.316B, the word "as' is inserted after the word" as' and the word "as' is inserted after the word" as appropriate '.

93. In Annex Chapter 5, Section III, point 5.388A:
"5.388A The bands 1 710-1 980 MHz, 2 010-2 025 MHz and 2 110-2 170 MHz in Regions 1 and 3 and the bands 1 710-1 980 MHz and 2 110-2 160 MHz in Region 2 are identified for use by platforms at high altitudes as HIBS base stations for the provision of International Mobile Telecommunications (IMT). This identification does not preclude the use of these bands by any service applications to which they are assigned and do not give priority in the Order. Resolution 221. HIBS must not require protection from existing priority services. Clause 5.43A does not apply. This use of HIBS in the 1 710-1 785 MHz bands in Regions 1 and 2, and 1 710-1 815 MHz in Region 3 is limited to the reception on HIBS, and the 2 110-2 170 MHz band is limited to the transmission from HIBS. '
94. In Annex, Chapter 5, Section III, point 5.389A, the words "as provided for 'shall be inserted after the words" a'.
95. This identification does not preclude the use of these bands by any service applications to which they are assigned and do not give priority in the Order. Resolution 218. HIBS must not require protection from existing priority services. Clause 5.43A does not apply Such use of HIBS in the bands 2 500-2 510 MHz in Regions 1 and 2, and 2 500-2 535 MHz in Region 3 is limited to the reception by HIBS stations. '
98. In Annex, Chapter 5, Section III, point 5.410, the word "feasible 'is inserted after the word" all'.

"5.434A The priority use of the 3 600- 3 800 MHz floating band, other than air moving service in Region 1, is subject to an agreement concluded in accordance with the provisions of 9.21 of the Order, provided that the power flow density limit (pfd) below is exceeded. In the coordination phase, provisions 9.17 and 9.18 of the Order will apply. Before the administration in Region 1 puts into service a mobile service station in the 3 600- 3 800 MHz band, for the protection of fixed and satellite fixed service stations, it must ensure that the power flow density (pfd) produced 3 m above the ground does not exceed -154.5 dB (W / (m2 of 4 kHz)) for more than 20% of the time at the borders of any other administration. The mobile service stations operating in the 3 600-3 800 MHz band shall not claim greater protection from space stations than provided in Table 21-4 of the Order. ';
104. In Annex Chapter 5, Section III, point 5.441, the words "10,7-10,95 GHz (downwards direction) and 'are replaced by the words" 10,7-10,95 GHz (downwards direction)', the words "systems on non-geostationary tracks' are replaced by the words" geostationary systems', the words "(BR) 'are inserted after the text" ITU' and the words "systems' are inserted after the words" as appropriate '.
105. In Chapter 5 of Section III (5.447B) of the Annex, "dBW / m2 'is replaced by" dB (W / m2)'.
106. In Annex Chapter 5, Section III, point 5.448C, the words "from them 'are replaced by the words" before them'.
107. The following point 5.450 is inserted after point 5.449 of Chapter 5 of the Annex:
"5.450 Additional allocation: In Austria, Azerbaijan, Iran, Kyrgyzstan, Romania, Turkmenistan and Ukraine, the 5 470-5 650 MHz band shall in addition be primarily allocated to the air navigation service. ';
108. The following point 5.457E is inserted after point 5.457B of Chapter 5 of the Annex:
"5.457E Belt 6 425- 7 125 MHz in Region 1 and 7 025- 7 125 MHz in Region 3 are identified for use by administrations intending to implement the terrestrial component of International Mobile Telecommunications (IMT). This implementation does not preclude the use of these bands by any service applications to which they are assigned and do not give priority in the Order. Resolution 220. These bands are also used to implement wireless access systems (WAS) including radio local networks (RLAN). '
109. In point 5.461 of Section III of the Annex, at the end of the text of the first sentence, the words "subject to an agreement concluded under the procedure laid down in clause 9.21 of the Order and except that provision No 9.21 will not apply to GSO satellite networks in a mobile satellite service whose complete coordination information BR received on 1 January 2025 with regard to NGSO satellite systems for which complete coordination or notification information, as appropriate, was adopted on 1 January 2025 '.
110. In Annex Chapter 5, Section III, point 5.461, the second sentence is replaced by the following: "NGSO satellite systems for which complete coordination or notification information, as appropriate, was adopted by BR on 1 January 2025, shall not cause unacceptable interference with, or require protection from, the GSO satellite mobile service networks operated in accordance with the Order. Clause 5.43A of the Order shall not apply. '.
111. In Annex, Chapter 5, Section III, point 5.461A, the second sentence is deleted.
112. In Annex, Chapter 5, Section III, the following point 5.461AC is inserted after point 5.461AB:
"5.461AC NGSO satellite-based fixed service systems operating in the 7 375- 7 750 MHz band, whose complete coordination or notification information, as appropriate, was adopted by BR on 1 January 2025, shall not cause unacceptable interference with, or require protection against, the GSO satellite-based mobile satellite service operated in accordance with the Order. Clause 5.43A shall not apply. ';
113. In Annex, Chapter 5, Section III, point 5.469, the word "Mongolia, 'is deleted and the word" Russia' is replaced by the word "Russian Federation '.
114. In Annex Chapter 5, Section III, point 5.469A, the word "stations' is replaced by" stations'.
115. The following point 5.473 is inserted after point 5.472 of Chapter 5 of the Annex:

For the use of the 12,2-12,7 GHz band by satellite radio service in Region 2, see Appendix 30 to the CRD. '
124. In the Annex to Chapter 5 of Section III, the words "as appropriate 'shall be added at the end of the text of point 5.492.
125. The following points 5.496 and 5.496A are inserted after point 5.492 of Chapter 5 of the Annex:
"5.496 Additional allocation: in Austria, Azerbaijan, Kyrgyzstan and Turkmenistan, the 12,5-12,75 GHz band shall be allocated, in addition, preferably to a fixed service and a mobile service other than air moving. However, stations in these services must not cause harmful interference to terrestrial fixed satellite stations in the countries of Region 1, other than those mentioned in this note.
5.496A The band 12,75- 13,25 GHz (ascending direction) can be used by ground stations in motion, limited to ground stations on board aircraft and ships, communicating with GSO space stations in a satellite fixed service. Resolution 121. '
126. In Annex Chapter 5, Section III, points 5.499A and 5.499C, the words "cosmos' are replaced by the words" satellites' and the words "(BR) 'are inserted after the text" ITU'.
