of 22 June 2022
on dedicated technical gas installations and safety requirements
The Government hereby orders, pursuant to § 23 (a), (b), (d) and (f) to (h) of Act No. 250 / 2021 Coll., on the safety of work in connection with the operation of reserved technical installations and on the amendment of related laws (hereinafter referred to as "the Act '):
Subject matter
This Regulation implements the relevant provisions of the European Union1) and provides for:
(a) a list of the technical gas installations that are reserved (hereinafter referred to as "dedicated gas installations") and their classification in classes, groups and sub-groups;
(b) requirements for safety and health at work on dedicated gas installations, requirements for ensuring the safety of their operations and requirements for the level of safety, location, implementation of assembly and repair, operation, checks, inspection, revisions, tests and operational documentation;
(c) requirements for the eligibility of legal persons and business natural persons operating dedicated gas installations or persons carrying out the installation, repair, revision, testing and filling of gas containers and laying down requirements for the verification of their competence; and
(d) the requirements laid down for the competence of natural persons carrying out on dedicated gas installations assembly, repair, revision, testing, operation of the person responsible for operating, operating and checking in respect of the prescribed qualifications and periods of professional experience in the field and requirements for checking their professional competence.
Definition of terms
For the purposes of this Regulation:
(a) any substance which, at 1,013 bar and + 20 ° C, is fully gaseous or has a vapour pressure greater than 3 bar at + 50 ° C; a mixture of gases meeting the criteria of part of the sentence before the semicolon shall be considered as a gas;
(b) by putting a dedicated gas installation into service the moment when the dedicated gas installation started to operate;
(c) accompanying documentation a set of design, project and documentation for the installation and repair of dedicated gas equipment;
(d) an open end pressure-free pipe discharge device;
(e) the professional practice of the revision or testing technique in the design, construction, assembly, repair and operation of the dedicated gas equipment of the group concerned;
(f) the professional practice of a natural person to carry out the installation, repair and operation of dedicated gas installations of the relevant group of activities in carrying out the assembly, repair and operation of dedicated gas installations carried out under the direct management and supervision of a person with competence certified in the relevant scope;
(g) by a test technician, a natural person with a certificate of competence for activities on dedicated technical installations;
(h) a release volume of a parameter characterising the degree of hazard of the installation with flammable gases in the event of its accident.
Gas distribution
(1) For the purposes of this Regulation, gases shall be divided into:
(a) heating gas which is used for the production of heat by combustion for heating, technological heating, hot water preparation, food preparation, mechanical work, vehicle propulsion and electricity production;
(b) technical gas which is used for purposes other than heating gas.
(2) For the purposes of this Regulation, gases shall be subdivided into:
(a) flammable, non-flammable combustion promoting and non-flammable inert;
(b) breathable, non-breathable, toxic, irritating, suffocating and corrosive;
(c) lighter or heavier than air.
Voltage available
(1) When determining the release volume, the water volume of that part of the dedicated gas installation from which the medium may be released should its integrity be impaired. The boundary of this part usually consists of two serial security features, a vacuum cleaner, a blower or a compressor. The volume of supply lines shall also be included in the volume of the installation, starting from the place where the gas flow can be guaranteed to be closed. If more gas storage storage containers are installed for one dedicated gas installation, the release volume shall be determined for the maximum volume container.
(2) The available volume for all types of flammable gases is expressed in cubic meters of natural gas under conditions of 1,013 bar and + 20 ° C. From a higher pressure or other temperature shall be converted by the state equation of the ideal gas according to the relationship p × V / T = konst. The transfers referred to in Annex 1 to this Regulation shall be used to convert other flammable gases into released gas volumes.
Classification of reserved gas installations
(1) Reserved gas equipment is to be classified as equipment for:
(a) production and treatment of gases into Group A;
(b) storage of gases in Group B;
(c) filling of containers of gases, pressure stations, filling and pumping equipment of vehicles with gases in group C;
(d) liquefaction and evaporation of gases into group D;
(e) increasing and reducing gas pressure to Group E;
(f) gas distribution to Group F;
(g) gas consumption by combustion, including fixed gas engines, in machinery spaces or in boiler rooms to Group G;
(h) the discharge of the extinguishing gases into group H.
(2) Reserved gas installations are not:
(a) production facilities in which gases are produced as by-products with the exception of the gas management of sewage treatment plants;
(b) chemical production facilities where gases are produced as intermediate products which are further processed into non-gaseous products;
(c) construction sites for the storage of pressure vessels for the transport of gases, storage cabinets for pressure stations, individual pressure vessels for the transport of gases, water-volume gas containers up to 0,22 litres, gas containers used as parts of machinery, such as liquid air, liquid oxygen and gas containers with a critical temperature higher than -10 ° C, but lower than + 70 ° C, in tanks in a liquid state of deep cooled, such as carbon dioxide or ethene;
(d) sample and calibration bottles up to 3 litres in volume for laboratory purposes for which legislation and other regulations are in force to ensure safety and health at work;
(e) equipment forming part of separate working machinery or apparatus or of separate portable fire extinguishers;
(f) self-operating compressors which are not permanently connected to long-term operating gas pipelines, pumps, self-operating bottle regulators and control equipment which are part of another gas device group;
(g) media distribution for measurement and control technology;
(h) gas transfer equipment within a single workplace;
(i) air conditioning equipment;
(j) air-engineering systems, flue gas drafts and combustion lines;
(k) self-operating gas burners up to 10 kW in enclosed space, in open spaces without restrictions, in particular laboratory, glassware, welding and soldering sets, and outdoor and camping equipment;
(l) plants in which gases are consumed other than by combustion, in particular plants of the synthesis process in the production of ammonia, ethanol,
(m) air distribution to 16 bar operating pressure;
(n) fuel tanks and gas engines of means of transport.
(3) If a dedicated gas installation meets the conditions for inclusion in several groups by its nature and technical values, the basic technological function of the dedicated gas installation is decisive for inclusion. At the same time, in the accompanying documentation of the dedicated gas installation, the boundaries between the inclusion of the dedicated gas installation in individual groups must always be defined.
Classification of reserved gas installations into classes
(1) The reserved Class I gas installations are:
(a) equipment for filling pressure vessels with heating gases;
(b) equipment for filling pressure vessels with technical gases flammable, toxic and corrosive with a pressure greater than 4 bar, acetylene and other gases with a pressure of 20 bar or higher;
(c) equipment for filling and pumping vehicles;
(d) compressor stations of flammable gases containing oxygen with an operating pressure greater than 0,05 bar, in particular metallurgical gases;
(e) compressor stations of flammable, toxic and corrosive gases with a pressure above 4 bar, compressor stations of other gases with a pressure of 20 bar or more;
(f) control stations with a pressure greater than 4 bar;
(g) heating gas distribution equipment with a pressure greater than 4 bar;
(h) equipment for the distribution of technical gases flammable, toxic and corrosive with a pressure greater than 4 bar, equipment for the distribution of acetylene with a pressure of 0,2 bar, equipment for the distribution of gases of others with a pressure of 20 bar or more;
(i) plants for gas consumption by combustion with an individual output exceeding 3,5 MW;
(j) equipment for the production of flammable gases with an individual power greater than 100 m3 × h-1;
(k) oxygen production facilities with a unit power greater than 1 500 m3 × h-1;
(l) plants for gas consumption by combustion in public buildings with a space for collection of at least 200 persons with a sum of the nominal output of 1 MW or more gas appliances in a single construction;
(m) plants for the storage of toxic and corrosive gases with a volume exceeding 5 m3;
(n) equipment for the storage of inert gases with a pressure greater than 40 bar;
(o) equipment for the storage of flammable gases with a release volume in the gaseous phase exceeding 5000 m3, for liquid
1. petroleum gas in the LPG marking above 20 000 m3;
2. natural gas in the LNG marking above 50 000 m3.
(2) Other reserved gas installations not referred to in paragraph 1 are to be classified in Class II.
Requirements for the competence of the revision and testing techniques and verification of their competence
The professional experience and training requirements of the applicant for the issue of a certificate of revision and testing technique on competence for activities on dedicated gas installations are laid down in Annex 2 to this Regulation.
Activities provided by the revision technician
(1) The Revision Technician shall review, test and evaluate the tests of reserved gas installations within the scope of its certificate of competence for the activities of dedicated technical installations under the law, properly and in accordance with laws and regulations to ensure safety and health at work. The revision technician shall draw up a revision report or a test record.
(2) The Revision Technique separately performs the assembly to carry out tests and measurements on gas distribution equipment up to and including 0,05 bar and for appliances with individual heat output below 50 kW.
(3) The Revision Technique processes or verifies and confirms by its signature a written technological revision or examination procedure within the scope of its certificate of competence for activities on dedicated gas installations under the law.
(4) The Revision Technician proposes, on the basis of the outcome of the revision of the measures to address the identified deficiencies, including the date of removal, and also proposes the immediate decommissioning of the dedicated gas equipment in the event that the installation is directly endangering the life, health and safety of persons, property or the environment.
Record-keeping of tests and revisions
(1) A natural person entitled to the installation, repair, revision or testing of a dedicated gas installation, not for his own use, is required to keep a record of the tests and revisions carried out. That record shall be kept for at least 10 years.
(2) The records referred to in paragraph 1 shall contain:
(a) the serial number of the revision or test report and, where appropriate, the test record;
(b) the date of issue of the above documents,
(c) the identification of the group and the location of the dedicated gas installation under consideration;
(d) copies of the documents relating to the examination or revision.
Activities provided by the test technician
(1) The testing technique may carry out and evaluate tests of reserved gas installations within the scope of its certificate of competence for activities on dedicated technical installations under the law, in accordance with the laws and regulations to ensure safety and health at work. On the basis of the test result, it may recommend a test dedicated gas device to be put into service.
(2) The test technician shall separately test or install dedicated gas equipment to perform pressure tests on gas distribution equipment up to and including 0,05 bar and, for gas consumption equipment, by combustion with individual heat output below 50 kW; for other equipment and other groups, the performance and evaluation of pressure tests by the test technician shall be subject to the achievement of knowledge and competence in accordance with the requirements of the manufacturers of such equipment, in particular the testing of burners of appliances, compressors, regulatory equipment, or the requirements of laws and regulations to ensure safety and health at work.
(3) The test technician shall process the written technological test procedure or test record in accordance with legal and other regulations to ensure safety and health at work.
Professional competence requirements of natural persons for assembly and repair
(1) A person qualified to carry out independent assembly and repair of dedicated gas installations shall be a natural person who meets the professional experience and education set out in Annex 2 to this Regulation, who holds a certificate of professional competence for assembly and repair and has received training to the extent provided for in the laws and regulations to ensure safety and health at work, taking into account the nature of the work.
(2) The training course covers repeated proficiency tests, including the extension of the validity of the proficiency certificate for activities on dedicated gas installations.
(3) In the case of repeated proficiency tests, the continuing training system in vocational gas education, organised by the relevant authorized community registered with the Czech Chamber of Commerce, can also be completed.
(4) Staff who do not have the competence referred to in paragraph 1 may carry out assembly work only under the supervision of staff who have that competence.
Requirements for the competence of natural persons to operate and control
(1) A certificate of competence for activities on dedicated technical installations under the law is not required for checks on dedicated gas installations and for their operation.
(2) The operator of the dedicated gas installation shall ensure that, prior to the designation of the operator and the checks, it is made known, including the verification of the knowledge of the laws, regulations and other regulations to ensure safety and health at work related to the dedicated gas installation.
(3) If the control is carried out not for the own use of the operator of the dedicated gas installation, it shall be considered as a competent person
(a) a revision technique;
(b) a test technician; or
(c) a person with a valid certificate for the installation and repair of a dedicated gas installation with an appropriate range of activities on dedicated gas installations.
(4) An order for an inspection by an operator of a dedicated gas installation shall be deemed to be responsible for carrying out the checks referred to in paragraph 3.
(5) The professional operator of a dedicated gas installation under the law shall be a natural person who meets the professional experience and education set out in Annex 2 to this Regulation, duly trained with the operator of that dedicated gas plant. The training syllabus and the duration of professional experience shall be determined by the operator of the dedicated gas installation in cooperation with the revision technician, taking into account the nature of the work and the complexity of the operation of the dedicated gas plant.
(6) The qualified operator of a dedicated gas installation shall undergo regular verification of knowledge to the extent of the operating activities performed. The verification of the knowledge of the operator of a dedicated gas installation shall be carried out by a review technician with a certificate of competence for activities on dedicated gas installations for the group and a subset of dedicated gas installations as set out in Annex 3 to this Regulation. Verification of operator knowledge shall be carried out at least once every 3 years for dedicated Class I gas plants, at least once every 5 years for dedicated Class II gas plants. A written record shall be made of the result of the verification of operator knowledge.
(7) In the event of a change to a dedicated gas installation affecting operational requirements and, where applicable, operational safety, it is necessary to complete and verify the operator's knowledge without delay, irrespective of the time limits referred to in paragraph 6.
(8) The verification of knowledge by a revision technician shall not be required for the operation of dedicated gas equipment operating on gas distribution equipment with a pressure not exceeding 0,05 bar and with appliances with individual heat output below 50 kW, except for industrial thermal equipment, and for the handling of fillers. The filling end handling during filling of gases into means of transport shall not be considered as operating a dedicated gas installation but as an activity carried out by the instructed user.
Installation and repair of dedicated gas equipment
(1) In carrying out the installation and repair of the dedicated gas installation, the legal and other rules to ensure safety and health at work and, where appropriate, the manufacturer's specific requirements on the competence of persons carrying out the installation or repair of the dedicated gas installation shall be complied with. Service shall also be considered as assembly.
(2) The legal or business natural person carrying out the installation and repair of a dedicated gas installation shall:
(a) accompanying documentation in the Czech language in accordance with the requirements for completeness and scope, laid down by laws and regulations and other provisions to ensure safety and health at work;
(b) carrying out the relevant revisions and tests;
(c) the conduct of revisions in the case of repairs, where provided for in other legislation to ensure safety and health at work;
(d) documentation for the processing of operational documentation in the Czech language,
(e) carrying out an inspection to verify the completeness, integrity and safety of the dedicated gas installation immediately before it is put into service;
(f) training of operators of dedicated gas equipment in accordance with the requirements of manufacturers of individual parts of dedicated gas equipment.
(3) The documents shall be transmitted by the legal or business natural person carrying out the installation or repair of the dedicated gas installation to the operator of the installation, together with the documentation for the processing of the local operating rules.
(4) For the completion of the installation or repair of the reserved gas installation, the legal or business natural person carrying out the installation or repair of the reserved gas installation shall keep and maintain accompanying technical documentation for at least 10 years to the extent laid down by the laws and regulations to ensure safety and health at work.
(5) In the case of the installation and repair of a dedicated gas installation where there is a risk of leakage of flammable, toxic or corrosive gas, the legal or commercial natural person carrying out the installation or repair of the dedicated gas installation shall develop a technological process of the work, unless otherwise provided for in laws and regulations to ensure safety and health at work.
(6) Where installation or repair is carried out on a dedicated gas installation already operated, the operator shall provide to the natural or legal person carrying out the installation and repair of the dedicated gas equipment documentation on equipment for the preparation of the technological process, installation and repair and, where appropriate, the addition and modification of this documentation.
Safety requirements for dedicated gas installations
(1) Reserved gas equipment may be operated only after all prescribed revisions and tests have been carried out, demonstrating that its technical condition is in accordance with the laws and regulations to ensure safety and health at work.
(2) An operator of a dedicated gas installation shall ensure the safe and reliable operation of the installation during its operation in such a way that it does not cause a threat to the life, health and safety of persons, property or the environment, and that all activities on the dedicated gas installation are carried out within the scope and time limits laid down by laws and regulations to ensure safety and health at work.
(3) Operator of dedicated gas equipment
(a) when a dedicated gas installation is put into service, appoint the person responsible for operating the gas installation and ensure that it is trained with a knowledge check;
(b) ensure, within one month of the entry into service of the dedicated gas installation, the development of a local operating order in accordance with the requirements of legislation and other regulations to ensure safety and health at work, processed for specific local conditions; local operating rules need not be developed for gas collection facilities for gas distribution to appliances with individual heat output of less than 50 kW;
(c) maintain and maintain the prescribed accompanying technical documentation, operational documentation and records of the reserved gas installation in the extent and under the conditions laid down in the laws and regulations to ensure safety and health at work;
(d) keep an operating log on the operation of a dedicated gas installation which contains records in accordance with the requirements of the laws and regulations to ensure safety and health at work; the operating logbook shall not be kept for gas collection facilities for the distribution of gas to appliances with a single heat output of less than 50 kW, with the exception of boilers;
(e) ensure that operational revisions and checks of the reserved gas installation are carried out within the time limits laid down in this Regulation;
(f) keep the operating log for at least 10 years from the last record;
(g) keep evidence of the checks carried out on the dedicated gas installation, regular service, maintenance and operational revision carried out for 10 years; evidence of the tests carried out after completion of assembly or reconstruction of the equipment and the initial revision shall be preserved throughout the period of operation of the equipment;
(h) ensure that the installation and repair, revision and testing of dedicated gas installations are carried out only by legal and business natural persons authorised to carry out the activity under the law and the operation of dedicated gas facilities by qualified natural persons only;
(i) ensure that only natural persons who are competent and, in specified cases, are subject to tests, revisions, repairs, assembly and inspections of the reserved gas installation and are legally certified,
(j) ensure the implementation of corrective measures and the removal of defects laid down by the revisions or by the public authorities on dedicated gas installations during their operation;
(k) identify, analyse and evaluate the causes of accidents and other serious incidents occurring on a dedicated gas installation and implement corrective and preventive measures.
(4) The local rules of operation shall be a regulation laying down, in particular, procedures for the operation, inspection and maintenance of the dedicated gas equipment for local conditions and which shall be processed in accordance with the laws and regulations to ensure safety and health at work.
Additional safety requirements for dedicated gas equipment
(1) The legal and business natural person is obliged to install dedicated gas installations in accordance with the laws, regulations and other provisions to ensure safety and health at work and with the requirements of manufacturers or importers.
(2) The person responsible for the operation of the dedicated gas installation shall be designated by the operator of the gas installation, who shall be responsible for familiarising it with the requirements of the legislation and other regulations to ensure safety and health at work for the installation concerned.
(3) The legal and business natural person must, in particular, ensure that, when installing and operating a dedicated gas installation:
(a) the documentation transmitted by the manufacturer or supplier of the reserved gas installation contains the data necessary for the assessment of the state of the gas installation in the revisions, tests, assembly and repairs, including drawing documentation for the processing of technological processes of revisions and tests, the determination of the operation and processing of the local operating rules and other operational documents ensuring safety and health at work;
(b) the spaces in which toxic, explosive, flammable or flame-retardant gases are stored or modified and the spaces in which these substances are treated have been equipped with fixed lamps corresponding to the protocol on the determination of external influences and have been marked with safety plates or marks at the entrance and access routes in accordance with the requirements of other legislation;
(c) the different parts of the dedicated gas installation are conductively connected and protected against atmospheric, static and atmospheric effects, unless otherwise specified by another regulation;
(d) the materials used in the construction and construction of the dedicated gas installation comply with the operating conditions and characteristics of the gases they come into contact with; their suitability shall be demonstrated by the test or the certificate of conformity,
(e) the condition of the reserved gas installation is ensured by its strength and tightness and the equipment is protected against corrosion if it is made of non-corrosion resistant material;
(f) adequate ventilation has been ensured in the premises where the reserved gas installation is operated, taking into account the nature of the equipment, the technology used and the gas used;
(g) the reserved gas equipment has been equipped with pressure and quantity measurements as appropriate;
(h) protection zones where open fire handling and storage of flammable and flame-retardant substances are prohibited have been established and respected in the storage of gases;
(i) the filling plant has been located in separate ground buildings, when filling vessels with gases heavier than air, these spaces must not be understowed and must not be connected by underground spaces with other objects;
j) the main gas supply cap was placed in an easily accessible and marked location preferably outside the building,
(k) each section of the gas distribution has been closed in view of their operational function and each section, except for substations in residential units, has the possibility of safe ventilation and de-gasification into free space;
(l) gas distribution during the passage of construction structures and other management conditions are in accordance with the requirements of the legal and technical regulations to ensure safety and reliability of operation;
(m) the gas manifolds have not been guided by lift shafts and as passing through the ground under the objects; their seals shall be easily accessible and operable and shall be protected against unauthorised handling;
(n) the distribution by type of gas transported is marked with a safety mark, in particular in places where the distribution of another medium could be confused;
(o) the combustion crops are carried out in such a way that they do not endanger the life, safety and health of persons, property or the environment;
(p) respiratory technology is secured for equipment where toxic, irritating, nitrous or corrosive gases are used;
(q) gas containers have been safely secured against overthrow when filling and the connection of the container to the filling device is made in such a way as to guarantee the tightness of the connection between the connection line and the closing valve of the container.
In accordance with the requirements for safe operation of reserved gas installations under the law, it is prohibited to fill vessels,
(a) for which the period of periodic examination has passed;
(b) which do not have the prescribed marking or, where appropriate, the marking is illegible;
(c) which have damaged surface, feet, valves, fittings or insulation;
(d) which do not have prescribed equipment;
(e) which are intended for acetylene if they do not have porous matter markings; or
(f) for which the content of the substance in which the acetylene is dissolved is below the limit.
Requirements for the test of dedicated gas equipment
(1) After completion of the installation or reconstruction, the test of the dedicated gas installation shall determine whether its condition complies with the legal and other regulations to ensure safety and health at work.
(2) The test of a dedicated gas installation shall be carried out by a legal or business natural person who has performed the installation or reconstruction of the installation. The person referred to in the first sentence shall designate the natural person who controls the test and shall be responsible for producing a written report on the course and outcome of the test. The person referred to in the first sentence shall, in writing, notify the designated organisation at least 15 days in advance of the place and time of the test of reserved Class I gas installations under this Regulation. A Class I installation may only be submitted by the assembly organisation to the customer after a successful test of the equipment certified by the designated organisation, which subsequently gives an expert opinion.
(3) Before starting the revision or testing technician test, a written technological test procedure shall be prepared containing in particular:
(a) the extent of the test;
(b) a description of the operations carried out, including the use of the relevant measuring techniques;
(c) the necessary measures to ensure the safe conduct of the test;
(d) the conditions under which the test is found to be successful.
(4) For dedicated gas installations of the same sub-group, the type-technology test procedure may be processed. This procedure may also be the basis for the possible development of a specific technological test procedure on the dedicated gas installation concerned.
(5) The legal or business natural person carrying out the test before starting the test shall ensure:
