Decree of the Minister for Foreign Affairs on the Agreement on Cooperation in the Development and Use of Reference Materials of the Council of Mutual Economic Assistance

concerning the Agreement on cooperation in the production and use of mutual economic assistance Council reference materials
On 5 July 1985, the Agreement on Cooperation in the Development and Use of Reference Materials of the Council of Economic Assistance was signed in Berlin. The Agreement entered into force on 3 October 1985 on the basis of Article 15 thereof and entered into force on that date for the Czechoslovak Socialist Republic.
The Czech translation of the Agreement is announced simultaneously.

AGREEMENT
on cooperation in the development and use of mutual economic assistance Council reference materials
the Governments of the People's Republic of Bulgaria, the People's Republic of Hungary, the Socialist Republic of Vietnam, the German Democratic Republic, the Republic of Cuba, the People's Republic of Mongolia, the People's Republic of Poland, the Union of Soviet Socialist Republics and the Czechoslovak Socialist Republic, hereinafter referred to as the Contracting Parties,
managing the principles of cooperation between the Member States of the RVHP and the tasks arising from the comprehensive programme for further deepening and improving cooperation and the development of the socialist economic integration of the RVHP Member States, as well as the long-term target cooperation programmes of the Member States of the RVHP,
Taking into account the increasing importance of the development and use of reference materials for the composition and properties of substances and materials in the Member States of the RVHP for metrological product production and quality control in the various sectors of the national economy, as well as in scientific research and other areas of activity,
Recognising the effectiveness of closer cooperation to ensure consistency and credibility of the measurement of the composition and properties of substances and materials in the Member States of the RVHP and wanting to consolidate the positive experience gained in this area from mutual cooperation, as well as the experience gained by each Member State of the RVHP,
Wishing to ensure the fullest satisfaction of their national needs in the reference materials of substances and materials,
taking into account the Statute of the Council's mutual economic assistance reference material,
agree on the following:
The Parties shall ensure cooperation on the development and use of RVHP reference materials (RM RVHP) in economic and scientific and technological cooperation between the Member States of the RVHP under the conditions laid down in this Agreement.
The Contracting Parties shall entrust the fulfilment of the obligations arising from this Agreement to the national authorities listed in the Annex, which shall ensure that works are carried out on the formation of RM RVHP and also perform coordination functions in their States and monitor the progress of works on the formation and use of RM RVHP.
The relevant Contracting Party shall immediately inform the other Contracting Parties of the change of those national authorities through the depositary of the Agreement.
The Parties agree that the coordination, planning and methodological management of the work to create RM RVHP, as well as monitoring the implementation of this Agreement, will be carried out within the Standing Committee on Standardisation Cooperation on the basis of the programmes approved by this Commission.
The Contracting Parties agree that the RM RVHP is approved by the Standing Committee on Standardisation Cooperation.
The national authorities of the Contracting Parties shall cooperate on the design and use of RM RVHP under this Agreement in accordance with the requirements of the RVHP standards, the RVHP normative documents for standardisation and other standard RVHP documents and taking into account relevant international documents related to the subject matter of the Agreement.
The creation of RM RVHP shall take place by developing new RM RVHP or on the basis of the national RM of the participating Member States of the RVHP, taking into account the need for cooperation. In doing so, forms of cooperation such as coordination, cooperation (under contracts and contracts), or other forms recognised by the States, will be used.
Mutual accounting for scientific and technical work shall be determined in accordance with the applicable recommendations of the competent authorities of the RVHP.
The costs of travel and residence of specialists in the State-organiser's work to perform tasks related to RM RVHP creation and testing shall be borne by the national authority or organisation of the Party sending the specialists.
Where work requires equivalent costs from each of the two parties concerned, the stay of specialists may take place on the basis of exchange free of foreign exchange according to an arrangement between the competent authorities of those parties.
The supply of RM RVHP will take place on the basis of the "General terms and conditions for the supply of goods between the organisations of the Member States of the RVHP 1968 / 1975 (VDP RVHP 1968 / 1975)."
RM RVHP prices will be determined in accordance with the principles applicable under the RVHP.
The use of RVHP reference materials in the economic and scientific and technical cooperation process shall be ensured by reference to the national authority or organisation of the Contracting Parties in the RVHP standards as well as in the agreements and contracts concluded (contracts).
RM RVHP shall be used in the national economy of the Contracting Parties in accordance with their national legislation.
The national authority of the Contracting Party may express its non-participation in the formation and / or use of individual RMs or amend previous decisions not to participate in the formation and / or use of individual RMs by means of written notification to the national authorities of the Contracting Parties.
The declaration of non-participation in the creation and / or use of individual RM RVHP shall be without prejudice to the obligations arising from agreements and contracts previously concluded (contracts) in which the RM RVHP refers.
The legal protection and use of inventions, industrial and utility designs and trade marks is governed by the "Treaty of 12 April 1973 on the legal protection of inventions, industrial and utility models and trade marks when carrying out economic and scientific and technological cooperation '.
Issues of legal protection which are not covered by the above Treaty shall be dealt with by the competent authorities of the Contracting Parties.
This Agreement shall not affect the rights and obligations arising from other international agreements concluded by the Parties.
This Agreement shall be submitted to the Secretariat of the Mutual Economic Assistance Council, which shall perform the functions of depositary of this Agreement. The depositary shall send certified copies of this Agreement to all Contracting Parties and shall also inform them of any notifications and requests received.
This Agreement shall enter into force between the Contracting Parties which sign it without reservation of approval, 90 days after its signature.
For Contracting Parties which sign this Agreement subject to additional approval, the Agreement shall enter into force 90 days after notification by the depositary of the Agreement's approval.
This Agreement may be supplemented or amended with the consent of all Contracting Parties. Applications for additions and amendments shall be sent to the depositary. Complements and amendments shall be made by means of a Protocol which enters into force in accordance with the provisions of Article 15 of this Agreement.
If disputes arise in connection with the implementation of this Agreement, they shall be resolved in agreement between the agents of the Contracting Parties.
This Agreement shall be concluded for an unlimited period.
Each Contracting Party may terminate this Agreement by giving written notice to the depositary.
The denunciation of the Agreement shall take effect 12 months from the date of receipt by the depositary.
The denunciation of this Agreement shall not affect obligations arising from agreements and contracts (contracts) concluded for the implementation of this Agreement.
This Agreement may be acceded to by other States, with the agreement of the Contracting Parties, for which they shall send a written request to the depositary of the Agreement.
The accession shall enter into force on the date on which the depositary received its consent from all Contracting Parties.
