on a trialogue agreement between the Government of the Czechoslovak Socialist Republic, the Federal Government of Austria and the Government of the People's Republic of Poland on the provision and proper implementation of the supply, transit and collection of electricity from the People's Republic of Poland through the territory of the Czechoslovak Socialist Republic to the Republic of Austria
On 31 August 1977, A tripartite agreement between the Government of the Czechoslovak Socialist Republic, the Austrian Federal Government and the Government of the People's Republic of Poland on the provision and proper implementation of the supply, transit and collection of electricity from the People's Republic of Poland through the territory of the Czechoslovak Socialist Republic to the Republic of Austria. The Agreement entered into force on 2 August 1979 pursuant to Article 4 thereof.
The Czech version of the Agreement is hereby published at the same time.

THIRD PARTY AGREEMENT
between the Government of the Czechoslovak Socialist Republic, the Federal Government of Austria and the Government of the People's Republic of Poland on the provision and proper implementation of the supply, transit and collection of electricity from the People's Republic of Poland through the territory of the Czechoslovak Socialist Republic to the Republic of Austria
The Government of the Czechoslovak Socialist Republic, the Federal Government of Austria and the Government of the Polish People's Republic
bearing in mind the successful development of economic relations between the three Contracting States,
determined to fully implement the provisions of the Final Document of the Conference on Security and Cooperation in Europe, signed in Helsinki on 1 August 1975,
the management is willing to ensure further expansion of economic relations between the three Contracting States on the basis of equality and mutual benefits,
Taking into account the role to be played in further dynamic development of mutual relations, close cooperation between three contracting States in the field of electricity,
they have agreed as follows:
The Contracting Parties shall take note of:
- the contract of 23 May 1975 for the supply of electricity concluded between Centrala Handla Zagranicznego Weglokokes, Katovice and Österreichische Elektrizitätswirtschafts-AG (Verbundgesellschaft), Vienna,
- the contract of 18 April 1977 concerning the transit of electricity from the People's Republic of Poland to the Republic of Austria, concluded between Centrala Handla Zagranicznego Weglokokes, Katovice and PZO Metalimex, Prague,
- the agreement of 31 August 1977 on the joint financing and use of the high voltage DC converter plant, concluded between Österreichische Elektrizitätswirtschafts-AG (Verbundgesellschaft), Vienna and Polskie Towarzystwo Handlo Zagranicznego Elektrim, Warsaw.
The Contracting Parties shall provide each other with mutual guarantees covering, in accordance with their laws, appropriate measures to ensure the proper performance of the supply, transit and collection of electricity supplied from the People's Republic of Poland to the Republic of Austria through the territory of the Czechoslovak Socialist Republic in the years 1983- 1999 and confirm the following:
- the Government of the People's Republic of Poland shall ensure the issue of the relevant electricity export licences in the quantities foreseen for both the importing party and the transit party during the period of validity of this Agreement,
- the Government of the Czechoslovak Socialist Republic shall ensure the transit of electricity from the People's Republic of Poland to the Republic of Austria during the period of validity of this Agreement,
- The Federal Government of Austria shall ensure, after the period of validity of this Agreement, the uninterrupted consumption of electricity supplied from the People's Republic of Poland as well as the free transfer of the relevant energy payments in accordance with the arrangements in force between the two States.
The Contracting Parties shall create the most favourable conditions for the implementation of this Agreement in this field.
The Contracting Parties agree that in order to supervise the implementation of this Agreement, the competent authorities of each State shall designate authorised representatives to meet upon written request by one of the Contracting Parties no later than 30 days after the transmission of such a request alternately in the Czechoslovak Socialist Republic, the Republic of Austria and the People's Republic of Poland.
1. This Agreement shall enter into force on the date on which the conditions for entry into force laid down by the laws of each of the three Contracting Parties are fulfilled and shall remain in force until 31 August 1999.
2. The Contracting Parties agree to discuss, at the latest 3 years before the expiry of this Agreement, the possibility of extending it, if any.
Written in Warsaw, 31 August 1977, in three originals, each in the Czech, German and Polish languages, each of the three texts being equally authentic.
