DECLARATION
of 28 July 2015
on progress in the service evaluation of soldiers and their aspects
According to § 17 (5) of Act No. 221 / 1999 Coll., on professional soldiers, as amended by Act No. 332 / 2014 Coll.:
Evaluator
(1) The assessment shall be carried out by an assessor who is a direct superior soldier whose subordination is continuously at least 3 months.
(2) If the assessor is not referred to in paragraph 1, the assessor shall be the nearest other superior of the rated soldier.
(3) For the evaluator directly subordinate to the Minister of Defence, a period of at least 3 months of his authority shall not be required for the evaluated soldier.
Processing of professional evaluations
(1) The evaluator shall draw up a service evaluation of the soldier in writing on a form, the model of which is set out in the Annex to this Regulation, by means of a point evaluation of the criteria set out in its individual parts, and a verbal evaluation of the other facts about the soldier and his performance of the service referred to in the form for a calendar year (hereinafter referred to as "period of assessment") in the period from 1 December to 28 February of the following calendar year (hereinafter referred to as "period of assessment").
(2) The evaluator shall process the service evaluation outside the evaluation period at all times
(a) within 3 months of the end of the evaluation process in which the soldier was considered to be unsatisfactory;
(b) prior to the transfer of a soldier, if, in the new official classification, he carries out a service in the calendar year prior to the evaluation period for a period of less than 3 months;
(c) prior to the departure of the soldier, if the time of departure interferes with the evaluation period; or
(d) after the end of the temporary incapacity of a soldier to serve for sickness or injury, provided that the soldier did not perform the service during the evaluation period.
(3) The evaluator will not produce a service evaluation of a soldier who
(a) during the evaluation period, he has served for less than 6 months;
(b) he has served in his official capacity for less than 3 months; or
(c) has been last evaluated on official duty in the last 3 months before the start of the evaluation period, except for the evaluation referred to in paragraph 2 (a).
Service evaluation documentation
(1) The supporting documents for the service evaluation are:
(a) an evaluation of the results of the training and the performance of other tasks of the unit in which the soldier is assigned, if the soldier has participated or has personally participated in them;
(b) an evaluation of the results of a soldier in preparation or in the performance of specific tasks for the evaluation period, in particular an evaluation at the end of the basic preparation, an evaluation at the end of the foreign operation or an evaluation at the end of career or professional courses; and
(c) a written verification of the knowledge of legal and internal regulations and of military-expertise related to the performance of the service of the rated soldier.
(2) The evaluator is entitled to verify in writing, for the purposes of the service evaluation of the rated soldier, the knowledge of the legal and internal rules and the knowledge of the military-technical topics related to the performance of his service. Circles and expert subjects whose knowledge will be verified by the evaluator shall be published in writing at least 10 days before the verification is carried out in a manner customary for the disclosure of information in the unit in which the rated soldier is classified.
(3) The evaluator shall inform the soldier orally of the documentation for the service evaluation when evaluating the individual tasks. In cases where this is a negative assessment of the performance of tasks, the rating officer shall inform the soldier in writing of the evaluation of each task.
Soldier assessment method
(1) In the evaluation, the evaluator sums up the points gained by the soldier in each area and then calculates their percentage of the total number of points available. The result is rounded up to a whole percent.
(2) The soldier is evaluated by percentage
(a) as excellent where the percentage referred to in paragraph 1 is between 86% and 100%;
(b) as very good if the percentage referred to in paragraph 1 ranges from 64 to 85 percent or more, but has gained less than 3 points in a given area;
(c) as good as possible if the percentage referred to in paragraph 1 is between 46% and 63% or higher, but in some areas it has obtained less than 1 point;
(d) as satisfactory where the percentage referred to in paragraph 1 is between 30% and 45%; or
(e) as non-compliant where the percentage referred to in paragraph 1 ranges from 0 to 29 per cent; such a soldier is unfit for further service.
Procedure for difference in service evaluation
(1) If the difference in the total score is more than 30 points compared to the previous service rating, the evaluator shall submit a service evaluation before he or she informs the rated soldier to his direct supervisor.
(2) If the direct superior evaluator does not agree with the level of the overall score referred to in paragraph 1 and the evaluator does not agree to its modification, he shall process the new rating himself in the manner laid down in this decree.
Evaluation interview
With the service evaluation, the evaluator informs the rated soldier without undue delay after his or her preparation during the evaluation interview. If the findings of the interview result in the need to modify the professional evaluations, the evaluator shall carry it out on the spot.
Opposition against service evaluation
(1) Opposition against the service assessment is made by the evaluated soldier to the direct superior evaluator through the evaluator.
(2) The appellant shall attach his observations and written supporting documents in accordance with Article 3 (1) and transmit them to his direct superior within 3 working days of their receipt.
(3) If the direct superior of the evaluator finds the objections to be justified, the service evaluation shall be adjusted accordingly. With the modified service evaluation, the rated soldier evaluator will be informed accordingly in accordance with § 6.
(4) The soldier's objections may be rejected only in writing, on the basis of a statement of reasons for the assessment of the performance of his duties during the evaluation period.
New service reviews
(1) If the service authority responsible for determining the soldier's service salary orders a new service evaluation, the direct superior assessor shall process it within 10 days of the date on which the new service evaluation was ordered.
(2) In the event of objections to a new service evaluation, the solution shall be treated mutatis mutandis in accordance with Section 7.
End of evaluation process
(1) The evaluation process ends with the futile expiry of the opposition period.
(2) In the event of objections to the service evaluation, the evaluation process shall end with the presentation of the soldier with the result of the assessment of the objections.
(3) Upon completion of the evaluation process, the service evaluation shall be included in the personal file of the soldier.
Repeal
Decree No 414 / 2009 Coll., on the procedure for the service evaluation of soldiers, is hereby repealed.
Efficacy
This decree shall take effect on the day of its publication.
