amending Act No 563 / 2004 Coll., on pedagogy workers and amending certain laws, as amended, and Act No 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended
Parliament has decided on this law of the Czech Republic:

Amendment of the Education Workers Act
Čl. I
Act No. 563 / 2004 Coll., on pedagogic workers and amending certain laws, as amended by Act No. 383 / 2005 Coll., Act No. 179 / 2006 Coll., Act No. 264 / 2006 Coll., Act No. 189 / 2008 Coll., Act No. 384 / 2008 Coll., Act No. 223 / 2009 Coll., Act No. 227 / 2009 Coll., Act No. 422 / 2009 Coll., Act No. 159 / 2010 Coll., Act No. 82 / 2011 Coll., Act No. 199 / 2015 Coll., Act No. 333 / 2012 Coll.
1. Paragraph 1 (1) reads as follows:
"(1) This law regulates the conditions for the exercise of the activities of teaching staff, the continuing training of teaching staff and their career system, derogations from the arrangements for the layout of working time and special rules for the negotiation of duration of employment. '.
2. in Article 2 (2), the following point (e) is inserted after point (d):
"(e) school speech,"
Points (e) to (j) shall be renumbered as points (f) to (k).
3. in Article 3 (1) (a), the words "eligible for legal action" shall be replaced by the words "authorised."
4. In Paragraph 4 (1), the word "relevant 'is deleted and at the end of the paragraph the sentence" The examination according to the first sentence shows the knowledge of the Czech language corresponding to at least level B2 according to the Common European Framework of Reference for Languages. A natural person who is to perform the activities of a kindergarten teacher, a primary school teacher, a secondary school teacher or a general secondary school educational subject shall demonstrate the knowledge of the Czech language corresponding at least to level C1 according to the Common European Framework of Reference for Languages. "
5. In Paragraph 4 (4), the words "or an individual examination corresponding to the examination of the common part of the Czech language and literature, according to the Education Act 24, shall be added at the end of the text (b)."
Footnote 24 reads:
"24) Sections 113 and 113a of the Education Act, as amended."
6. In Article 4, at the end of paragraph 4, the dot is replaced by "or 'and the following point (d) is added:
"(d) which teaches the subject in a foreign language under the conditions laid down in the Education Act (25).
25) Paragraph 13 (3) of the Education Act. '
7. In Article 5 (2), "2 years" is replaced by "3 years" and "4 (a)" is replaced by "2."
8. In Article 5 (3), the words "school management," are replaced by the words "organisation and management of education," a comma is inserted after the word "school," and the words "accredited for further education of teaching staff" are added at the end of the text of the paragraph.
9. in Article 6 (1) (b) and (d), the words "education in a lifelong learning programme undertaken by a university and targeted" shall be replaced by the words "study to extend professional qualifications aimed at."
10. in Article 6 (2) (c):
"(c) the training provided for in paragraph 1 for teachers of a parent school; and
1. a university degree obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at special pedagogy; or
2. study to extend vocational qualifications focusing on special pedagogical, educational and educational activities in schools and classes set up for children, pupils and students with special educational needs, or to obtain the professional qualifications of a special educator. "
11. in Article 7 (1) (b), the words "Master's degree" shall be inserted after the words "where appropriate in accredited" and the words "education in a lifelong learning programme undertaken by a university and targeted" shall be replaced by the words "study to extend professional qualifications aimed at."
12. in Article 7 (1) (c):
"(c) in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or general secondary school subjects and at the extension of vocational qualifications for the preparation of primary school teachers,"
13. in Article 7 (1), point (d) is deleted;
Points (e) to (h) shall be renumbered as points (d) to (g).
14. in Articles 7 (1) (d), 9 (2) (b) and (c), 9 (3) (a), 10 (1) (a), 11 (1), 11 (2) (a) and 13, the words "the field of study" shall be deleted;
15. in § 7 (1) (e), § 8 (3), § 9 (8) and § 11 (4), the words "the field of study of artistic education" shall be replaced by the words "with artistic education."
16. in Article 7 (1), the following points (f) and (g) are inserted after point (e):
"(f) in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of teachers of subjects of the second degree of primary school or secondary school only for the teaching of the corresponding subjects of the physical or artistic field;
(g) in an accredited university study programme in the field of pedagogical sciences aimed at education only for the teaching of subjects of physical or artistic orientation, '.
Points (f) and (g) shall be renumbered as points (h) and (i).
17. in Article 7 (2) (b), the words ", the field of study of special pedagogy, and education in a programme of lifelong learning carried out by a university and targeted" shall be replaced by the words "and by study to extend professional qualifications aimed at."
18. in Article 7 (2) (c):
"(c) the training provided for in paragraph 1 for primary school teachers; and
1. higher education obtained by study in an accredited study programme in the field of pedagogical sciences aimed at special pedagogy; or
2. study to extend vocational qualifications focusing on special pedagogical, educational and educational activities in schools and classes set up for children, pupils and students with special educational needs, or to obtain the professional qualifications of a special educator. "
19. the following Section 7a is inserted after Section 7, including the title:
„§ 7a
Common ways of obtaining vocational qualifications as a secondary school teacher and as a general teacher of secondary school subjects
The second degree teacher of primary school and teacher of general secondary school subjects is awarded professional qualifications in higher education obtained by study in an accredited Master's degree programme.
(a) in the field of pedagogical sciences, aimed at preparing second-degree teachers of primary school or at preparing teachers of general or vocational subjects of secondary school;
(b) in the field of pedagogical sciences, aimed at the preparation of primary school teachers and studies to extend the professional qualification aimed at the preparation of secondary school teachers or secondary school;
(c) whose focus corresponds to the nature of the subject being taught; and
1. a university degree obtained by studying in an accredited Bachelor's programme in the field of pedagogical sciences aimed at preparing teachers of practical teaching or vocational training of a secondary school; or
2. study of pedagogy according to § 22 (1) (a);
(d) in the field of pedagogical sciences aimed at preparing teachers of the primary art school, which corresponds to the nature of the subject being taught, only for teaching the corresponding subject; or
(e) under Section 12, for the teaching of a foreign language only. "
20. Paragraph 8 (1) is deleted.
Paragraphs 2 to 4 shall be renumbered paragraphs 1 to 3.
21. Paragraph 8 (1) (b) reads as follows:
"(b) a university degree obtained by study in an accredited Master's degree programme in the field of pedagogical sciences aimed at special pedagogy; and
1. a university degree obtained by studying in an accredited Bachelor's programme in the field of pedagogical sciences aimed at preparing teachers of practical teaching or vocational training of a secondary school; or
2. study of pedagogy according to § 22 (1) (a), "
22. in Article 8 (1) (c), the words "education in a programme of lifelong learning carried out by a university and aimed at special pedagogy, or" shall be replaced by "" higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at special pedagogy or study to extend the professional qualification aimed at specific pedagogical, educational and educational activities in schools and classes set up for children, pupils and students with special educational needs or to obtain the professional qualification of a special educator; "
23. in Article 8 (1) (d), the words "paragraph 1" shall be replaced by the words "§ 7a" and the words "education in a programme of lifelong learning carried out by a university and dedicated to special pedagogy" shall be replaced by the words "study to extend professional qualifications aimed at specialised pedagogic, educational and educational activities in schools and classes set up for children, pupils and students with special educational needs, or to obtain the professional qualifications of a special educator."
24. In Article 8, at the end of paragraph 1, the dot is replaced by "or 'and the following point (e) is added:
"(e) higher education obtained by study in an accredited Master's degree programme in the field of pedagogical sciences aimed at special pedagogy and the preparation of second-degree teachers of primary school or the preparation of teachers of general or vocational secondary school subjects."
25. in Article 9, paragraph 1 is deleted;
Paragraphs 2 to 9 shall be renumbered paragraphs 1 to 8.
26. in Paragraph 9 (1) (d), the words "which correspond" shall be replaced by "corresponding."
27. in Paragraph 9 (1) (d), the word "or" shall be added at the end of point 1.
28. in Article 9 (1) (d) (2):
"2. study of pedagogy under § 22 (1) (a) or (b)."
29. in Article 9 (1) (d), point 3 is deleted;
30. in Paragraph 9 (2) (a), the word "or" shall be added at the end of point 1.
31. in Article 9 (2) (a) (2):
"2. study of pedagogy under § 22 (1) (a) or (b),"
32. in Article 9 (2) (a), point 3 is deleted;
33. In Article 9 (2) (a) (1) (b) (1) (c) (1) and (4) (c) (1), the words "practical teaching or vocational training" and the words "or second degree primary school" shall be inserted after the words "teacher training";
34. in Paragraph 9 (2) (b), the word "or" shall be added at the end of point 1.
35. in Article 9 (2) (b) (2):
"2. study of pedagogy in accordance with § 22 (1) (a) or (b), or '.
36. in Paragraph 9 (2) (b), point 3 shall be deleted;
37.In Article 9 (2) (c), the word "or" shall be added at the end of point 1.
38. in § 9 (2) (c) (2):
"2. study of pedagogy under § 22 (1) (a) or (b)."
39. in Paragraph 9 (2) (c), point 3 is deleted;
40. in Article 9 (4) (a), the words "paragraph 3 or" shall be replaced by "paragraph 2,"
41. in Article 9 (4), the following point (b) is inserted after point (a):
"(b) secondary education with a graduate examination obtained by the termination of the secondary education programme in the field of education, which corresponds to the nature of the subject being taught, and by obtaining a professional qualification for the activity of a vocational training instructor under the Law on the Recognition of the Results of Further Education, or"
Point (b) shall be renumbered (c).
42. In Article 9 (4) (c) (2) and (3):
"2. a study of pedagogy under § 22 (1) (a) or (b); or
3. obtaining a professional qualification for the activity of a vocational training instructor under the Law on the Recognition of the Results of Continuing Education. ';
43.In Article 9 (5), "3 and 4" is replaced by "2 and 3."
44. in Paragraph 9 (6) (a) of the introductory part of the provision, the words "paragraphs 1 to 6" shall be replaced by "§ 7a or under paragraphs 1 to 5";
45. in § 9 (6) (a) (2):
"2. a study to extend vocational qualifications aimed at specialised pedagogical, educational and educational activities in schools and classrooms set up for children, pupils and students with special educational needs, or to obtain the professional qualifications of a special educator;"
46. in Paragraph 9 (6) (b), the words "education in a lifelong learning programme undertaken by a university for the preparation of second-degree teachers of a primary school or secondary school, or" shall be replaced by "study of pedagogy according to § 22 (1) (a),"
47. In Paragraph 9 (6), the words "or education under § 7 (2) or § 8 (1)" shall be added at the end of the text of point (c).
48. In Article 9, at the end of paragraph 6, the dot is replaced by "or 'and the following point (d) is added:
"(d) higher education obtained by study in an accredited Master's degree programme in the field of pedagogical sciences aimed at special pedagogy and the preparation of second-degree teachers of primary school or the preparation of teachers of general or vocational secondary school subjects."
49. The following Section 9a is inserted after Section 9, including the title:
„§ 9a
Recognition of fulfilment of the condition of professional qualification of second-degree teacher of primary school or secondary school teacher
(1) A staff member who is a graduate of an accredited Master's degree programme whose focus corresponds to the nature of the subject being taught may be recognised in writing by the school director as a condition of professional qualification as a secondary school teacher or as a teacher of general secondary school subjects for a period of no more than 3 years from the date on which he began teaching.
(2) A staff member who is a graduate of an accredited Master's Degree Programme whose focus corresponds to the nature of the subject being taught and who has had continuous experience in the field for a period of at least 5 years may be recognised in writing by the School Director as having been completed for a period of no more than 3 years from the date on which he began teaching.
(3) A staff member who is a graduate of at least secondary education with a graduate examination in the field which corresponds to the nature of the subject being taught and who has had continuous experience in the field for at least 5 years may be recognised in writing as having been completed for a maximum period of 3 years from the date on which he began the teaching activity.
(4) A staff member who is a graduate of at least secondary education with a certificate in the field which corresponds to the nature of the subject being taught and who has had a continuous practice in the field for at least 5 years may, in writing, recognise the presumption of professional qualifications of a teacher of vocational training as having been completed for a maximum period of 3 years from the date on which he began that teaching activity.
(5) The total period of recognition of the professional qualification requirement referred to in paragraph 1, 2, 3 or 4 for the same staff member may not exceed 3 years in total for several employers. A staff member shall inform the school director, prior to the establishment of an employment relationship, whether and for what period he has previously received recognition of the presumption of professional qualifications referred to in paragraphs 1, 2, 3 or 4.
(6) Employees who have obtained a university degree in an accredited Bachelor's Study Programme in the field of pedagogical sciences, while being a student of an accredited Master's degree programme for the preparation of secondary school teachers or secondary school teachers, which builds upon a Bachelor's course programme, may in writing recognise the assumption of a second degree teacher or a secondary school teacher of general-education subjects at that school for a period of study of that accredited Master's degree programme, but no later than 3 years from the date of commencement of the study of that programme. "
50. in Paragraph 10 (1) (a), the word "or" shall be added at the end of point 1.
51. in Article 10 (1) (a) (2):
"2. study of pedagogy under § 22 (1) (a) or (b),"
2. in Article 10 (1) (a), point 3 shall be deleted;
53.In Article 10 (1) (c) to (e):
"(c) higher education obtained by studying in an accredited Master's study programme in the field of pedagogical sciences aimed at preparing teachers of general education subjects for a musical instrument play or solo singing only for the teaching of such subjects at primary art school;
(d) higher education obtained by study in an accredited Master's degree programme in the field of pedagogical sciences aimed at the preparation of teachers of general subjects for Fine Education only for the teaching of the art field in primary art school;
(e) higher education obtained by study in an accredited master's programme in the field of art with an artistic and pedagogical focus, '.
54. in Paragraph 10 (1) (g), the word "or" shall be added at the end of point 1.
55. in § 10 (1) (g) (2):
"2. study of pedagogy under § 22 (1) (a) or (b),"
56. in Paragraph 10 (1) (g), point 3 is deleted;
57. in Paragraph 10 (1) (h), the word "or" shall be added at the end of point 1.
58. in § 10 (1) (h) (2):
"2. study of pedagogy in accordance with § 22 (1) (a) or (b), or '.
59. in Paragraph 10 (1) (h), point 3 is deleted;
60. in Paragraph 10 (1) (i), the word "or" shall be added at the end of point 1.
61. Paragraph 10 (1) (i) (2) reads:
"2. study of pedagogy under § 22 (1) (a) or (b)."
62.In Paragraph 10 (1) (i), point 3 is deleted.
63.In Article 12 (b), the word "Master's" shall be inserted after the word "accredited."
64. In Article 12 (c), the word "or 'shall be added at the end of point 1.
65.In Paragraph 12 (c) (2):
"2. study of pedagogy in accordance with § 22 (1) (a) or (b), or '.
66.In Article 12 (c), point 3 is deleted.
67.In Paragraph 12 (d):
"(d) an accredited master's programme other than those referred to in points (a), (b) and (c), by carrying out a language examination of the relevant foreign language corresponding to at least level C1 of the Common European Framework of Reference for Languages, supplementing the didactic study of the relevant foreign language; and
1. higher education obtained by study in an accredited study programme in the field of teaching science aimed at teacher preparation; or
2. study of pedagogy according to § 22 (1) (a). '
68. In Article 14 (c), the word "bachelor 'is deleted.
69. In Section 14 (c), the words "school and 'are replaced by the words" school,' and the words "accredited for further education of teaching staff 'are added at the end of the text.
70. In Paragraph 15, "5 'is replaced by" 4';
71.In Paragraph 16 (1) (c):
"(c) higher education obtained by the termination of an accredited bachelor's programme other than those referred to in points (a) and (b) and by the study of pedagogy referred to in Article 22 (1),"
72.In Article 16 (1) (e):
"(e) higher vocational education obtained by the termination of an accredited training programme other than those referred to in (d) and by the study of pedagogy referred to in Article 22 (1),"
73.In Paragraph 16 (1) (h):
"(h) secondary education with a graduate examination obtained by the termination of a secondary education programme other than those referred to in points (f) and (g) and by the study of pedagogy in accordance with § 22 (1)."
74. In Article 16 (2) (c), the words "education in a lifelong learning programme carried out by a university and aimed at special education" shall be replaced by the words "study to extend the professional qualification of a special pedagogical, educational and educational activity in schools and classes set up for children, pupils and students with special educational needs or to obtain the professional qualification of a special educator."
75. in Article 17 (1), point (b) is deleted;
Points (c) to (f) shall be renumbered (b) to (e).

2. study for the preparation of leisure teachers engaged in a part-direct teaching activity in private education; or
3. obtaining a professional qualification for the activities of the head of the leisure activities of children under the Law on the Recognition of the Results of Further Education. "
79.Paragraph 17 (3) reads as follows:
