on the approval of railway vehicles and special traction equipment
The Federal Ministry of Transport provides in agreement with the competent central authorities pursuant to Sections 19 and 29 of Act No. 51 / 1964 Coll., on Railways, as amended by Act No. 104 / 1974 Coll.
§ 1
(1) Trailing vehicles and special contact devices (hereinafter referred to as "railway vehicles") are:
(a) rolling stock driven and towed;
(b) combined vehicles,
(c) trolleybus vehicles,
(d) cableway vehicles, 1)
(e) mechanisation equipment designed for the operation of runways;
(f) mechanising equipment for loading, unloading, sealing and defrosting railway vehicles and their handling and containers.
(2) The railway vehicles to be used on national rail, railway, urban and cableway tracks shall correspond to the type approved by the railway administration, which is the Federal Ministry of Transport for national rail vehicles and lifts and the competent authority of the state administration of the Czech Socialist Republic2) or the competent authority of the state administration of the Slovak Socialist Republic3) for urban railway vehicles and special purpose runways.
§ 2
(1) At the time of approval of a new type of groove vehicle, the railway authority shall assess the characteristics of the groove vehicle; finds in particular whether:
(a) complies with its technical, conceptual and manufacturing implementation with the approved technical conditions (§ 6);
(b) meets the parameters laid down by the rules of technical operation of the relevant type of runway;
(c) it has the necessary operational reliability;
(d) important parts have adequate service life or service life determined by technical conditions (Section 6);
(e) guarantees transport safety, complies with the requirements of safety and hygiene of work, the economy of operation, typing, unifying and standardisation as well as those arising from international arrangements;
(f) it also meets other requirements which are normal for its impeccable operation, taking into account its nature and purpose of use.
(2) The railway authority may delegate to another authority or organisation the identification of the characteristics of the type approved.
(3) The application for approval of a new type of groove vehicle is submitted by the manufacturer after the end of the prototype control. The design shall be accompanied by the approved technical conditions, the prototype test documents and other documents necessary to assess the suitability of the type of train vehicle. The railway authority may set a deadline for the removal of the deficiencies of the proposal.
(4) The railway authority may require the manufacturer to supplement the design with additional evidence.
§ 3
(1) When approving a new type of groove vehicle, the railway authority shall proceed in agreement with the Federal Ministry of National Defence, if not a railway vehicle to be used on urban lines.
(2) With regard to health and safety at work, the railway authority shall proceed with the approval of a new type of railway vehicle in agreement with the Czech Labour Safety Authority or the Slovak Labour Safety Authority.
§ 4
The procedure, content and scope of approval shall be determined by the railway administration.
§ 5
(1) If the type meets all the requirements, the railway authority shall take a decision on the approval of a type of train vehicle.
(2) If the type approved does not comply with all requirements, the railway administration shall suspend the approval procedure and fix a time limit for the removal of deficiencies.
§ 6
(1) Before starting the development of a new type of groove vehicle, the railway administration shall establish design and operational requirements to be met by the railway vehicle; In view of the needs of the state transport policy and the concept of the development of the transport system, it is cooperating with the Federal Ministry of Transport.
(2) The manufacturer shall submit the technical conditions for serial production to the railway administration for approval of the basic technical conditions for the construction of the prototype and after the end of the prototype control. In the case of basic technical conditions, approval shall consist in particular of an assessment of the safety requirements of the groove operation, the utility value of a new type of groove vehicle in operation, work hygiene, typing, unification and standardisation. In the case of technical conditions for series production of a new type of groove vehicle, approval shall also consist in assessing in particular the technical characteristics of the groove vehicle, the principles of the production of the groove vehicle, its reliability and its durability. In doing so, the Railway Administration shall also benefit from the results of the tests, findings and assessment documents of the State Service.
(3) Paragraphs 2 (2) and 4 apply mutatis mutandis.
§ 7
(1) The application for approval of the mass production of a new type of groove vehicle shall be submitted by the manufacturer after the completion of the in-service verification and after evaluation of that verification by the groove undertaking; the proposal shall be accompanied by the results of the evaluation.
(2) The decision to approve a new type of groove vehicle is also a decision to approve the production of a verification series; may be linked to the decision to approve the mass production of a new type of groove vehicle if the verification series is not implemented.
(3) In case of completion of the verification series, the manufacturer shall submit a proposal for the approval of mass production of a new type of groove vehicle after completion of the verification tests; submit the results of the evaluation referred to in paragraph 1 to the proposal.
(4) Paragraph 1 (2) to (5) applies mutatis mutandis.
§ 8
(1) The application for approval of imports of a new type of groove vehicle is submitted by a railway undertaking. The approval shall consist of the finding that the imported type of groove vehicle meets the needs of the transport system development concept and the rules of technical operation of the relevant type of railway.
(2) Paragraph 1 (2) to (5) applies mutatis mutandis.
§ 9
(1) If substantial changes are to be made to the groove of a vehicle, the manufacturer or railway undertaking shall submit a proposal for approval to the railway authority.
(2) Paragraph 1 (2) to (6) applies mutatis mutandis.
§ 10
(1) Where a railway administrative authority finds on its own initiative or on the proposal of a railway undertaking that series-supplied railway vehicles do not have the characteristics of an approved type or that substantial changes in the groove have not been approved by the railway authority, the railway authority shall withdraw the approval of mass production pursuant to § 7 (2) and (3).
(2) Decomposition against the decision to withdraw approval does not have suspensory effect.
§ 11
This Decree shall take effect on 1 April 1981.
