DECLARATION
of 28 April 2008
on improving the professional competence of drivers and amending Decree No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws, as amended by Act No. 478 / 2001 Coll.
The Ministry of Transport (hereinafter referred to as "the Ministry '), pursuant to § 47 (6), § 48 (5), § 50 (3), § 51 (5), § 52b (8), § 52c (9), § 52f (2), § 52g (5) and § 52i (3) of Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 374 / 2007 Coll. (hereinafter referred to as" the Act'):
DETERMINATION OF THE TRAINING ELIGIBILITY OF THE ROAD
INTRODUCTORY PROVISIONS
This decree implements the relevant provisions of the European Union16)
(a) the curriculum for entry and regular training and safe driving;
(b) the share of teaching and training on the overall range of entry and regular training;
(c) the content of teaching and training of entry and regular training and safe driving training;
(d) the scope of the common part and the specific parts of the initial training and the part of the training in driving the vehicle, which may be replaced by training on the driver's trainer;
(e) the scope of the part of the teaching of regular training, which may take place in a way that allows remote access, and the conditions for the course of that part of the teaching;
(f) the scope of teaching and training for safe driving;
(g) the maximum number of participants in the entry and regular training courses and safe driving training;
(h) fields related to road transport within secondary education with a graduate examination and higher vocational education;
(i) a model for the certificate of teaching and training completed;
(j) the content, scope and method of carrying out the test and evaluating its results and the model of the certificate of completion;
(k) the model of the driver's professional licence and the model of the certificate of loss, theft, damage or destruction of the driver's professional licence;
(l) basic technical requirements for non-residential premises and equipment for providing safe driving training and for the training area, its equipment and technical provision of training on it;
(m) a model of the certificate of completion of safe driving training;
(n) the content and manner of the training of starting drivers and the maximum number of participants;
(o) the model of the certificate of completion of training for starting drivers; and
(p) the method of keeping a record of training of starting drivers.
(Paragraph 47 (6) of the Law)
(1) The curriculum, the proportion of teaching and training in the overall range of initial training and the scope of the common part and the specific parts of teaching are defined for:
(a) a basic range of 140 hours in Annex 1;
(b) an extended range of 280 hours in Annex 2.
(2) The maximum number of participants in the entry training course is 30 persons.
DETERMINATION OF TRAINING LIQUIDITY OF RANGE FOR THE PURPOSES OF PROFESSIONAL ELIGIBILITY OF RANGE
Entry and regular training
Teaching the theory of advanced rational driving and safe and defensive driving
(Paragraph 47 (6) of the Law)
(1) The common part of teaching the theory of advanced rational driving and safe and defensive driving principles for all categories of driving licences is aimed at
(a) the characteristics of the transmission system for the optimum use of the torque and power curve, the specific fuel consumption, the optimal driving by speed meter, the area of optimal use of the number of speeds when gear is being arranged;
(b) the technical characteristics and operation of the safety controls for driving the vehicle, the minimisation of wear and the prevention of disturbances in its functions;
(c) limits on the use of brakes and retarder, combined use of brakes and retarder, use of the relationship between vehicle speed and transmission ratio, use of vehicle inertia, use of deceleration and braking modes when driving on slopes, interference in the event of failure, use of electronic and mechanical devices such as electronic stability programme (ESP), advanced emergency braking systems (AEBS), anti-lock braking system (ABS), traction control systems (TCS) and on-board monitoring systems (IVMS), and other assistance or automation devices approved for use;
(d) optimisation of fuel consumption, the importance of forecasting traffic flows, compliance with adequate distance from other vehicles and the use of vehicle momentum, steady driving speed, smooth driving style and proper tyre pressure and awareness of intelligent transport systems that improve driving efficiency and assist in route planning;
(e) defensive driving technique, safe driving principles, crisis management,
(f) anticipation and assessment of road traffic risks under different road conditions, traffic and weather conditions and adaptation of the management method to these risks, planning of the journey during exceptional weather conditions, decisions when to postpone or cancel the journey due to extreme weather conditions, adapting the management method to traffic risks, including dangerous behaviour in transport or dispersion while driving;
(g) the ability to identify dangerous situations and to manage the stress arising from this, in particular in relation to the size and weight of vehicles and vulnerable road users and to adapt the management method, to anticipate potentially dangerous situations and to take appropriate measures to enhance safety to the extent possible to prevent them.
(2) A specific part of the teaching of advanced rational driving theory and safe and defensive driving principles for categories of driving licences C, C + E, C1, C1 + E includes the teaching of the loading of the vehicle with regard to the safety rules and proper use of the vehicle with a focus on vehicle forces in motion, the use of the transmission ratio of the corresponding vehicle load and road profile, the use of automatic transmission systems, the calculation of the useful load of the vehicle or the combination of vehicles, the calculation of the load distribution, the consequences of the axle overload, the stability of the vehicle and its centre of gravity, the types of packaging and the pallets, the main groups of items requiring security, the clamping and locking equipment, the use of the handling equipment, the location and covering the sail and its removal.
(3) A specific part of the teaching of advanced rational driving theory and safe and defensive driving principles for categories of driving licences D, D + E, D1, D1 + E contains teaching
(a) the ability to provide passengers with comfort and safety with the aim of adapting the journey to the longitudinal and lateral fluctuations of the vehicle, taking into account other road users, the favourable position of the vehicle on the road, defined lanes, continuous braking, the use of specific roads such as roads reserved for certain users, the handling of possible discrepancies between the requirement for safe driving and other tasks to be performed by the driver, negotiations with passengers, the specificities of certain categories of passengers, such as persons with reduced mobility or orientation and children;
(b) loading of the vehicle with regard to the rules of safety and proper use of the vehicle with a view to the forces acting on the vehicle in motion, the forces acting on passengers, the use of an appropriate transmission ratio of the corresponding vehicle load and road profile, the use of automatic transmission systems, the calculation of the payload of the vehicle or combination of vehicles, the calculation of the useful volume, the distribution of the load, the effects of the axle overload, the stability of the vehicle and its centre of gravity, the peaceful braking.
Teaching the application of national and international legislation relating to road transport
(Paragraph 47 (6) of the Law)
(1) The common part of teaching the application of national and international legislation relating to road transport for all categories of driving licences includes teaching aimed at:
(a) driver mode, driving time, rest periods and safety breaks;
(b) the application of the Europe Agreement on the work of vehicle crews in international road transport (AETR) 1, Regulation (EC) No 561 / 2006 of the European Parliament and of the Council on the harmonisation of certain social legislation relating to road transport, amending Council Regulations (EEC) No 3821 / 85 and (EC) No 2135 / 98 and repealing Council Regulation (EEC) No 3820 / 85 and the directly applicable European Union tachographs in road transport17),
(c) the relationship between the regulations referred to in point (b) and Act No. 111 / 1994 Coll., on road transport, as amended;
(d) penalties for infringements of the provisions referred to in points (b) and (c);
(e) shipments outside the scope of Regulation (EC) No 561 / 2006;
(f) exemptions falling outside the scope of the Europe Agreement on the work of vehicle crews in international road transport (AETR);
(g) the driver's mode of transport under Decree No. 478 / 2000 Coll., implementing the Road Transport Act, as amended,
(h) the specificities of the working time of drivers under Government Decree No. 589 / 2006 Coll., which provides for a derogation from the working and rest periods of workers in transport,
(i) drivers' rights and obligations in relation to the qualification and regular training of drivers;
(j) technical competence of vehicles;
(k) road traffic rules;
(l) customs legislation,
(m) differences in legislation in certain neighbouring countries;
(n) the basis of liability for damage caused by vehicle operation (2).
(2) A specific part of the teaching of the application of national and international legislation relating to road transport for categories of driving licences C, C + E, C1, C1 + E includes teaching on:
(a) authorisation to operate the traffic;
(b) documents which, under other legislation, must be in the vehicle;
(c) obligations under standard freight contracts;
(d) the meaning and content of the documents constituting the contract of carriage;
(e) authorisation for international transport;
(f) obligations under the Convention on the Transport Contract in International Road Freight Transport (CMR) 3;
(g) the importance and content of international loading lists;
(h) crossing the border;
(i) a representative of the shipping companies;
(j) specific documents accompanying the goods carried;
(k) the European Agreement on the International Carriage of Dangerous Goods by Road (ADR) 4;
(l) the Agreement on International Transfers of Spoilable Food and on Specialised Means for Such Transfers (ATP) 5;
(m) restrictions on the movement of certain vehicles;
(n) the use of toll-charged infrastructure.
(3) A specific part of the teaching of the application of national and international legislation relating to road transport for categories of driving licences D, D + E, D1, D1 + E contains teaching aimed at:
(a) carriage of special groups of persons;
(b) bus safety equipment,
(c) a restraint safety system,
(d) the loading of the vehicle;
(e) Council Regulation (EEC) No 684 / 92 on common rules for the international carriage of passengers by coach and bus;
(f) Council Regulation (EC) No 12 / 98 laying down the conditions under which a non-resident carrier may operate national road passenger transport services within a Member State;
(g) Commission Regulation (EC) No 2121 / 98 laying down detailed rules for the application of Council Regulations (EEC) No 684 / 92 and (EC) No 12 / 98 as regards documents for the carriage of passengers by coach and bus;
(h) Agreement on the international occasional carriage of passengers by coach and bus (INTERBUS), including Annex 6;
(i) the Convention on a Transport Contract in the International Carriage of Passenger and Luggage by Road (CVR) 7;
(j) timetables for public passenger regular transport8),
(k) the timetable for public rail and road passenger transport (9).
Training of vehicle safety and environmental operation
(Paragraph 47 (6) of the Law)
(1) The common part of the teaching of the safety of the operation and of the environmental operation of the vehicle for all categories of driving licences includes teaching aimed at:
(a) economy and ecology of driving;
(b) maintenance and control;
(c) starting and preparing the vehicle before driving;
(d) principles of labour safety and possible risks.
(2) The specific part of the training of the safety of the operation and the environmental operation of the vehicle for categories of driving licences C, C + E, C1, C1 + E contains the training aimed at:
(a) cargo ride;
(b) loading and composition of the load with regard to different types of cargo, such as bulk or liquid materials, containers;
(c) the fixing of loads and loads;
and the practical part aimed at preparing the vehicle, maintenance, inspection, replacement of tyres and the use of winter chains.
(3) The specific part of the training of the safety and environmental operation of the vehicle for categories of driving licences D, D + E, D1, D1 + E includes the training for the safe transport of persons and the practical part for the preparation of the vehicle, maintenance, inspection, replacement of tyres and the use of winter chains and loading and unloading of luggage.
Teaching services and logistics
(Paragraph 47 (6) of the Law)
(1) The common part of teaching the provision of services and logistics for all categories of driving licences includes teaching aimed at:
(a) an introduction to logistics;
(b) basic terms;
(c) the role of logistics and traffic trends;
(d) decision-making in logistics;
(e) driver and undertaking;
(f) driver and customer,
(g) organisation of work;
(h) advertising on a wagon;
(i) logistics and the environment.
(2) The specific part of teaching the provision of services and logistics for categories of driving licences C, C + E, C1, C1 + E includes teaching on:
(a) driver and spec;
(b) structures of distribution and trade chains;
(c) retail supplies, direct deliveries from production to stores, direct sales and mail order.
(3) A specific part of the teaching for categories of driving licences D, D + E, D1, D1 + E contains a training course aimed at:
(a) drivers and passengers, behaviour of drivers;
(b) addressing problem situations with non-compliant passengers.
Training of the economic environment and organisation of the transport market
(Paragraph 47 (6) of the Law)
(1) The common part of the teaching of the economic environment and of the organisation of the transport market for all categories of driving licences includes teaching aimed at:
(a) transport rights;
(b) the specificities and principles of transport business;
(c) transport and performance;
(d) the transport process;
(e) working conditions and welfare.
(2) The specific part of the teaching of the economic environment and of the organisation of the transport market for categories of driving licences C + E, C1, C1 + E contains the teaching of:
(a) the economic environment of road freight transport and the organisation of the market;
(b) road transport relationship to other modes of transport (competition, shippers),
(c) various transport activities such as custom transport and in-house transport;
(d) auxiliary transport activities;
(e) the organisation of major transport undertakings and ancillary transport activities;
(f) transport specialisations such as tanker transport and controlled-temperature transport;
(g) industrial changes such as diversification of services provided, combined transport with rail or subcontracting.
(3) A specific part of the teaching of the economic environment and of the organisation of the transport market for categories of driving licences D, D + E, D1, D1 + E contains a study aimed at:
(a) the economic environment of passenger transport and the organisation of the market;
(b) the relationship between road passenger transport and other modes of passenger transport, such as rail transport and individual passenger transport,
(c) various road transport activities;
(d) crossing borders in international transport;
(e) the organisation of major types of road passenger transport undertakings;
(f) transport of disabled persons.
Teaching social and legal environment in road transport
(Paragraph 47 (6) of the Law)
(1) The common part of teaching the social and legal environment in road transport for all categories of driving licences includes teaching aimed at:
(a) behaviour promoting a favourable image of the undertaking;
(b) the relationship between the driver's behaviour and the image of the undertaking;
(c) the quality of the service provided by the driver, the importance for the undertaking;
(d) the various roles of the driver, the people to be dealt with by the driver;
(e) organisation of work;
(f) the commercial and financial consequences of the legal dispute;
(g) the rights and obligations of drivers in training.
(2) A specific part of the social and legal environment in road transport for categories of driving licences C, C + E, C1, C1 + E includes teaching on:
(a) trade;
(b) transport documents;
(c) international road transport contracts;
(d) spec.
(3) A specific part of the social-legal environment in road transport for categories of driving licences D, D + E, D1, D1 + E contains a training course aimed at:
(a) transport of special groups of passengers;
(b) restraint systems;
(c) the loading of the vehicle.
Training and prevention of health risks on the road
(Paragraph 47 (6) of the Law)
Training and in-service prevention of health risks
(a) the risk of road traffic and accidents at work;
(b) types of accidents at work in the transport sector;
(c) statistics on road traffic accidents;
(d) the impact of lorries and buses on the risks of accidents at work;
(e) the health, material and financial consequences of accidents at work;
(f) ability to prevent health risks;
(g) ergonomic principles,
(h) movements and positions representing hazards;
(i) fitness,
(j) safety in cargo handling;
(k) protective equipment;
(l) physical and mental fitness and care;
(m) principles of healthy and balanced nutrition;
(n) the effects of alcohol, drugs or other addictive substances and medicines which may affect behaviour or psychological or medical conditions,
(o) symptoms, causes and effects of fatigue and stress,
(p) the essential role of the basic work and rest cycle.
