DECLARATION
of 10 June 2013
amending Decree No. 418 / 2001 of the Ministry of Justice Coll., on procedures for execution and other activities, as amended
The Ministry of Justice provides, pursuant to § 49 (4) and § 131 (e) of Act No. 120 / 2001 Coll., on judicial executors and enforcement activities (Enforcement Regulations) and amending other laws, as amended:
Decree No. 418 / 2001 Coll., on procedures for the execution and other activities, as amended by Decree No. 463 / 2009 Coll. and Decree No. 491 / 2012 Coll., is amended as follows:
1. In Article 2 (3) and (5), the word "other 'shall be inserted after the words" money or'.
2. In Article 4 (1) (f), the words "goods, listed securities or instruments administered by the monetary institution to the debtor or kept by the debtor or by the debtor or by the monetary institution 'are replaced by the words" which are managed by the monetary institution or which is held by the debtor or by the obliged institution'.
3. The following Section 5a is inserted after Section 5:
The format and structure of the data file, which is an annex to the execution order and an annex to the notification that the conditions laid down in Section 52 (3) of the Act have been met, if the execution is carried out by collisions from other income paid by the Czech Labour Office or the Czech Social Security Administration, and the data file by which the Office of Labour of the Czech Republic or the Czech Social Security Administration gives the executor an indication of the obligation to be recovered from the execution, are set out in Annex 2 to this decree. "
4. In Paragraph 10a (2), "2 'is replaced by" 3'.
5. In Section 13, the words "or a payment order from an account with a money institution 'are deleted.
6. in Article 16, the title of Article 16a and Article 16a (1), the word "real estate" is replaced by "real estate."
7. In Article 16, the word "undertaking 'is replaced by" business establishment'.
8. In Article 16a (1), the words "or the reservation of repurchase 'shall be inserted after the words" the right to buy'.
9. In Paragraph 16a (1), the words "and rental 'are replaced by the words", exchange and lease, coupage or pre-purchase'.
10. The following Annex 2 is inserted after Annex 1:

Format and structure of the data file containing information on the execution order and on the notification of execution
This Annex sets out the definition of the data contained in the data file accompanying the routinely issued execution order or notification of execution, as well as the rules for the data transmission itself.
1. General rules for data files
a) Data file uses XML syntax (eXtensible Markup Language).
b) The file is encoded in UTF-8.
c) For element and attribute names it is necessary to distinguish large and small letters.
(d) One data file corresponds to one execution order and one person or husband of the debtor - the recipient of the affected benefit, or one notification of compliance under Paragraph 52 (3) of the Act (notification of execution and, where applicable, the legal power of the execution order).
e) The name of the data file accompanying the execution order consists of the following:

(f) The data file shall always be sent together within a single data message with an electronic copy of the execution order or, where appropriate, a notification of execution.
(g) The recipient of the data file attached to the execution order shall send back the data message to the sender of any format containing at least the information on the enforcement obligations (as specified by the sender in accordance with point 3 (i) of this Annex) and the reference number of the instrument to be endorsed.
h) Data set meets xsd definition published by the Ministry of Labour and Social Affairs.
2. Transmission of data
On completion of the execution order, the executor shall attach the data file and send it to the data box information system (ISDS) within one message.
3. Structure of the data file for the execution command
a) The data file contains just one element exPrikaz.
(b) The root element exPrikaza must contain the subterms of the header, the quad, the levy, the obligations and the payment.
c) The header element describes the basic data of the execution order, may contain executive _ titles and posteni _ ex, and the following elements with dates:

Rules on the labelling of persons:
For persons the identifier and its type, i.e. the birth number or the IČO is given.
Persons are numbered in the cis attribute, where applicable legal or other representation is expressed in the cis attribute, where the entity to which the representation relates is identified (value of its cis attribute). There must be sufficient data in the element to identify the person clearly, so the following rules must be followed:
The legal person is designated with the help of the IČO and the company.
The natural person shall be identified by:
Names, surnames and birth numbers
or Names, Surname and IČO
or names, surname, date of birth and address of place of permanent residence or, where applicable, residence
g) If the entity's address needs to be completed, the element usastnik contains an empty element address with the following attributes:

(h) Element penalised _ davka contains one blank element of the davka in which the payer's attribute is marked with the batch payer and the recipient's attribute is marked with the serial number (attribute cis element ucastnik) by the party who acts as a compulsory party and is the recipient of the affected income or benefit.

(i) The element of the obligation describes the obligations imposed under the execution procedure and, therefore, the amount of the claim which is enforced by the execution order. The element of the obligation may contain attributes:

The individual obligations are numbered in the cis attribute or, where applicable, if the obligation is related to or otherwise based on another obligation, it is expressed in the cis attribute where the obligation to which it relates is indicated (the value of its cis attribute).

4. Structure of the data file to notify the execution / legal power of the execution order
a) The data file contains just one root element understood.
b) The root element of the notification must contain the elements of the header _ ep, the executor and the entity _ collisions.
(c) Element of the header _ ep and contains information on the date of execution or the date of acquisition of the enforcement order (if this time after the date on which the execution may take place) within the meaning of Article 46 (6) of the Act:

Rules for filling in the element header _ ep:
Elements of spzn _ predcisli, spzn _ strain, spzn _ end and ep _ issued are used for identifying a single execution order, then the date in the element ep _ right power must be completed. The vp _ file extension contains the file name that accompanies this data file.
(d) Element of the entity _ collisions contains information on the person against whom the execution is carried out by a deduction from wages or other income. The structure of the data as well as the rules for filling the element is exactly the same as the element of the usastnik from point 3 (f), or it may contain an address indicating the address in the structure referred to in point 3 (g), if necessary to identify the person.
5. Special data types
(a) The data type of the second claim may contain only values of the String type in a range of 12 characters, plus only values corresponding to the following final statement:
PREDNOSTNI, NEPREDNOSTNI
b) The data type DruhUcastnika indicates the status of the participant in the execution procedure, may contain only the values of the String type in the range of 2 characters, plus only the values corresponding to the following final listing:
P - mandatory, M - husband of the debtor, O - authorised, PZ - legal representative, OZ - general agent, ZZ - legal representative
c) Data type Second Persons denotes the status of a person, can contain only the values of the String type in the range of 2 characters, plus only the values corresponding to the following final listing:
P - legal person, F - natural person
(d) The data type Second Obligation indicates the obligation, may contain only the values of the String type in a range of 20 characters, plus only the values corresponding to the following final enumeration:
The principal, repeated _ full, no matter what, owes _ due, no matter what, owes _ balance, interest _ interest, interest _ interest, interest _ interest, fee _ interest, interest, contract _ fine, expenses _ pre _ interest, expenses _ interest, expenses _ appeals, etc.
e) Secondary data type indicates the obligation, may contain only the values of the String type in the range of 2 characters, plus only the values corresponding to the following final enumeration:
D - day, T - week, M - month, R - year
f) The data type of the Secondary Identifier indicates the participant identifier, may contain only the values of the String type in a range of 5 characters, namely RC or ICO. In case of the introduction of another suitable generally used identifier, the list may be extended.
(g) The data type of the Secondary Payment indicates the payer of the deducted dose, can contain only the values of the String type in the range of 5 characters, plus only the values corresponding to the following final reading: CSSSZ, UP
h) The data type of DruhDect indicates the method of deduction (common, with read, without deduction, total reading), can contain only the values of the String type in the range of 15 characters, plus only the values corresponding to this final enumeration: bezony, with _ deduction, without _ deduction, cell _ batch.
6. Current data types
(a) The String data type corresponds to the alphanumeric string, the maximum length determined by the column "Range" in tables describing the elements and attributes.
b) The Integer data type corresponds to the whole number.
c) The Decimal data type corresponds to the decimal, the decimal is separated by the dot symbol.
d) The Boolean data type corresponds to the calculation type with the permissible values 0 and 1 (true and false if applicable).
e) Data type Date corresponds to the entry date in the order of year, month and day (YYYY-MM-DD). '.
Annex 2 is renumbered Annex 3.
Transitional provision
The provisions of Section 16a of Decree No. 418 / 2001 Coll., as effective before the date of entry into force of the Decree, shall apply to enforcement proceedings initiated before the date of entry into force of this Order.
Efficacy
This Decree shall take effect on 1 July 2013, with the exception of points 1, 2 and 6 to 9 of Article I, which shall take effect on 1 January 2014.
