ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 30 March 2020
on the adoption of crisis measures
Following the Government Resolution 194 of 12 March 2020, the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status for the territory of the Czech Republic because of a health threat related to the detection of coronavirus / referred to as SARS CoV-2 / in the territory of the Czech Republic and pursuant to § 5 (a) to (e) and § 6 of the Act No. 240 / 2000 Coll., on crisis management and on the amendment of certain laws (Crisis Act), as amended, for dealing with a crisis situation, the adoption of emergency measures, by virtue of § 5 (c), (d) and § 6 (1) (c) of the Crisis Act.
Government with effect from 30 March 2020
I. prohibits all employees of critical infrastructure entities under § 2 (k) of the Crisis Act who, in the performance of their tasks, participate in the provision of critical infrastructure element function within the meaning of Government Regulation No 432 / 2010 Coll., on criteria for determining critical infrastructure element, as amended by Government Regulation No 315 / 2014 Coll., (hereinafter referred to as "critical staff"), drawing leave during the emergency period, except for persons to whom quarantine has been ordered;
II. Orders all critical employees
1. stay in the course of security breaks and outside working hours, including the time of food and rest breaks, exclusively in places designated by their employer except:
(a) journeys strictly necessary to procure their own basic needs;
(b) travel to health facilities strictly necessary for the provision of urgent health services to the staff member;
(c) journeys strictly necessary to deal with their own urgent official affairs;
where a critical staff member is obliged, in the cases referred to in points II / 1a to (c) of this resolution, to notify his employer in advance of any such journey and, if such prior notification is not possible, to inform his employer as soon as possible,
2. where they find themselves in direct contact with a person who has been confirmed with COVID-19, without adequate personal protective equipment ("risk contact"), to inform their employer without delay;
III. Ordering all critical infrastructure entities under Section 2 (k) of the Crisis Act to operate a critical infrastructure element (the employer concerned),
1. Ensure that all critical staff who are ordered to stay in a place other than their place of residence, free of charge accommodation and other necessary living conditions, including the provision of:
(a) the basic needs of these staff,
(b) adequate contact between these staff members and family and close persons;
(c) at the request of a staff member, the care of persons close to or of animals kept by that staff member who would normally be provided by that staff member in person and who, as a result of the restriction of freedom of movement referred to in point II, cannot exercise properly,
(d) at the request of a staff member of the management of the assets of that staff member who, as a result of the restriction on freedom of movement referred to in point II, is unable to exercise properly,
2. ensure conditions for critical staff who have had risk contact so that those critical staff can comply with all the rules under this measure;
3. in connection with the risk contact of a critical staff member, comply with the following rules:
(a) where the employer concerned finds that his critical employee has had a risk contact, he shall decide whether the work carried out by the critical employee is necessary to ensure the function of the relevant critical infrastructure element operated by the employer concerned;
(b) if the work carried out by a critical worker is not necessary to ensure the function of the relevant critical infrastructure element operated by the employer concerned, the employer concerned shall inform the local competent public health authority which shall order the critical staff of the quarantine;
(c) where the work performed by the critical staff member is necessary to ensure the function of the relevant critical infrastructure element operated by the employer concerned, the employer concerned and the critical staff member shall proceed in accordance with point IV of this resolution; the employer concerned shall notify the competent public health authority, locally,
(d) if, within 14 days of the risk contact, any known clinical signs of COVID-19 disease or any of the tests carried out in accordance with point IV are detected by a critical worker. the resolution will have a positive outcome, then the employer concerned shall inform locally the competent public health authority which shall order the critical staff member to quarantine or isolation;
IV. Instructs all critical employees without clinical signs who have had risk contact and whose work is necessary to ensure the function of the relevant critical infrastructure element operated by the employer concerned to comply with the following rules:
1. a critical employee works with an FFP2 class respirator without an exhalation valve for 14 days;
2. a critical employee uses one respirator for a maximum period of 8 hours;
3. Critical employee uses the room for rest and meals without the presence of another person,
4. A critical employee works in such a mode of work to minimise contact with other workers,
5. Critical staff member shall limit the movement of the workplace to the necessary level;
6. the critical staff member shall, at the beginning of each shift immediately prior to the start of the work, measure the body temperature and communicate the result of the temperature measurement and his current state of health and any medical difficulties to the superior staff member;
7. Critical staff member shall undergo a test on SARS-CoV-2 in 5 days from the risk of contact of the nosehltan swab with the RT-PCR and a rapid test of capillary blood for IgM and IgG antibodies,
8. In the event of a negative result of the two tests referred to in point IV / 7 of this resolution, the critical staff member shall continue to perform his work and, 14 days after the risk contact, shall undergo a second sample of the nosalate with the RT-PCR test for SARS-CoV-2 and a second rapid test of capillary blood for IgM and IgG antibodies,
9. In the event of a negative outcome of the two examinations referred to in point IV / 8 of this resolution, the critical staff member shall continue to work under normal work arrangements;
V. instructs public health authorities and health service providers to avoid quarantine for critical workers who have no clinical signs of risk contact and whose work is necessary, according to the employer's decision, to ensure the function of the relevant critical infrastructure element operated by the employer concerned, provided that the staff member and the employer concerned comply with the procedures set out in paragraph IV. of this resolution and none of the examinations carried out under paragraph IV. of this resolution are positive;
VI. Provides that the exemption from the prohibition on the sale of accommodation services provided for in Article I (7) of the extraordinary measure of the Ministry of Health of the Czech Republic of 26 March 2020, No. MZDR 13361 / 2020-1 / MIN / KAN, also applies to the sale and provision of accommodation services while providing accommodation for critical employees under point III of this resolution.
