concerning the Agreement establishing an Organisation for Cooperation in the Steel Industry and the Statute for an Organisation for Cooperation in the Steel Industry of Intermetal
On 15 July 1964, an Agreement was signed in Moscow between the Governments of the Czechoslovak Socialist Republic, the People's Republic of Hungary and the People's Republic of Poland on the establishment of an iron steel cooperation organisation and the Statute of the Intermetal steel cooperation organisation.
The Government of the Czechoslovak Socialist Republic agreed to the Agreement and the Statute on 9 September 1964.
Pursuant to Article XII thereof, the Agreement and the Statute for the Czechoslovak Socialist Republic entered into force on 2 November 1964.
The Czech translation of the Agreement and the Statute is announced simultaneously.

AGREEMENT
establishing an Organisation for Cooperation in the Steel Industry
the Governments of the People's Republic of Hungary, the Polish People's Republic and the Czechoslovak Socialist Republic,
following the principles of international socialist division of labour,
Desiring to ensure better satisfaction of the economic needs of iron metallurgy products by using new more effective means of cooperation for the rational use and development of the production capacities of the Contracting Parties and to increase the technical and economic level of production,
Recalling that close cooperation on the basis of equality, mutual advantages and mutual assistance will create conditions for further development of production,
have decided to conclude the following Agreement:
1. The Parties hereby establish an Organisation for the Coordination of Production and Development and Cooperation in the Steel Industry, called Intermetal, by this Agreement.
2. The seat of Intermetal is in Budapest.
Intermetal shall operate under this Agreement and the Statute, which shall form an integral part of the Agreement.
Intermetal's activities include the coordination of production and development and cooperation in the field of rolling material, steel pipes and in the agreed extent in the field of metallurgical products.
The main tasks of Intermetal are:
1. develop proposals to specialise in the production of iron metallurgy and measures to implement such proposals;
2. develop proposals for coordination of the detailed product structure of the iron metallurgy production plans of the Contracting Parties;
3. develop a common methodology to coordinate and use quarterly production programming in the work of Intermetal;
4. develop proposals to focus on unifying standards and technical supply conditions and to assist their implementation;
5. keep records of investment projects, carry out their analyses and develop proposals for their coordination;
6. to draw up a single nomenclature of iron metallurgy products and other equipment necessary for the work of Intermetal;
7. take measures to make use of temporary spare production capacities in the iron metallurgy;
8. To facilitate the introduction and expansion of the production of deficient iron metallurgy products;
9. Organise the use of iron metallurgy products;
10. Improve the principles and modalities of the exchange of iron metallurgy products.
Intermetal's tasks will be carried out gradually as conditions are created for this.
Intermetal is a legal person.
1. The Council shall manage the work of Intermetal. The Parties shall be represented in the Council by delegations composed of three representatives, one of whom shall be the Head of Delegation. Each delegation shall have one vote.
2. The Council shall be led by the President elected by the Council from the Heads of Delegation of the Parties.
3. The Council shall discuss issues related to Intermetal's activities and shall act on decisions or recommendations only with the agreement of the Heads of Delegation of all Contracting Parties.
4. Decisions may concern both the substance of the questions under consideration and procedural questions. They shall be valid from the date of signature of the Protocol on the Council meeting, unless otherwise specified therein.
5. Recommendations shall be made by the Contracting Parties on the basis of decisions taken by their competent authorities.
6. The Council shall establish the annual and multiannual plans of Intermetal and shall examine the progress of their implementation.
The Council shall establish the rules of organisation and procedure of the bodies of Intermetal.
8. The Heads of Delegation of the Parties shall inform the Council of the implementation of the Council's decisions and recommendations.
1. Intermetal's permanent executive body is the Office.
2. The Office shall consist of the Director, its Deputy Directors, the necessary number of experts and administrative technical staff who are citizens of the Contracting Parties. As administrative technical staff, citizens of the State in whose territory the seat of Intermetal is established are generally recruited.
3. The director is in charge of the office. The Director, his deputy and experts shall be appointed and dismissed by the Council. The Director shall be accountable to the Council for the implementation of the Council's orders and for all activities of the Office.
4. The Director shall represent Intermetal to the extent laid down in the Statute.
5. The organisational structure of the Office, its systemisation and working and wage conditions of its staff shall be determined by the Council.
The Contracting Parties agree that the Government of the People's Republic of Hungary will provide Intermetal with adequate rooms and facilities.
1. The Contracting Parties shall bear the costs of Intermetal's activities equally.
2. Contributions to the financing of Intermetal shall be non-commercial payments and shall be paid by the Contracting Parties on a semi-annual basis under the applicable payment agreements between the Contracting Parties.
3. The cost of staying the members of the meetings and meetings held in the framework of Intermetal shall be borne by the State sending its representatives to those meetings and meetings. The costs of providing rooms and technical means for such meetings shall be borne by the State in whose territory such meetings and meetings shall be held.
4. Intermetal shall be financed on the basis of a budget for a period of one year.
5. The budget shall be established and the report shall be approved by the Council.
(6) The Financial Action Directive for Intermetal shall be established by the Council.
7. The Office's financial activities shall be examined by the review committee set up by the Council. The rules of organisation of the review committee shall be laid down by the Council.
This Agreement shall not affect the rights and obligations arising from contracts concluded between the Contracting Parties or with other States.
The official languages of Intermetal are the languages of the Contracting Parties. Intermetal's working language is Russian.
This Agreement shall require approval by the Governments of all Contracting Parties and shall enter into force 30 days after the date of the submission of the last document of approval by the depositary, which shall be communicated by the depositary to all Contracting Parties.
This Agreement shall be deposited with the Government of the People's Republic of Hungary, which shall be the depositary of the Agreement.
1. The Agreement shall be negotiated for an unlimited period.
2. The Agreement may be amended only with the agreement of all Contracting Parties.
3. Other States may accede to this Agreement with the agreement of all Contracting Parties. The State wishing to accede to this Agreement shall make a declaration to the depositary.
4. Each Contracting Party may terminate this Agreement by notifying its denunciation through the depositary to the other Contracting Parties by the end of February. The denunciation of the Agreement shall take effect from 1 January of the following year.
The Agreement was drawn up in one copy in Russian. The depositary shall send certified copies of the Agreement to all Contracting Parties.
This Agreement has been signed by the agents of the Contracting Parties to prove this.

STATUT
Intermetal steel cooperation organisation
I. General provisions
1. The tasks of Intermetal are laid down in the Agreement on the Establishment of an Organisation for Cooperation in the Steel Industry, signed in Moscow on 15 July 1964.
2. Intermetal shall perform its tasks by its bodies, the Council, the Office and the Review Commission.
3. Intermetal as a legal person may acquire rights and undertake to the extent necessary for the performance of its tasks.
II.
4. The Council as Managing Authority of Intermetal
(a) determine the focus of work on the fulfilment of tasks and the way in which they are implemented;
(b) establish the annual and multiannual work plans for Intermetal and approve the annual activity reports;
(c) establish the annual budget and approve the report on its implementation;
(d) establish the Council's Rules of Procedure and the Rules of Procedure of the Office and of the Review Commission;
(e) appoint and dismiss the Director of the Office and its Deputy Directors, define their powers and responsibilities, appoint and dismiss experts and lay down the terms and conditions of employment and pay of such officials;
(f) establish the organisational structure and systemisation of the Office; the national breakdown of functions shall be indicated in the systemisation;
(g) appoint a chairman and members of the review committee on a proposal from the Heads of Delegation and approve the report on its activities.
5. The governments of the Contracting Parties shall appoint delegations composed of the Head and two other representatives as well as alternates of Heads of Delegation. The appointment and withdrawal of Heads of Delegation, their alternates and other representatives shall be notified by the Contracting Parties to the President of the Council.
6. The President of the Council shall convene Council meetings, negotiate with the Heads of Delegation the agenda of the Council meetings, manage the Council meetings and monitor the Office's activities. He shall act at the same time as Head of Delegation of his State at Council meetings.
7. In the Presidency of the Council, the Heads of Delegation shall alternate in the manner and within the time limits set by the Council. If the President of the Council is unable to perform his duties on a temporary basis, he shall be transferred to his alternate in the delegation.
The Council shall meet as necessary and at least every six months. Meetings of the Council shall be convened by the President on the basis of an action plan, from a Council decision or on a proposal from one of the delegations. It may also convene meetings on a proposal from the Director of the Office.
9. Decisions and recommendations shall normally be taken by the Council with the participation of all delegations at its meetings. In exceptional cases, the Council may decide on a case-by-case basis on the basis of a query by delegation.
The Protocol on Council meetings shall be signed by the Heads of Delegation. The original protocol is stored in the Office. The certified copies of the Protocol shall be sent to the Head of Delegation in the Council.
11. The Director of the Office and its Deputy Directors shall attend Council meetings.
III. Office
12. The Office, as the permanent executive body of Intermetal, shall carry out the work of a technical and administrative nature necessary to comply with Council orders; in particular:
- carry out operational work related to the preparation and implementation of measures of a technical economic nature,
- prepare materials for Council meetings,
- organise meetings of the Council,
- records the decisions and recommendations of the Council and their implementation,
- actively prepares proposals on Intermetal's activities.
13. The Office shall be managed by the Director under the authority of the Council. The Director shall have Deputy Directors representing him in full, if necessary, his rights and duties and, at the same time, manage the designated sections of the Office's activities.
14. The Director of the Office, its Vice-Presidents and experts shall, on a proposal from the Contracting Parties, be appointed by the Council, as a general rule, for three years.
15. During the periods between Council meetings, the Director of the Office shall, within the limits of his competence, take operational measures in accordance with Council resolutions and with the action plan and inform the President of the Council of the progress of the work.
16. Director of the Office
- requires the information and documentation necessary for the work of Intermetal from the authorities and organisations designated by the Heads of Delegation,
- convene, where appropriate, expert consultations to discuss or examine certain issues,
- has the funds of Intermetal in accordance with the established budget and guidelines for the economic activity of Intermetal,
- receives and releases administrative technical staff of the Office according to approved systemization and determines their salaries.
17. The Director shall represent Intermetal vis-à-vis the official persons and organisations of the Parties and other States, international organisations and in the relations in which Intermetal acts as a legal person.
IV. Financial issues
18. The annual budget of Intermetal shall consist in particular of the following cost items:
(a) administrative costs, including expenditure on Office staff, and expenses on services and reimbursement of work carried out for Intermetal by other organisations;
(b) amortisation depreciation for the provision of rooms and equipment by the Government of the People's Republic of Hungary.
V. Revision Commission
19. The Revision Committee shall be set up by the Council; It shall be composed of members appointed by the Council on a proposal from the Heads of Delegation of the Parties for one of each State for a period of three years.
In the presiding committee, members shall alternate each year in the order of the names of the States according to the Russian alphabet.
20. The Revision Committee shall be subordinate to the Council.
21. The Revision Committee shall examine in particular the accuracy of the management of the funds, the disposal of other assets and the keeping of accounting records, the treasury agenda and the accounts.
22. Membership of the review committee is incompatible with any other function in Intermetal.
23. The Office is obliged to create appropriate conditions for the work of the Review Committee and to make available to it all the documents and materials necessary for the revision.
24. The costs associated with the activities of the review committee shall be borne by the Intermetal budget.
