DECLARATION
of 11 May 2023
amending Decree No. 177 / 1995 Coll., establishing the construction and technical rules of the runways, as amended
The Ministry of Transport provides, pursuant to § 66 paragraphs 1 and 3 of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll., Act No. 64 / 2014 Coll., Act No. 319 / 2016 Coll., Act No. 367 / 2019 Coll., and Act No. 426 / 2021 Coll., ("Act ') for the implementation of Section 5 (5), Section 7 (1), Section 20 (4) and Section 49o (9) Act:
Čl. I
Decree No. 177 / 1995 Coll., which is published in the Railway Construction and Technical Regulations, as amended by Decree No. 243 / 1996 Coll., Decree No. 346 / 2000 Coll., Decree No. 413 / 2001 Coll., Decree No. 577 / 2004 Coll., Decree No. 58 / 2013 Coll., Decree No. 8 / 2015 Coll., Decree No. 117 / 2017 Coll., Decree No. 48 / 2018 Coll. and Decree No. 269 / 2020 Coll., are amended as follows:
1. In the introductory sentence of the Decree, "§ 5 (3), § 6 (1), § 7 (2) and § 20 (3) 'is replaced by" § 5 (5), § 6 (1) and (2), § 7 (1), § 20 (4) and § 49o (9)'.
2. in Article 5 (2) (a):
'(a) the technical competence of the designated technical equipment, supported by:
1. a licence for a designated technical installation;
(2) EC by a declaration of conformity or suitability for use if it is an interoperability constituent; or
(3) EC declaration of verification, if it is a subsystem, ';
3. In Article 11, the following paragraph 12 is added:
"(12) On a track built for a speed exceeding 200 km / h, if not a section in the tunnel, it shall be maintained between the structures, fixed installations or other obstacles and adjacent tracks of that track free space to protect the structures and fixed installations from aerodynamic loads. Free space shall not be used for the storage of articles which are not firmly linked to the ground, unless otherwise specified by the railway operator. ';
4. In Article 16, the following paragraph 2 is inserted after paragraph 1:
"(2) On a track built for a speed exceeding 160 km / h, it is not permitted to establish a crossing for passengers or the public. ';
Paragraphs 2 to 6 shall become paragraphs 3 to 7.
5. In the first sentence of Paragraph 16 (7), "4 'is replaced by" 5'.
6. In Article 19, paragraph 4 is added:
"(4) In a conveyor on a track built for a speed exceeding 200 km / h, it shall be protected by a direct lateral protection provided solely by deflection tracks.
(a) the main and pre-passable station track from the handling track; and
(b) the main track from the pre-mobile station track. ';
7. in § 23 (1) (d) (3):
'3. if the railway line is national or regional, European train safety system6) or ';
footnote 6:
"(6) Commission Regulation (EU) 2016 / 919 of 27 May 2016 concerning the technical specification for interoperability relating to the control-command and signalling subsystems of the rail system in the European Union, as amended. ';
8. In Article 23 (1) (d) (4), the words "ERTMS / ETCS Train Safety System under European Union Regulation 'are replaced by the words" European Train Safety Systems (ERTMS / ETCS)'.
9. In Article 23, the following paragraph 7 is added:
"(7) For the operation of a safety device on a track built for a speed exceeding 200 km / h, a backup workstation located differently from the main workstation shall be established. ';
10. The following Sections 24a and 24b are inserted after Section 24, including the title and footnote 8:
„§ 24a
When reconstructing or modernising national or regional railway construction, the arrangement of electrical, communication and signalling equipment shall be ensured to enable the operation of an AC traction system with a voltage of 25 kV with a frequency of 50 Hz.
§ 24b
Technical conditions and requirements for the construction of a national track built for a speed exceeding 200 km / h
(1) A national runway built for speeds above 200 km / h is designed to ensure its operational reliability in such a way that:
(a) the duration of the disruption in the operation of the railway transport for which the railway operator is responsible, due to the failures of the runway components (8), did not exceed 1 minute per 1000 train kilometres per given part of the runway during the timetable period;
(b) the duration of each individual failure of the track components with an obstacle to the operation of the runway, for which the runway operator 8 is responsible, does not exceed 200 minutes; and
(c) the number of railway traffic disruptions for which the runway operator is responsible (8) is not more than 15 per 100 km of track length over the timetable period.
(2) A national runway built for a speed exceeding 200 km / h shall be secured against the intrusion of unauthorised persons, animals or the fall of foreign objects on such a runway.
8) Paragraph 4 (1) (b) of Decree No 76 / 2017 Coll., on the content and scope of the services provided by the rail operator and the operator of the service facility. '
11. In Article 26, paragraphs 5 to 7 are added:
"(5) The inspections, the measurement of the construction and verification of the operational parameters of the railway structures built for speeds exceeding 200 km / h shall be carried out at night between twenty-third and five o'clock; in other times, the maintenance of the runway shall be carried out only in exceptional cases and for the necessary time.
(6) Automated diagnostic systems shall be set up on a track built for a speed exceeding 200 km / h to ensure the operational and safety of railway transport, and periodic inspections and measurements of buildings shall be carried out within the time limits set by the railway operator in technological procedures to ensure the operational reliability of such a runway pursuant to Section 24b (1) of this Decree.
(7) The measured values of the technical condition and other facts found at regular inspections which are relevant for ensuring the operability of the runway, including the outputs from the automated diagnostic systems referred to in paragraph 6, must be registered by means of a digital recording system within the time limits set by the railway operator and stored for at least 5 years. "
12. in Paragraph 54 (2), "70" is replaced by "80."
13. In Paragraph 72 (4), the first sentence is replaced by the following: "The cableway shuttle vehicles shall be equipped with a guide operated or remotely operated by external headlamps and a red-coloured end-light, adjustable according to the direction of travel."
14. Paragraph 83 (7) reads:
"(7) Cabin cableway vehicles shall be equipped with secure buttons for emergency shutdown of cableway. ';

Efficacy
This Decree shall take effect on 1 July 2023.
