of 13 June 2018
amending Government Regulation No 48 / 2017 Coll., laying down requirements pursuant to acts and standards of good agricultural and environmental condition for areas of cross-compliance rules and the consequences of infringements for the granting of certain agricultural aid
The Government mandates pursuant to § 2b (2) and § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No 48 / 2017 Coll., on the establishment of requirements according to the acts and standards of good agricultural and environmental condition for areas of cross compliance rules and the consequences of infringements for the granting of certain agricultural aid, is amended as follows:
1. In Annex No 1 to Act No 5 of the Order Number of Requirement 1 in the column Definition of the requirement in the legislation of the Czech Republic, the words "§ 5 (1) and (2) (b) 'are replaced by the words" § 5 (1) (d) and (i)'.
2. In Annex No 1 to Act No 10 to the order number of requirement 5 in the column "Paragraph 51 'is replaced by" Sections 51 (3) and (4) and 51 (8) (c)' and "Sections 3 to 5 'are replaced by" Sections 3 to 5 and 11'.
3. In Annex No 1 to Act No 10 to Order Number 7 in the column "Paragraph 13 (1) and (5) to (7) ', the words" Paragraph 13 (1) and (4) to (6)' are replaced by the words "Paragraph 13 (6) '.
4. In Annex No 1 to Act No 13 to the Order Number of Requirement 1 in the column Definition of the requirement in the Czech legislation, the text "§ 5 (2) (c) 'is replaced by" § 5 (4) (b)'.
5. In Annex No 1 to Act No 13 to the order number of Requirement 3 in the column Definition of the requirement in the legislation of the Czech Republic, "§ 5 (1) (e) and (f), § 5 (2) (b) 'is replaced by" § 5 (1) (d), (e) and (i)'.
6. In Annex No 2, point 1 (b), the words "liquid fertilisers with rapidly released nitrogen 'are replaced by the words" fertilisers with rapidly released nitrogen, excluding solid fertilisers'.
7. In Annex 2, point 5:
"5. The applicant shall ensure that a continuous area is not present within the soil block part of its use with the agricultural culture of standard arable land.
(a) maize, potatoes, beet, beet, soya, sunflower and sorghum of a size between 2,01 and 4 ha, which contains a continuous area of strongly eroded land greater than 2 ha;
(b) maize, potatoes, beet, beet, soya, sunflower and sorghum of a size greater than 4 ha, which contains a continuous area of strongly eroded land greater than 2 ha or whose area is more than 50% covered by strongly eroded land;
(c) oilseed rape and other cereals grown without the use of adequate soil protection technology for these crops of a size between 2,01 and 4 ha containing a continuous area of strongly eroded land greater than 2 ha;
(d) oilseed rape and other cereals grown without the use of adequate soil protection technology for such crops of more than 4 ha, which contains a continuous area of strongly eroded land greater than 2 ha or whose area is more than 50% covered by strongly eroded land;
(e) maize, potatoes, beet, seed, soya, sunflower and sorghum grown without application of the corresponding soil protection technology for these crops of a size of between 2,01 and 4 ha, which contains a continuous area of eroded land greater than 2 ha not referred to in (a); and
(f) maize, potatoes, beet, seed, soya, sunflower and sorghum grown without application of the corresponding soil protection technology for these crops of more than 4 ha containing a continuous area of erosion-vulnerable land of more than 2 ha or the area of which is more than 50% covered by erosion-endangered soil not referred to in (b); the applicant does not have to comply with this condition on a part of a soil block of more than 4 ha, which does not contain a continuous area of erosion at risk of more than 2 ha or whose area is not more than 50% covered by erosion at risk of soil not referred to in point (b).
The applicant may not comply with the condition set out in points (b) and (d) on a part of a soil block of more than 4 ha, which does not contain a continuous area of strongly eroded threatened soil of more than 2 ha or whose area is not more than 50% covered by strongly eroded soil. '
8. In Annex 2, point 6 (a), "a 'is replaced by" a';
9. In Annex No 2, at the end of point 6, the dot is replaced by "a 'and the following point (c) is added:
"(c) the total area referred to in point (b) shall not include the area of the land block parts included in the coverage of the grassland under Paragraph 20 or the grass cover of concentrated effluents under Section 22a of Government Decree No. 75 / 2015 Coll., on the conditions for the implementation of agri-environmental climate measures and amending Government Decree No. 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended, as amended."
10. In Annex 3 to Act No 4, order number 13, in the range row Large, in the column Evaluation and in the row Severity Great, in the column Evaluation, the sentence "For slaughterhouses, the animals for which the withdrawal period has not been respected have been delivered or the animal products for which residues of veterinary medicinal products of Group B1 and B2 have been found have been found to be above the limit value of Council Directive 96 / 23 / EC. 11. 12. In Annex 3 to Act No 7 to the order number of Requirement 5, in the row Severity Medium, in the column Evaluation and in the row Severity Great, in the column Evaluation, the sentence "The denominator of the share is 10 in the holdings where it was sent up to 10 late reports."
13. In Annex 3 to Act No 8 to the order number of requirement 4 in the row Severity Medium, in the column Evaluation and in the row Severity Great, in the column Evaluation, the sentence "The denominator of the percentage 10 is added to the column Evaluation."
14. In Annex 3 to Act No 11, Order No 7 in the "Continuity Unremovable," in the "Evaluation" column, the text "X" is replaced by "Unremovable infringement."
15. In Annex 3 to Act No 11, the serial number of requirement 7 shall be:

23. In Annex 3 to Act No 13, Order No 11, in the Major row, in the column "Animals are not guaranteed access to water or feed at specified intervals for each species and category. Animals show signs of dehydration. In case of insufficient access to feed, the animals are cachectic. 'are replaced by the sentence" The animals are skinny or show signs of dehydration or mortality on the holding due to dehydration or malnutrition'.

Transitional provision
Legal relations arising before the date of entry into force of this Regulation shall be governed by Government Regulation No 48 / 2017 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall be binding in its entirety and directly applicable in all Member States.
