concerning the Convention on the Exchange of Official Publications and Government Documents between States and the Convention on International Exchange of Publications
On 3 December 1958, the Convention on the Exchange of Official Publications and Government Documents between States and the Convention on International Exchange of Publications was adopted in Paris at the X. session of the United Nations General Conference on Education, Science and Information.
On 29 November 1963, a document was filed with the Director-General of the United Nations for Education, Science and Information on the adoption of the abovementioned Conventions by the Czechoslovak Socialist Republic.
On the basis of the relevant provisions, the two Conventions for the Czechoslovak Socialist Republic shall enter into force on 29 November 1964.
The Czech translation of the Treaties is announced simultaneously.

CONVENTION
on the international exchange of publications
adopted by the United Nations General Conference on Education, Science and Information at its 10th session in Paris on 3 December 1958
The United Nations General Conference on Education, Science and Information, meeting at its tenth session in Paris from 4 November to 5 December 1958,
Building on the belief that the development of international exchanges of publications is essential to the free dissemination of ideas and knowledge among nations around the world,
taking into account the importance attached to international exchanges of publications by the United Nations Institute for Education, Science and Information,
recognising the need for a new international convention on the exchange of publications,
familiar with the proposals for international exchanges of publications contained in item 15.4.1 of the agenda of this sitting,
Decide at its ninth meeting that, according to these proposals, the international arrangements should be implemented by adopting an international convention,
adopted the following Convention on 3 December 1958:
Exchange of publications
The Contracting States undertake, in accordance with the provisions of this Convention, to promote and facilitate the exchange of publications between government bodies as well as non-governmental institutions in the form of education, scientific, technical or educational, unless such exchange serves gainful objectives.
Scope of publication exchange
1. Under this Convention, the following publications may be exchanged, but not resales, between the institutions and bodies referred to in Article 1 of this Convention:
(a) publications relating to information, legal, scientific, technical, cultural or information such as books, newspapers, magazines, maps, plans, prints, photographs, microfilms, music, blind publications in Braille and other printed documents;
(b) publications referred to in the Convention on the Exchange of Official Publications and Government Documents between States, adopted by the United Nations General Conference on Education, Science and Information on 3 December 1958.
2. This Convention shall in no way affect the exchange carried out under the Convention on the Exchange of Official Publications and Government Documents between States, adopted by the United Nations General Conference on Education, Science and Information on 3 December 1958.
3. This Convention shall not apply to confidential documents, official circulars and other documents which have not been published.
Exchange service
1. Contracting States may entrust a national exchange service or, if the national exchange service, centre or exchange centre does not fulfil the following development and coordination tasks between the institutions and bodies referred to in Article 1 of this Convention:
(a) facilitate the international exchange of publications, in particular by sending appropriate materials for exchange;
(b) provide advice and information on exchange options to domestic and foreign authorities and institutions;
(c) to encourage, where appropriate, the exchange of duplicates.
2. However, if it is not considered appropriate to concentrate all the care for the development and coordination of the exchange between the institutions and bodies referred to in Article 1 of this Convention in a national exchange service or centres of exchange, the tasks referred to in paragraph 1 of this Article may be entrusted as a whole or in part to another institution or other bodies.
Method of transmission
Publications may be sent either directly between competent authorities and institutions or through a national exchange service, or through exchange centres.
Transport charges
Where consignments are sent directly between the exchanging parties, the Contracting States shall not be obliged to cover transport costs. Where consignments are dispatched through the exchange centre or centres, the Contracting States shall pay transport charges up to their destination; However, in the case of sea transport, the packing and transport costs shall be borne only by customs at the port of destination.
Transport rates and conditions
The Contracting States shall take all necessary measures to ensure that the authorities in charge of the exchange receive the most favourable applicable rates and conditions, irrespective of which means of transport they use: mail, road transport, rail, river or sea transport, air mail or air freight.
Customs and other advantages
Each Contracting State shall exempt its authorities responsible for exchange from payment of both export and import duties for materials exchanged under this Convention or under agreements concluded in its implementation and shall grant them the most favourable treatment with regard to customs and other advantages.
International exchange coordination
In order to assist the United Nations Organisation for Education, Science and Information in carrying out the tasks of coordinating international exchanges imposed by the Constitution, the Contracting States shall report annually to the Organisation on the implementation of this Convention and the copies of bilateral agreements concluded in accordance with the provisions of Article 12.
Reports and studies
The United Nations Organisation for Education, Science and Information shall publish the information it receives from the Contracting States pursuant to Article 8 and shall process and publish studies on the implementation of this Convention.
Unesco assistance
1. The Contracting States may contact the United Nations Organisation for Education, Science and Education with a request for technical assistance to address any problem related to the implementation of this Convention. The organisation shall provide such assistance within the limits of its programme and its capabilities, in particular when establishing and organising national exchange services.
2. The organisation shall be entitled to contact the contracting States on such matters on its own initiative.
Ratio to earlier agreements
This Convention is without prejudice to commitments already entered into by the Contracting States under international agreements.
Bilateral agreements
Whenever necessary and desirable, Contracting States shall conclude bilateral agreements in order to supplement the provisions of this Convention and to address issues of their common interest arising from the implementation of this Convention.
Languages
This Convention is drawn up in the English, French, Russian and Spanish versions, all four texts being equally authentic.
Ratification and acceptance
1. This Convention shall be subject to ratification or acceptance by the United Nations Member States of education, science and education in accordance with their constitutional procedure.
2. The instruments of ratification or acceptance shall be deposited with the Director-General of the United Nations for Education, Science and Information.
Access to the Convention
1. This Convention is open to access to all non-Member States of the Organisation which will be invited to access by the United Nations Executive Committee on Education, Science and Information.
2. Access shall be effected by the deposit of an instrument of access with the Director-General of the United Nations for Education, Science and Information.
Start of validity
This Convention shall enter into force 12 months after the date of deposit of the third instrument of ratification or accession, but only in proportion to those States which have deposited their respective instrument on or before that date. For any other State which deposits its instrument of ratification or accession, the Convention shall enter into force 12 months after the date of deposit of the instrument of ratification or accession.
Territorial application of the Convention
At the same time as ratification, acceptance or accession, or at any time thereafter, any Contracting State may notify the Director-General of the United Nations for Education, Science and Information in writing that it extends the scope of this Convention to all or some territories for whose international contacts it is responsible. This notification shall enter into force 12 months from the date on which it was accepted.
Termination
1. Each of the Contracting States may denounce this Convention on behalf of its own or on behalf of any territory for whose international contacts it is responsible.
2. The denunciation shall be notified in writing and the instrument shall be deposited with the Director-General of the United Nations for Education, Science and Information.
3. The denunciation shall enter into force 12 months after the date on which the instrument of denunciation was adopted.
Notifications
The Director-General of the United Nations for Education, Science and Information shall inform the Member States of the Organisation, the non-Member States referred to in Article 15, as well as the United Nations, of the deposit of all instruments of ratification and accession referred to in Articles 14 and 15, as well as of all notifications and testimonies referred to in Articles 17 and 18.
Amendment to the Convention
1. This Convention may be amended by the United Nations General Conference on Education, Science and Information. The amended text shall be authentic only to those States which become Parties to the Convention of Amendment.
2. In the event that the General Conference adopts a new Convention which would amend this Convention as a whole or parts thereof and does not provide for something else, this Convention shall cease to be open for ratification, acceptance or accession as from the date on which the new Convention on Amendment enters into force.
Registration
In accordance with Article 102 of the Charter of the United Nations, this Convention shall, at the request of the Director-General of the United Nations for Education, Science and Information, be registered in the Secretariat of the United Nations.
Done at Paris, 5 December 1958, in two equally valid copies signed by the President of the 10th session of the General Conference and the Director-General of the United Nations for Education, Science and Information. Both copies shall be deposited in the United Nations Register for Education, Science and Information and copies thereof shall be forwarded to all States referred to in Articles 14 and 15 as well as to the United Nations.

The United Nations General Conference on Education, Science and Information, which met at its 10th session in Paris from 4 November to 5 December 1958,
Building on the belief that the development of international exchanges of publications is essential to the free dissemination of ideas and knowledge among nations around the world,
taking into account the importance attached to international exchanges of publications by the United Nations Institute for Education, Science and Information,
having regard to the provisions on the exchange of official publications contained in the Convention on the International Exchange of Official Documents, Scientific and Literary Publications and in the Convention on the immediate exchange of an official certificate, as well as parliamentary yearbooks and documents concluded in Brussels on 15 March 1886, as well as in the various regional agreements on the exchange of publications,
recognising the need for a new international convention on the exchange of official publications and government documents between States,
familiar with the proposals for the exchange of official publications and government documents between the States included in item 14.4.1 of the agenda of this meeting,
Decide at its ninth meeting that, according to these proposals, the international arrangements should be implemented by adopting an international convention,
adopted the following Convention on 3 December 1958:
Exchange of official publications and government documents
Contracting States shall express their willingness to exchange their official publications and government documents on a reciprocal basis in accordance with the provisions of this Convention.
Definition of terms of official publications and government documents
1. For the purposes of this Convention, official publications and government documents shall be deemed to be official publications and government documents if they are issued by order and by the cost of any national government body, the following publications: government publications, parliamentary reports and documents and other legislative texts; publications and reports of central, local and regional government bodies; State bibliography and administrative manuals, collections of laws, judgments of courts and other publications to be established by agreement.
2. However, in implementing this Convention, Contracting States may agree themselves to define the scope of official publications and government documents to be exchanged.
3. This Convention shall not apply to documents of confidential, official circulars and other documents not intended for the public.
Bilateral agreements
Whenever necessary and desirable, Contracting States shall conclude bilateral agreements in order to supplement the provisions of this Convention and to address issues of their common interest arising from the implementation of this Convention.
National authorities responsible for exchange
1. The exchange of publications shall be carried out in each Contracting State by a national exchange service or, where that service is not established, by a centre or centres of exchange.
2. The exchange authorities shall be responsible in each Contracting State for the implementation of this Convention and for the implementation of the bilateral agreements referred to in Article 3, where such agreements have been concluded. Each Contracting State shall authorise its national exchange service or exchange centres to collect the documents for exchange and shall provide the necessary financial means for the exchange.
List and number of publications to be exchanged
The authorities of the Contracting States in charge of the exchange shall establish by common agreement the list and number of official publications and government documents to be exchanged. The agreed list and the number of official publications and government documents exchanged may be amended by agreement between those authorities.
Method of transmission
Consignments may be sent directly to the exchange authorities or to the addressees designated by them. The method of keeping records of consignments may be established by mutual agreement between the authorities responsible for the exchange.
Transport charges
Unless otherwise agreed, all transport costs shall be borne by the exchange centre drawn up by the consignment until their destination; However, in the case of sea transport, the packing and transport costs shall be borne only by customs at the port of destination.
